The measures adopted by the 10th Congress of the Romanian Communist Party had as a result the increased competence and responsibility of the popular councils in all areas of social-economic activity, thus contributing to the continuous lifting of the role local bodies of state power and administration in the economic and social life of the country. Starting from the necessity of unitary and democratic guidance of the complex activity of the local bodies of state power and administration, the National Conference of the Romanian Communist Party of July 1972 decided to establish an organ for problems of popular councils For the accomplishment of this decision, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 GENERAL PROVISIONS + Article 1 The Committee for the Problems of People's Councils, a party and state body, with deliberative character, is established, having the task of analyzing and debating the major problems of the economic and social development of counties, municipalities, cities and the communes, to guide, orient and control, under the conditions of this law, the activity of the folk councils and their executive committees or offices, in order to fulfill by them their tasks according to the law and decisions of party and state. The Committee for the Problems of the People's Councils ensures the unitary achievement of the party's policy and the status in the areas of systematization of urban and rural territory and localities, housing household, communal household, local industry, housing, as well as in the field of local state administration. + Article 2 The Committee for the Issues of the People's Councils is made up of the first vice-presidents of the executive committees of the county and county councils of Bucharest, chairmen of the permanent offices of the executive committees County folk and the city of Bucharest, chairmen of the committees or executive offices of the popular councils of some municipalities, towns and communes, representatives of the working people from the units subordinated to the folk councils and from other units as well as highly qualified and rich specialists experience in the areas of systematization, communal household, housing management, state administration and other areas of the activity of popular councils. + Article 3 The Committee on the Issues of the People's Councils, as a party and state body, operates alongside the Council of Ministers. In the problems regarding the activity of local bodies of state power, the committee presents briefings and proposals to the Great National Assembly or the Council of State; in the problems regarding the activity of local bodies of state administration present briefings and makes proposals to the Council of Ministers. + Article 4 According to its competence established by law, the Committee on the Issues of the People's Councils adopts decisions and takes measures to solve the problems in the sphere of activity of popular councils and their executive committees or offices. Together with the ministries and other central bodies concerned, they analyze the problems that arise in the activity of local bodies of state power and administration and establish, according to the law, measures to solve them. + Chapter 2 TASKS + Article 5 The Committee on the Issues of People's Councils has the following a) analyze and debate, together with the Section for systematization, social and publishing constructions within the Supreme Council of Economic and Social Development of Romania, the main forecasts in territorial aspect developed by the central bodies and local state administration and submit appropriate proposals to the competent bodies; b) analyze and debate, together with the State Planning Committee and other central bodies concerned, how the projects of five-year and annual plans in territorial aspect ensure the valorization, superior of material resources, the use of rational of labor resources and balanced development of economic and social activity of each county and of the city of Bucharest and makes proposals corresponding to the Council of Ministers; c) analyze, together with the State Planning Committee and other central bodies concerned, the stage of implementation of the plan tasks for the local economy and establish appropriate measures in order to achieve them within and in good conditions; d) analyze and debate, with the participation of the Central Party and State Commission for the systematization of urban and rural territory and localities, the projects of systematization of the territory, municipalities and cities: the provisions of the National Program for systematization of urban and rural territory and localities; makes proposals to the Council of Ministers in this field; e) analyze how popular councils and their executive committees or offices are concerned with the permanent adincement of socialist democracy in their entire activity, of perfecting style and methods of work, as well as stimulating the initiative of the masses of citizens in carrying out the tasks that stand before the popular councils; adopt measures on the generalization of positive experience related to the work of local bodies; f) analyze and debate how the local bodies of power and state administration apply the party and state decisions on the organization and participation of masses of citizens in the resolution of state and public affairs; for the continuous improvement of the work of the popular councils, their executive committees or offices and the standing committees of the popular councils; g) analyze how laws, decrees, and decisions of the Council of Ministers by local bodies of state power and administration are applied; h) analyzes and debates draft laws and other normative acts of particular importance regarding its fields of activity and makes proposals, as the case may be, to the Council of State or to the Council of Ministers; i) performs any other duties provided by law or assignments established by the Central Committee of the Romanian Communist Party, the State Council and the Council of Ministers. + Article 6 The Executive Office of the Committee on the Issues of the People's Councils shall organise and ensure that the Committee decides. The Executive Office shall, as an organ of the Committee on the Issues of the People's Councils, a) directs the organization activity in order to achieve the provisions of the National Program for systematization of urban and rural territory and localities; gives its consent or endorses, according to the law, documentation of systematization; b) conduct studies and submit proposals on the administrative organization of the territory, assignment or change of names of administrative-territorial units; endorse the editing of maps containing elements of the organization administrative territory; c) organizes and directs the activity of elaboration of studies and proposals on the edilitary development of localities, correlated with their economic and social-cultural development; d) make, according to the provisions of the Constitution, proposals to the Council of State or to the Council of Ministers, as the case may be, to suspend or annul the illegal decisions and decisions adopted by the local bodies of the state e) guide, provide expert assistance and control the activity with regard to: -systematization of urban and rural territory and localities and authorization in construction; -the communal household, the administration, maintenance and modernization of the property housing stock gives the state, the development of the construction of state and personal property and the sale of housing from the state fund to the population; -organization and conduct of the design and execution activity in constructions that are carried out through the units subordinated to the folk councils; -developing and diversifying the production of local industry by harnessing the material resources and the local workforce; -the way in which the activity of services and the supply of the population is carried out; -the exercise of civil status duties, of guardianship and notary authority, the circulation of documents and the organization of the expertise and archiving of documents of local bodies; -organization and conduct of actions on carrying out works of public interest through the contribution of the population, good management and embellishment of localities, carrying out the public security and the activity of the court committees; f) elaborates mandatory norms and regulations, according to the law, in the fields of systematization, communal household, housing household and local state administration; g) supports and controls the work of the executive committees and offices of the popular councils on making, according to the law, the preparatory works for the election of h) establishes measures to simplify and streamline the local state administration; i) guide the work of improving the professional training of the staff in the system of popular councils and organize this activity for the staff in the subordinate units and their own apparatus; j) organizes the activity of collaboration and economic, technical and scientific cooperation with abroad, in its field of activity; ensures the application of international conventions and agreements regarding its field of activity; k) organizes the activity of technical documentation and publishes publications on the problems specific to its fields of activity. + Article 7 The Executive Office shall be responsible for its entire activity before the Committee on the Issues of the People's Councils, to which it shall report and report. + Chapter 3 ORGANISATION AND OPERATION + Article 8 The Committee on the Issues of the People's Councils is composed of 75-85 full members. The composition of the Committee on the Issues of the People's Councils is approved by the Central Committee of the Romanian Communist Party, the Council of State and + Article 9 The meetings of the Committee on the Issues of the People's Councils may be invited delegates of some state bodies and organizations or interested in examining the issues subject to debate, as well as other specialists. + Article 10 The Committee on the Issues of the People's Councils shall carry out its activity in the presence of at least two thirds of the members and shall adopt decisions with the vote of at least half plus one of the total number of its members. + Article 11 The Committee on the Issues of the People's Councils shall be convened in plenary or twice a year, or whenever necessary, on the initiative of the Executive Office or at the request of at least one third of its members. The works of each plenary are chaired by a chairman of the permanent office of the executive committee of the county folk council or of the Bucharest municipality elected by the committee among its members. + Article 12 The Committee on the Issues of the People's Councils has a president, a first vice-president and vice-presidents. The president and the first vice-president are appointed by presidential decree and are members of the Council of Ministers. Vice presidents are hereby appointed by presidential decree. + Article 13 The President, First Vice-President, Vice-Presidents, and a number of members appointed by the Council of Ministers make up the Executive Office of the People's Councils Committee. + Article 14 The president represents the Committee on the Issues of People's Councils in relations with other state bodies and other organizations in the country, as well as in international relations. + Article 15 In the execution of the decisions of the Committee and of the Executive Office, as well as in the exercise of their own duties, the President shall issue, according to the law, order, instructions + Article 16 The Executive Board of the People's Councils Committee is organized and operates, according to the law, the Technical-Economic Council, the Central Commission for Names, as well as other commissions. + Article 17 For the performance of its tasks, the Committee on the Problems of the People's Councils has a permanent apparatus, with the following organizational structure a) Directorate of organization, control and local state administration; b) Direction of communal household, housing and local industry; c) Directorate of systematization, design and construction; d) Secretariat-administrative, legal, economic service. The organizational structure on labor compartments and the maximum number of posts in the permanent apparatus of the Committee for the Problems of the People's Councils are those provided in Annex no. 1 1 *) and Annex no. 2 2 *), which are an integral part of this law. ------------ Note * *) The Annexes were communicated to the interested institutions. + Article 18 The Committee for the Problems of the People's Councils is subordinated to the Institute of Research and Design for systematization, housing and communal household and other units. + Article 19 The duties and rules of operation of the permanent apparatus and the units provided for in art. 18 are established by the Executive Office of the People's Councils Committee, according to the legal norms. + Chapter 4 FINAL PROVISIONS + Article 20 Decree no. 453/1969 on the organization and functioning of the State Committee for Economy and Local Government, which became Law no. 31/1969, as amended, shall be repealed. ------------
