Law No. 27 of 3 November 1978 the law ISSUING NATIONAL metrology ASSEMBLY Published in the Official Gazette nr. 100 of 11 November 1978 the realization of the objectives of the programme of the Communist Party of faurire socialist society and advancing multilateral developed Romania toward communism should be promoted on a large scale of technical progress in all sectors of economic and social life, corresponding to the requirements of contemporary scientific-technical revolution, organizing and conducting of metrological activity throughout the economy in order to ensure the necessary accuracy and permanent of the legality of the measures , the officials and correct use of measuring instruments.
The work of metrology must actively contribute to the pursuit of production processes in accordance with the prescribed information, technologies and quality control of products and services, to ensure the safety of the facilities and environment, transport safety, compliance with the rules on safety and health protection of the population, to carry out commercial operations and management of the assets in accordance with the law , the proper conduct of the business of scientific research and economic development, trade and economic cooperation actions and technical-scientific in other countries, as well as other activities that involve the making of measurements.
Ministries, other Central and local bodies, industrial plants and the economic and social units have the task of continuously improve the work of metrology, measuring instruments, in accordance with the needs imposed by the erection of permanent technical level and quality of production, increasing mechanization and its automation, harnessing the upper material and human resources, as well as participation in international exchanges of material values with competitive products the quality norms.
Ensuring the correctness and legality of measures constitutes a permanent obligation of all working people who must use only legal units of measure and the corresponding measuring instruments in the process of production of the goods, as well as in other sectors of activity measurements are carried out and to participate actively in the improvement and the creation of new instruments, in accordance with the needs of the national economy.
In order to strengthen the contribution of the raspunderilor and, in the field of metrology, ministries and other Central and local bodies, social and economic units, all working people, the National Assembly of the Socialist Republic of Romania adopts this law.


Chapter 1 General provisions Article 1 In the Socialist Republic of Romania in all fields, including in foreign trade relations and economic cooperation and technical-scientific in other countries, compulsory are used only units of measure and measuring instruments.
Framework of organizational and technical measures to ensure the performance of units of measure and measuring instruments and the preciziile required, is carried out in a uniform manner throughout the country through the work of metrology.


Article 2 of the national plan for developing unique economic and social development ensure the necessary material and technical conditions of metrology, in accordance with the requirements of the introduction of technical progress and the development of the national economy.


Article 3 precision levels, constructive conditions and regulations on the use and maintenance of measuring instruments shall be established by the State standards and technical regulations, metrology, mandatory in all sectors of activity, developed and approved as provided by law.


Article 4 the State Inspectorate for quality control of products is responsible together with ministries, other Central and local organs of the judiciary in the uniform of the party and State policy in metrology.


Article 5 Units of scientific research and engineering are required to continuously improve the measuring instruments and to create new kinds with functional parameters picked-up.
In the preparation of projects for the development or construction of new objectives will provide, under the conditions fixed by law, the material basis of metrological activity corresponding to the needs of the entire production process.


Article 6 Staff worker with tasks in the field of metrology carries full responsibility for making the time and conditions of legal norms of the etalonarilor and checks the correct operation of metrology, measuring instruments, their maintenance and repair in order to ensure the necessary accuracy and legality of measures in production processes, and other areas of economic and social activity.


Chapter 2 legal units of measure and measurement section 1 legal units of measure in article 7 the system of legal units of measure and binding in the Socialist Republic of Romania is based on the specific needs and requirements of the national economy, as well as the international system of units of measurement, and symbol.

The main units of measure are those indicated in the derivatives annex which forms an integral part of this law; other units of measure are established through derivative State standards.


Article 8 In cases justified, cannot be used as legal units of measure and other facilities in addition to those provided for in article 10. 7, laid down in the decreeing of standards approved by the State Council.


Article 9 the names, symbols, definitions and rules for the use of legal units of measure, multiples and sub-multiples thereof shall be established by the State standards.


Article 10 export contracts concluded with foreign partners, on request, you can use other units of measure agreed between the parties.


Section 2 article 11 measuring instruments constitute the instruments any measures, apparatus, devices, facilities, as well as samples of materials and substances, which materialized and preserve the units of measure and provide measurement information.


Article 12 measuring instruments, depending on their destination, shall classify the standard measuring instruments and measuring instruments work.

Article 14 National Standards are provided, maintained and used by the State Inspectorate for quality control of products.


Article 15 national standards at the level of Maintenance of precision necessary economic and social activity and improvement continue to be ensured by scientific research in the field of metrology, as well as through periodic comparison with international standards of the International Bureau of weights and measures and with national standards of other countries.


Article 16-Standards in addition to those national-am, stored and used by the State Inspectorate for quality control of products and of approved establishments, according to the law, to produce, to measuring instruments or transmitting units of measure.

Proposals for supplementing the industrial classification is done by ministries and other central organs with the opinion of the State General Inspectorate for quality control of products and are subject to approval by the Council of Ministers.


Article 19 ministries, other Central and local organs, producing, are obliged to take measures in order to achieve the necessary means of measuring the economy, precision and in compliance with the technical and functional parameters.
Importation of instruments may be carried out, under the conditions provided by law, when does it justify their technical and economic production in the country.
Putting into manufacturing or import measuring instruments can be made only after they have received the approval of the model and have been included in the nomenclature of the measuring instruments.
Machinery and technological equipment manufactured in the country, as well as imports, will be equipped with measuring instruments that comply with the unification and typification of the nomenclature contained in the measuring instruments approved under conditions provided by law.


Article 20 approval model is a document attesting, metrological point of view, as a certain type of measuring instrument meets the conditions of quality and reliability, and falls into the classification of measuring instruments.


Article 21 the manufacture and importation of instruments with special destination and the low precision to achieve the indicative guidelines should be made without the approval of the model while complying with the conditions laid down by law and with the opinion of the General State Inspectorate for quality control of products.


Article 22 shall be granted pattern approval, at the request of the unit concerned, the State Inspectorate for quality control of products, based on the results of the tests on the state metrological measuring instruments, performed by it through its own laboratories or through specialized laboratories of other units. Pattern approval is given not later than 60 days after the date of the instrument model and technical documentation.
State metrological tests shall consist, as appropriate, in evidence, determinations, analyses and studies in order to determine compliance with the requirements of standard models State technical regulations, specifications, technical regulations and Metrology concerning the instrument tested.
State metrological tests cannot be substituted for the metrological tests carried out by the manufacturer.


Article 23 measuring instruments tested for which has been granted pattern approval, shall be invested with the metrological model brand.

Metrology mark pattern shall be determined and applied by the State Inspectorate for quality control of products.

Article 24 shall be granted pattern approval unit that produces and delivers the measuring instruments or measuring installations as finished products, foreign trade enterprise of import measuring instruments or, as the case may be, the beneficiary undertaking to import, they suportînd and the costs of obtaining the approval of the model. Changing the manufacturer shall entail the obligation to obtain a different pattern approvals granted on the basis of state metrological tests, performed on the accomplished measurement in the new establishment.
In special cases where it is necessary to knowing the reaction in time of measuring instruments can give provisional approval by model, by the State Inspectorate for quality control of products, under the conditions laid down by the technical rules of metrology. The approval is valid only for a certain length of time and for a limited number of instruments.


Article 25 Technical Documentation that accompanied the state metrological tests the models which have been approved shall be retained by the State Inspectorate for quality control of products and enterprises producing or importing. These documents, approved and initialled by the State Inspectorate for quality control of products, constitute the legal documents to verify the functional and technical characteristics of the instrument to which it refers, the manufacture of series or to any disputes. To the same end, and in some cases laid down by the General Inspectorate for quality control of products, keeping them in a similar manner and a copy of the approved models.


Article 26 EC type approval of measuring instruments produced in the Socialist Republic of Romania is made only after approval of the model.


Article 27 establishments are obliged to produce only measuring instruments with the technical and functional features in accordance with technical documentation and reference patterns and respond to it. The same obligation and liability rests and importing units that will need to import only measuring instruments complying with technical documentation and reference models that were presented at the attempt of State Metrology.


Article 28 of the State Inspectorate for quality control of the products carry out checks on the conformance of technical and functional characteristics of measuring instruments manufactured or imported, with those of the reference model, embodied in the technical documentation.
In the event of the detection of some technical documentation and compliance with approved pattern, State Inspectorate for quality control of the products it has deficiencies or, where appropriate, inform the prior central or local organs, stopping the manufacture or import restriction.


Article 29 In the case of instruments whose technical-functional features no longer meet the requirements to technical progress, the State Inspectorate for quality control of products may withdraw approval of model; Similarly may withdraw approval of model for measuring instruments derived from import.

Article 32 or metrological Calibration is made compulsory:-initially on every instrument, manufactured or imported prior to delivery to the beneficiary and each unit measuring instrument repaired before putting into service;
-periodically, on measuring instruments in use, the length of time limit fixed by the technical rules of metrology.
Economic and social units have the obligation to provide for shorter periods of time, where the concrete conditions of use shall result in a reduction of the duration of time for which the instrument is working properly;
-whenever it is necessary to ensure the proper functioning of the measuring instruments.


Article 33 the measuring instruments used solely for domestic use or teaching demonstration, are subject to mandatory metrological verification only, piece by piece, or-as appropriate-random, set by State standards and Metrology technical standards.


Article 34 the measuring instruments that have been found appropriate metrological calibration or, were invested with the metrological verification mark and have been issued a certificate of calibration or verification report, constitute legal measuring instruments.
Metrological verification mark is the mark which shall be affixed to the instrument in order to attest, metrological point of view, the right to be used.
Metrological verification mark shall be established and shall be issued only by the State Inspectorate for quality control of products.


Article 35 measuring instruments calibration or verification rejected shall be subject to repair or, if necessary, removal from service, in accordance with the law. Of imported measuring instruments, rejected the initial verification, will be communicated timely foreign trade enterprises that have made imports.


Article 36 measuring instruments graduated in units of measure other than those referred to in article 1. 7 and 8 are used in special cases, are subject to etalonarilor initial and periodic checks or by holding unit that is responsible for this.


Article 37


Transmission of the measure shall be carried out in a uniform manner, the State Inspectorate for quality control of products and metrological laboratories authorised for this purpose.


Chapter 5 Technical Supervision and control of the activity of the Metrology Article 38 Technical Supervision of the measuring instruments, comprises mainly: making etalonarilor and measurement checks and repair programmes drawn up; correct usage of measuring instruments of the worker in the process of work; proper maintenance of instruments and the removal from service of those worn or defective; identification of defections from the measurement processes for waste generators; the setting up of instruments for ensuring the continuity of production processes, installations and labour security, as well as the necessary spare parts maintenance of the measuring instruments.
Technical supervision of measuring instruments is performed by staff of the authorized metrology economic and social units.


Article 39 the metrological Control activity is carried out mainly on: implementation and observance of legal regulations in the field of metrology; to ensure levels of precision achieved in the transmission units of measure and precision of the measuring means and methods; to equip the production processes with measuring instruments according to technical documentation and their proper use; book-keeping and technical condition of measuring instruments; compliance with the deadlines for carrying out metrological checks etalonarilor and periodicals, as well as maintenance and repair of measuring instruments according to the annual programmes of checks and repairs; to ensure appropriate conditions for the operation of metrology laboratories and workshops to repair instruments.
Metrological control activity is executed by the General Inspectorate shall state for quality control of products, as well as by staff authorized metrology from ministries, other Central and local bodies and Central.


Chapter 6 Permits measurement and manufacturing metrology Article 40 Laboratories and workshops of repaired measuring instruments in the sectors of economic and social activity can function only on the basis of the authorization given by the General Inspectorate for quality control of products.


Article 41 shall be issued upon request, on the basis of metrological expertise, areas of measurement and levels of precision. Article 42 the Metrology Laboratories authorised to carry out checks and-where appropriate-the calibration of the measuring instruments belonging to the units in which it works, only in the areas and levels of precision for which they were authorized.
Authorized metrology laboratories may conduct, with the approval of the State General Inspectorate for quality control checks of the products, or, where appropriate, and the calibration of the measuring instruments belonging to the other economic and social units.
Measuring instruments for verification of which do not justify the economic establishment of the laboratories within the enterprise or can not be done in laboratories of other units, it will verify the metrological laboratories within the County of a State Inspectorate for quality control of products.


Article 43 Calibration and Metrology verification, and repair and maintenance of measuring instruments shall be made only by authorized metrologi of the State Inspectorate for quality control of products.
Authorization shall be granted at the request of the unit-based exam and is valid for a period of three years, with the exception of the first authorizations that expire after a period of one year.


Article 44 staff worker Categories used in the professional activity of the basis of measuring instruments for carrying out operations, management, distribution and marketing, as well as the operators of panels measuring instruments of the commands, you need to possess a permit, issued by the State Inspectorate for quality control of products, based on exam, whose validity is five years.


Article 45 the metrological activity Coordination from the central units, industrial ministries, other Central and local bodies, shall be carried out by specialized staff worker called by written order issued by the management of the establishment concerned, on the basis of authorisation issued by the General Inspectorate for quality control of products, after an examination. Authorization shall be valid for a period of one year. The change in the function, the disciplinary sanction or termination of work of this staff worker, can be done only with the consent of the State General Inspectorate for quality control of products.


Article 46 no Authorization is simply great. Violation of the legal provisions concerning the exercise of the powers conferred by the authorization, depending on the gravity of the infringement-temporary suspension or cancellation thereof.
Application for renewal of authorization, as well as replacement of staff whom cancelled the authorization constitute obligations of establishments, in order to ensure continuity with the observance of legal metrology.


Article 47 the conditions for approval of metrology laboratories, workshops to repair instruments and of the personnel referred to in articles 43, 44 and 45 shall be established by the technical norms issued by metrology Inspectorate for quality control of products.


Article 48 shall be subject to approval by the State General Inspectorate for quality control of products, order or, where necessary, the construction projects relating to metrological laboratories and workshops to repair instruments of economic and social objectives that are to be constructed, the regulations for the Organization and conduct of the business of metrology, the curricula of State educational shapes that convey knowledge in metrology topics, programs and forms of staff training worker working in the field of metrology, inventions and innovations concerning the methods and measuring instruments.


Article 49 the costs of carrying out the checks and etalonarilor, state metrological tests of models, expertise metrology, metrological tests and issuing permits for metrology laboratories, and workshops authorizing repaired instruments, testers, namely authorisation metrologilor metrologilor repairers, engineers or technicians who coordinate metrology and staff; 44 is the recipient of the support units.
Fees and charges for the services referred to in the preceding paragraph shall be determined by the State Inspectorate for quality control of products, with the agreement of the State Committee for prices.


Chapter 7 Powers and responsibilities Article 50 to ensure the necessary accuracy and legality of measures of the State Inspectorate for quality control of products has the following duties and responsibilities: responsible for realization of), preservation and improvement of national standards to the level of precision required by the needs of the economy;

c) responsible for carrying out scientific researches in the field of metrology relating to national standards, the base transmission units of measurement, development of methods and realization of calibration, measurement, verification and improvement of theoretical bases of the user;
  

d) issues, edit and disseminate the technical rules of metrology and metrology, methodological instructions obligatory for the whole economy and develop a centralized activity information, documentation and publishing in the field of metrology;
  

e) coordinates and controls the work of metrology from ministries, other Central and local bodies, industrial and economic units; directs and controls in all sectors of economic and social activity uniform application of laws and other normative acts in the field of metrology, having the right of access to all places where they are used, are built or repaired, shall be etaloneaza or verify measuring instruments metrology;

Article 51


State Inspectorate for quality control of products ensure the participation in the work of international bodies and organizations in the field of metrology, of which the Socialist Republic of Romania is part, together with the ministries and other actions in the Metrology field of interest.


Article 52 the ministries, other Central and local bodies and industrial plants are responsible for ensuring the accuracy and legality of measures needed to coordinate units, in which purpose are obliged to take measures to: (a) organizing, guiding and) the activity of subordinate units in metrology; where justified to establish rules respecting the structure of the separate compartments of metrology based on the number of instruments from use, the importance and the level of accuracy of the measures carried out. Bins of metrology-metrology laboratories and workshops to repair-measuring instruments can be organized, as appropriate, and groups of units or industrial platforms;
  

(b) training and in-service) of metrologi, and-where appropriate-of those who perform precision measurements;

Article 53 businesses and other economic and social units that hold and use measuring instruments, are responsible for the accuracy and legality of measures in which purpose are obliged to take measures to: (a)) to organize the metrological laboratories and workshops to repair instruments and equipping them based on rules set out, thanks activity under the law on metrology and-where appropriate-the establishment of separate compartments of metrology. b) transmission units of measure, in accordance with the law, to all measuring instruments in use; If the unit does not have its own metrology laboratories, and the necessary checks to ensure the etalonarile of the State Inspectorate for quality control of products through its authorized metrology laboratories or other units;
  

c) equipping the base program with appropriate measuring instruments as span measurement, accuracy, conditions of work and the number of manufacturing processes, and other activities; the setting up of the instruments required to ensure continuity of production processes, installations and labour safety;
  

d) technical surveillance of measuring instruments and measures and establishing calibration periods and metrological measuring instruments according to the specific conditions of use and the importance of the measures carried out, within the deadlines laid down in the technical regulations for metrology. These calibration and verification period of measuring instruments shall be approved by the management of the establishment; ensuring the performance of the term of metrological checks etalonarilor and periodicals, as well as repair of measuring instruments in use, on the basis of annual programmes approved by the management of the establishment;

f) in-service training of metrologi and staff worker who performs the work measurement;

Article 54 Units of scientific research and technological, engineering and design units, are obliged to provide for: (a)) in technical documentation only measuring instruments contained in the classification of measuring instruments;
  

(b) to establish the documentation) of the measuring instruments is carried out in the country, metrological characteristics and high reliability, according to the demands of the economy and the State of technical progress at the international level;
  

c) ensure typing assemblies and sub-assemblies of measuring instruments, differentiated conditions of use, depending on the requirements of the activity;
  

d) distinct projects provide facilities and equipment, methods and means for measuring parameters and appropriate tolerantelor value which must be guaranteed by the measurement Assembly conditions and proper use thereof; to provide technical and managerial measures necessary in order to ensure continuity in terms of production processes and maintaining the level of quality of the products, as well as possibilities for regular verification of measuring instruments, without prejudice to the operation of facilities;
  

(e) to establish documentation) in measuring technical points needed to drive processes, security equipments and installations, control flow, and finally the quality of products, the safety of people and protection of the environment, specific consumption, measuring performance of energy balances, and any other required balances that are determined on the basis of measurements; to provide level-measuring instruments of active control, automated, enabling centralized leadership of technological processes and after adapting to the necessities with computers; to determine when it is necessary in processing mode and the interpretation of the results of the measures;
  

f) to provide, depending on the requirements of the activity, the new objectives or projects that extend, metrology laboratories and workshops to repair instruments equipped with corresponding standards and equipment, to ensure the conditions for protection against disruptive factors set by State standards and technical regulations, metrology and metrological staff needed, as provided by law.
  


Article 55 Units producing measuring instruments are required: a) to obtain pattern approval for measuring instruments are factory them;
  

b) to carry out the survey in which it operates, as well as reliability tests for measuring instruments that you factory;
  

c) ensure continuing diversification, renewal and improvement of metrological characteristics and reliability of measuring instruments, to meet the requirements of the economy;
  

d) to ensure the necessary spare parts for maintenance and repair of measuring instruments in the economy.
  


Article 56 Councils working people from units, as well as staff of the compartments that hold and use measuring instruments, are required to achieve material conditions, technical and organizational measures for the metrological activity in accordance with the provisions of law, to ensure the accuracy and legality of measures carried out in the unit.


Article 57 Heads of sections and shops who use instruments, will participate in the drawing-up of annual programmes and metrological calibration and repair of measuring instruments, together with follow-up staff worker from fulfilling their metrology and are obliged to control at all workplaces from workshops and departments, use the correct measuring instruments.


Article 58 Workers, leaders, technicians and engineers will use only legal instruments provided for in the documentation and will notify immediately any situation that creates uncertainty over the accuracy of the measures carried out, given the obligation in such cases ask for checking or replacement of measuring instruments concerned.


Article 59 Staff worker tasked with co-ordinating metrological activity, as well as workers, leaders, technicians and engineers who work in metrology activity responsible for the application of the legal provisions on ensuring accuracy and legality of measures taken with measuring instruments in use. They are required to control the flow of manufacturing and at all workplaces, correct usage of measuring instruments and to seize leadership of the unit and the General Inspectorate for quality control in situations that involve Products ensuring accuracy and legality of measures.


Chapter 8 Sanctions the violation of article 60 this law shall entail disciplinary, material, administrative, civil or criminal, as appropriate.


Article 61


Constitute contraventions to the rules concerning the work of metrology the following facts, if they were not committed in such circumstances that, according to the criminal law, be considered offences: a) operation without authorization of the metrological laboratories and workshops to repair instruments and the use of unauthorized personnel on metrology;
  

b manufacture or import) of instruments without obtaining prior approval or not complying with the approved pattern; the import of measuring instruments graduated in units of measure other than the legal units of measure, with exceptions provided by law;
  

c) transmission of units of measure, by performing the calibration and metrological with breaching the provisions of the technical regulations for metrology; the use of economic gauges with calibration certificates expired;
  

d etalonarilor) and not the measurement of new measuring instruments manufactured, imported or repaired before delivery or commissioning;
  

It's) failure to calibrate measuring instruments and metrological periodic repair, in accordance with the programme of checks and repairs;
  

f) carrying out measurements with the measuring instruments whose accuracy measurement intervals and are not in accordance with the provisions of the technical documentation;
  

g) fitting and the use of instruments in improper working conditions, in compliance with the provisions of the technical documentation with the manufacturer or the technical rules of metrology;
  

h the use of unauthorized) personnel to carry out metrological measurements for management, distribution, trade and transport of goods, or making public cintariri;
  

I) making measurements with measuring instruments, non-defective, improperly maintained or rejected or metrological calibration, the calibration certificate or without the valid verification;
  

j) preventing any form of State Metrological Inspection bodies and shall exercise the powers provided for by the provisions laid down by law.
  


Article 62 Offences referred to in articles. 61 shall be imposed as follows: (a)) with fine from 800 to 1500 lei those referred to. a)-(b));
  

b) fine from 300 to 700 lei those referred to. c)-j).
  

Finding contraventions and penalties are carried out by authorized personnel for this purpose within the General Inspectorate for quality control of products.
Against the minute of finding of violation may make the complaint within 15 days from the date of its communication.
The complaint shall be lodged to the organ in which the agent is discovered.


Article 63 to the extent that this law does not stipulate the offences provided for in its applicable provisions they are law. 32/68 on the establishment and sanctioning violations.


Chapter 9 final provisions Article 64 in order to achieve uniformity in the application of metrology Inspectorate for quality control of the products fulfills its tasks in this area through the State Inspection on metrology within it.


The provisions of article 65 of the law face applies to cooperative organizations and other public organizations.


Article 66 the present law shall enter into force 90 days following its publication.
On the same date shall be repealed:-Decree No.. 21/1954 for the general application of the metric system, published in Official Gazette No. 6 of 26 January 1954;
-Decree No. 403/1954 concerning the interpretation of the Decree nr. 21/1954 for the general application of the metric system, published in Official Gazette No. 44 of 8 October 1954;
-Decision of the Council of Ministers No. 495/1953 approving the State tests, published in the collection of decisions and provision of the Council of Ministers No. 12 of 25 February 1953;
-Decision of the Council of Ministers No. 498/1953 approving the regulation on supervision measures and equipment in enterprises, published in the collection of decisions and provision of the Council of Ministers No. 12 of 25 February 1953;
-Decision of the Council of Ministers No. 499/1953 approving the State checks measures and measuring apparatus, which was published in the collection of decisions and provision of the Council of Ministers No. 12 of 25 February 1953;
-Decision of the Council of Ministers No. 626/1968 on the system of legal units of measure and binding in the Socialist Republic of Romania, published in Official Gazette No. 46 of 9 April 1968;
-Article 1 (a). c), d), (e)), f), u) and v) of the decision of the Council of Ministers No. kaelble/1969 laying down and punish contraventions of the rules relating to state standards, metrology, mechanical installations under pressure and packaging plants, published in Official Gazette No. 160 from 31 December 1969, as well as any other provisions to the contrary.
Annex 4. 1 on the main units of measure derived and other legal units of measure lies published in Official Gazette No. 100 of 11 November 1978.
