+ Chapter 1 General provisions + Article 1 The popular councils are local bodies of state power, elected by universal, equal, direct and secret suffrage, through which the people exercise state power in the counties, the city of Bucharest and its sectors, the other municipalities, cities, cities and communes. In carrying out the constitutional provisions, according to which the power of the people is based on the working-peasant alliance, the popular councils ensure the development and strengthening of the unity of the working class, the peasants and intellectuals, of all Working people, without distinction of nationality. The entire activity of the folk councils is carried out on the basis of the self-driving and economic-financial self-management and aims to strengthen the socialist order, affirming the principles of socialism in all the localities of the country, good management of material and labour resources, development of productive forces and diversification of local economy, continuous growth of material and cultural well-being of the people, ensuring freedom and dignity of man, multilateral affirmation of human personality, consistent promotion of ethics and equity Socialist. Popular councils carry out a wide work of educating the masses in the spirit of devotion to the homeland and the cause of socialism, socialist internationalism and solidarity with working people everywhere. + Article 2 Popular councils operate under the leadership of the Romanian Communist Party, the ruling political force of the entire society. + Article 3 Popular councils are organized and operate on the basis of the principle of democratic centralism, a fundamental principle of the organization of the entire state activity in the Socialist Republic of Romania. Popular councils promote in economic, social and state life, locally, the principle of work and collective leadership. Popular councils resolve issues of local interest consistent with the country's general interests. They have the fundamental obligation to ensure the application of the Constitution and the laws of the country, to combat any tendencies to disregard the legal provisions, to act for the knowledge and respect of the laws, the strengthening of the socialist legality, the removal Bureaucracy and formalism. The folk councils exercise, in the administrative-territorial units in which they are elected, the control in all fields of activity, in order to establish the spirit of responsibility and discipline in work, of revolutionary combativeness, solicitude and operativeness in solving citizens ' requirements and proposals. + Article 4 Popular councils base their activity on the principles of socialist democracy, ensuring the direct participation of all citizens, without distinction of nationality, race, sex or religion, at the local debates of state affairs and obstesti and to the achievement of decisions and measures that have been taken. Citizens ' assemblies will be organized on communes, cities, municipalities or counties, as follows: a) in communes, general meetings of citizens: within the larger communes, assemblies are organized on villages; b) in cities and municipalities, citizens 'assemblies on neighborhoods, with the participation of deputies, standing committees, citizens' committees, housing associations, as well as representatives of working people from enterprises and other economic units and social; c) in counties, citizens ' assemblies, with the participation of deputies, permanent commissions, mayors of communes, cities and municipalities, representatives of working people of enterprises and economic and social unity, as well as of citizens of appointments, cities and communes within the county. Popular councils ensure citizens ' rights are protected and public order is maintained. + Article 10 The folk councils analyze the economic and social-cultural problems of local interest and those of republican interest in the administrative-territorial units in which they are elected and, as the case may be, they solve or make proposals to the competent bodies for their resolution, taking part in the preparation of appropriate measures. If, in solving some porblems of republican interest regarding the state activity locally, the opinion of the county folk council or the city of Bucharest differs from that of a central body, the State Council will be informed. + Article 11 The folk councils examine and solve, together with the state bodies, economic units and social-cultural institutions that are not subordinated to them, all problems of common interest regarding the multilateral development of the counties, the municipality Bucharest and its sectors, municipalities, towns and communes. + Article 12 Popular councils are responsible for the entire agricultural production activity, the proper organization and development of agricultural works, the rational and efficient use of the land fund, the increase of plant and animal production; it controls and supports the activity of state and cooperative agricultural units, as well as of households in the administrative-territorial units in which they are elected and adopt appropriate measures. The decisions of the popular councils are mandatory in the administrative-territorial units where they are elected. + Article 14 The guidance and general control of the activity of the popular councils are exercised by the Great National Assembly. In the interval between the sessions of the Great National Assembly, the work of the folk councils is guided and controlled by the State Council. Popular councils guide and control the work of lower hierarchical folk councils. In the exercise of control, the higher hierarchical organs of state power have the right to analyze the illegal acts of their subordinate bodies. + Article 15 The county folk councils, of the city of Bucharest, of its sectors, as well as the celea of the municipalities, choose executive committees, and the popular councils of cities and communes choose practiced offices between their deputies. + Article 16 Executive committees or, as the case may be, executive offices are local bodies of the state administration with general competence in the administrative-territorial units in which they operate, being subordinated to the popular councils that elected them, as well as higher hierarchical folk councils and committees or, as the case may be, their executive offices. + Article 17 The work of the committees and executive offices of the popular councils is led and controlled by the Council of Ministers. The committees and executive offices of the popular councils lead, guide and control the work of the lower hierarchical executive committees and offices. + Chapter 2 Role of folk councils in the economic and social development of administrative-territorial units + Article 18 Popular councils coordinate the entire economic and social development activity in counties, municipalities, cities and communes according to the principle of self-driving and economic and financial self-management, ensuring the direct participation of to all citizens, without distinction of nationality, in their capacity as owners, producers and beneficiaries, to the achievement of the party's policy and the state of harmonious, multilateral development of all counties and localities. + Article 19 In order to carry out their special tasks in the economic, social-cultural and edilitary-household development of the counties and localities the folk councils must base their entire activity on the continuous strengthening of the link with citizens, on their broad consultation, on stimulating the initiative and on the direct and responsible participation of every citizen in the achievement of the general program of building the multilateral socialist society developed and advancing Romania towards communism. + Article 20 In accordance with the provisions of the single national plan of economic and social development, the popular councils are responsible for the elaboration and implementation of economic and social development plans in territorial aspect; they organize, guide and control carrying out the tasks of the plan by all economic units, regardless of their subordination. Popular councils are taking steps to develop industry, agriculture, transport, services and other economic branches, for the full valorisation of local resources, helping to increase the economic potential throughout the territory the country, to the continuous lifting of the quality of life of all citizens + Article 21 Popular councils are obliged to act firmly to reduce production costs, increase labor productivity, introduce a severe savings regime, use the material base with a household spirit. To this end, they take measures to reduce the consumption of materials, fuels and energy, the use of reusable and recoverable materials, the increase in the valorization of all resources of locally existing materials and materials. + Article 22 Popular councils respond, according to the law, to the guidance and coordination of all small industry activity, an integral part of the socialist economy, to the good organization of the activity of production and service units, regardless of their subordination, the efficient valorisation of material resources and work forces to satisfy the requirements of products and services of the population in the best conditions. Popular councils take measures to increase citizens ' contribution to solving the problems that modernization, good management and beauty of municipalities, cities and communes raise, to increase the contribution of acesstora to the realization road works, white regularizations, banks consolidations, water supplies, sewers, park facilities, green spaces, playgrounds for children, land and simple sports facilities, as well as other similar works. + Article 31 Popular councils take measures, according to the law, for environmental protection, control how socialist units meet established measures and use investment funds aimed at protecting and improving quality. environmental factors. + Article 32 Popular councils respond, under the law, to meet the water requirements of the population and economy, harnessing new water sources, rational use of waters, their protection against exhaustion and pollution, as well as for the arrangement and maintenance of waters of local interest and flood defences. + Article 33 The popular councils respond, according to the law, to ensuring the conditions of permanent use of traffic arteries, the execution of works of upgrades, repairs and maintenance of them, the cleanliness of the streets, the preservation and maintenance technical-urban and household facilities, road signs and plantations, training in these actions the population of the localities. + Article 34 The folk councils ensure the guidance of the entire political-educational and cultural activity, carried out in education and culture institutions, schools, cultural hostels and other units, ensure the good organization of the National Festival "Cintarea României" and other cultural-educational actions, in order to permanently raise the social conscience of citizens, the formation of the new man, builder of the socialist and communist society in Romania. + Article 35 The folk councils ensure the guidance, control and coordination of the education in the administrative-territorial units in which they are chosen, following the proper organization and conduct of the instructive-educational process, the development and the judicious use of the material basis and the strengthening of the responsibility of the teaching staff for continuous improvement, in relation to the requirements of society, of the preparation for work and life of the young generation At the same time, they will take measures to achieve, within the practical activity carried out in schools and high schools, industrial products, especially consumer goods. + Article 36 Popular councils are responsible for carrying out their tasks in ensuring the health of the population and social assistance, the development and modernization of health facilities and the efficient use of the technical-material base, as well as distribution and good use of medical-sasnitar personnel, in order to prevent and combat diseases, the continuous strengthening of the health of the entire population. + Article 37 Popular councils are obliged to take measures for the strict knowledge and enforcement of party decisions and state laws by all citizens, strengthening public order and discipline, defending public wealth, peace and property. citizens. Popular councils are obliged to submit to the debate of citizens ' assemblies plans in territorial aspect, income and expenditure budgets of localities, all basic problems regarding their development and to submit reports on work carried out + Article 40 The provisions of this Chapter shall also apply accordingly to the work of the executive committees and offices of the popular councils. + Chapter 3 Popular councils + Section I Tasks + Article 41 The popular councils decide, according to the law, in all state issues locally, exercising the following main tasks: a) adopt the economic and social development plans in territorial aspect, based on the tasks arising from the single national plan; b) adopt the local budget and approve the closing account of the budget year; establish local taxes and fees; c) decide on the problems regarding the local economic and social plan and the local budget and are responsible for their implementation; they follow the implementation of the economic and social development plan in territorial aspect; the territory and the localities, the concession of economic objectives, the realization of investments, the development of the small industry, the growth of agricultural production, the use of the land fund, the water management and the execution of watersheds, forestry development, forest management and communal passions, communal and housing management, environmental protection, commercial activity and service provision, development of educational activity, culture, snatting and social assistance, carrying out tasks relating to national defence; d) choose and revoke the executive committees or offices, choose and revoke any of their members; e) establish the number of permanent commissions, choose and revoke their members, lead, guide and control their activity; f) examines the proposals made in citizens ' assemblies and decides on how to be resolved. g) decide, according to the law, on the revocation of deputies, based on the proposals of the local councils of the Front of Democracy and Socialist Units: approve, in consultation with the local councils of the Front of Democracy and Socialist Unity, the cessation, at application, of the mandate of MP, before the expiry of the mandate of the h) establishes, according to the law, economic units, institutions of education, culture and socialist education, health, as well as for labor problems and social protection, of local interest; i) organize the own apparatus of the executive committee or office, as well as the local bodies of specialists of the state administration, appoint and revoke their leaders, with the consent of the bodies of the superior hierarchical state administration of specialty; call and revoke the leaders of the local authorities of the militia, with the consent of their superior hierarchical organs j) lead, guide and control the work of their executive committees or offices; k) organizes and coordinates the entire activity of popularization, knowledge and understanding of party decisions and state laws by citizens, in order to act in accordance with their provisions, for which purpose special measures; ensure the application and observance of party decisions, laws and decrees, as well as own decisions, by the apparatus, subordinate bodies and units and periodically analyze the way they are carried out; l) take measures to fulfill the decisions of the congress, the legislative chamber, the conferences of popular councils and the decisions of the higher hierarchical folk councils; m) lead, guide and control the activity of the local specialized bodies of the state administration of economic units and subordinate social-culural institutions; examine their activity and establish measures to improve the work n) exercise any other duties provided by law. + Article 42 Apart from the duties provided in art. 41, the popular councils still have the following specific duties: 1. The county folk councils shall elect and revoke the presidents and judges of the county court, the judges for the courts of the county, as well as the chief prosecutors of the county prosecutors. The election is made in the first session of the popular council, after the session of its establishment, at the proposal of the Ministry of Justice and the Prosecutor General. The elected officials work until new elections of judges and chief prosecutors. The sessions of the popular councils are public, unless the popular council decides otherwise. Debates in sessions are made in Romanian, ensuring in the administrative-territorial units inhabited and population of other nationality than the Romanian one, the use of the mother tongue of that population. organizes the activity of ralization of investments, of the publishing, maintenance and modernization works of the circulation arteries, of the electrification of villages, of the construction of state property and personal property; authorizes the operation of units of cooperative organizations; authorizes the work of craftsmen; k) establish prices and tariffs for products and services and control the application of prices and tariffs in the administrative-territorial units, according to the law; l) organize, in collaboration with the specialized central bodies, the activity of education, culture and education, the medical assistance of the population and tourism, as well as the work on labor, social security and social assistance; Executive committees of the county folk councils: a) take measures for the harmonious development of municipalities, cities and communes, for their endowment with economic, social-cultural constructions, technical-urban works and for the improvement of public transport; b) approve, under the law, the modification of the investment and construction-assembly plan between objects, within the total volume approved by the economic-social development plan, without affecting the deadlines for the implementation provided in the plan: approve the technical-economic documentation for investment works from its own plan; approve the modification of indicators and plan tasks, following the handover or takeover of tasks provided for in the single national plan; c) approve the centralized plans of income and expenses for the advantage of some activities of the local subordination units; d) use the budgetary reserve made available to them, in order to finance the actions or tasks involved during the year; e) organize the exercise of substantive management control over the activity of economic units and subordinate social-cultural institutions, on the activity of the executive committees or offices of the municipal, city and city folk councils communal, as well as on the activity of housing associations; f) orgnizes the activity of systematization and construction, as well as the elaboration of the documentation of systematization of urban and rural localities; g) issue, after prior consultation of the committees or executive offices of the popular councils of municipalities, towns and communes, the agreement for the location and construction, in the counties, of economic units and social institutions cultural interest of the Republican; h) ensure the administration, maintenance and exploitation of the state property housing stock; i) guide and control the activity of civil status, of guardianship and protection of minors, as well as the notary activity carried out, according to the law, by the executive offices of the folk councils; protection of minors and social assistance subordinated to local bodies; j) approve, for subordinate units, the scientific research plan and the introduction of technical progress, the plan of measures on the scientific organization of production and work, as well as the norms and norms with the foundation technical-economic; participate in the elaboration of state standards for activities of local interest; organize the research, design and introduction of computer systems for the management of subordinate units; organize, lead the guide and control the activity of the technical-economic council k) prepare draft decrees and initiate draft decisions of the Committee of Ministers, which concern the county; l) edit the official bulletin board. 2. The decisions of the popular councils of the sectors and of the suburban communes, as well as the decisions of their committees or executive offices, are mandatory in the suburban sectors or communes in which the popular councils are elected. + Article 92 The provisions regarding the organization and functioning of the popular councils and their executive committees or offices shall apply, accordingly, to the popular councils of the city of Bucharest and its sectors, as well as to their committees executive. + Article 93 The popular council of the city of Bucharest exercises, accordingly, the powers provided for in this law for all categories of folk councils. + Article 94 The Executive Board of the People's Council of Bucharest shall, accordingly, exercise the powers provided for in this law for the executive committees of all categories of popular councils The President of the Executive Board of the People's Council of Bucharest is, at the same time, the general mayor of the Capital of Socialist Republic The chairmen of the executive committees of the popular councils of the Bucharest sectors are also the mayors of the sectors. + Article 95 The popular councils of the sectors of Bucharest shall exercise, accordingly, the powers provided for in art. 41 41 and art. 42 42 section 2 2 letter a) and c). + Article 96 The executive committees of the popular councils of the sectors of Bucharest shall exercise, accordingly, the powers provided for in art. 50, 51, 52 and art. 53 53 section 2. + Chapter 9 Other provisions + Article 97 Where the functions of the Chair, First Vice-Chair and Vice-Presidents of the Board or Executive Board of the People's Board have vacant, exceptionally and provisionally vacant, vacant rams may be delegated to these positions persons who do not have the qualification of MP. The delegation is made until new elections are made in the respective popular council, by presidential decree for the county folk council and the city of Bucharest and by the decision of the executive committee of the county folk council and the Bucharest Municipality for the committees and executive offices of the municipal folk councils, of the sectors of Bucharest, city and communal. + Article 98 In carrying out the task of organizing citizens 'participation in the local resolution of state and public affairs, executive committees or, as the case may be, the executive offices of the popular councils organize citizens' committees on municipal electoral districts, of the sectors of Bucharest, city or communal, besides social-cultural institutions, as well as for carrying out works of public interest. The citizens ' committees shall be elected after the sessions of establishment of the popular councils during the mandate of the acesotra; they shall be responsible for their work in front of those who elected them. + Article 99 The classification, transfer and disposal of the employment contracts of the staff with management positions and of the technical, economic, other specialized and administrative personnel of the own apparatus shall be made by the executive committees or offices of the popular councils. The classification, transfer, as well as the dissolution of the employment contracts of the deputy heads of the local state administration special bodies, shall be made according to the law, by the committee or the executive office of the popular council besides that works. The classification, transfer and disposal of the employment contracts of the technical, economic, other specialized and administrative personnel of the local specialized bodies of the state administration shall be made by the collective management bodies or, where appropriate, by the driver, according to their jurisdiction. The executive committees of the county folk councils and the city of Bucharest can establish that the presidents, the first vice-president, and their secretaries, in the compartments of activity that they coordinate, through provisions, to fit into work, to transfer, to sanction the disciplinary and to open the employment contract to the staff provided in par. 1 1 and 2. The permanent offices of the executive committees of the county folk councils and the city of Bucharest resolve the appeals: against the measures taken under the disciplinary conditions ordered by the heads of the local specialized bodies state administration, economic units and social-cultural institutions subordinated to the county, as well as against disciplinary sanctions ordered by the committees or executive offices of the lower hierarchical folk councils which, according to the Labor Code or other provisions of the law, were not given in the competence the court or other organs. + Article 100 The executive committees of the county folk councils and the city of Bucharest will issue operating regulations for their own apparatus, as well as for the apparatus of the lower hierarchical executive committees and offices. --------------
