Law No. 37 of 26 November 1975 (republished) concerning the planning, designing and conducting traffic artery in urban and rural localities ISSUING NATIONAL ASSEMBLY and published in OFFICIAL GAZETTE No. 82 of 6 September 1978 in economic and Social Development of the country, increase people's welfare and civilization require the adoption of measures of modernization and systematization of all urban and rural settlements, in accordance with the legal provisions.
In achieving this objective, an important place to formulate, design and realization of traffic arteries.
In order to meet current and future requirements of the road traffic traffic arteries, carrying out urban and rural needs to be made into a unified conception, on scientific grounds, according to binding rules to ensure constant improvement of living conditions and employment of residents, preserving and capitalizing on the upper part of the network of existing streets, land conservation, increased efficiency and reliability of transportation.
Planning, designing and conducting traffic arteries from the municipalities, cities and municipalities will have to ensure the smooth integration of new objectives with economic, cultural or social housing within the architectural and streetscape, respecting the particularities of each of the localities.
In order to ensure rigorous order in the field of systematic design and achievement of the movement in urban and rural localities, the great National Assembly of the Socialist Republic of Romania, adopted this law.


Chapter I General principles Article 1 the planning, designing and conducting traffic arteries, in urban and rural settlements are effected in a unitary concept, taking into account the criteria of economic efficiency and social, of the specific conditions of the localities, based on the provisions of the single national economic and social development.
Development of circulation in townships, an integral part of the process of rezoning, should contribute to the constant improvement of living conditions and employment of residents, increasing the efficiency and safety of transport, land conservation and to modernisation.


Article 2 Ordering traffic arteries is based through the study of movement, which is concluded for a period of not less than 15-year perspective, and other specialized studies and are approved according to the law, with the outline of the locality.


Article 3 the planning, designing and conducting traffic arteries in localities must ensure the preservation and use of the system of existing streets, the alignment, as well as avoiding construction, demolition, preservation of specificity of architectural and urban planning.
Through the systematization of street network will ensure that national roads to traverse the locality by one or at most two important arteries.
Establishment of economic goals, social sites and housing will be made taking into account the possibility of using the existing network of streets, assuring at the same time the all-in-one character of movement arteries for local transport and transit, for commercial activities, social, cultural and other activities.
Dismantling, widening or creation of new streets within the existing districts can only be made with prior approval given by presidential decree.


Article 4 the design and construction of new streets can be made only in cases justified by the traffic needs of localities, driven by economic development and social objectives, cultural and housing, on short routes, direct, without detours, variations in compliance with the provisions of this law.
New targets for industrial, social and cultural, as well as housing, will only be made after the design and construction of the network of streets, which will be carried out taking into account the nature of existing streets in the village.


Article 5 Residential Buildings will be located on the edge of sidewalks and will have to be provided, as a rule, the interior courtyard for household needs.
Around each block of flats will provide protection from concrete sidewalks or paved provided with pits for drainage.
Within the inner courtyards can arrange parking for cars, household utilities and, where appropriate, green areas.
Care and arrange the Interior courtyards, green areas and other household units constitutes an obligation of each inmate.


Article 6 the streets of urban areas shall be classified in relation to the intensity and composition of traffic, as well as with the functions they fulfil, as follows: category I-bus; category II-liaison; category III-collectors and category IV-local service.
The streets of rural areas are classified into primary and secondary.
Functions, sizes and how to achieve each category of streets are those laid down in this law.
Classification of streets in each township or rural is made by the executive committees of the District Councils or popular Bucharest, based on studies of movement approved according to law.


Article 7 Works for the establishment or modernization of streets is approved with the preliminary rezoning and run in the following order: trace, making technical-urban underground works, construction, followed, where appropriate, by enforcement of socio-economic objectives, cultural and housing. Through technical and economic documentation of realization of the investment will be established, by stages, the categories of works to be executed in this order, for the purpose of decreasing the duration of execution, saving funds and rational organisation of execution of works.


Article 8 the executive Committees of councils and popular of Bucharest are responsible for drawing up systematic studies of movement, as well as coordination of technical and economic documentation elaboration and execution of all work, investments, modernization, repair and maintenance activities to be implemented on the movement of cities and municipalities, in compliance with the provisions of this law.


Article 9 measures of the artery Street, and the construction, maintenance and operation thereof, will be carried out with the active participation of citizens.
To that end, popular councils will inform citizens on the main aspects of the development of the movement, will analyze their suggestions and proposals on the various proposed solutions and will attract, organized within the framework of actions, to the realization of the measures adopted.


Chapter 2 designing and conducting traffic artery in urban areas 10 streets in urban areas have the following functions and features: the first category) blocks-bus, which connects the takeover of the city flows on the main direction of the connection with the national road that crosses the town, with 6 lanes of traffic, including tram lines and other means of transport;
  

b) category II blocks-a-liaison, who shall ensure the overall movement between functional areas and cities, having 4 lanes of traffic, including tram lines and other means of transport;
  

c) category III-streets-to-collector, acquiring traffic flows the functional areas and direct them towards the connecting streets or bus having 2 lanes of traffic;
  

d) streets of IV category of local service, which provides access to the residential blocks the roadway, in their courtyards, as well as in areas with very low traffic, for current services and incidental damages, having a single tape movement.
  

The streets of category I-lines will design and implement only if their realization is justified in terms of money and the movement and intensity will be maximum of two into a village, usually located on the national road directions.


Article 11 Employment streets in one of the categories referred to in this law shall be carried out at the initiative of the executive committees of the District Councils and the popular Bucharest, through sketches and details of town-approved under the provisions of law No. 58/1974 concerning systematization of planning and urban and rural localities.


Article 12 Blocks of class I and II, with or without green area median, and other streets with a wider range of movement than bands. 10 or with separate tram platform of the carriageway, road arteries, rocade, belts and breakthroughs, may only be carried out in cases where the size of the city, traffic intensity, the configuration of the terrain, movement of pedestrians or other circumstances determines the need of such works, with prior approval by presidential decree.


Article 13 in the design of new urban streets will adopt, as a general rule, the type of category III, with sidewalks of 2 m depending on the intensity and movement of economic efficiency of work may be taken and types of blocks of class I with sidewalks up to 5 m wide, or blocks of class II , laid down as a general rule, with 4 m wide sidewalks.

Features and technical requirements to design the urban streets, as well as the maximum capabilities of movement on them, are set out in appendices. 1 and 2.


Article 14 when designing intersections will take account of the specific conditions of the arrangement, corresponding to relations between competing flows, as well as the conditions of visibility and safety, fluency of movement, referred to in the technical rules in force, in accordance with the annex. 2. Intersections and squares of movement can be realized only if the solutions adopted are justified economic and technical and will occupy the surface of the ground is strictly necessary in order to ensure their functions. In the case of intersections required intense may provide uneven passages for pedestrians and vehicles.
Realization of intersections on the streets of categories I and II, is carried out with the approval of the executive committees of councils or Bucharest city folk.


Article 15 shall be located underground urban Works, usually outside the carriageway of the street party.
Grids of the distribution or collection for water, electricity, telephone, gas, district heating should be placed in galleries and provided with points of branşare distributed at optimal distances, according to studies of systematization, ensuring minimum lengths of branşamentelor, according to the annex. 3. Article 16 Upgrading streets shall be implemented in accordance with the outline of the study of movement and maintaining the existing alignment.

Article 17 executive committees of councils and County folk Bucharest will determine, based on studies of movement, measures for the efficient use of the street system, by separating and distributing traffic flows in relation to the nature of the traffic, the introduction of one-way movement, suppressing some intersections and nearby streets with heavy traffic and transit, as well as other measures to organize the movement.


Article 18 for the purpose of making studies in localities, executive committees of councils and popular of the municipality of Bucharest will ensure, with the participation of the organs of militia, regular registration, according to the technical rules laid down for that purpose.


Article 19 for the movement of pedestrians will arrange the sidewalks with a width of between 1 and 5 m depending on the intensity of the movement and where they are located. The rules for sizing the sidewalks are those set out in the annex. 4. The crossing of streets in categories I and II of the urban areas, by large streams of pedestrians, may be laid down, where necessary, shelters or passages through the bumpy passages.
Inside housing assemblies, pedestrian access to housing, social-cultural, commercial spaces, places of rest and playgrounds can be ensured through the alleys.

Article 22 for parking motor vehicles can use the courtyards of buildings housing arranged properly, the Interior streets, special spaces in residential neighborhoods, markets and, where appropriate, the sidewalks and streets that are not extensively used.


Article 23 within the housing assemblies with a population of about 8,000-10,000 inhabitants anticipated arrangement of parks, with diverse plantings, facilities for rest and recreation, children's playgrounds and other facilities serving the population.


Article 24 Speeds of movement taken into account when designing, intensity and nature of trafficking in human beings, as well as organizing movement, arrangement and fitting intersections on the streets of urban areas, are established through studies, in compliance with the provisions of the annex. 1. Article 25 carriageway number of lanes Dimensioning is made depending on the intensity and characteristics of trafficking, with due regard to the maximum capacity of the movement on the streets set out in the annex. 2. Article 28 Areas of carriageway and pavements from housing estates shall be determined according to schedule. 7. Article 29 composition of road system will be made depending on the intensity and the composition of traffic, climatic factors and possibilities for the use of local materials and industrial waste, the completion of the work in stages, in accordance with the annex. 8. Sizing of clothing, the Foundation and base layers will be made in compliance with the technical rules in force with regard to traffic of perspective for a duration of at least 15 years.


Chapter 3 designing and conducting traffic arteries in rural areas Article 30 Streets in rural areas have the following characteristics: a) main streets, with two lanes for two-way traffic;
  

b side streets with) a single tape movement for low traffic.
  


Article 31 the main streets will have the width of carriageway of 5.50 m and 7 m platform, and the secondary will have the width of carriageway of 3.50 m and 5 m platform.


Article 32 Platforms from rural streets will be lined by ditches or drains.
For the movement of pedestrian walkways shall be provided with a width of 0.75 m.


Article 33 the distances between fences or construction on both sides of the streets in rural areas will be 11 m from main streets and 8 m to the side.


Article 34 depending on the size of the land configuration, and features the popular councils, County and the municipality of Bucharest will be able to approve the widths of streets or distances between fences or building higher than those laid down in article 21. 31-33, without however being able to overcome, according to the law, 7 m carriageway widths and the sidewalks of 1.50 m width, i.e. distances between fences or building 17 m For capacity development of national roads in the suburbs, crossing the distance between fences or building will be 22 m.


Article 35 the provisions of art. 14-16 shall apply accordingly to the planning, design and achievement of streets in rural areas.


Chapter 4 Liability and sanctions Article 36 violations of the provisions of this law shall entail disciplinary, material, administrative, civil or criminal, as appropriate.
For offences committed in the field of systematic design and achievement of the movement by individuals shall establish penalties with fine from 1,000 up to 10,000 lei lei, and for those committed by legal persons, sanctions with fine from 3,000 up to 30,000 lei lei.
Provisions of art. 25 para. 1 and art. 26 of law No. 32/68 on the establishment and sanctioning offences does not apply in the case of offences committed in the field of the design and implementation of a systematic traffic arteries.
Under the decision of the Council of Ministers shall establish offences in the field of systematic design and implementation of circulation, arteries and the penalties to be applied.


Article 37


Constitute irregularity, if the Act is not committed in such circumstances that, according to the criminal law, it constitutes an infringement, damage by any means of traffic arteries from both urban and rural settlements, to prevent any form of their use, as well as household units or degradation of green spaces.
That offence is sanctioned with a fine of from 500 to 2,000 lei, the offender being forced to repair, according to the law, the damage caused.
The discovery and application of fine evaluation shall be made through the report concluded the mayor or persons authorized by him, namely well by militia officers and enlisted.
The provisions of this article shall be supplemented by the provisions of law No. 32/68 on the establishment and sanctioning violations.


Chapter 5 final provisions Article 38 under the projects of the localities will have to carry out the new monuments, as well as exploiting the existing monuments that represent the history and struggle of the people.
It prohibits making squares or green spaces around the socio-cultural objectives, by demolishing the existing constructions.


Article 39 the realization of urban traffic arteries and countryside is financed from funds allocated through the popular councils plan and other resources provided by law.
Works for the streets providing access to economic units and contributes substantially to the achievement of technological transport and plan their production can finance from funds of the respective units.


Article 40 Expenditure necessary for the maintenance and repair of the road arteries is financed from local budgets and other resources provided by law.


Article 41 the work on construction, modernization, maintenance and repair of the road arteries, urban and rural areas, may also be carried out through financial contribution and employment of citizens, according to the law.


Article 42 executive committees or, where appropriate, the executive offices of the popular councils are responsible for ensuring that the conditions of use and in good condition of traffic arteries, of street cleaning, maintenance and upkeep of buildings and technical facilities and household, the flags on the road and plantations, the antrenînd population in the settlements.


The provisions of article 43 of this law shall apply to portions of national and County Road crossing of the localities, in so far as the law of roads No. 13/1974 otherwise.


Article 44 1-8 Annexes form an integral part of this law.


Article 45 the provisions of art. 12 lit. c roads) of the law No. 13, 1974 is hereby repealed.
