Pursuant to art. 57 of the Constitution of the Socialist Republic of Romania we sign and we have to be published in the Official Bulletin of the Socialist Republic of Romania Law no. 13 13 of 19 December 1980 on the establishment, distribution and use by county of resources to supply the population with meat, milk, vegetables and fruits. NICOLAE CEAUSESCU PRESIDENT OF SOCIALIST REPUBLIC OF ROMANIA The achievement of the program of continuous lifting of the standard of living of the entire people, established by the 12th Congress of the Romanian Communist Party, requires the increase of agricultural, plant and animal production, in all state and cooperative units, Increasing the resources of households, in order to improve the supply of citizens with agri-food products, to broaden the raw materials base of the industry and to meet other needs of the national economy. The folk councils have the obligation to act permanently for the full fulfilment of the programs for the development of vegetal and animal agricultural production in the administrative-territorial units in which they operate. In each county and locality, the establishment and use of meat, milk, vegetables and other agri-food products must be carried out on the basis of the application of the principles of working-class self-driving and economic-financial self-management. Through the full use of the productive potential of the earth and the good management of existing resources, in terms of efficiency as high as possible, the folk councils must ensure the satisfaction of the needs of agri-food products of the population from each county in close correlation with increasing production and increasing the contribution to the realization of the state fund, to cover the other requirements of the national economy. To this end, the Grand National Assembly of the Socialist Republic of Romania adopts this law. + Article 1 Popular councils have the obligation to ensure the unitary management of agriculture from the administrative-territorial units in which they operate, based on the principles of working-class self-driving and economic-financial self-management, in order to the increase of agricultural production, the satisfaction of the consumption needs of the population in the resources of each county and of the participation to an increasing extent to the establishment of the state fund. + Article 2 The folk councils are responsible for the application of all the measures provided in the agricultural production development programs in territorial aspect, to capitalize as fully as possible the productive potential of the earth, the high yield use of the other means of production and the rational use of the employed workforce in agriculture, in order to continuously increase the production of meat, milk, vegetables and fruits in state and cooperative agricultural establishments and households. + Article 3 The production obtained in all sectors of agriculture must ensure, in each county, the full fulfillment of the obligations of delivery to the state fund of the production of meat, milk and other animal products, of vegetables, potatoes and fruits, as well as making additional quantities of products through contracting and purchasing from households. All rural and urban residents, who own agricultural land, are obliged to cultivate and grow animals and birds in order to cover their own consumption needs, as well as to create availabilities to be capitalized on the state fund or the market, Under the conditions provided by law. + Article 4 The popular councils respond, according to the law, to the constitution of the goods fund for the full, rhythmic satisfaction of the consumption needs of the population with meat, milk and dairy products, potatoes, vegetables and fresh fruits, the organization and supply, in appropriate conditions, of agri-food markets for the good service of the population, the establishment of autumn and winter stocks, the provision of the canning industry with raw materials, as well as the creation availability to meet other needs of the national economy. Decisions related to the supply of the population, the establishment, distribution and use of agri-food resources, the development and diversification of the product range, the good organization and supply of agri-food markets are taken jointly agreement by the executive committees or offices of the popular councils and territorial union councils. + Article 5 Popular councils bear the full responsibility for the full fulfillment of their obligations to deliveries of meat, milk, vegetables and fruits for the establishment of the state fund. The realization of the state fund in accordance with the provisions of the single national plan, the contracting and acquisition of additional quantities of products from households and the development of the other production activities must ensure good supply of the population with meat, dairy products, vegetables and fresh fruits from the production obtained in each county, as well as meeting the other needs of the national economy. Meat, milk, vegetables and fruit resources for the consumption of the population through the market fund and the other needs of the national economy shall be ensured from 1. the state fund constituted, according to the law, of: a) the production delivered by the state agricultural units; b) production capitalized by contracting and procurement by the cooperative agricultural units; c) contracting and procurement from households. 2. additional resources made in each county from: a) the quantities of products made by contracting and additional purchases from households; b) the production obtained in the annexes of the cantine-restaurant, public-food establishments, tourist cottages, ocoals and forest cantons and the like; c) other production activities organized locally, under the conditions provided by law. + Article 6 The quantities of products necessary to supply the population from the state fund and from the additional resources constituted in each county are established annually, through the single national plan of economic and social development, differentiated by county, depending on the total number of inhabitants, the population of urban and working-class centres, including the seasonal population, as well as the existing production conditions in each area, in the following average proportions: a) for meat, 90 percent of the state fund and 10 percent of resources constituted in each county and derived from additional contracting and acquisitions from households, the production carried out in the annexed units and other activities organised locally; b) for milk products, 85 percent of the state fund and 15 percent of the products additionally taken by contracting and purchases from households in the respective county; c) for fresh vegetables and fruits, 70 percent of the state fund and 30 percent of additional contracting and purchases, made in the county, depending on the structure of production and the pedoclimatic conditions. When developing the supply plan in each county, it will ensure the establishment of agri-food reserves of up to 5 percent in meat, 10 percent on milk and dairy products and 15 percent on vegetables and fruits, calculated on the quantities of products planned to supply the population from the state fund. + Article 7 In relation to exceeding the delivery tasks to the state fund, the consumption, sales and delivery levels to the market fund, established on each county, are supplemented as follows: a) with 10 percent of the quantities delivered over the plan by the state agricultural units; b) by 40 percent of the quantities delivered over the plan by the cooperative agricultural units; c) with 70 percent of the quantities delivered over the plan to the state fund from contracting and procurement from households; d) the quantities obtained by exceeding their own production tasks by canteens, restaurants and other food establishments will be used in full by the producer unit. The provisions of this Article on the supplementation of consumption levels to meat shall apply only on condition that the planned animal herds are carried out and the delivery of the delivery tasks to the state fund throughout the county. Additional deliveries compared to the tasks established by the plan will be possible only from the communes that carry out the planned livestock in the households. For socialist units additional deliveries of live animals will be able to be made under the conditions of the realization of herds, the average planned cutting weights, as well as the classification in the rules of consumption of feed. + Article 8 In case of full non-fulfillment of the delivery obligations to the state fund, the quantities provided to be distributed from the state fund on each county shall be reduced in proportion to the degree of non-fulfilment of live animal delivery tasks, milk and milk products, vegetables and fresh fruit. + Article 9 The supply of meat, dairy products, fresh vegetables and fruits, nurseries, kindergartens, hospitals and social assistance units is provided from the state fund, based on consumer norms established according to the law. + Article 10 The meat supply of canteens, restaurants and other food establishments is made from the state fund, as well as from its own production, according to the tasks established by the plan of each unit. To this end, the executive committees or offices of the municipal and city folk councils will take measures to develop production capacities for pig farming and fattening, canteens, restaurants and other establishments. public catering, for the full use in animal feed of culinary debris, as well as for equipping with the necessary equipment for animal feed, under the conditions of compliance with veterinary rules. Also, county folk councils will take measures to identify and award virane land from the buildable perimeters of localities, which annually will be made available to units with collective consumptions-canteens, restaurants, interned and other units-or citizens, in order to cultivate these lands with vegetables, potatoes and other food crops. + Article 11 The establishment, distribution and use of resources established by the plan and additional ones for the supply of the population to the market fund, collective consumptions and other consumptions, with meat, dairy products, vegetables and fruits shall be made by public councils in agreement with territorial union councils, on the basis of programs developed and approved under the conditions established by law. The public councils are obliged to submit to the debate the population supply programs and to present reports in assemblies of citizens regarding the decisions and measures adopted in connection with the constitution of resources and the distribution of agri-food products, by localities and commercial systems. + Article 12 The Central Union of Consumer Cooperatives and the units of consumer cooperation must ensure the intensification of the activity of valorization on the path of contracting and procurement of agricultural products available in households. In order to increase agricultural production, the consumer cooperation will organize, in its own capacities, the production of day-old chicks, the growth of prasila sows for obtaining piglets and the multiplication of homemade rabbits. The chickens, piglets and homemade rabbits obtained from the consumer cooperative units will be sold to households, with which contracts are concluded for the valorisation of animals and birds to the state fund or through contracting and procurement. additional, as well as for meeting their own consumption needs. Also, the units of consumer cooperation can sell piglets, chickens and rabbits to the house of canteens, restaurants and other food establishments, for their organization of their own activity of animal breeding and fattening, birds and rabbits for meat. + Article 13 The Ministry of Agriculture and Food Industry together with the National Union of Agricultural Production Cooperatives and the popular councils will take measures to fully meet the animal husbandry programmes, complete the total numbers and the codend, of the breeding indices, as well as for the rhythmic delivery and the hardships established by law of the animals intended for slaughter. They will also provide the fodder base through the cultivation and full use of surfaces intended for fodder plants, double crops, as well as for the reseeding of natural meadows and finesse, harvesting, storage and full use of all volume feed resources and plant by-products. The Ministry of Agriculture and Food Industry and the Central Union of Consumer Cooperatives have the obligation to ensure, according to the tasks established by the single national plan, prasila material and incubation eggs to the units of consumer cooperation. Also, the Ministry of Agriculture and Food Industry will provide the necessary technical assistance for the organization of incubation and breeding activity in the units of consumer cooperation. + Article 14 The Ministry of Agriculture and Food Industry together with the National Union of Agricultural Cooperatives of Production and popular councils are obliged to ensure that all socialist, state and cooperative agricultural units, all holders of agricultural land to apply the measures provided for the full use of the earth and to increase its production potential, to use with high efficiency the labor force and the technical-material basis, to execute in good conditions all agricultural works established by production technologies, to fully realize programs to increase agricultural, plant and animal production. + Article 15 Failure to comply with the provisions of this law shall entail, where appropriate, disciplinary, material, civil or criminal liability This law was passed by the Grand National Assembly at its meeting on 19 December 1980.
