The achievement of the program of creation of the multilateral socialist society developed and the advance of Romania towards communism requires the continuous improvement of the forms and methods of organization and management of society, of participation of large masses of people of work when adopting decisions at all levels of social and state life. Corresponding to the multilateral development of the national economy, of the entire economic and social life, the Romanian Communist Party acted with consistency for the establishment of a comprehensive system of collective management bodies, the use of forms of participation of all working people in the management and management of the units, the application of the latest conquests of the science of organization and management, the lifting on a higher quality step of the leadership of the socialist units. Based on the extensive program of measures established by the Romanian Communist Party, the participation of the working class, all categories of working people, without distinction of nationality, to the leading activity in the economic, political and social, non-relentless improvement of the activity of collective management bodies, of all central and local state bodies. The measures adopted to erect on a higher plan of working-class self-driving and strengthening economic-financial self-management ensure that the role of the collective of working people in the management of the entire economic and social life, I agree the economic and financial mechanism with the democratic organizational framework created to ensure the economic units and collective management bodies of the pyramids and economic and financial means of effective exercise of the rights and responsibilities conferred by law and for the maximum efficiency management of the part of the wealth the national entrusted by the company for administration. All these measures contribute to accelerating the development of production on the basis of modern technique, continuous improvement of product quality, achieving an efficient high and increasing profitability, qualitative lifting of the entire economic life. This creates conditions for increasing the contribution of each enterprise to the general development of our socialist society and, at the same time, for the more direct co-interest of the collective of working people in fulfilling the provisions of plan, in the economic development of each enterprise, to be reflected in the increase of the incomes of those who work, according to the program of raising the standard of living established by the party and the state. In particular, they increase the role of planning and financial activity in meeting development programs in high rhythms of the production forces, as well as the initiative and liability of businesses and plants in planning and running your own activities The harmonious combination of the autonomy of each enterprise, by broadening its competence and duties, with the unitary leadership of the entire economic and social life on the basis of democratic centralism ensures the full valorization of the advantages socialist order, the acceleration of the progress of our homeland, the development of socialist democracy. The improvement of the system of organization and management of the economy is carried out under the conditions of concentration of production in large economic units, of the profiling and specialization of production units, of the fullest use and rapid introduction in the production of scientific research results. The enterprise, as a basic unit of the national economy, operates on the basis of plan and has the role to manage with maximum efficiency the material and money means, ensuring the rhythmic and full fulfillment of the established tasks through the plan, the achievement of higher quality products in conditions of increased economic efficiency. The planning activity starts from the basic economic and territorial-administrative units. The plans shall be drawn up on the basis of economic contracts to ensure certainty of supply and undoing. The management of the financial activity is based on the revenue and expenditure budget of the enterprise. The strengthening of economic and financial self-management requires all companies to cover their production and circulation expenses, to obtain benefits from which to ensure their own development and to contribute to the overall development of society, to create the resources for the participation of working people to the benefits and to cover the expenses necessary to satisfy their social-cultural needs within the framework of the program of raising the standard of living. The industrial plant, as a large autonomous economic unit, is constituted by the grouping of enterprises and other units according to the criterion of homogeneity of products or manufacturing technologies, cooperation in production, integration the manufacture of finished products or the territorial location of the component units. Through the measures to improve leadership and economic-social planning, they ensure the plants, in their capacity of plan titulation, increased possibilities for the development of scientific research and the introduction of technical progress, profiling and specialization of production, development of relations of international economic cooperation and foreign trade, efficient use of fixed funds and circulating means, reduction of production expenditures and increase of production profitability on overall and on each subordinate undertaking. Within the vast program to improve the qualitative sides of economic activity, enterprises, industrial plants and other economic units must focus their efforts to raise the technical and qualitative level of products, the faster development of the internal raw materials base, the rational management of fuels and energy, the increased increase in labor productivity, the rapid increase in the efficiency of fixed funds, the increase in the degree of recovery of raw materials and materials and a sharper reduction in expenditure of production. Starting from the necessity of continuous improvement of socialist production relations, from the quality of the working people of the owners of the means of production, of producers and beneficiaries of all material and spiritual goods of the society, corresponding to the widening and lifting on a higher stage of socialist democracy, the working people bear the full responsibility for the direct and effective management of each economic unit, for the efficient management of the goods they are entrusted to the administration, having the duty of unrelentlessly concerned with the smooth running of the unit they belong to. By itself its content, the socialist property requires the organic integration of the masses in the activity of organization and management of production, the strengthening of the discipline and social responsibility of every citizen for the performance of tasks entrusted, the direct participation of those who work on decision-making, the exercise of a demanding control by working people on the way in which the adopted decisions are fulfilled. Institutionalization of general assemblies of working people, organization of labor people's councils at all enterprises and other socialist state units, granting increased powers to all these collective management bodies, broadening their competence and increasing the share of workers and foremen who work directly in production in the councils of working people, have created the organizational framework for the effective participation of the working class, of all working people at the process of elaboration and adoption of decisions at the direct management of the units, the to the whole society, to the full manifestation of socialist democracy and to the exercise of working-class self-driving. The appointment of the secretary of the party organization as president of the council of working people, and of the director as president of the executive office, ensures the role of the councils of working people, the increase of party in good conduct of the enterprise's activity, as well as clearer clarification of the duties and tasks of the executive office and the director, in the realization in life of the decisions of general meetings and councils of working people. By regulating the forms of collective leadership, expression of the consistent democratism of our order, at all state socialist units-ministries, other central state bodies, local bodies of the state administration, economic units and institutions-collective leadership is a general principle of the entire institutional framework of our socialist state. To further improve the production relations, improve the organization of the councils of working people and other collective management bodies, broaden the framework for participation of the working class, all working people, at the helm the units and the development of workers ' self-driving, The Great National Assembly of the Socialist Republic of Romania adopts this law: + Chapter 1 Organisation and operation of enterprise + Article 1 The state enterprise is the basic unit in which economic and social activity is carried out and in which working people, based on the principle of working-class self-driving, directly exercise their prerogatives arising from their quality of owners of means of production (goods of all people), producers and beneficiaries of material goods. According to the principles of working-class democracy, every working man, falling within the collective of a state socialist enterprise, participates directly in the management of the enterprise and the management of the patrimony entrusted to it, has the right and the obligation to actively contribute to the improvement of the enterprise's activity, to rule on all issues relating to the smooth running of the entire economic and social activity in the establishment and to commit, at the same time, to the whole society to make every effort to ensure effective use and the continuous development of the public wealth, to put its full capacity and power of work and creation at the service of general interests, to contribute to the increase of economic efficiency, the lifting on a higher quality step of the whole activity, basic condition for the continuous improvement of the material and spiritual living standards of all those who work. The company has as its object of activity, depending on the specific, the production of goods, the performance of works or the provision of services, the supply and disposal of products. + Article 2 Businesses organize and operate on the basis of the principle of working-class self-driving and economic-financial self-management. Raising on a higher stage of working-class self-driving and strengthening economic-financial self-management ensures the growth of the role of the collective of working people in the management of economic and social life and increases the responsibility of everyone for the exemplary performance of the tasks, the management with the maximum efficiency of the goods entrusted to the unit for administration, the development of the creative initiative and the promotion of a combative, revolutionary and uncompromising spirit in the entire activity. The organization of economic activity is also based on the principle of democratic centralism, which organically combines the unitary leadership of the economy with the functional autonomy of each unit. The company operates according to the laws in force, based on the plan, which is an integral part of the single national plan of economic and social development, while having broad tasks in the field of planning, scientific research and technological engineering, design, investment, supply and sale of products, in the preparation of working personnel, in the organization of production and work, as well as autonomy in the management of funds. The undertaking shall be the holder of the plan and shall be responsible for the body to which it is subject to the fulfilment of the plan, all technical, economic and financial indicators + Article 3 The financial activity of the enterprise is based on the revenue and expenditure budget. The strengthening of economic and financial self-management requires companies to cover their production and circulation expenses, to obtain benefits from which to return the funds received from society, to ensure their own development, to contribute to the overall development of society, create resources for the participation of working people in benefits, as well as to cover the expenses necessary to meet social-cultural needs within the general growth programme of the standard of living of working people established by the party and the state. Companies are obliged to carry out a cost-effective activity, with increased efficiency, to ensure the participation of working people in the realization of production, benefits and benefit-sharing. The enterprises have legal personality, which they bring down on the date of their registration at the Ministry of Finance or, in the case of those of local subordination, to the county financial bodies or the city of Bucharest. Enterprises have their own plan corresponding to the activity they carry out, an integral part of the single national economic-social development plan, concludes the balance sheet, take into account the bank, benefit from bank loans, have economic, financial relations and legal with other units, use the forms of material cointerest provided by law, exercise control over all the activities they carry out. Factories, plants, farms, mines, construction site groups and other similar units without legal personality have economic and financial autonomy within the undertaking to which they belong, for which purpose they have their own plan and revenue budget and expenses. Relations with the state budget are carried out through the enterprise they belong to. + Article 4 Businesses of Republican interest are established by decree of the State Council, and businesses of local interest, by decisions of popular councils. The founding act establishes the name, the seat and the object of activity. Enterprises are directly subordinated to industrial plants or units assimilated to them, ministries, other central state bodies, popular councils, according to the founding act. The abolition of enterprises, their reorganization, the modification of the name, the headquarters or the object of activity are made by the bodies that have the competence to establish them. The organization of enterprises is based on the uniform rules of structure established by law; the organizational structure of the enterprise includes production compartments, conception, as well as functional compartments. The plants and large enterprises may have in their structure sections or centres of scientific research and technological engineering that carry out works to introduce technical progress for the respective plant or business. In addition to enterprises, sections or workshops can be set up for the production of consumer goods in order to fully capitalize on the reusable materials and materials resulting from the production process. Besides businesses can also operate units of a social-cultural character. + Article 5 The fixed funds and the circulating means necessary to carry out the activity of the enterprise are constituted, based on the principle of self-financing, under the law Fixed funds cannot be alienated, mortgaged or pledged and cannot be traced under any title and on any path. Fixed funds become available, in a state of operation or used, transfer, capitalize, or get out of service, as the case may be, according to the law. Raw materials, materials, fuels and other such goods intended for the production process, in so far as they exceed the needs of the holding units, may be transmitted with payment, under the law. The finished products are based on economic contracts or other conditions provided by law. For the realization of receivables, only the money means of enterprises can be traced. + Article 6 Businesses have direct budget relations. They make payments representing companies from the value of net production, the tax on the movement of goods, part of the benefits under the conditions established by law and other income due to the state budget. At enterprises in the power and thermal energy branch, the state budget is carried out through industrial plants, and at the mail and telecommunications units, through the higher hierarchical body, according to the law. + Article 7 The company shall be at its disposal and shall use the following funds under the law: a) the economic development fund; b) the fund of circulating means; c) the fund for housing and other social investments; d) the fund for social actions; e) fund for the participation of working people in benefits; f) the fund for scientific research, technological development and the introduction of technical progress; g) the fund for labor protection; h) other funds provided by the legal provisions. + Article 8 The benefits made under the plan shall be distributed, under the conditions established by law, for the refund of funds received from the company, for the establishment of own funds and for the payments to the state budget. The benefits made over the plan are distributed, according to the law, for its own economic development fund, the housing construction fund and other social investments, the addition of the labor people participation fund to benefits, payments to the state budget. + Article 9 The enterprise benefits, under the conditions provided by law, also by funds distributed by the body to which it is subordinated. + Article 10 In the field of planning, execution and control of the plan tasks, the undertaking shall have the following main A. In the elaboration and substantiation of the plan tasks a) elaborates the five-yearly and annual plans for the entire activity, aiming at the classification, in the indicative levels and in the norms gives the plan received from the plant or from the organ to which it is subordinated. In drawing up the plans, businesses provide -the thorough study and knowledge of the internal and external market, the early contracting of the entire production, so that the economic activity will serve the concrete needs of the economy; -maximizing the productive potential through the full use of production capacities; applying the results of scientific research in order to modernize the production and promote technical progress; raw materials and materials, fuels and energy; improving the use of fixed funds and other production funds; -rational use of the workforce; -widening the manufacturing profile in order to adapt permanently to the requirements of domestic consumption and export; -creating the necessary financial resources; b) elaborates, directly or together with the relevant institutes, studies and forecasts regarding the development in perspective of the enterprise; c) develop special programs for superior resource valorization, rational use of production capacities, increased labor productivity, reduction of production and circulation expenditures, increase of funds efficiency productive; d) work with the supplier and beneficiary units, with the local bodies, permanently ensuring the correlation of the provisions with the tasks of the plant or bodies under which it is also with the requirements of the plan in territorial aspect; e) establishes on subunits, wards and workshops their tasks and finalize the necessary measures for their realization. B. In execution of plan a) ensure the rhythmic and full fulfilment of the plan indicators and report periodically to the body to which it is subordinated to the way they are carried out; b) organize the production capacities and take measures for their optimal use; c) pursues the implementation of special programs for the efficient use of resources at its disposal; d) take measures for the plan to be exceeded in products with an export and domestic sale; e) also meets other duties provided by law, in this area. + Article 11 In the field of research and development, the company has the following main A. Scientific research, technological engineering and the introduction of technical progress a) develop, together with the research and profile design institutes, their own five-yearly and annual scientific research plans, technological engineering and the introduction of technical progress and ensure the necessary advance for the realization of these works; makes proposals for scientific research, design and technological engineering objectives to be included in the single national economic-social development plan; b) develop studies, documentation and projects and carry out research, for the realization of new products and the modernization of existing ones, the development and modernization of machinery and installations, retooling, expansions of production capacities, improvement of production processes, introduction of new technological methods and processes, increasing the value of raw materials and materials, faster development of the internal raw materials base, introduction of some new materials and replacement of deficient materials; c) apply in production and pursues the result of the valorisation of studies and scientific researches concluded, of those received from the higher hierarchical body, as well as those who enter its profile and have been carried out in other units; d) organize the research activity and the introduction of technical progress and collaborate with the scientific research and technological engineering units, as well as with the higher education institutions, for the achievement of research objectives scientific entries in the plan; conclude contracts for the objectives of scientific research, technological development and introduction of technical progress for the entire period of implementation, from the initiation of the works until the introduction of the results in production; e) elaborates the preparation documentation of the manufacturing, develops consumer norms for raw materials, materials, fuels, energy, as well as labor consumption norms on the product; f) organizes and ensures the activity of inventions and innovations; ensures the registration and protection of the patented technical solutions realized within the unit and takes measures for their experimentation and application, elaborates standards, technical standards, prospectuses and instructions for use for products falling within its nomenclature; g) provide information, documentation and technical-scientific propaganda; h) also performs other duties established by law on scientific research and technological engineering, design and introduction of technical progress. B. Investments and construction a) develop their investment, financing and lending plans; b) ensure in advance, according to the law, the technical-economic documentation necessary to plan and make investments; c) approve, according to the law, the technical-economic documentation for investments; d) conclude contracts for the execution of investment works, provide the sites, finance the works and make them according to the charts; organize the execution of works in their own direction; e) conclude contracts and draw up, in collaboration with suppliers, graphics for the delivery of machinery, correlated with the schedule of investment staggered and with the deadlines for commissioning of capacities; f) ensure the realization of own resources for investment financing; g) pursues the achievement of investment objectives and responds to the timely commissioning of new production capacities; approves the reception of investments to which the technical-economic documentation falls within its approval competence; h) nominate the machines that have not been specified by the superior hierarchical body and are to be purchased within the investment funds provided in the plan; i) also meets other duties established by law in this field of activity. C. Organization of management, production and work a) ensure the organization on a scientific basis of the management and production activity; perform studies on the improvement of the organizational structure, rationalization of the information system and introduction of modern methods of calculation, elaboration and improving the regulations of organization and functioning, establishing specific tasks and responsibilities for all fields of activity; b) take measures for the application of the most modern and efficient methods of organization, programming and tracking, optimization of manufacturing flows, improvement of labor processes, maintenance, repairs, usual transport and ensure expansion and their generalisation; c) ensures continuous improvement of the organization and work of the labor and elaborates normative and labor norms specific to its field of activity; elaborates the labor plan and takes measures to fulfill it; ensures the application of the norms of work with scientific foundation in all categories of personnel; d) ensure the rational organization of all jobs, as well as the judicious organization of shift work; e) ensure the application of studies and projects of own organization and of those transmitted by the plant or ministry for expansion and generalization; f) ensures that in the projects of the new investment objectives the organization projects are also included. + Article 12 In the field of production, the undertaking shall have the following a) organize and ensure the fulfilment of the production plan under conditions of high efficiency; b) ensure compliance with the normal consumption of raw materials, materials, fuels and energy; take measures of superior valorisation of raw materials and materials; c) ensure the rhythmic realization of the production and staggered its delivery in correlation with the contractual deadlines; ensure the spare parts, in the structure and quantities required, for the executed machinery; d) ensure the carrying out of cooperation tasks in production with other undertakings; e) establish measures for the realization of top quality products, organize the technical quality control on the phases of the production process, respond to the manufacture and delivery of products to the qualitative parameters provided in state standards, technical rules or other technical documentation and contracts concluded; f) establish the works of small mechanization, ensure their documentation and realization; g) ensures the reduction of specific consumption, the optimization of stock values, the elimination of non-economic expenses from its own activity and the increase in the profitability of products h) ensures the operation, rational use, maintenance, repair and modernization of fixed assets; i) ensure optimal loading of production capacities, intensive use of machinery, machinery and installations; ensure the achievement of the parameters designed to the new production capacities put into operation; take measures to achieve a higher yields per 1,000 lei fixed funds; j) provides fuel supply, electricity, heat, water and other utilities for the needs of the enterprise; takes measures for the rational use of thermal energy installations, modernization of technological processes at installations fuel and energy intensive measures; ensure that measures are applied to continuously reduce energy consumption and save fuels and energy; draw up energy balance sheets and take measures to make rational use of energy resources; k) ensures the application of the norms of protection and hygiene of work in order to prevent accidents at work and occupational illnesses, the application of fire prevention and extinguishing norms, those of security of goods, as well as other measures additional necessary in relation to the specific conditions in the establishment; draw up the programme of work protection works and ensure its fulfilment; ensure the application of measures to prevent and combat environmental pollution; l) proposes norms of labor safety technique, normative of equipment for protection and attrition specific to their own activity when they are not provided in republican and departmental norms; m) meets other duties established by law in this field. + Article 13 In the commercial field, the company has the following main tasks A. Technical-material supply a) elaborates and substantiates, corresponding to the contracted production and plan tasks, the technical-material supply program, which includes the needs in the country and from the import and delivery times, in compliance with the norms and norms of consumption and stock approved for raw materials and materials, fuels and energy, as well as the maximum efficient use of all material resources; b) responds to the provision of the necessary material base for the smooth implementation of the plan tasks; concludes long-term, annual economic contracts or for shorter periods and responds to their full realization, ensuring technical-material supply at the time necessary for the production rhythmically c) develop proposals for stock rules for raw materials, materials, fuels and spare parts; take measures to prevent the formation of overgrown stocks and operative valorisation of those available; d) perform the reception of raw materials, materials, parts, semi-finished products and sub-assemblies; ensure the storage and preservation in their proper conditions. B. Undoing a) conclude economic contracts for the entire period of 5 years, for the production provided for in the five-year plan on domestic consumption, in accordance with the destinations in the material balances on products, so that at the time of approval of the plan prepared firm contracts for all domestic consumption; it also concludes long-term contracts for products from its manufacturing profile, for durations of more than 5 years, based on development guidelines and forecasts in perspective, the cooperation agreements with other countries, in particular for deliveries to be made in the framework of international cooperation actions for long-cycle machinery, plants and machinery; b) adapt and detail, if necessary, through the annual plans, the provisions of the contracts concluded for periods of up to 5 years; c) participates in the prospecting of the internal market for the purpose of knowledge of consumer needs; ensures advertising and presentation of products; participates in exhibitions, practical demonstrations and fairs in the country and abroad; elaborates and broadcasts catalogues commercial; d) exercise the powers of the law, according to the law, as coordinator of balances; e) take measures for the introduction into manufacturing only of products that have ensured the disposal through contracts or firm orders; at the same time, the manufacturing enterprises are obliged to contract, in relation to the production capacity and the profile of manufacturing, all products requested by the beneficiary units; f) organizes the tracking in operation of the delivered facilities and equipment, as well as the "service" activity according to the contractual clauses, in the country and abroad; g) ensure the resolution of complaints regarding the quality and quantity of production, packaging, delivery times or other conditions provided for in the economic contracts; h) approves the transport plans with its own means; it aims and responds to the proper use of the means provided and takes measures to optimize the transport. C. External trade and international economic cooperation a) elaborates and responds to the fulfilment of the plan of foreign trade and international economic cooperation and the trade balance of its own activity; b) take measures that at the time of approval of the plans the production of export and the necessary imports should be based on firm contracts, framework contracts, orders or conventions, to ensure the certainty of supply and dissolution; c) act to ensure the needs of orders and contracts for as long as possible, enter into cooperation relations with enterprises and companies from other countries and ensure the operative adaptation of production to external market demands; d) be responsible for the proper organization of production for export, the delivery and delivery of the goods fund for export, in accordance with the terms and conditions of the contract; of products which ensure a high recovery of raw materials, for the continuous renewal of products for export, while ensuring a competitive technical and qualitative level and production costs as low as possible; e) participate, together with the specialized companies of foreign trade, to prospecting the foreign market, to negotiate and conclude firm contracts, framework contracts, orders or conventions for export production; f) participate in production cooperation with companies and organizations abroad, directly-if authorized for this purpose-, or through specialized foreign trade enterprises; can initiate, treat and conclude, within the limits of their competences, cooperation actions, including participation in the establishment of joint ventures; g) permanently seeks to increase the financial and foreign exchange efficiency of foreign trade operations; h) resolve complaints about the quality and quantity of production, packaging, delivery times or other conditions set out in external economic contracts; i) also performs other duties established by law on economic contracts, foreign trade activity, economic and technical-scientific cooperation and other legal regulations in this field. + Article 14 In the financial and accounting field, the undertaking shall perform the following main tasks A. Preparation and implementation of the revenue and expenditure budget a) elaborates the revenue and expenditure budget, basic instrument of financial management and planning and financial balance insurance. In the elaboration and execution of the revenue and expenditure budget, enterprises are obliged to cover their production and circulation expenses, to obtain benefits from which to refund the funds received from the company, to ensure their development own, to contribute to the general development of society, to create resources for the participation of working people in benefits and to cover the expenses necessary to satisfy social-cultural needs; b) includes in the revenue and expenditure budget, depending on the specific activity: -revenue, expenditure, financial results on production, service provision, movement of goods and other basic or ancillary activities; proceeds from foreign trade activity; -own funds of the undertaking referred to in art. 7 7; -bank loans; -the peaks to the state budget; -other income, resources and expenses; c) develop proposals for the loan plan and the house; d) carry out studies and analyses in order to increase the efficiency of fixed funds, increase the money accumulations and speed up the speed of rotation of the circulating means; e) establishes the maximum level of stocks of raw materials, materials, products, goods and other elements of circulating means, in compliance with the indicative levels approved by the plant or ministries and other central or local state bodies; f) take measures for the execution of the revenue and expenditure budget, as well as for the term performance and in the established amount of payments due to the state budget or the higher hierarchical body, as the case may be; g) ensure the creation of financial resources to cover the costs of production and circulation, normal conduct of economic activity, establishment of own funds, reimbursement of bank loans, as well as maintaining balance between income and expenses. B. Other duties a) organize and exercise preventive financial control and control of the fund manager on the management of material and money means; b) organizes and leads the accounting, prepares the balance sheet and the situation of the main economic and financial indicators; c) establishes, with the agreement of the beneficiary, prices and tariffs on products and services for which it has this competence, as well as additions and bonuses, under the law; d) follow the situation of stocks of material values and take measures to fit the established maximum level; e) make the inventory of assets in the patrimony of the unit and take appropriate measures, according to the f) establishes or proposes, as the case may be, the passage on account of the production or circulation expenses of the material value deprivation found at the inventory above the legal norms, in cases where the deprivation is not due to the fault of some individuals, and the decrease in management of other damages, under the conditions provided by the legal provisions; g) also performs other duties established by law in the field of finance, prices and tariffs, financial control and accounting records. + Article 15 In the field of personnel activities, the undertaking has the following main tasks a) organize professional orientation, selection, employment and promotion of personnel, according to the requirements established for each job; ensure the bookkeeping of the staff; take measures to apply objective criteria of appreciation annual worker and distribution staff and its judicious use; b) establishes the needs of frames in perspective, on trades and specialties; c) prepare the own plan of insurance, training and improvement of the workforce on trades and specialties and take measures to achieve it; organize the training of the staff through qualification courses, vocational schools, practice at the place work, schools of foremen and others, based on the tuition plan and within the limits of the funds allocated through the plan; in collaboration with the educational institutions organize and follow the practice in the production of students and students and the internship of high school graduates; ensure the timely preparation of the necessary frameworks to the new investment objectives; d) organize the improvement of the training of the working staff through training at work, courses organized in the unit, individual study, internships or other forms that take place within or outside the unit; e) provide the material basis of the school units, equipping the laboratories, workshops and workplaces for the students ' practice, as well as the necessary specialized frameworks; f) ensures the application of the legal provisions on retribution by quantity and quality of work and applies the forms of material stimulation of the working personnel, established by the law, to ensure a correlation as closely as possible to the retribution with the results obtained; g) take measures to organize the defense activity of the state secret; h) take measures to improve working conditions, prevent accidents at work and occupational illnesses, as well as for rational use of the workforce; ensure compliance with the discipline of work and the full use of time work; i) ensure the achievement of the tasks assigned to it, according to the law, for the establishment of canteens, nurseries, kindergartens, social groups for the creation of accommodation conditions, solving medical assistance problems, housing space, as well as the material basis necessary for cultural-sportive; j) ensure the drawing up of the pension file for the working staff of the enterprise, as well as the correct record of all the data necessary for the k) ensure that all necessary measures are taken to re-educate people who have committed deviations and violations from the norms of social coexistence and the laws of the country; l) also meets other duties established by law on employment, education, retribution, improvement of the training of the working staff and other regulations in these fields. + Article 16 The undertakings under the power plants shall fully exercise the tasks in the field of production, as well as the tasks corresponding to the other fields, which are not economically justified to be carried out in a centralised manner. The tasks related to scientific research and technological engineering, investments, preparation and improvement of the training of the staff are usually exercised by the company, which are subordinated to the companies. Enterprises in the sectors of movement of goods and services shall exercise the duties of Chapter D of this Law, adapted to their specific activity. + Chapter 2 Organisation and operation of plants + Article 17 The plant is an autonomous economic unit of production, construction, movement of goods, transport and other services. The plant comprises subordinate enterprises and component units such as factories, plants, exploits, construction site groups or construction-assembly sites, autobases, wards, workshops, sectors and similar ones; it may also have its component of scientific research and technological engineering, design, external trade, supply, sale, automatic data processing, training and processing of frameworks, service supplies or other necessary units the performance of his duties. The plant provides management, guidance and control of the activity of subordinate enterprises and component units. The plant is usually constituted on the structure of a large and representative enterprise. The grouping of subordinate enterprises and component units within the plant is mainly based on the criterion of homogeneity of products or manufacturing technologies, cooperation in production, integration of the manufacturing of products the final or territorial location of the units that are part of the plant. + Article 18 Industrial plants, railway regionals, groups of undertakings or other units assimilated to them, referred to in this Central Law, shall be organised and operated on the principle of economic and financial self-management. + Article 19 The plants have legal personality, which they bring down on the date of their registration at the Ministry of Finance or, in the case of those of local subordination, to the county financial bodies and the city of Bucharest. The plants are a plan-an integral part of the national single economic-social development plan. They conclude the balance sheet, take into account the bank, benefit from bank loans, have economic, financial and legal relations with other units, as well as with foreign beneficiaries and suppliers. + Article 20 The plants are established, reorganized-by merger, absorption, total or partial division-or disband by decree of the State Council. The plants are subordinated, as the case may be, to ministries, other central bodies of the state administration or county folk councils and the city of Bucharest. By the act of establishment of the plant the name, seat and object of activity are established. + Article 21 The fixed funds and the circulating means necessary to carry out the activity of the plant are based on the principle of self-financing, under the law. + Article 22 The plants have direct budget relations for their own activity, for investments on new economic units and more important developments at the units in operation, as well as for other activities provided by law. + Article 23 The plant is at its disposal and uses, under the law, the following funds: a) fund for the financing of investments in new enterprises, including housing and other social investments for these enterprises, and for the financing of important developments in enterprises subordinates that are in operation, set distinctly in the single national plan. This fund is constituted by the amortization of fixed funds taken from enterprises, other resources provided by law, as well as from allowances from the state budget; b) the fund for scientific research, technological development and technical progress; c) the reserve fund for the circulating means, constituted by taking up a quota of 0.5 percent of the funds of the circulating means constituted annually by the subordinated enterprises; d) the reserve fund, within the foreign exchange funds, allocated, in order to meet urgent import needs; e) other funds, according to legal provisions. + Article 24 Art. 7 and 8 relating to own funds, as well as to the planned benefits and those carried out over the plan, shall also apply, accordingly, to industrial plants and units assimilated to them, both for their own activity and for that of subordinate undertakings. + Article 25 The plant can award prizes and other incentives to the working staff, under the conditions provided by law + Article 26 Plants, plants, holdings and similar establishments, with complex activity and specific conditions of production, located in other localities or on sites other than the plant or the undertaking to which they belong, may be organised, in cases duly justified, as units with legal personality, according to the legal norms on the organization and operation of enterprises. The units provided for in the previous paragraph are organized by decree of the State Council, have in charge a director, a chief engineer and a chief accountant and maintain their compartments in the functional structure, existing at the date of organization. The director, chief engineer and chief accountant will receive the tariff repayments and driving allowances set by law for the corresponding units without legal personality. + Article 27 In the field of planning and controlling the performance of the plan tasks, the plant, as the plan holder, bears the full responsibility for the elaboration of the plan in its field of activity and for the performance of the plan tasks the plant and each subordinate unit and has the following main tasks: A. In the elaboration and substantiation of the plan tasks a) elaborates the five-year and annual plans of its own, based on the proposals of subordinate enterprises and component units, following the classification in the indicative levels and the plan norms received from the State Planning Committee. In determining the tasks and means of achieving them, the plant will particularly follow: -the timely conclusion of supply and sale contracts, so that, at the time of approval, the plans are fully covered in full with contracts with beneficiaries and internal suppliers, and for export and import to be based on a volume as much as possible firm contracts, framework contracts, orders or conventions to ensure certainty of supply and undoing; -intensive use of the full productive potential of subordinated enterprises and component units; -optimal development of production capacities, modernization and development of existing units; -specialization and profiling of production, establishment of cooperation programs between plant units, as well as with other plants; -the assimilation of new and redesigned products, the introduction of advanced technologies, the valorization and generalization of the results of own scientific research and other scientific research and technological engineering units; -management with maximum efficiency of material and money funds, ensuring a strict savings regime and strengthening the discipline of the plan in all units; -effective use of the workforce in accordance with the norms of increasing the productivity of physical and value labor, aiming at the classification of personnel norms; b) develop together with the relevant central ministries or central bodies the indicative levels and plan norms and establish them for each subordinate enterprise; after the approval of the single national economic and social development plan carry out the plan tasks on the subordinate units and establish measures to comply with them; c) develop special programs on products, groups of products, subsystems, activities or synthesis problems, by counties or localities; in these programs the concrete ways and measures are included to ensure the material base and the superior valorization of resources, rational use of production capacities, introduction of technical progress, training and improvement of staff training, increased labour productivity, reduction of production expenditure, increased efficiency of funds productive and other elements defining the qualitative and quantitative sides of the all economic activities; d) develop studies and forecasts on the development in perspective, of the plant activities, as well as on the main products; e) constitute a plan reserve at the retribution fund up to 1.5 percent of the total retribution fund approved on the plant; for seasonal and construction-assembly activities the reserve may be up to 2 percent of the retribution fund approved quarterly. The plan and the number of personnel shall be provided accordingly; f) collaborates with subordinate enterprises, with other plants, with coordinating ministries and, with local bodies to develop and substantiate plan tasks. B. In execution of plan a) pursues the rhythmic and integral realization of the plan on the whole of the plant and on each subordinated enterprise; takes measures to increase the discipline of the plan and to solve the operative problems that arise during the execution of the plan; b) pursues the implementation and implementation of special programs; takes measures to update them in accordance with the additional needs to increase production and economic efficiency; c) uses the plan reserve at the retribution fund and the number of personnel to solve problems that arise in the subordinate enterprises in the process of carrying out the plan; d) organize production capacity records on the plant, subordinate enterprises and component units; take measures to increase their use, in order to carry out the physical production tasks approved by the plan and adaptation in execution to the additional requirements of the market for export and internal market; e) also meets other duties established by law on the planned economic-social development of the country. + Article 28 In the field of research and development, the plant has the following main A. Scientific research, technological engineering and the introduction of technical progress a) develop, together with the central research institutes, their own five-yearly and annual scientific research plans, technological development and introduction of technical progress, ensuring the necessary advance for the realization of these works that must be the basis for the orientation of the plant and enterprises towards the realization of new products of high technicality and quality, technically and economically competitive with the like products on the external market; scientific research, technological development and introduction of technical progress to be included in the single national economic and social development plan, ensure the implementation of the approved plan; b) develop, together with the central research institutes, studies and forecasts for the development of the plant as a whole, subordinate enterprises and component units, in order to profile and specialize them, the concentration of production and typing of products and sub-assemblies; endorses studies on development directions, the profile of subordinate enterprises and component units, developed by them; c) ensure the technical-scientific cooperation with establishments abroad and conclude conventions with them, within the limits of the established competences; d) organize and guide the design activity, take measures for the use of type, directives and reusable projects; e) organize and ensure the activity of scientific research and technological engineering both for its own needs, as well as for other units, for new products and technological products: conclude contracts with the specialized units for the objectives scientific research, technological development and introduction of technical progress throughout the period of achievement, between the moment of initiation of works and that of the introduction of results in production; profile, technical assistance to new investment objectives; f) prepares the comparative study of offers for complex imports and proposes its option; g) elaborates or, as the case may be, organizes the elaboration of studies for the assimilation of new products from the plant profile, as well as for the modernization and raising of the technical-qualitative level of the products; new assimilated; h) organizes the elaboration of studies on the improvement of technologies, while improving the working conditions, for the introduction into manufacturing of new high quality materials and with increased efficiency, replacement of materials deficit or import; ensure the introduction and expansion of new and high productivity technological processes; take measures to expand the mechanization and automation of production, modernize machinery and installations, introduce means mechanized and automated calculation; i) submit proposals to the Ministry for the purchase j) establishes the thematic plan of inventions and innovations; ensures the necessary measures to identify and protect the patented technical solutions made within the subordinate enterprises and the component units; take measures and ensure experimentation, application and generalization of inventions and innovations; make proposals for patenting and capitalizing abroad of inventions; k) provides information, documentation and technical-scientific propaganda; l) establish, together with the central research institutes, measures for the development of the material basis of own design units, scientific research and technological engineering; ensure the experimentation, approval and rapid application in production the results of scientific research; m) elaborates the norms and norms of consumption, which are approved by the single and departmental national plan, for raw materials, materials, fuels, energy; establishes such norms and normative for other raw materials and materials in order to technical and economic foundation of productive consumption; n) also performs other duties established by law in the field of scientific research and technological engineering, design and introduction of technical progress. B. Investments and construction a) develop investment plans on the plant, based on own studies, proposals of subordinate enterprises, institutes and component units; develop, based on their proposals, the financing and lending plan of investments; b) ensure the elaboration, together with the central research institutes, through own or third-party design organizations, of the technical-economic documentation necessary for the planning and realization of investments; investment objectives to be achieved, mainly, with raw materials, materials and machinery in the country; makes proposals for the location of production units, considering the existence of labor, reduction of transport, use of utilities of the area; draws up the comparative study of offers on complex imports and proposes the plant option c) approve, according to the law, the technical-economic documentation for investments; d) conclude contracts with construction units for the execution of investment works or may empower the component units to conclude these contracts; organize, where economically justified, the execution of works in their own direction; e) establish, in collaboration with the suppliers, graphics for the delivery of machinery and installations, linking their delivery times with the schedule schedules of investments and the deadlines for the commissioning of production capacities; f) pursues the realization of resources for the financing of investments, in which purpose it takes measures to establish, according to the plan, the funds that are obtained on account of the benefits realized and g) apportion, in compliance with the order provided by law, the investment funds available to it; h) organizes the reception of investment works; approves the reception of the investment objectives to which the technical-economic documentation falls within its approval competence; i) also meets other duties established by law in the field of investments. C. Organization of management, production and work a) ensure the organization and scientific conduct of the management activity in the central and subordinate units; take measures for the application of modern driving methods, the development of collective management, the foundation of decisions using electronic computing technique; ensures the application of uniform structure norms, continuous improvement of the information system according to the tasks and responsibilities of each organizational step, following the approach of decision-makers of the production process; b) take measures for the organization on the scientific basis of production for the purpose of rational use of production capacities, application of modern forms and methods of organization and programming of production in order to optimize the production processes, the use of rational systems for the movement of raw materials, materials and products; ensures the application of modern methods of organization of maintenance, repair, transport, loading and other activities indirectly productive; c) ensure continuous improvement of the organization and work of the labor, the use of appropriate forms of division and cooperation in work, the rationalization of office work, the rational organization of jobs, the organization of shift work; normative and unified work rules specific to its field of activity, with the agreement of the union of branch unions; d) elaborates, on the basis of proposals of subordinate enterprises, of its own components and analyses, the technical work plan of work and takes measures to fulfill it; ensures the application of scientifically substantiated labor norms to all personnel activities and categories; controls the application of labour standards; e) aims to capitalize on own studies, those developed by subordinate enterprises and component units, by applying, expanding and generalizing them; elaborates, based on them, synthetic calculations on the possibilities of growth production, increasing the productivity of work and carrying out benefits over the plan; f) provide specialized assistance to subordinate enterprises and component units, in matters specific to the organization of management, production and labor; g) ensure that the projects of the new investments are included in the projects of organization. + Article 29 In the production field, the plant has the following main tasks a) ensure the rhythmic realization of the production plan by the component units under conditions of high economic efficiency; b) develop the documentation of technological preparation of production for typified technological processes, as well as the manufacturing programs for subordinate enterprises and the component units for which these activities are executed centrally; c) ensures the continuous reduction of the specific consumption of raw materials, materials, fuels and energy; checks the energy balance sheets and aims to apply the fuel and energy saving measures resulting from them; d) organize and follow the application of modern methods of preparation-programming-launch and tracking of production in order to rationally use production and labor capacities; e) establish the production cooperation plan for subordinate undertakings and component units; pursue and take measures to complete it; ensure cooperation without production with other plants; f) organizes and controls the operation, maintenance and repair of machinery and installations, measuring and control apparatus, production of tools, devices and verifiers, as well as spare parts for machinery own, metrology activity, as well as other auxiliary production or benefit activities to ensure the servicing of subordinate enterprises and component units; plan capital repairs of fixed assets and ensure keeping them in office for the duration of the service; g) organize and guide the performance of the quality technical control activity; h) establishes the necessary measures for the prevention of accidents at work and occupational illnesses, taking into account the specific conditions in the units; ensures the application of measures to prevent and extinguish fires, combat pollution the environment, for the treatment and protection of water quality; i) ensure full and maximum use of production capacities, reaching within the planned deadlines of the parameters projected at the new production capacities; take measures to achieve a superior production per 1,000 lei fixed funds; j) also performs other duties established by law in the field of production, use of fixed assets, quality of products and other similar activities. + Article 30 In the commercial field, the plant has the following main tasks A. Technical-material supply a) ensure the elaboration of technical-material supply programs that include the needs in the country and from import, suppliers and delivery times, in compliance with the norms and norms of consumption and approved stock and the use with maximum efficiency of all material resources; elaborates the technical-material supply programs for carrying out the activity of enterprises that are not in operation during the plan elaboration period; b) ensures, according to the destinations in the balances; the material basis necessary for the rhythmic conduct of the production process at the subordinate units; supports and pursues the conclusion by the subordinate enterprises of supply contracts technical-material for the entire period of 5 years, as well as other durations provided by law; aims to establish contractual relations, as a rule, with traditional suppliers, in compliance with the indicators of optimization of transport and calculations of area of supply; c) contracts with the supplier enterprises the raw materials, materials, fuels and energy necessary for the activity of the new units not put into service during the period of elaboration of the plan, as well as for the products of which supply shall be provided by the plant; d) ensure the proper sizing of stocks, taking measures to establish stock rules for raw materials, materials and fuels; take measures to prevent the formation of overgrown stocks and to liquidate those existing; approve the stock rules that are within its competence; ensure redistribution between subordinate enterprises, component units, as well as other units, overgrown stocks and those available for their reintroduction into economic circuit; e) pursues the way in which the subordinate enterprises and the component units conclude the contracts and realize the technical-material supply for the products left in their competence; subordinate; f) organize, as the case may be, own supply deposits. B. Undoing a) ensure the contracting of the production established by the five-year plan, for the entire period of 5 years, in accordance with the destinations in the material balances, aiming at the conclusion of firm contracts for domestic consumption, as well as of firm contracts, framework contracts, or other conventions for products intended for export; conclude contracts for the production of new units not put into service during the period of preparation of the plan; b) adapt and detail, if necessary, through the annual plans, the provisions of the contracts concluded for periods of up to 5 years; c) conclude long-term contracts, durations of more than 5 years, based on the guidelines and forecasts of development in the perspective of the branch and subramure they coordinate and of collaboration agreements with other countries, especially for deliveries that are perform in the framework of international cooperation actions for long-cycle machinery, plants and machinery; d) prepare balances for the five-year and annual plans for the products to which it is the balance coordinator, with the obligation to ensure the coverage of the justified needs of the economy, using the own resources, of the other suppliers, as well as the derived from import; collaborates with other plants and supplying and beneficiary units and their superior hierarchical organs when establishing the most effective materials balance balancing solutions; ensures the judicious sizing of stocks, framing consumptions in established norms and norms, expanding the use of substitutes and raw materials and materials in the country, taking or proposing measures to enhance their manufacture; enroll in balances appropriate plan reserves for the purpose of the production process rhythmically and carrying out the tasks of the plan and disposing of their use according to their respective competences; ensures the optimisation of transport for the products to which e) establishes the nomenclature of products that are contracted and undone by the plant and those that are opened by subordinate enterprises; establish direct relations with the beneficiaries for the establishment of the order portfolio and the determination other elements useful to the conclusion of economic contracts; take measures to take over in execution all contracts and orders corresponding to the needs of the national economy, act to strengthen the contractual discipline, respect full of obligations assumed by subordinate units, speeding up the speed of rotation of the circulating means, as well as for the maximum efficiency of the material and money funds; f) elaborates together with the other producers and disseminates commercial catalogues comprising the products made by the subordinate enterprises and the component units, with the indication of all the elements necessary to establish contractual relations, including the responsibility of the balance coordinator; reviews and annually improves the catalogues elaborated; g) organize the prospecting of the internal market in order to know consumer needs; ensure advertising and presentation of products; organize and, as the case may be, participate in fairs, exhibitions, practical demonstrations for the products to which it is coordinator or who is carried out by subordinate enterprises and component units; compiles albums and prospectuses encompassing the qualitative characteristics and areas of use of products in their profile and takes measures for the wide dissemination of h) meets, according to the law, the position of general supplier for supplies of complex installations; i) organize, as the case may be, outlets or own shops of presentation and sale in the country, "services", as well as sales in consignment; j) ensure the resolution of complaints regarding quality, quantity, packaging, delivery times or other clauses provided for in domestic contracts. C. External trade and international economic cooperation a) develop export, import and international economic cooperation plans based on own studies and proposals received from subordinate enterprises; breakdown of plan indicators approved on subordinate units; b) elaborates and responds to the performance of the trade balance; foreign trade enterprises are obliged to ensure, under the law, the contracting of export goods; c) ensure the contracting of the entire commodity fund for export; d) organize and pursue the realization in the production units of goods intended for export, in accordance with the terms and clauses of the contracts concluded; the plant in the monthly and quarterly instalment established and the increase of the financial-foreign exchange efficiency of foreign trade operations; e) proposes to the higher hierarchical body the foreign exchange funds necessary for imports and after approval takes measures for their use in strict accordance with the objective needs of subordinate enterprises and component units; technical for the import of production and investment and ensure the timely contracting and delivery of the products from import through specialized foreign trade enterprises; ensure the supply of subordinate enterprises and units components with imported products; f) participate, together with specialized foreign trade enterprises, to prospecting the foreign market, to negotiate and contract products; g) organizes and aims to improve the assortment structure and the quality of the products delivered for export h) contracts with the Romanian Foreign Trade Bank for obtaining credits in foreign currency; i) ensure the resolution of complaints, relating to quality, quantity, packaging, delivery times or other conditions provided for in external contracts; j) the plant participates in production cooperation with companies and organizations abroad, directly-if authorized for this purpose-or through foreign trade enterprises; it can initiate, treat and conclude, within the limits of its powers, actions cooperation, including participation in the establishment of joint ventures for: insurance with raw materials and other products of high economic importance; broadening the export of plants, machinery, machinery and other products with high degree of processing and competitiveness on the world market; provision of technical or expert assistance; the expansion, modernization and retooling of existing objectives; the more rational use of currency means for imports; the acceleration of the introduction of modern technologies into production, the lifting of the qualitative technical level of production and services, as well as ensuring a high productivity of work; k) meets, according to the law, the function of the external general l) also meets other duties established by law in the field of economic contracts, foreign trade activity and international economic cooperation, as well as other regulations in this field. + Article 31 In the central financial-accounting field, the following main tasks are: A. Preparation of the revenue and expenditure budget a) elaborates the revenue and expenditure budget comprising the revenue and expenditure on the entire activity of the plant, as well as the funds that are made available to it according to art. 23 23; b) ensure the mobilization of all the reserves available to the units in subordination, with the classification in the indicative levels received from the higher hierarchical organs; c) establish for subordinate undertakings and component units indicative levels of financial indicators; d) develop proposals for credit and home plans and allocate the approved ceilings on subordinate enterprises and component units; e) carry out studies and analyses on the efficiency of production funds, the evolution of money accumulations, the structure of material expenditures, stocks of material values and other financial indicators; f) analyze the foreign exchange plan proposals for the services and non-commercial operations received from the subordinated enterprises and the component units and prepare the draft of the currency plan of the plant; g) develop indications for the application in subordinate enterprises and component units of the methodology and formulations of financial planning. B. Execution of the revenue and expenditure budget a) ensure the fulfillment of the revenue and expenditure budget on the whole of the plant, subordinated enterprises and component units, aiming at the realization of money accumulations and financial obligations to the state, increase of profitability and use efficiency of material and money means, as well as compliance with financial discipline; b) take measures to accelerate the rotation speed of the circulating means, by improving the technical-material supply, production programs and sales activity; follow the situation of stocks of material values and take measures for the classification of subordinated undertakings and component units in the total level of circulating means, for the liquidation of overgrown stocks and those available, and the pre-occurrence of the formation of such stocks; c) analyze the causes that led to the exceeding of the planned funds and the non-repayment of bank loans to subordinated enterprises and the component units and take measures to ensure their classification in the planned funds; d) verify and centralize the accounting balance sheets and the situation of the main economic and financial indicators of the subordinated enterprises and the other component units; which they submit to the competent bodies; e) establish or propose, as the case may be, the passing on the expenses of production or circulation of the material value deprivation found at the inventory above the legal norms, in cases where the deprivation is not due to the fault of some individuals, as well as the decrease in management of other damages, under the legal provisions; f) establishes deadlines for carrying out annual patrimonial inventory at subordinated enterprises; examines and resolves the patrimonial disputes between subordinate enterprises and resolves disputes of a value below 1000 lei in case which the subordinate undertakings are debtors; g) organize preventive financial control under the law, organize and exercise the substantive management control over the material and money means to the subordinate enterprises and the component units; j) takes measures to improve working conditions and rational use of the workforce; organizes and aims to achieve social actions on the whole of the plant regarding the establishment of canteens, nurseries, kindergartens, accommodation, solving healthcare problems, as well as providing the necessary materials for cultural-sportive; k) ensure the preparation of the pension file for the staff of the plant and component units l) ensure that all necessary measures are taken to re-educate people who have committed deviations and violations from the norms of social coexistence and the laws of the country; m) also meets other duties established by law on employment, education, retribution, improvement of the training of the working staff and other regulations in this field. + Chapter 3 Driving economic units + Article 33 The working personnel of each state socialist unit bear the responsibility for the management of the patrimony entrusted and for the economic results obtained in the unit. k) analyze the performance of the tasks of the unit regarding the sanctioning and reeducation through work of persons who have committed deviations and violations from the norms of social coexistence and the laws of the country; l) elaborates, together with the union committee, the collective labor contract and submits it to the approval of the general meeting; periodically analyzes the fulfilment of its provisions, the realization of labor protection measures, surrounding; apportion the housing space; m) analyses how to carry out measures to ensure the working and life conditions of working people and improve them; n) ensure the establishment and use of the fund for housing construction and other social investments, for which purpose: -permanently controls the execution stage of the construction works of dwellings; Commission for the proper management and defence of public property The Commission for the proper management and defence of public property operates on the basis of the work programme approved by the council of working people and has the following main tasks: a) control how the machines, machinery, installations and other fixed funds are maintained and repaired, if their operation is done in accordance with the provisions of the technical norms and specific working instructions and proposes measures removal of detected deviations; b) verify that the conditions for the preservation of unused fixed assets ensure the maintenance of the production capacity; c) follow the observance of the schedule of stops for revisions and repairs of machinery, machinery and technological installations, which determine the interruption of production and propose measures to shorten the duration of execution of repairs; d) pursues the elaboration of technical instructions for the operation, maintenance, periodic overhaul and repair of machinery, machinery and installations, controls their mode of application and informs the operative of the unit's management of the deficiencies found; e) participate in the analysis of technical accidents occurred in machines, machinery, installations, in order to establish the causes, effects and responsibilities; propose measures for compliance with the working regime provided by the manufacturing technology, prescriptions technical work and exploitation; f) analyze and pronounce on proposals for the removal from operation of fixed assets and the recovery of parts and subassemblies from dismantling; g) pursues the recovery of damage to the obstesc property through deprivation or degradation of goods; h) pursues and informs the council of working people, on the way in which the technical guidance of the production is provided by the heads of departments, the heads of installations and the masters, the equipping of jobs with specific instructions, in the purpose of the rhythmic production of production, prevention of damage, accidents and fires; proposes measures to ensure technical assistance on each working exchange; i) participate in the elaboration of the programs of the technical commission for fire prevention and extinction, analyze the activity of this commission and inform the council of working people on the results; propose measures to improve the commission technical fire prevention and extinguishing; j) initiates, in the labor collectives, actions to develop the sense of high responsibility towards the entrusted goods, compared to the continuous increase of the national wealth, puts in the discussion of labor the deviations from the technological discipline, the operation, maintenance and repair of fixed assets and take measures, together with the masters, the heads of workshops and wards, for their elimination; k) analyze the way in which the defense of socialist property is ensured, by organizing and carrying out preventive control and internal financial control and proposes measures to improve this activity; l) pursues the way in which the operations of periodic inventory of materials, products and other goods are carried out: analyzes the results of the inventory and proposes measures aimed at ensuring compliance with the legal provisions, in order to defend the integrity of the obstesc; m) analyses the way in which the security of material and public means is ensured and proposes measures to prevent any manifestations of damage to the public wealth; n) performs any other duties provided by law or established by the council of working people of the enterprise. Committee on Social Affairs The Committee on Social Issues operates on the basis of the work programme approved by the Labour People's Council and has the following main tasks: a) aims to ensure proper working and life conditions of the staff in the establishment; b) analyze the way in which social funds constituted according to the law are used in enterprises; c) supports the work of protection and hygiene of work, prevention of accidents at work and illnesses; organizes, together with the relevant bodies, the periodic analysis of disability states and temporary incapacity for work in turn the staff of the establishment and shall control the implementation of the measures d) aims to carry out the tasks of the unit, according to the law, for the establishment of canteens, nurseries, kindergartens, social groups, for the creation of accommodation conditions, solving medical assistance problems, housing spaces; e) pursues the application of special measures to protect women's health and to create the necessary conditions for the care and education of children; f) it deals with the best use of the free time of the working staff by organizing cultural-artistic events, excursions, sports events and other similar actions; g) establishes, together with the trade union bodies, the distribution, for the staff of the unit, of the rest and leisure tickets in the spa resorts; h) aims to comply with the legal provisions when granting social security rights, state child benefit, as well as other social rights; i) cancel and make proposals for framing in degrees of disability for the staff of the unit; j) follow and support the timely preparation of retirement files for the age limit, invalidity or survivor; check the files drawn up and signal to the management of the unit any irregularities found; k) supports people who due to accidents or diseases can no longer work under the conditions previously had for their distribution to new jobs, corresponding to their work capacity, or with working hours reduced by half; l) pursues strict compliance with the law on the correct and up-to-date completion of the work books, as well as the other acts necessary to prepare the retirement files; m) aims to prepare the revenue and expenditure budget and to achieve physical and value indicators on social security and pensions and work capacity recovery; n) concern themselves with the way in which the employment of persons who carry out their sentence at work is ensured; o) performs any other duties provided for by the legal provisions. The Committee on Social Affairs also serves as the pension and social security committee provided by law, in which case the conclusions, proposals and decisions of the commission are valid if they have met the agreement of at least two thirds of the members who compose it, and the general working procedure is the one provided for in the Regulation on the organization and functioning of pension and social insurance commissions and commissions of medical expertise and work capacity recovery. Training and Improvement Commission, employment and promotion The training and improvement, employment and promotion commission shall carry out its work on the basis of the work programme approved by the Labour People's Council and shall have the following main tasks: a) participate in the elaboration of the draft annual, five-year plan and the perspective for the professional training and improvement of personnel; b) propose the forms, topics and methodology of conducting programs for professional training and improvement; c) pursues the way of conducting the training and professional development work that is carried out in enterprises and proposes measures to improve and increase the efficiency of this activity; d) it follows the way in which the staff who did internships, of improvement abroad or in the country apply in practice the acquired knowledge and make proposals for the most effective valorization of these internships; e) study and propose forms of preparation necessary for the retraining of personnel in accordance with the structure and requirements of the production; f) analyze the use of personnel and propose measures for the more judicious distribution of it on jobs corresponding to the plan tasks; g) pursues and supports the employment and integration of graduates of vocational, technical, higher education schools in order to use their work capacity as fully as possible; h) elaborates and proposes criteria for selection and promotion in relation to the skills and work experience of the staff and the needs of the production; i) pursues strict observance of the law in the activity of knowledge, appreciation, employment and promotion of personnel; j) organize, together with the trade union bodies, the consultation of the labor authorities in case of promotion of a person to a leading position; k) responds to the smooth conduct of exams or competitions for employment and promotion in work and ensures compliance with the legal provisions on the employment and promotion of working personnel from socialist units; l) presents to the collective management bodies the results of exams or competitions; m) answers, together with the heads of the labor compartments, the activity of granting the annual qualifications; analyzes and submits for approval to the collective management body the way of solving the appeals made in relation to the qualifications granted; n) propose the necessary measures to ensure the stability of personnel, strengthen order and discipline in work and follow the application of the adopted measures o) supports the activity of raising the level of socialist consciousness, developing the attitude towards work, defense and judicious management of the public wealth, citizen education of the working people; necessary to carry out the tasks of the enterprise on the line of sanctioning and re-education through work of persons who have committed deviations and violations from the norms of social coexistence and the laws of the country; p) performs any other duties provided by law, as well as those given in its charge by the collective management bodies. -------------
