The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter I General principles of the system of retribution of work in cooperative agricultural units + Article 1 (1) The continuous lifting of the standard of living of the cooperators and of all those working in the cooperative agricultural units is directly conditioned by the results of the work of each and is carried out according to the increase of agricultural production and public wealth, the development of the entire national economy. (2) The remuneration of the work in the cooperative agricultural units is based on the socialist principle of distribution by the quantity, quality and social importance of the work performed, as well as according to the results obtained by each unit in part fulfilling the plan of physical production and the revenue and expenditure budget. ((3) The remuneration of the cooperators ' work shall be ensured, in relation to the implementation of the production plan and the revenues provided in the revenue and expenditure budget, from the own funds obtained by each unit on the basis of firm application of the principles self-driving, economic self-management and self-financing. + Article 2 (1) The consistent and rigorous application of the socialist principle of distribution must ensure the material co-interest of the cooperators in increasing the production and productivity of labor, in good management and development of public wealth, strengthening the spirit of responsibility and discipline in work. ((2) Cooperators who perform all their tasks, perform the works in good conditions and carry out the production employed, in compliance with the expenses related to it, shall be provided with the retribution to the novel provided for in the production plan and the revenue and expenditure budget of the unit. ((3) Cooperators cannot be repaid without providing useful work to contribute to the production in the cooperative agricultural unit. + Article 3 (. Cooperative agricultural establishments shall be obliged, when drawing up the crop production plan, to provide for the areas necessary to ensure the quantities of cereals, potatoes, beans and other products in order to carry out the delivery tasks. to the state fund, to ensure the food consumption of the cooperators, the feed needs, as well as to the establishment of the reserve, food and feed fund, and the other funds provided by the law. (2) Each cooperative agricultural unit shall draw up its production plan and revenue and expenditure budget, determining both the revenue to be made from plant and animal production, small and other industries. activities, as well as material expenses, with labor and other related expenses, so as to displace the financing of the production activity from own resources, the retribution fund in relation to the level of production and income, the recovery full of expenses from the proceeds and an appropriate benefit, from which to constitutes the economic development fund, the reserve fund, the other statutory funds, as well as the benefit-participation fund. (3) Agricultural cooperatives of production are also obliged to establish the retribution fund of the cooperators in relation to the workload necessary for the execution of the works and with the tariffs established, to provide, in the revenue budget and expenses, a reserve in money and in kind, up to 15%. + Article 4 In order to ensure the means of payment necessary to carry out the material expenses and for the retribution of work, the cooperative agricultural units are obliged to fully realize their planned physical production and to contract, to deliver to state fund, plant and animal agricultural products at least at the level established by the development plan of agriculture and food industry in territorial aspect. + Article 5 (1) Cooperative agricultural units must ensure the participation in the work of cooperators and all other able-bodied residents of villages and communes, including those working in other sectors of activity. (2) In order to reduce the costs and the judicious use of the retribution fund, the cooperative agricultural units will take measures to reduce the necessary damage to the staff who do not work directly in the production. + Article 6 (1) At the distribution of the retribution fund, in each unit will be aimed at ensuring a fair proportion between the minimum and maximum incomes, firmly repecting the principle of socialist equity. (2) The maximum basic remuneration that a cooperator may receive in order to carry out the tasks of the plan may not exceed the income of the functions or similar trades in the state agricultural enterprises with the same volume of activity, under the same conditions work and with the same results. + Article 7 (1) The elements of the system for the remuneration of the members of the agricultural production cooperatives are: a) basic retribution, in money or in money and in kind, established on the basis of tariffs on the labor norm, on the product unit or at 1000 lei value of physical production, which constitutes the main part of the total retribution of cooperators; b) retribution in the form of participation in benefits, in money or in money and in kind, for the realization of the planned production; c) additional retribution in the form of participation in benefits, in money or in money and in nature, for the production carried out over the plan; (2) Under the conditions provided by law, an increase for uninterrupted seniority may be granted in the same unit and in the same sector of activity. (3) The level of basic retributions in cooperative agricultural units can be established differentiated by activities, depending on their importance in the development and economic and financial consolidation of the cooperative, according to the general meeting. (4) In the framework of activities, retribution is differentiated by categories or groups of works, corresponding to the degree of complexity of work, as well as in relation to the level of qualification, degree of responsibility and seniority. + Article 8 The members of the agricultural production cooperative benefit, in addition to the retribution for their work and the results obtained, and in the state consumption fund for education, health care, culture, as well as pensions, material insurance in case of temporary incapacity for work, birth, aid for families with children and other social rights, under the conditions established by law and by the Statute of the Agricultural Cooperative of Production. It also benefits from proper labor protection conditions, according to the law. + Chapter II Organization of production and labor in agricultural production cooperatives + Article 9 (1) The activity in the agricultural production cover is carried out through the work of its members. (2) For the full use of land, the increase of agricultural production and the increase of the labour income of all members, agricultural production cooperatives are required to ensure the participation in the work of all cooperators and their members of the family, so that at least 60-65% of the total population related to the activity of each cooperative is the active labor force, to participate in the timely and in good conditions execution of all agricultural works. + Article 10 (1) In order to carry out agricultural works in optimal periods, the single agro-industrial state and cooperative councils, the management boards of agricultural production cooperatives, together with the committees or executive offices of the councils They will immince and debate in general meetings work programmes that provide for the full use of the existing workforce, through the participation in the work of all cooperators, including labour and youth pensioners. Pensioners who cannot participate in the execution of agricultural works, as well as students of schools in the communes, will be trained, in relation to age, to the execution of works, such as crop maintenance, harvesting of vegetables, fruits and grapes, medicinal plants, in sericulture, service supplies and other such activities. (2) During the period of agricultural campaigns all able-bodied residents of villages and communes, including those who work in industry, construction, trade or other activities, specialists of any profile and their family members are obliged participate in prasit and other works of maintenance of crop harvesting, transport and storage of products, irrigation works, desecation, removal of excess moisture, cleaning and improvement of natural pastures and meadows and other such actions, according to approved work programmes. (3) Persons referred to in par. (2) will provide work in teams and will be repaid in the agreement, in relation to the volume of works carried out. + Article 11 (1) Each cooperator has the obligation to perform quality works, in the established places and in the optimal periods of time provided, to realize the number of working days and the corresponding workload, approved by the general meeting of the cooperative agricultural production, and comply with the established work schedule. (2) Presidents of agricultural production cooperatives, other management staff, technical, economic and administrative staff, as well as those working in cooperatives, in small industry, construction and service provision activities, will participate directly in the performance of agricultural works during the peak periods of agricultural campaigns. + Article 12 (1) In order to ensure the participation in work, throughout the year, of as many cooperators as possible and the gradual increase of their occupancy up to 300 days per year, the management boards of agricultural cooperatives are obliged, in addition to agricultural activity, to develop small industry activities, construction, service supplies and similar ones, fully capitalizing on the raw material resources available to each unit. (2) In agricultural production cooperatives where there is labour available, management boards are required to organize, with the support of the executive boards or executive offices, brigades and teams to work in. other cooperative and state agricultural establishments, on construction sites, on logging and in other activities. (3) The units in which the cooperators work according to the provisions (2) are obliged to pay monthly agricultural cooperatives of production from which they come the rights of retribution, the tax and the contribution for related social insurance, the share of the common and general expenses, as well as a share of the benefit calculated on the total amount of these expenses. + Article 13 The management boards of the agricultural production cooperatives will include in the production plans and in the income and expenditure begetes all the works that are carried out under the conditions of art. 9-12. + Article 14 (1) For the rational use of the labor force, the realization of agricultural production and the increase of labor productivity, production subunits are organized in the agricultural production cooperatives, and within them labor formations are constituted. (2) The production subunits in the agricultural production cooperatives are: farm, brigade and sector, which have their own production plan or, as the case may be, and plan of revenue and expenditure, which are an integral part of the production plan and the budget of revenue and expenditure of the agricultural production unit. (3) The management board of the agricultural production cooperative shall allocate on each farm, brigade and sector, depending on the production profile, crop areas, wine plantations, livestock, tractors and machinery. agricultural, the other inventory, the quantities of fertilizers, herbicides, feed, materials and materials, as well as the labor necessary to achieve the established production. + Article 15 (1) The basic formation in the organization of labor within the production subunits is the mixed team of mechanizers and cooperators, the team of mechanizers or the team of cooperators. (2) The organization of team work aims to strengthen the collective work spirit, discipline, increase the responsibility of the entire team and its individual members for the full use of the technical-material basis, timely execution and quality of the workload established on the entire surface or on the whole of the livestock and the production of the intended production levels. (3) On farms, brigades and sectors where production technologies and the degree of mechanization allow for the reduction of the workforce, cooperators and mechanisers working directly in production in these subunits shall be constituted in a single Team. + Article 16 ((1) The team shall be organized on a permanent basis, on sole, terlals, species and categories of animals, at least during a production cycle or a calendar year. In plant production, the production cycle means the period from the preparation of the land for sowing or planting until the harvest, delivery and storage of production, and in animal husbandry, production period, growth or fattening, corresponding to each species or categories of animals. (2) The composition and size of the team shall be established by the assembly of the farm, respectively of the brigade or sector, with the approval of the management board of the unit, depending on the structure of the crops, species and categories of animals, the degree of mechanization of works, land dispersal, plot area, exploitation system and other similar criteria. The size of the team must be within the limits set by the Ministry of Agriculture and Food Industry. ((3) The crew shall be assigned, corresponding to the provisions of the farm, brigade or sector production plan, areas of crops, plantations of vineyards and trees, livestock, means of production and necessary materials, and shall be established. the productions to be obtained, as well as the workload to be executed according to the technologies used. (4) In plant production, the team has the obligation to execute on time and in good conditions the works necessary to obtain the planned production: preparation of the land, sowing, ensuring the density of plants throughout the vegetation cycle, filling the gaps, the maintenance of crops, harvesting, transport and storage of the entire production, as well as the release of the land by the For irrigated crops, the team has the task of executing and watering, maintenance and exploitation of the landscaped surfaces and irrigation equipment, in which purpose within the team a permanent group of cooperators can be organized. (5) In animal husbandry, the team has the obligation of animal care and exploitation, to obtain the number of products and planned animal productions. The team provides preparation, transport and administration of feed, evacuation of dejections, disinfection and deratization. + Article 17 (1) The team is led by a team leader, who actually works in production, designated by the management board of the agricultural unit among the best mechanizers in that team or among the cooperators with the greatest experience and with skills in the organization of work, which enjoys prestige and authority among the team members. (2) The head of the team has the obligation to ensure strict compliance with order and discipline in production, to control daily the workload carried out by cooperators and mechanizers, the quality of the executed works and to draw up the timesheet for each Team member. (3) The responsibility for the timely and quality execution of the entire volume of works provided by the technologies and inscribed in the works estimates lies with the entire team. If some of the members of the team do not execute in the established period the amount of work provided, the works will be carried out, through the care of the team leader, by the other members. The volume of work carried out will be ponta to those members of the team who executed the respective works. + Article 18 (1) The obligations of the units to ensure the technical and material conditions necessary to carry out the established productions, the responsibilities of the cooperators, the mechanizers and specialists for the timely performance of the entire volume of works and compliance with the technologies, as well as the rights of retribution, shall be entered into a commitment made by the Head of Team with the Head of Farm, Brigade or Sector; Head of Farm, Brigade or Sector, together with the Head of the Mechanisation Section, enter into commitments with the co-op. The commitments shall be approved by the management board of the agricultural production cooperative. (2) In the commitment will be provided the areas of crops, species and categories of animals distributed, the productions to be obtained, the workload, the periods of time when the works and the rights of retribution are to be executed. The commitment will be signed by all team members. (3) In order to strengthen the responsibility of all the members of the team in achieving and exceeding the productions established in the undertaking, the management boards, the heads of the farm, the brigade and the sector have the obligation to control at all times the way the works provided in the estimates, the depth and uniformity of the arature, the realization of the plant density on the surface unit, the completion of the gaps, the execution of the number of prasile and the other maintenance and control works pests, the execution of water drainage works on land and crops, harvesting within and without losses of all production, the release of land. (4) In animal husbandry, management boards, farm and brigadier heads are required to permanently control the work carried out for animal care, the breeding and selection process, the production, preservation, preparation and administration of feed, as well as the manner in which the veterinary measures are observed, in order to ensure the achievement and overcoming of the productions and effectives provided for in the commitments concluded by each team. + Article 19 (1) The level of labor consumption and material expenses necessary to carry out the planned production in the cooperative agriculture shall be established, annually, by the single national economic and social development plan. (2) The Ministry of Agriculture and Food Industry shall allocate by county the indicators on the consumption of labor, the maximum personnel requirements on the structure, as well as the material expenses, differentiated on technologies for the main crops, species are categories of animals, depending on the conditions of pedoclimatic, within the level established according to par. ((1). (3) The Ministry of Agriculture and Food Industry will also take measures to improve technologies on crops, species and categories of animals and to regularly review labour and consumer rules, with a view to reducing labour, material expenditure, energy and fuel expenditure, as well as increasing labour productivity and economic efficiency in cooperative farming units. (4) The Directorate-General for Agriculture and Food Industry shall allocate the indicators on the consumption of labour and material expenditure, on agricultural cooperatives of production and, summed up, on the single agro-industrial state council and cooperatist, depending on the concrete conditions in each unit, differentiated on technologies for the main crops, species and categories of animals, without exceeding the total level established by the county. + Article 20 (1) In the agricultural cooperative of production, the normation of the work performed is based on the labor norms developed by the Ministry of Agriculture and Food Idustria together with the National Union of Agricultural Cooperatives of Production, according to the criteria and within the limits set by law. (2) Depending on the nature of the activity, the labor rules may be established in the form of time norms, production norms, concrete tasks with specifying the areas of activity, service tasks or other types of appropriate norms that work. (3) In determining the workload for the works carried out in the agricultural production cooperatives, it will be ensured that in the same norm there are several work operations provided for in the technologies, so that each cooperator will execute a wide range of works in the sector in which it has been assigned and to be able to work effectively throughout the year in order to achieve constant income and at an increasing level, in relation to the quantity and quality of work. + Chapter III Retribution of labour in agricultural production cooperatives 1. Labour retribution forms + Article 21 (1) The main form of retribution of labor in agricultural production cooperatives is the global agreement, with tariff on the product unit or at 1000 lei value of the physical production obtained, respectively of the services performed. (2) In the framework of the form of remuneration in global agreement, a team, farm, brigade or sector shall assume the obligation to carry out a certain production of cereals, technical plants, vegetables, meat, milk, eggs, wool or other production established in establishments. physical, for which due retribution is established globally, in money or in money and in kind, and is granted in proportion to the physical production achieved, the observance of the expenses, the deadlines and the other conditions provided for in the undertaking, without being capped. (3) The form of retribution in the global agreement ensures the strengthening of the responsibility for the realization of the planned productions and benefits, the permanent increase of labor productivity, the reduction of material and labor expenses on the product unit and, on this basis, the increase in cooperative and cooperative income. + Article 22 (1) In the agricultural cooperative of production, the following forms of retribution may be used under the present law: a) in direct agreement; b) in directing; c) on the basis of percentage shares of production or from its value to some crops. (2) The remuneration in direct agreement shall be made on the basis of tariff per unit of product, per work or at 1000 lei of production value, in proportion to the quantity of products, works or other physical units executed, and shall apply to works which, due to the specific conditions in which they are executed, cannot be engaged in global agreement, such as some small industry activities and service provision, some agricultural works from the age periods and other activities in which the measurement of work is done individual on the basis of rules. (3) Retribution in directing shall apply only in the cases provided by law, provided that the service tasks are fully realized in a certain time unit. (4) Retribution on the basis of percentage shares of production or of its value shall apply only in exceptional cases, when no conditions for retribution in agreement, to natural and cultured finesse, beans, pumpkins, melons, vegetables and other products in intercalated crops, including in tree and living plantations, cut and gathered coke, sugar beet parcels, straw, fodder of double crops, depending on the specificity of each cooperative. The percentage shares and the conditions for granting retribution shall be established by the Ministry of Agriculture and Food Industry, together with the National Union of Agricultural Cooperatives of Production. + Article 23 (1) The labor retribution forms shall be approved by the general assembly of the agricultural production cooperative, at the proposal of the management consilyui, according to the specific conditions of each unit and sector of activity, ensuring the correlation of the fund of retribution with the level of production and revenues provided for in production plans and revenue and expenditure budgets. (2) The form of remuneration on the basis of percentage shares is approved by the general meeting of the cooperative, with the opinion of the general directorate for agriculture and food industry, at the proposal of the single agro-industrial state council and cooperatist. + Article 24 (1) Agricultural production cooperatives holding isolated, hard-to-access land that cannot compress and work mechanized, can allocate these land to cooperators to be cultivated, for a period of 3-5 years. In this case, the retribution of work is done in kind, up to 50% of the production obtained, provided that the expenses carried out by the cooperative and the realization of a benefit of at least 5% are recovered. (2) Land that can be distributed according to par. (1) and the level of retribution in kind shall be established by the general meeting, with the approval of the general directorate for agriculture and food industry and the county union of agricultural production cooperatives, at the proposal of the single agro state and cooperative. 2. Retribution rates on the work norm + Article 25 (1) The work performed in the cooperative agricultural units shall be made with tariffs on the labor norm, differentiated by 4 groups of complexity and production sectors, as follows: -lei/norm of work- -------------------------------------------------------------- Production Sector Group of complexity of the works -------------------------------------------------------------- I II III IV -------------------------------------------------------------- plant production 40 48 56 65 animal production 50 60 70 80 -------------------------------------------------------------- (2) Agricultural cooperatives that carry out high yields and incomes may apply the three-way triffs provided for all four categories of works. (3) Agricultural production cooperatives which do not have the conditions to fully constitute the necessary retribution fund will apply the tariffs provided for groups I and II, following that, as they increase their economic power, production and income, apply and rates corresponding to groups III and IV. + Article 26 (1) During the execution of the works, the three-month work-time retribution measures provided for in the production plan and the revenue and expenditure budget may be increased or decreased, as follows: a) in plant production, in relation to the insurance and maintenance of the normal density of plants until harvest, with the obligation to complete the gaps, the execution of the number of prasile, the other maintenance and control of diseases and pests, the application of watering on irrigated areas and the carrying out of water drainage works, harvesting and land release on the established dates; b) in animal husbandry, in relation to the observance of animal care norms, the realization of herds, birth indices, planned productions and the preservation of animal health. (2) The increase of tariffs above the limits shown in art. 25 can be done by cooperatives that obtain high yields or incomes, but without exceeding the level of tariffs established for state agricultural enterprises. + Article 27 In agricultural production cooperatives cooperators or other working personnel who work permanently and directly in animal husbandry, carry out the volume of works established, according to labor norms for state agricultural enterprises, care for the same number of animals or birds, ensure the feeding, care and preservation of animal health, in compliance with the animal health rules and obtain the production of milk, meat, eggs, wool, products and other animal products, provided for by the plan, may benefit from the levels of retribution established by law, under similar working conditions, for the staff of state agricultural enterprises. 3. Retribution of the work of cooperators working in agricultural production + Article 28 (1) Retribution of the work of cooperators working in agricultural production shall be generalised, in a general manner. (2) The retribution rates in agreement on the product unit or at l000 lei value of the physical production shall be determined by the general meeting of the agricultural production cooperative, based on the workload from the works estimates for each crop, species or category of animals and other activities, of the rates of retribution on the labour standard and of the production or value of the aceteia provided for, within the limit of the planned retribution fund. + Article 29 ((1) Retribution shall be granted to the cooperators on the basis of the tariffs, in proportion to the actual workload achieved, the production obtained by the entire team and the material expenses distributed, provided that all the works are carried out during the fixed periods provided in technologies and the entire workload enrolled in the works estimates, as well as other works imposed by the natural conditions. (2) In the crop or category of animals, in which the production provided for in the undertaking, in global agreement, was carried out or exceeded on the whole team, the rights due to the members of the team shall be granted according to the achievements obtained in culture or the category of animals concerned. (3) Within the team, the retribution of work can be done and differentiated on the cooperators who compose the working band, for each animal culture or category, provided the timely and quality execution of all works and realization production engaged on the whole team. (4) Retribution of mechanizers from the teams of mechanizers and mixed teams of mechanizers and cooperators and personnel of the mechanical sector, assigned to the resort for the mechanization of agriculture, shall be ensured from the retribution fund of this units, and of the cooperators, from the retribution fund of the agricultural production cooperative. (5) Provisions of para. ((2) and (3) shall also apply accordingly for the retribution of cooperators working on farms, brigades and sectors, which are constituted in a single team. + Article 30 Qualified cooperators in driving trades, driver of road tractors, locksmith, welder, electrician and others can be repaid in agreement or direction, with the approval of the general meeting, up to the level of retribution set for the trades similar to state units, provided that works of the same volume and complexity are executed, without exceeding in the case of retribution in directing the retribution of the office of president. 4. Retribution of the work of cooperators working in small industry, construction and service activities + Article 31 The retribution of the work of cooperators working in small industry activities, construction and service provision is made in global agreement or in direct agreement, with tariff on the work, on the product unit or at 1000 lei value of production, tariffs which is determined on the basis of the rules developed according to + Article 32 (1) Cooperators working in small industry activities, construction and service provision may be repaid, under the conditions art. 189 189 of Law no. 57/1974 , on the basis of tariff networks in state or local industry, profile and similar complexity. (2) The inclusion in the three-way networks and the level of retribution that can be granted to cooperators according to par. (1) is approved by the general assembly of the agricultural production cooperative, with the opinion of the Directorate-General for Agriculture and Food Industry. 5. Retribution of cooperators who perform management and technical execution functions, economic, other specialty, administrative, service and security. + Article 33 The basic retribution for cooperators serving as president shall be set at a level representing up to a maximum of 2.5 times the average income achieved by cooperators working directly in production and carrying out the workload. approved by the general meeting, as well as in relation to the value of the planned physical production, the size and the complexity of the unit, 1. + Article 34 The level of basic retribution for the other management and technical, economic, other specialized, administrative, serving and security functions shall be determined in relation to the average annual income realized by the cooperators working directly in production and performs the workload approved by the general assembly, as well as in relation to the value of the planned physical production, the size and complexity of the unit, without exceeding the limits set against the basic retribution calculated for the function by the President, according to Annex no 2. + Article 35 The retribution of cooperators who perform management and technical, economic, other specialized and administrative functions is done in global agreement, with tariff per 1000 lei value of physical production, both for staff with attributions to the level of the agricultural cooperative, as well as for those with attributions at the farm, brigade and sector. + Article 36 In the event of exceeding the physical production engaged in global agreement, the addition of agreement due to the president, the chief engineer, the chief accountant and the head of the farm, repaid by the state, shall be granted by the agricultural cooperative of production. + Article 37 Cooperators who perform the duties of guard or guardian-caretaker are repaid in directing. + Article 38 The rights of retribution for staff performing technical, economic, other, administrative, administrative, service and security functions shall be provided on condition that they execute, in relation to the size and the complexity of the unit, agricultural works representing 25-50% of the workload established for cooperators working directly in production, according to the decision of the general assembly, without receiving, for these works, a distinct retribution to the due one for the function performed. + Article 39 (1) For the performance of the office of president, vice president of production, head of farm or head of brigade, cooperative members who are not repaid by the state receive a monthly allowance from the state of: -420-520 lei for the president; -210-260 lei for other functions. (2) The amount of allowances shall be determined by the general direction for agriculture and the food industry and the county union of agricultural production cooperatives, taking into account the responsibility they have in the organization in good conditions of production and work, the proper execution of agricultural works, the application of agrootechnical measures, in order to increase plant and animal production, and the realization of obligations to the state fund, as well as the degree of organization of Unity. (3) The allowance shall be granted only for the time actually worked. ((4) In case of non-realization of the tasks established monthly, the organs provided in (2) may decide to reduce the allowance. 6. The way and conditions for granting retribution A. (2) Of the benefit obtained by the agricultural cooperative of production, the fund for participation in the social part of the cash deposits of the cooperators, mechanisators and specialists at the development fund is also constituted Economic cooperation. B. Pensioners and other cooperators, unfit for work, and orphaned children receive up to 50 kg corn per person for animal feed, from the aid fund, as well as up to 50 kg corn per person for a fee. (2) In order to exceed the planned grain production, the agricultural production cooperatives give in their entirety, as additional retribution from the fund of participation to benefits over the plan, to the cooperators who realized the workload established by the general meeting, the quantities of wheat, maize and barley from the additional retribution funds in kind, constituted according to art. 47. + Article 52 The quantities of cereals made over the plan, which are to be revisited as additional retribution in the form of participation in benefits, can be capitalized by the cooperative, with the approval of the general meeting, at the state fund. The amounts thus obtained will be fully allocated to the cooperators. + Article 53 ((1) Retribution in kind shall be granted from the own production of each agricultural cooperative. ((2) Agricultural cooperatives which do not grow cereals or cannot ensure, from the planned production, the quantities of cereals due to the working cooperators, their dependent family members, and the other persons provided for in of the law, will benefit from the state fund from the quantities necessary for food consumption established by the self-supply program, provided that they hand over equivalent other products-potatoes, beans, fruits, meat, milk, etc. or, in cases exceptional, with payment in money, of the rights of retribution, provided that the unit to deliver to the state fund the contracted products that it performs according to the specificity. D. Granting of retribution rights at the end of the year a) Basic remuneration + Article 55 (1) The total retribution fund shall be determined at the end of the year, after the end of the balance sheet, on the basis of the physical production and the benefit of the cooperative. (3) The General Assembly may reduce or not grant the share of benefits to cooperators and other working people who, during the year, have had deficiencies in their activity or have enjoyed disciplinary misconduct. + Chapter IV Organization of production and work and retribution in intercooperative economic associations. + Article 62 (1) The activity in the intercooperative economic association is carried out through the work of members of the associated agricultural production cooperatives (2) The production sub-units of the intercooperative economic association are firm and sector. (3) In the production farms and in the sectors of activity in the intercooperative economic associations the work is organized on teams of agricultural mechanics and cooperators or only by cooperators, constituted for a period of at least one cycle of production or a calendar year. (4) The team is led by a team leader designated by the labor board of the intercooperative economic association. ((5) The team takes in receipt, from the head of the farm, an area of land or, as the case may be, animal herds, with the shelters and other means necessary for the execution of the works and the production. + Article 63 (1) The size of the team shall be determined by the council of the working people, depending on its activity profile and the specific conditions in which it works. The size of the team must be within the limits set by the Ministry of Agriculture and Food Industry. (2) The main obligations and responsibilities of the team, the farm and the sector shall be entered into a commitment between the head of the farm, respectively the sector, and the team leader and shall be approved by the council of the working people of the association. The commitment is signed by all team members. + Article 64 (1) The remuneration of the work in the intercooperative economic associations is based on the production obtained, the incomes and the benefits achieved, so that in each unit the self-management and self-financing are ensured. (2) The rights of retribution in the intercooperative economic associations shall be established on the basis of retribution and tariffs, in money or in money and in kind, under the conditions laid down for agricultural production cooperatives. ((. Rights in kind shall be granted by the associated cooperatives, within the limits and under the conditions laid down for the cooperators. + Article 65 (1) The rights of retribution of cooperators from the intercooperative economic associations with agrootechnical profile, who perform the same volume of works and carry out the same productions as those provided for the state agricultural enterprises, shall be establish the provisions Law no. 57/1974 , applicable to such undertakings, of a similar degree and profile. (2) The rights of retribution of cooperatives from intercooperative economic associations with a profile other than agrootechnical associations shall be established according to the provisions of Law no. 57/1974 , applicable to state economic units or craft cooperative, of similar degree and profile, if they execute the same volume of works and perform the same productions. + Article 66 The benefit provided in the revenue and expenditure budget of the intercooperative economic association shall be allocated to: a) shares due to the associated cooperatives, in proportion to the social part of each, at least 65%, for: -the return of investment loans; -completing the cooperatives ' own income; b) the economic development fund of the association, at least 20%; c) fund of circulating means of the association, up to 5%; d) the social-cultural and sports fund of the association, up to 1%; e) the reserve fund of the association, up to 2%; f) the intercooperative fund of aid, up to 2%; g) the fund to participate in benefits of cooperators and other working people in the association, up to 5%. + Article 67 The benefit that is carried out by the intercooperative economic association over the one established by the plan shall be allocated to: a) shares due to the associated cooperatives, in order to complete their cash income, 45%; b) the association's economic development fund, 20%; c) fund of circulating means of the association, 7%; d) supplementing the fund of participation in benefits of cooperators and other working people in the association, 25%; e) the social-cultural and sports fund of the association, 3%. + Article 68 The way and conditions for determining the fund to participate in the benefits under the plan and over the plan, as well as the individual rights that are due to the cooperators and other working people of the intercooperative economic associations, are the ones provided for agricultural production cooperatives. + Chapter V Guaranteed income + Article 69 ((1) Retribution shall be granted to the cooperators in money or in money and in kind, in proportion to the physical production and the benefits achieved. (2) Cooperators from farms, brigades, sectors and teams who perform all their tasks, perform the works in good conditions and carry out the committed physical production, in compliance with the expenses related to it, shall be guarantees basic retribution and participation in benefits, provided for in the plan. (3) The head of the farm, the brigade, the sector or the team receive the retribution in relation to the results obtained by the entire formation they lead and with the average incomes of its members. (4) In case of exceeding the planned production, with the related expenses, the cooperators shall be guaranteed, in addition to the due retribution according to par. (1), an additional retribution in the form of participation in the benefits obtained over the plan. ((5) In case of non-realisation of planned production and benefits, retribution shall be reduced accordingly. + Article 70 During the year, the cooperators are provided with advances in money, in the quotas provided by this law, as well as 50% of the rights of retribution due in kind, after the harvesting of the products. + Article 71 Cooperators who participate in the work and carry out the workload approved by the general assembly shall be guaranteed the assignment of a lot in use, from the land owned by the agricultural cooperative, under the conditions provided by the + Article 72 Cooperators who work permanently, throughout the year, in the sectors provided for by this law, in the same unit and in the same sector of activity, are recognized uninterrupted seniority and are guaranteed to be given the increase for seniority in work. + Article 73 Agricultural production cooperatives and intercooperative economic associations are obliged to fully realize the planned physical production and benefits, to ensure the balance between income and expenses and, in this way, to enshrine the funds necessary for the retribution and participation in the cooperative's offices, at least at the level provided for in the production plan and the revenue and expenditure budget. + Chapter VI Other retribution rights + Article 74 (1) Cooperators operating in animal husbandry, vegetable farming, viticulture, fruit growing, skilled and those working in agricultural cooperative in the trades of driver, driver of road tractors, locksmith, electrician and others, as well as those who perform management and technical, economic, other specialized, administrative and serving functions, who work throughout the year, permanently, carry out their tasks, are repaid by the cooperative and have uninterrupted seniority in the same unit and in the same business sector, benefit, from the retribution fund of each unit, from an uninterrupted seniority increase. (2) In the calculation of uninterrupted seniority in the same sector enters the period during which the cooperators referred to in par. (1) work temporarily in other sectors of productive activity, for the use of working time and carrying out works imposed by the production process. (7) Those who have, in the course of a month, one or more unmotivated absences lose the spore of uninterrupted seniority for that month. + Article 75 (1) For savings in the consumption of materials, fuels, energy, compared to established norms, cooperators in working bands can benefit from prizes during the year, according to the law. ((2) Cooperators may benefit, under the conditions Law no. 57/1974 , and awards during the year, for labor savings to which they contributed directly. + Article 76 Cooperators appointed by the general assembly to perform the functions of president, vice president removed from production, head of farm or head of brigade, during the time the holders repaid by the agricultural cooperative of production take courses for perfecting professional training or satisfying their military internship, are in temporary incapacity to work, on maternity leave or for the care of sick children, benefit from the monthly allowance from the due state the holder according to art. 39, with the exception of the vice president removed from production, who replaces the president. The allowance shall be granted only if this period exceeds 30 calendar days. + Article 77 Cooperators who perform technical, economic and other technical management and execution functions, during the period as long as they attend professional training courses, receive from the cooperative a retribution established according to Annex no. 2. + Article 78 (1) For the contribution made to the production of the production plan, the agricultural cooperative shall grant to the chief engineer, the chief accounting officer and the heads of farm, the state retributions, a retribution representing up to 15% of the remuneration due to the office of president, in relation to the realization of the physical production (2) The state repaid agricultural specialists, elected as president and who also perform the duties of chief engineer, receive a retribution of up to 25% of the due retribution for the position of president, in relation to the production physical. (5) Agricultural specialists and the chief accounting officer of the agricultural production cooperatives, repaid by the state, participate in the benefits carried out under the plan and over the plan, under the conditions established for the cooperators. + Article 79 Cooperators, as well as agricultural mechanics assigned to the resort for agricultural mechanization, which, in addition to the work carried out in production, lead a team, benefit, from the co-opetter, from an increase of up to 10% of the retribution of basis, respectively tariff. + Chapter VII Final provisions + Article 80 (1) The failure to organize agricultural production cooperatives and the intercooperative economic associations shall be made, upon establishment, by decree of the State Council, at the proposal of the Ministry of Agriculture and Food Industry, National Union of Agricultural Cooperatives of Production and Executive Committees of the County People's Councils and of the Municipality of Bucharest. (2) The inclusion in the organization ranks of farms and sectors is made, at the establishment, by the Ministry of Agriculture and Food Industry, at the proposal of the Directorate-General for Agriculture and Food Industry, based on the criteria provided in the regulations in force. (3) The modification of the organization of the units and subunits provided in par. (1) and (2) it will be possible to do so, where appropriate, with the approval of the single national plan for economic and social development. + Article 81 (1) The management bodies of the cooperative agricultural units shall take measures to ensure the execution of all works of the cooperative units by the cooperators, for the full use of the working time of the mechanizers, as well as to qualify for the necessary trades of an appropriate number of members of the cooperative. (2) For the trades of driver, locksmith, welder, electrician and others will be used primarily agricultural mechanics in the agricultural mechanization departments, distributed in cooperatives. (3) If some work requiring qualification cannot be entirely carried out by cooperators or agricultural mechanisers, exceptionally, with the approval of the general direction for agriculture and the food industry, in the cooperatives agricultural production and intercooperative economic associations can be classified, with labor contract, on the basis of the norms developed by the Ministry of Agriculture and Food Industry and the National Union of Agricultural Cooperatives of Production, a limited number of qualified persons in the trades of driver, locksmith, welder, electrician and others, to work directly in production, until the qualification in these trades of some cooperators. (4) The cooperative agricultural units can fit, with employment contract, shepherds, with the approval of the general direction for agriculture and food indusstria and within the limits of the norms provided in par. ((3). (5) Also, in the cooperative agricultural units may be employed persons with technical, economic, financial and other specialized training, and in the intercooperative economic associations of valorization of agricultural products, and operative staff, within the rules of structure approved by law. (6) The remuneration of the personnel employed by the production agricultural cooperative and the intercooperative economic association shall be made according to the provisions of the Law no. 57/1974 , subject to the execution of works of volume and complexity similar to those established for staff in state units with the same profile and degree of organization, without exceeding the level of retribution of the respective functions or trades in the state units or the craft cooperative and the total monthly retribution due to the president of the agricultural production cooperative, respectively to the director of the intercooperative economic association. (7) The contestations of the personnel with employment contract, in connection with the retribution of labor, shall be settled according to the provisions of Law no. 57/1974 . + Article 82 (1) Agricultural cooperatives who have large areas of land and do not have sufficient manpower for the execution of works on time and in good conditions can receive, as members of the cooperative, persons from other areas of the country, where there is surplus labor, if they establish their legal domicile in the locality where they have their cooperative headquarters. (2) Exceptionally, with the approval of the Ministry of Agriculture and Food Industry and the National Union of Agricultural Cooperatives of Production, on the proposal of the general directions for agriculture and food industry and county unions of agricultural production cooperatives, cooperative agricultural units may use labourers assigned to employment during a production cycle or a calendar year, to work directly in production, on agricultural works vegetable or animal husbandry. ((3) The remuneration of workers who work during a production cycle or a calendar year will be determined at the level of the retribution of cooperators in the same sector of activity, who carry out similar works.
