Chapter 1 General Provisions



Article 1


People's Councils are local organs of state power, elected by universal, equal, direct and secret ballot by which people exercise state power in counties, Bucharest and its sectors, other cities, towns and villages.
The implementation of constitutional provisions according to which the power of the people is based on the worker-peasant alliance, popular councils ensure the development and strengthening of the unity of the working class, peasantry and intelligentsia, of all working people, regardless of nationality.
The entire activity of the people's councils are conducted on workers' self-management and self economic-financial and aims to strengthen the socialist system, consolidating the principles of socialism in all areas of the country, proper management of material and labor resources, development and diversification of the productive forces local economy continue increasing material and cultural well-being of the people, ensuring freedom and human dignity, of human personality multilateral assertion, consistently promoting socialist ethics and equity.
Carries a large people's councils work to educate the masses in the spirit of devotion to the motherland and the cause of socialism, the socialist internationalism and solidarity with the working people everywhere.

Article 2


People's Councils operate under the leadership of the Romanian Communist Party, the leading political force of the entire society.

Article 3


Popular councils are organized and operate on the principle of democratic centralism, a fundamental principle of organizing the entire activity of the Socialist Republic of Romania state.
People's Councils promotes the economic, social and state, local, labor and collective leadership principle.
People's Councils solve local problems in accordance with the general interests of the country. They have the basic obligation to enforce the Constitution and laws of the country, to combat any tendency to disregard of the law, to act for cunoastrea and rule of law, strengthening socialist legality, removing bureaucracy and formalism.
Popular councils exercise in administrative-territorial units that are chosen control in all fields, in view to establishing the spirit of responsibility and work discipline, combativeness groundbreaking welfare and efficiency in solving citizens' demands and proposals.

Article 4


Popular councils base their work on the principles of socialist democracy, ensuring the direct participation of all citizens, irrespective of nationality, race, sex or religion, to debate local affairs of state and public measures and the implementation of the decisions and what -took.
People's Councils citizens assemblies subject to debate basic issues of economic and social development of localiatilor and shall submit periodic reports on their activities.
People's Councils are obliged to organize semi-annual gatherings of citizens, in which primaii communes, towns, municipalities and chairmen of county folk executive committee, will report on the decisions taken, timely execution and smooth-household municipal works, providing public supply, maintenance and housing management, housing allocation as provided by law, the settlement proposals and complaints, bringing to public knowledge the fulfillment of decisions and measures.
Citizens Assemblies will be held on villages, towns, cities or counties as follows:

A) joint general assemblies of citizens: the municipalities within larger assemblies organized by villages;


B) in cities and municipalities, citizens 'assemblies in neighborhoods with the participation of deputies, standing committees, committees of citizens, residents' associations, and representatives working people in enterprises and other economic and social units;



C) counties, assemblies of citizens, with the participation of deputies, standing committees, mayors of municipalities, towns and cities, representatives of working people in enterprises and economic and social unit, and you citizens of numicipii, towns and municipalities in the county . Appointment of representatives of citizens is by committees of citizens and displays at popular council at least 10 days before the date of the meeting.


In meetings, citizens have the right to ask questions, to seek clarification on any questions, participate in discussions and make proposals.
Committees and executive offices of the People's Councils are obliged to notify the public at least 3 days before the date at which the citizens assembly.

Article 5


Councils are obliged to keep the citizens through the media, display, wire broadcasting stations, other means of mass information on the work done and decisions taken with regard to economic and social development of administrative-territorial units in which they are elected as and on other tasks incumbent upon them proper management and administration of the municipalities in solving problems related to the life and work of citizens.

Article 6


In performing all their duties, popular councils apply the principles of workers' self-management and self economic and financial ensure, in accordance with the provisions of the economic-financial mechanism, with maximum efficiency using material and financial resources entrusted to them, the continued development and proper management of settlements, increasing their income and, on this basis, self-financing of municipalities, cities and counties.

Article 7


People's Councils strengthen and develop links with local bodies of the Socialist Democracy and Unity Front to mobilize working people to achieve LOAD plan and conduct activities to promote economic and social-cultural development of administrative-territorial units and activity systematization and proper management of cities, towns and villages.
Councils strengthen ties with popular mass organizations and public and give them support in carrying out their duties.

Article 8


Popular councils administer local Marxist-Leninist national policy of the party and state, assuring all citizens, regardless of nationality, fully equal rights in all areas of economic, political, legal, social and cultural.
The administrative units also inhabited by population other than the Romanian nationality in local bodies of state power and local bodies of state administration and working people are elected from among these nationalities. Local authorities use oral and written language and nationality question in turn make appointments or of other citizens who speak the language and way of life of the local population.

Article 9


People's Councils in the exercise of state power locally, have a broad autonomy. Article 10

Article 11


Examine and solve people's councils, together with the state, entities and social and cultural institutions that are not subordinate all issues of common interest relating to the development of multilateral counties, Bucharest and its sectors, municipalities and municipalities.

Article 12


Popular councils responsible for all agricultural production, good organization and conduct of agricultural operations, the rational and efficient use of land, plant and animal growth; controls and supports the work of state and cooperative agricultural units and households from administrative units in which they are elected and take appropriate measures.

Article 13


Popular councils, in their duties, adopt, with observance of the law, decisions.
People's Councils decisions are binding in administrative-territorial units in which they are elected.

Article 14


General business guidance and control people's councils are exercised by the Grand National Assembly.
In the interval between sessions of the Grand National Assembly, People's Councils work is guided and controlled by the State Council.
People's Councils directs and controls the activity of the hierarchically inferior People.
In exercising control, higher bodies of state power have the right to investigate the illegal acts of their subordinate bodies.

Article 15


County People's Councils, of Bucharest, industry, as well as those of municipalities choose executive committees and people's councils of towns and communes offices exercutive choose between their deputies.

Article 16


Executive committees or, where appropriate, executive offices are local organs of state administration with general competence in administrative-territorial units in which it operates, which are subordinated to the people's councils they chose and the superior people's councils and committees or where appropriate, their executive offices.

Article 20



According to the single national plan for economic and social development, people's councils are responsible for designing and implementing socio-economic development plans in territorial; organizes, directs and controls the tasks of the plan by all economic units, regardless of their subordination.
People's Councils shall ensure the development of industry, agriculture, transport, services and other economic branches, for making full use of local resources, helping to increase the economic potential throughout the country, to continue raising the quality of life of all citizens of this country.

Article 21


People's Councils are obliged to act with determination to reduce production costs, increase labor productivity, introducing a strict regime of savings, the use of the material with household spirit. To this end, take measures to reduce the consumption of materials, fuel and energy, the use of recyclable and recycled materials, increased recovery of all material resources and materials available locally.

Article 22


People's Councils are responsible, by law, guidance and coordination of all activities of small industry, an integral part of the socialist economy, good organization of the activity of production and services, regardless of their subordination, the effective exploitation of material resources and workforce satisfaction in the best conditions the requirements for products and services of the population.
In order to develop small industry, popular works councils to be included in production and provision of services, throughout the year, the workforce available.
Also popular councils take measures for collection and recovery industry in the small of all available local material resources, raw materials and recyclable materials, parts and subansambelor from the dismantling of fixed assets, durable goods and personal use waste, metal resources, chemicals, wood materials, textiles and leather, food residual substances resulting from production or consumption processes and the like.

Article 23


People's Councils provide leadership in unified whole aagriculturi administrative units that are chosen in order to increase agricultural production, increasing agriculture's contribution to national economic development and raising living standards.
Popular councils take action and respond to the defense, conservation, improvement and full and efficient use of land, the main means of agricultural production, cultivation of land all in the public sector, the cooperative sector and households.

Article 24


People's Councils provide conditions for development livestock to cover their household consumption increasing demands and needs of industry raw materials; shall ensure proper management of the whole area filled with natural meadows and pastures, using the full untapped potential for continuous development of animal husbandry.

Article 25


People's Councils rapsund entirely satisfying consumer needs of vegetables, potatoes and fresh fruit, a period during the year how much Amre, the building up of stocks for autumn and winter, canning supplies of raw materials, and the creation of reserves for export.

Article 26


To increase the contribution of households to increase crop production and animal consumption and ensuring their needs with meat and other animal products, popular councils shall ensure that all urban and rural residents who own agricultural land to cultivate and grow animals and birds.
Popular communal councils, town and city will draw up programs for livestock and poultry every household across administrative-territorial and will take measures to increase production at designated forage base, pastures and natural fîneţele, harvesting, storage and preservation of the entire production of feed, ensuring judicious use of it, so that every household could undertake the obligation to raise animals and birds.

Number of animals and birds that can be grown per household for its own needs or for sale on the market contraction or purchase is unlimited.
Popular communal councils, town and municipal programs will include specific targets for each household based on broad consultation of citizens, setting the number of livestock and poultry production and supply of animal products from the state, in conjunction with tasks economic and social development of administrative territorial unit. Properly tasks will be established and growing all areas, planting of trees and shrubs, it will get agricultural production and supplies of vegetables, potatoes, fruits and other agricultural products to the state fund.
Development programs of livestock and poultry are subject to debates general meeting of common citizens and become compulsory for all rural residents, after their adoption by popular councils.

Article 27


Popular councils responsible in conformtiate plan with tasks, providing the necessary resources to fund state constitution cereals, vegetables, fruits, livestock, poultry, milk, eggs and other food products plant and livestock, as well as meeting the needs of consumption of the population within their own activity.

Article 28

Article 30


In order to develop urban-household of urban and rural people's councils are responsible for the proper organization and operation of public transport, maintenance of water supply networks, sewerage and heating systems, upgrading and maintenance of roads and streets, sanitation settlements as well and carrying out other works with urban character and urban-household.
Popular councils ensure full implementation of the plan to build housing in strict compliance with systematization, ensuring their execution at a level appropriate quality and proper maintenance and management of housing stock.
Popular councils take measures to increase citizens' contribution to solving the problems raised by modernization, good housekeeping and beautification of cities, towns and villages, to increase the contribution acesstora the completion of the roads, regularization of whites, consolidation of banks, food water, sewerage, amenities parks, green areas, children's playgrounds, sports fields and simple, and other similar works.

Article 31


Popular councils take action according to the law for environmental protection, controls how the units meet socialist measures and use investment funds established to protect and improve environmental quality.

Article 32



People's Councils are responsible, under the law, to meet the water requirements of the population and economy, development of new water sources, rational use of water, protection from depletion and pollution and water for development and maintenance of local interest and flood protection.

Article 33


People's Councils are responsible by law for ensuring the conditions for permanent use thoroughfares, the execution of modernization, repair and maintenance thereof, cleaning streets, preservation and maintenance of facilities and technical urban household, the flags road and plantations involved in such actions population settlements.

Article 34


People's Councils provide guidance entire political-educational and cultural activities held in institutions of education and culture, schools, community centers and other units ensure smooth organization of the National Festival "Song to Romania" and other cultural and educational activities in order permanent raising social consciousness of citizens, training new man, builder of socialist and communist society in Romania.

Article 35


People's Councils provide guidance, control and coordination of education in the administrative-territorial units are selected soundly organization and conduct of the educational process, development and judicious use of material resources and strengthening accountability for teacher improvement continue, report required by the company, preparation for work and life of the young generation. At the same time, take measures to achieve, within the activity carried out in schools and colleges, industrial products, especially consumer goods.

Article 36


People's Councils are responsible for the fulfillment of their duties in ensuring health and welfare, development and upgrading of sanitary and efficient use of material and technical base, as well as distribution and proper use of professionals sasnitar in order to prevent and combat diseases, continue to strengthen the health of the entire population.

Article 37


People's Councils are obliged to take measures to cunoastrea and strict application of the decisions of the party and state laws to all citizens, strengthen public order and discipline, defense of public property, tranquility and property of citizens.
Local militia bodies and other bodies that have tasks in this field will present regular reports on the popular councils how they carry their respective legal duties.

Article 38


For firm enforcement of the new economic-financial mechanism in economic and social activity and ensuring self-financing local communes, towns, municipalities and county councils are obliged to take popular measures for the proper management and use of material and financial means to them are entrusted and the continuous increase of own revenues to the local budget through continued development of small industry, services sectors, activities for community management, social-cultural and other economic activities, and participation of citizens in the spirit of ethics and equity socialist formation own revenues of municipalities, as provided by law.
Rapsund People's Councils for ensuring the pursuit by each economic unit to a profitable activity, by increasing benefits and improvement of the system of savings in all productive and social-cultural units, the enhancement of all sources of revenue increase that is realized their territory, their judicious use, for the full plan in territorial, local budgets and budgets of income and expenditure of all units.

Article 39


People's Councils are obliged to harness energy, creative ability and initiative of all working people in adopting and carrying out decisions, to solve the welfare and efficiency all issues raised by citizens, so that all their needs are closely linked people's real, reflecting in this way, aspirations and interests of working people in building the multilaterally developed socialist society.

People's Councils are obliged to submit to debate plans in territorial assemblies of citizens, income and expenditure budgets of towns, all based on their development issues and to report on their activities.

Article 40


The provisions of this Chapter shall apply accordingly to the work of the committees and people's councils' executive offices.

Chapter 3


People's Councils
Section I


Duties
Article 41


Popular councils decide according to the law in all state matters locally exercised following main tasks:

A) adopt plans of economic and social development in territorial, based on the burden of the single national plan;


B) adopt and approve local budget closing account of the budget year; establish local taxes;


C) decide issues on local socio-economic plan and local government responsible for their implementation; pursue implementation of socio-economic development plan in territorial; decide on matters relating to land planning and localities's concentration of economic, investment, development of small industry, increasing agricultural production, use of land, water management and execution of work on the river basins, development of forestry, forest management and passions municipal communal services and housing, environmental protection, conduct of business and trade services, business development education, culture, SNAT and social assistance tasks related to national defense;


D) elect and dismiss executive committees or offices, choose and dismiss any of their members;


E) determine the number of standing committees, choose and dismiss their members, lead, guide and supervise their work;


F) consider proposals made in meetings of citizens and decide on how to be resolved.


G) decide, by law, the revocation of deputies of local councils on the proposals of the Socialist Unity and Democracy Front: approve in consultation with local councils of the Socialist Democracy and Unity Front, termination, upon request, from office before the People's council mandate expires;


H) set by law, economic entities, educational institutions, culture and socialist education, health and employment problems and social care, local interest;


I) organizing apparatus of the executive committee or office and local bodies of state administration specialtiate, appoint and dismiss their heads in agreement with the superior state administration specialist; appoint and dismiss heads of local bodies of militia, with the consent of their superior bodies;


J) lead, guide and supervise the work of their committees or executive offices;


K) organizes and coordinates the entire activity of popularizing knowledge and understanding of Party decisions and state laws by citizens, to act in accordance with their provisions, the purpose of measures drawn up special programs; ensure implementation and compliance Party decisions, laws and decrees, decisions and own the machine, organs and subordinate units and periodically review how they are to be executed;


L) shall ensure implementation of the decisions of the congress, legislative Chamber, conferences and councils popular decisions the superior people's councils;


M) lead, guide and supervise the activity of specialized local state administration of social-economic units and institutions subordinated culurale; examine their work and establish measures to improve their work;


N) exercise any other functions provided by law.


Article 42


In addition to the tasks listed in Art. 41 people's councils have the following tasks:

1. Revoacă councils and county people choose presidents and County Court judges, judges for the district courts in the county and the county prosecutor prosecutors chiefs. The choice is made in the first session of the People's Council session after its establishment, the proposal of the Ministry of Justice or the General Prosecutor. Section II component and constitute the popular

Article 43


People's Councils are made up of MPs from constituencies, each an MP for each constituency of citizens entitled to vote who have reached the age of 23 years, irrespective of nationality, race, sex or religion.

Article 44

Mandate ends when the elections for the new people's council.

Article 45


Newly elected People's Council is convened for its first session, the Committee or the Executive Office of the People's Council whose mandate expired within 30 days from the termination of the mandate of the previous People's Council.
Works first session of the People's Council are headed, until the election of a chair, the eldest of the deputies.
In exercising its powers, the president of age is assisted by two deputies elected to its proposal, the council popular.
People's Council, at its first session, check the legality of the election of each deputy, decided validate or annul the election.
To verify the legality of the election of Deputies, the council popular choice of deputies throughout their tenure, a validation committee composed of 3-9 members.
After validation of the election, deputies take the oath of faith and devotion to the Socialist Republic of Romania.
After taking the oath, people's council shall elect from among deputies, a presidium consisting of 3-9 members for leadership work session.

After the election committee or executive board, its members take the oath of faith and devotion to the Socialist Republic of Romania.
People's Council establishes branches and fields corresponding to specific local needs and the number and composition of the standing committees and Members choose their members.

Section III


The operation of people's councils
Article 46


Popular councils working sessions. The session is popular exercise form the Board democratic state power locally and the main mode by which MPs fulfill the mandate given by voters.
Popular councils sessions are held once every 3 months. Popular Councils sessions are convened by the decisions of committees or executive offices. Convening regular sessions shall be given at least 10 days before the date fixed for holding them.
People's Council can be convened whenever necessary, in extraordinary initiative committee or executive office or at the request of at least one third of the deputies.
Popular councils sessions are public, unless when people's council decides otherwise.

Debate sessions are in Romanian, assuring into administrative units also inhabited by population other than the Romanian nationality, language use of that population.
Popular during Council may be invited persons from the ministries and other central agencies of economic entities and state institutions, public organizations, and other persons whose presence is considered useful.

Article 47


Popular councils working in the presence of at least half plus one of the total number of deputies, and the session shall be headed by a presidium consisting of 3-9 members. Presidium elect from among its members, the People's Council session President.
People's Council adopt resolutions by open vote, unless the board decides that the popular vote is secret. The decisions are adopted by a vote of Deputies making increasing people's council and signed by the chairperson of the session. Decisions taken if art. May 45 and signed by the chairperson of age.

Article 48


Draft agenda of the session shall be prepared by the committee or the executive of the People's Council and is approved by the people's council.
If an issue was put on the draft agenda at the request of one or more deputies, or the proposal for a standing committee, they need to include in the agenda will be exposed, if necessary, by one Members of the standing committee or the chairman. Presentation of the problem after the agenda was approved may be made either initiators or by a member of the committee or the Executive Board of the People's Council.

Article 49


Debates are recorded in a protocol signed by the President of the People's Council session.
Normative decisions and other important decisions of the People's Councils are communicated to the citizens by publishing, displaying or any other means of advertising. The administrative units also inhabited by population other than the Romanian nationality, these decisions are communicated to the citizens in the language of that nationality.

Chapter 4

Executive Committees and People's Councils executive offices

Section I


Duties
Article 50


Committees and People's Councils provide executive offices in the administrative-territorial enforcement Party decisions, laws, decrees, resolutions of the congress, conferences and legislative Chamber popular councils, the Council of Ministers decisions and of authentic instruments regulatory ministries and other central bodies approved by the House legislative decisions of the superior people's councils and committees decisions or their executive offices.

They exercise their rights and fulfill their obligations as a legal person county, municipality, district of Bucharest, city and village.

Article 51


In the interval between sessions of the popular councils, committees or their offices and executive powers meet people's councils, except as provided in Art. 14 para. 3 and 4, Art. 41 lit. a), b), d), e), g) and j), and Articles. 42 pt. 1 and pt. 2 lit. b) decisions subject to ratification people's councils at their first session.

Article 52


Committees and People's Councils exercise of executive offices, by law, under the powers provided for in art. 50 and 51, the following main tasks and responsibility to fulfill their

A) drafts the plans for economic and social development in territorial and local draft budget and submit them for adoption by the People's Council respectively;


B) allocating the tasks directly subordinated units of socio-economic development plan in territorial council adopted by popular; establish the necessary measures to fulfill the tasks assigned and are responsible for their local budget; draw up reports on the performance of the plan by the subordinate units; draw up general account of the budgetary exercise; approve, under the law, transfers of budgetary credits;



C) lead, guide and supervise the work of subordinate entities; take measures for small industry development and expand cooperation with republican enterprises; organizes enhancement of local resources; provide enriching and enhancing assortment of consumer goods, and enhance product quality and prestarolor service, reduce costs and increase profitability subordinate entities; take measures for realization of an abolition of any wastage savings in electricity consumption, fuel and other raw materials, and to support the action of collecting recyclable material resources;


D) exercise under the law, control over business units republican and supports their collective management bodies in establishing the necessary measures for the full realization of the plan targets;


E) use the amounts collected during the year over budgetary provisions, including benefits over the plan made as a result of their own efforts, to cover expenses realization of economic and socio-cultural activities, under the law;

I) establish programs for enforcement measures in time and in good agricultural works by all landowners and are responsible for bringing them to fruition, ensuring full and effective conservation and use of the land, the application of scientific criteria zoning of production and a structure rational crop, full performance of the work of reforestation and sound forest management that are directly in the management, maintenance and development of pastures and natural heritage finetelor fruit-wine;


J) organize, in cooperation with central and local specialty of cooperatives based programs, the processing of food products, supply and service of the population; controlling commercial activity and the provision of services and compliance with trade rules; ensure judicious distribution of goods fund settlements and trade systems; supports handicraft cooperatives and consumer cooperatives; authorizes the operation of units of cooperative organizations; authorizes the work of craftsmen;


K) setting prices and tariffs for goods and services and controlling the application of prices and tariffs in the content of the administrative-territorial law;


L) organizes in cooperation with the central specialized bodies, the conduct of education, culture and education, healthcare and tourism population and labor force activity, social security and social assistance; pursuing continuous improvement of working conditions and lives of the population welfare; take measures to protect the natural environment; organizes fund preservation and development of archives;

Article 53


In addition to the tasks listed in Art. 50-52, committees and executive offices of the People's Councils have the following tasks:
1. Executive committees of county people's councils:

A) shall ensure harmonious development of cities, towns and villages, equipping them with economic construction, social-cultural, technical and public utility works and improvement of public transport;


B) approve, under the law, amending the plan investment and construction-assembly between objects in the total volume approved by socio-economic development plan without affecting the deadlines for their fucntie in the Plan: approve documentation technical and economic investment plan for its work; approve the change in indicators and plan tasks, following the surrender or taking over certain tasks provided for in the single national;


C) approve plans for centralized revenue and expenditure atuofinantarea activities of units of local subordination;


D) use budget reserve established at their disposal to finance actions or come up during the year;


E) organize exercise administrative control over the activity of economic entities and social and cultural institutions subordinated to the work of its committees or executive offices of the municipal people's councils, town and village, as well as business associations;


F) orgnizeaza systematization and construction activity, and to develop a systematic documentation of urban and rural areas;


G) shall, after consultation with committees or executive offices of the People's Councils of the cities, towns and villages, location and construction agreement for the contents counties, establishments social economic and cultural republican institutions;


H) provide management, maintenance and operation of state-owned housing;


I) directs and controls the activity of civil status, guardianship authority and youth protection and notary activity carried out according to the law, the executive offices of the People's Councils; ensure the material basis of youth protection institutions and social subordinated local bodies;



J) approve, for the subordinated units, the plan of scientific research and application of technical progress, the plan of measures on scientific organization of production and labor, and the rules and regulations on technical and economic substantiation; participate in the development of state standards for the activities of local interest; organizes research, design and introduce systems for the management of subordinate units; organizes, directs and controls the activity leading Technical and Economic Council;


K) prepare draft decrees and draft decisions initiates the Committee of Ministers, concerning county;


L) publishes the official bulletin of the People's Council.


2. Committees or executive offices of the municipal people's councils, town and village:

A) organize urban-household development of settlements; healthiness ensure their smooth functioning of transport, maintenance of water networks, sewage and heating, landscaping of parks and green spaces, places tourism, leisure and entertainment;


B) monitor the proper management of the housing stock owned by the state; controls, directs and supports the work of associations;


C) shall develop perspective and annual plans for arable farming and livestock in households;


D) organizes and manages markets and fairs, smooth and supply, as well as control over the disposal of goods;


E) ensure the smooth running of nurseries, kindergartens, schools, health units, as well as cultural and artistic establishments;


F) duties of civil status, guardianship authority and, where appropriate, notary.


Committees and People's Councils executive offices of municipal, town and village are obliged to consult delegations in all matters concerning rural villages for which they were elected.
March. Executive Offices of the popular communal councils:

A) and rapsund ensure the full and intensive use of agricultural land holders regardless of their culture based on plans drawn up by each household, harnessing all resources to increase crop production and livestock on state farms, cooperative agricultural production and private households and growing contribution to the formation commune state fund of plant and animal products; supports the fight against pests; take measures to develop beekeeping, silkworm rearing, fish farming and other productive activities;


B) undertakes measures to combat natural disasters, strengthening and use of natural lands to consolidate and use slopes, eroded and degraded for valuing wetlands and irrigation development resources locally;


C) organize agro-food processing establishments, local raw materials, catering and providing services for the population;


D) make provision for the maintenance and extension of electricity and drinking water supply sources, to ensure hygiene and housing; orgnizeaza and smooth operation of communal baths;


E) orgnizeaza public organization and conduct the business of security, prevention and firefighting;


F) provide work and living conditions for teaching specialist assigned to work in the village.


Section II


Structure and Functioning
Article 54


Executive committees or, where appropriate, executive offices are elected popular committees throughout the duration of the mandate of the people's councils. After leaving office People's Council Executive Committee or, where appropriate, continue to operate the executive office until the election of the new executive committee or office.

Article 55


Executive committees or, where appropriate, executive offices of the People's Councils shall consist of the President, one or more vice-presidents, one of whom may be first vice-president and other members whose number is fixed for each category of popular councils by decree of the State Council.
Executive Committee or, where appropriate executive of the People's Council shall have a secretary appointed by the Board popular with the consent of the state administration the higher committee or executive office.


Article 56


Executive offices of Chairmen of the Committees and People's Councils municipal, town and village are at the same time, municipal mayors, cities and municipalities.

Article 57


Committee or the Executive Office of the People's Council operates on the principle of collective leadership.
Committee or the Executive Office as a whole and each of its members are accountable to the People's Council, and to the committee or the Executive Board of the higher people's council and of the Council of Ministers. Each member of the committee or executive office is responsible both for proper own work and for the entire activity of the committee, or executive office in part.

Article 58


Committee or the Executive Bureau meets whenever necessary and at least once a month, working true majority of its members present.
Convening Committee or the Executive Office of the President is made with at least two days before the meeting date.

Article 59


To attend committee meetings and executive offices, as a rule, representatives of regional councils of trade unions, local councils of women, the local organization of the Communist Youth Union, the heads of specialized local bodies of state administration and union representatives county agricultural cooperatives or, where appropriate, of agricultural cooperatives.
Decisions about the allocation of housing units on businesses and other socialist supplying the population, as well as on other social and cultural issues are taken jointly by committees or executive offices and territorial councils of trade unions.
The executive committee meetings or offices may also be invited persons from the ministries, other central bodies of state administration of cultural entities and social institutions, public organizations, and other persons whose presence is considered useful .

Article 60


Committees or executive offices issue decisions on the basis of and for enforcement of the law by a majority vote of their members. Decisions shall be signed by the president and by the secretary of the committee or executive office.
Decisions are binding executive committees or offices in the administrative-territorial units are elected popular councils.
Illegal decisions of committees or executive offices of the People's Councils annulled their higher bodies.

Article 61

Article 62


Committee or the Executive Office of the People's Council establishes the duties of President, First Vice-President, Vice-Presidents and Secretary.

B) controls the execution of the development of the local economy .; controls the activity of specialized local state administration, economic units and institutions subordinated to the People's Council, and how they apply the laws, decisions of the People's Council and Committee decisions or executive office, making proposals popular council or committee or executive officers;

Article 66


Standing committees of the people's councils meet regularly and whenever necessary.

B) hear and discuss reports on activities of the people's council and the committee or execution office;


C) hear and discuss reports from the village council delegates on the work performed by them popular and make proposals on issues to be examined in the People's Council sessions or committee meetings or in the executive office, and about the organization and carrying out actions with universal character:


D) decide, by law, issues concerning the achievement of universal interest works, drawings systematization development of settlements, security of goods, management of forest and communal pastures, and other matters within their jurisdiction by law ;


E) performing other tasks, according to the law.


Article 72


Assembly convenes biannually citizens committee or the executive of the popular board together, when appropriate, with local bodies of the Socialist Democracy and Unity Front. The works are conducted by a citizens' assembly elected to the presidium.

Section III

B) is concerned with the effective exercise of economic, social and cultural content of the village; cares for proper organization and operation of security and public order maintenance in the village;


C) propose, when necessary, the citizens' assembly convened to debate or solving porbleme its competence; supports the organization and smooth running of meetings of citizens and ensure the fulfillment of their decisions;


D) seeks to address, according to the law requirements, the Board addressed any complaints popular office or the executive committee;


E) present in the assembly of citizens reports on their activities.


Chapter 6


Rights and Duties of Members

Article 75


MPs have the right and obligation to participate in the whole activity of the People's Councils to take part in the debate and adoption decisions. They should carry out extensive work to fulfill the mandate that was entrusted to them, to mobilize the masses of citizens to infaputirea in administrative units, the State party's policy sis.

Article 76

Members are entitled to be elected to the standing committees and the temporary committee or the executive of the People's Council, and the right and obligation to participate in the work.

Article 78

Members have the right and obligation
:

A) to address the committee or the Executive Board of the People's Council and local specialized bodies of state administration and to request assistance in solving the problems of interested people who are elected in constituencies;


B) to ask questions and interpellations to address the committee or executive office any member thereof, and the heads of specialized local bodies of state administration, units of economic and socio-cultural institutions subordinate to the People's Council, on the work thereof; or ask the questioner shall answer in the same session; when asked or when the questioner can not respond in the same session, they are required to answer before the next session of the People's Council;


C) to request and obtain information from the executive committee or office that you are required to participate in debates and interpellations preparation;


D) to lead in the constituencies in which they are elected, the work of committees of citizens;


E) to follow processing applications, complaints, complaints and proposals made by citizens, informing them of how they were solved.


Article 79


MPs exercise their rights and fulfill their duties throughout the term of office of the People's Council are elected. They are accountable to the voters both for their own activity, and for the people's council work. They also respond to people's council to fulfill the tasks entrusted to it.

Specialized local bodies of state administration are led, guided and controlled by committees or executive offices of the People's Councils in order to comply with the decisions of people's councils, committees or offices of executive decisions and the decisions of the Chamber legilative popular councils.

Specialized local bodies of state administration offices provide the assistance committees or executive boards beside the hierarchically inferior People who are organized in order to solve technical problems specialty.

Article 83


Ministries and other central executive offices will grant committees and councils of popular full support in solving the main problems in developing small industry, household utilities, and systematization of construction activity, the provision of services to the population, supply and outlets: also will give full support to the development of science and education, healthcare, culture and socialist education, the development of studies on the development of harmonious economic and social-cultural development of counties, municipalities and communes, in using resources efficiently material and human resources of the administrative territorial units to continue increasing material and cultural well-being of the people.

Article 84

People's Council of Bucharest coordinates, directs and controls the activity of popular councils and communes suburban sectors, pursuing continuous improvement, as well as attracting citizens to resolve state and public affairs; controlling decisions of popular councils and communes his suburban sectors.

Article 91


Popular executive committee of Bucharest districts and executive offices of the People's Councils of suburban municipalities are subordinated to the People's Councils that they have chosen and the Executive Committee of the Popular Council of Bucharest.
Decisions of councils of popular sectors and the suburban municipalities and the decisions of their executive committees or offices are binding in those sectors or suburban municipalities were elected popular councils.

Article 92


Provisions regarding the organization and operation of people's councils and their executive committees or offices shall apply accordingly, popular councils of Bucharest and sectors, as well as their executive committees.

Article 93


People's Council of Bucharest exercise properly the duties stipulated in this law for all popular councils.

Article 94


Executive Committee of the Popular Council of Bucharest exercise properly the duties stipulated in this law for the executive committees of all categories of popular councils
President of the Executive Council of Bucharest is popular, while Mayor Socialist Republic of Bucharest Romania.
Popular presidents executive committee of the Bucharest sectors are at the same time, municipalities and sectors.

Article 95


Popular councils of Bucharest districts exercise properly the duties provided for in Art. 41 and art. 42 pt. 2 a) and c).

Article 96


Executive committee of Bucharest Municipality popular exercise properly the duties provided for in Art. 50, 51, 52 and art. 53 pt. 2

Chapter 9


Other provisions
Article 97


If the positions of president, senior vice president and deputy chairmen of the committee or the Executive Board of the People's Council have vacancies Rams, exceptionally and tentative, these functions may be delegated to individuals who are not qualified deputy.

Article 99


Framing, transfer and termination of employment contracts of staff with management and technical personnel, economic, administrative and other specialized apparatus are made by committees or executive offices of the People's Councils.
Framing, transfer and termination of employment contracts of deputies specialtiate leaders of local bodies of state administration, are under the law, the executive committee or the board office beside popular works.
Framing, transfer and termination of contracts of employment of technical personnel, economic, administrative and other specialty specialty of the local bodies of state administration bodies shall be performed by collective leadership or, where appropriate, by the driver, according their competence.

Executive committee and county people of Bucharest may determine that presidents, prime vicepresdintii, and their secretaries in the departments they coordinate activities through provision was employed, transfer, disciplinary sanction and to terminate the employment of staff referred to in para.
1 and 2. The Standing Bureaus of the executive committee and county people of Bucharest resolve disputes: in terms of disciplinary measures taken against the leaders ordered local specialized bodies of state administration, units of economic and socio-cultural institutions subordinate County and against disciplinary sanctions imposed by committees or councils executive offices hierarchically inferior People who, according to the Labour Code or any other provision of law, they were not within the competence of the court or other organs.
