The economic and social development of the country, the increase of the civilization and well-being of the people require the adoption of measures to modernize and systematize all urban and rural localities, in accordance with the legal provisions. In achieving this objective an important place takes care of systematization, design and realization of circulation arteries. In order to meet the current and perspective requirements of road traffic, the realization of urban and rural traffic arteries must be made in a unified, scientific basis, according to mandatory norms, to ensure the permanent improvement of the living and working conditions of the inhabitants, the preservation and the superior valorisation of the existing street network, the saving of land, the increase of transport efficiency and safety Systematization, design and realization of circulation arteries in municipalities, cities and communes will need to ensure the harmonious integration of new economic, social-cultural or housing objectives within the architectural and system Existing street, respecting the peculiarities of each locality. In order to ensure a rigorous order in the field of systematization, design and realization of traffic arteries in urban and rural localities, The Great National Assembly of the Socialist Republic of Romania, adopts this law. + Chapter 1 General principles + Article 1 Systematization, design and realization of traffic arteries, in urban and rural localities, are carried out in a unified conception, taking into account the criteria of economic and social efficiency, the specific conditions of the localities, based on the provisions of the single national economic and social development plan. The development of the circulation network in localities, an integral part of the systematization process, must contribute to the permanent improvement of the living and working conditions of the inhabitants, to the increase of transport efficiency and safety, to save land and modernize localities. + Article 2 The systematization of circulation arteries is based on the circulation study of the locality, which is drawn up for a minimum period of 15 years, and other specialized studies and is approved, according to the law, with the systematisation of the locality. + Article 3 Systematization, design and realization of traffic arteries in localities must ensure the preservation and use of the existing street system, their alignments, as well as the avoidance of demolitions, the preservation of constructions, the specificity architectural and urban planning of the locality. By systematizing the street network will ensure that national roads cross the town through one or at most two important traffic arteries. The establishment of the sites of economic, social-cultural and housing objectives will also be made taking into account the possibility of using the existing network of streets, while ensuring the multifunctional character of traffic arteries, for local and transit transport, for commercial, social, cultural and other activities. The abolition, widening or creation of new streets within the existing neighborhoods can only be carried out with the prior approval given by presidential decree. + Article 4 The design and construction of new streets can be done only in cases justified by the traffic needs of the localities, determined by the development and location of economic, social-cultural or housing objectives, on short, direct routes, without bypass variants, in compliance with the provisions of this law. The realization of new industrial, social-cultural objectives, as well as housing, will be done only after the design and construction of the network of streets, which will be carried out taking into account the character of the streets existing in the locality. + Article 5 The residential buildings will be placed at the limit of the sidewalks and will have provided, as a rule, inner courtyards for household needs. Around each block of flats will be provided with simple concrete or asphalted concrete protection pavements provided with gullies for water drainage. Within the inner courts you can arrange parking spaces for motor vehicles, household utilities and, as the case may be, green areas. The care and arrangement of the inner courts, green areas and other household units is an obligation of each lessee. + Article 6 The streets of urban localities are classified in relation to the intensity and composition of the traffic, as well as with the functions they perform, as follows: category I-bus; category II-connecting; category III-collectors and Category IV-local service. The streets of rural areas are classified in the main and secondary. The functions, dimensions and manner of realization of each category of streets are those provided for in this law. The classification of streets in each urban or rural locality is made by the executive committees of the county folk councils or the city of Bucharest, based on the traffic studies approved according to the law. + Article 7 The works for the realization or modernization of the streets are approved with the systematization sketch and are executed in the following order: street tracing, performing underground technical-urban works, street building, followed, as the case may be, by the execution economic, social-cultural or housing objectives. Through the technical-economic documentation of the investment will be established, in stages, the categories of works to be carried out within this order, in order to shorten the duration of execution, to save the allocated funds and rational organization of the execution of the works ensemble. + Article 8 The executive committees of the county folk councils and the city of Bucharest are responsible for the elaboration of the systematization studies, the circulation studies, as well as the coordination of the elaboration of technical-economic documentation and the execution of all investment works, upgrades, repairs and maintenance that are carried out on the traffic arteries of cities and communes, in compliance with the provisions of this law. + Article 9 The elaboration of measures for the systematization of street arteries, as well as their construction and maintenance, will be carried out with the active participation of citizens. To this end, the popular councils will inform citizens of the main issues related to the development of circulation, analyze their suggestions and proposals on the various solutions envisaged and attract them, within some actions. organized, to the implementation of the measures + Chapter 2 Design and realization of circulation arteries in urban localities + Article 10 The streets of urban localities have the following functions and features: a) category I-bus streets, which ensure the taking over of the city flows, in the main direction of connection with the national road crossing the city, having 6 lanes of traffic, including tram lines and other means of transport in common; b) streets of category II-connecting, which ensure the general circulation of cities between functional and living areas, having 4 lanes of traffic, including tram lines and other means of public transport; c) streets of category III-collectors, who take over the traffic flows of the city from functional areas and direct them to the connecting streets or buses, having 2 lanes of traffic; d) streets of category IV of local service, which provide roadway access to the residential blocks, their inner courtyards, as well as in areas with very low traffic, for current and accidental services, having a single lane of circulation. The category I-bus streets will be designed and realized only if their realization is justified from a technical-economic point of view and the intensity of traffic and will be in number of no more than two in a locality, located, as a rule, on national road directions. + Article 11 The classification of the streets in one of the categories provided for in this law is made on the proposal of the executive committees of the county folk councils and the city of Bucharest, through the sketches and systematization details Law no. 58/1974 on the systematization of urban and rural territory and localities. + Article 12 Category I and II streets, with or without the median green area, as well as other streets with a higher number of traffic lanes than those provided for in art. 10 or with the tram platform separated from the carriageway, bypass arteries, rocade, connecting belts and piercings, will only be possible in cases where the size of the city, traffic intensity, terrain configuration, traffic pedestrians or other circumstances determine the need for such works, with the prior approval given by presidential decree. + Article 13 When designing new streets in urban localities will be adopted, as a rule, the type of street of category III, provided with sidewalks of 2 m. Depending on the intensity of traffic and the economic efficiency of the works can be adopted and types of streets of category I, provided with sidewalks of up to 5 m width, or category II streets, provided, as a rule, with sidewalks of 4 m width. The characteristics and technical conditions for the design of streets in urban localities, as well as the maximum traffic capacities on them, are provided in Annexes no. 1 1 and 2. + Article 14 The design of the intersections will take into account the specific conditions of arrangement, corresponding to the relations between the competing flows, as well as the conditions of fluency, visibility and traffic safety, provided in the technical norms in effect, according to Annex no. 2. Intersections and traffic markets can only be achieved if the solutions adopted are technically and economically justified and will occupy the area of land strictly necessary to ensure their functions. In the case of intensely requested intersections, uneven crossings for pedestrians and vehicles can be foreseen. The realization of intersections on the streets of categories I and II is done with the approval of the executive committees of the folk councils or the city of Bucharest. + Article 15 The underground edilitary works are usually located outside the road side of the street. Bus distribution or collection networks for water, electricity, telephony, gas, district heating will be located in visible galleries and provided with branching points distributed at optimal distances, according to systematization studies, ensuring minimum lengths of connections, according to Annex no. 3. High voltage and sewerage electricity networks are designed and carried out on independent routes, corresponding to technical norms. + Article 16 The modernization of the streets will be carried out in accordance with the provisions of the systematization sketch of the locality and the traffic study, with the maintenance of existing In order to align the road side of the street can be carried out, according to the legal provisions, some corrections by retreats of fences, without demolitions of buildings, while ensuring a sidewalk with minimum width. + Article 17 The executive committees of the county folk councils and the city of Bucharest will establish, based on traffic studies, measures for the efficient use of the street system, by separating and distributing traffic flows in relation to the nature of traffic, the introduction of one-way traffic, the suppression of secondary and close intersections on streets with heavy traffic and transit, as well as other measures to organize movement. + Article 18 In order to substantiate the circulation studies in localities, the executive committees of the county folk councils and the city of Bucharest will ensure, with the contest of militia bodies, the regular registration of traffic, according to the norms technical established for this purpose. + Article 19 For the movement of pedestrians will be set up sidewalks, with a width between 1 and 5 m, depending on the intensity of the traffic and the place where they are located. The rules for the dimensioning of sidewalks are those provided in Annex no 4. When crossing the streets of categories I and II of urban localities, by large pedestrian flows, refuges or passes through uneven passages can be provided, as the case may be. Inside housing complexes, pedestrian access to housing, social-cultural facilities, commercial spaces, resting places and playgrounds can be ensured through alleys. + Article 20 The location on the streets of the pillars for installations, trees or green areas will be made on a width of 1.50-2 m between the carriageway and the sidewalk. The rules for illuminating the circulation arteries differentiated in relation to their category, as well as the distances between the public lighting styles, will be determined by presidential decree. + Article 21 Public transport solutions are established on the basis of a comparative study of technical-economic efficiency and on the transport requirements of the population. Public transport will be carried out on the streets of categories I and II; the streets of category III will be able to be used for this purpose in exceptional cases, if the upper category streets cannot be used for this purpose. New tram lines are usually located on the road side of the street and at its level, and tram stops can be set up with pedestrian refuges. + Article 22 For car parking you can use the inner courtyards of the properly arranged living buildings, the inner streets, the specially arranged spaces in the squares of the living quarters and, as the case may be, the sidewalks and streets that are not Heavily circulated. + Article 23 Within the housing complexes with a population of about 8,000-10,000 inhabitants can be provided for the arrangement of parks, with diversified plantations, corresponding facilities for rest and leisure, playgrounds for children, as well as other facilities for serving the population. + Article 24 The traffic speeds taken into account in the design, intensity and nature of traffic, as well as the organization of traffic, arrangement and arrangement of intersections on the streets of urban localities, are established by traffic studies, with compliance with the provisions of Annex no 1. + Article 25 The dimensioning of the number of road lanes is based on the intensity and characteristics of traffic, in compliance with the maximum traffic capacities on the streets set out in Annex no. 2. + Article 26 The geometric elements of the characteristic profiles of streets in urban localities are those provided in Annex no. 5. The alignment of constructions along the streets of categories I-III is made in compliance with the maximum distances between their fronts, set out in Annex no. 6. Construction, other than housing, cinemas, houses of culture, shops, social-cultural facilities, commercial spaces, etc., which generate important pedestrian and vehicle flows, can be amplified withdrawn from the general alignment of the street and will be provided with local traffic arrangements that will be solved by systematization details and will be approved with them. + Article 27 Streets with widths greater than those set out in Annex no. 5 5 or with distances between the construction fronts larger than those set out in Annex no. 6, traffic markets and carriageway uneven passages, as well as the releases around the social-cultural objectives, can be achieved only with the prior approval given by presidential decree. + Article 28 The road surfaces and the sidewalks in the housing complexes shall be established according to Annex no. 7. + Article 29 The composition of the road system will be based on the intensity and composition of the traffic, the climatic factors and the possibilities for the use of local materials and industrial waste, the stage realization of the works, in accordance with Annex No 8. The dimensioning of clothing, foundation and basic layers will be done in compliance with the technical norms in force for prospective traffic for a duration of at least 15 years. + Chapter 3 Design and realization of circulation arteries in rural areas + Article 30 The streets of rural areas have the following characteristics a) main streets, with two traffic lanes for traffic in double meaning; b) secondary streets, with a single traffic lane for low intensity traffic. + Article 31 The main streets will have a road width of 5.50 m and the 7 m platform, and the secondary ones will have a carriageway width of 3.50 m and the 5 m platform. + Article 32 Street platforms in rural localities will be bordered by ditches or gullies. For pedestrian traffic, sidewalks with a width of 0.75 m are provided. + Article 33 Distances between fences or constructions located on both sides of the streets in rural localities will be 11 m at the main streets and 8 m at the secondary ones. + Article 34 Depending on the size of the locality, the configuration of the land and the traffic characteristics, the county folk councils and the city of Bucharest will be able to approve street widths or distances between fences or constructions larger than those provided to art. 31-33, without however being able to exceed, according to the law, 7 m road widths and sidewalks of 1.50 m width, respectively distances between fences or constructions of 17 m. For the development of the national road traffic capacity in the crossing of rural localities, the distance between fences or constructions will be 22 m. + Article 35 Art. 14-16 also applies accordingly to systematization, design and realization of streets in rural localities. + Chapter 4 Liabilities and penalties + Article 36 Violation of the provisions of this law attracts disciplinary, material, civil, contravention or criminal liability, as the case may be. For the contraventions enjoyed in the field of systematization, design and realization of traffic arteries by individuals, sanctions will be established with a fine of 1,000 lei up to 10,000 lei, and for those enjoyed by persons legal, sanctions with a fine of 3,000 lei up to 30,000 lei. Art. 25 25 para. 1 1 and art. 26 26 of Law no. 32/1968 on the establishment and sanctioning of contraventions does not apply to contraventions enjoyed in the field of systematization, design and realization of traffic arteries. The decision of the Council of Ministers will establish the contraventions in the field of systematization, design and realization of traffic arteries, as well as the sanctions to be applied. + Article 37 It constitutes contravention, if the act is not enjoyed in such incit conditions, according to the criminal law, it constitutes a crime, damage by any means of traffic arteries in urban and rural localities, preventing in any form a their use, as well as the degradation of household units or green spaces. The contravention is sanctioned with a fine of 500 to 2,000 lei, the offender being obliged to repair, according to the law, the damage caused. The finding of the contravention and the application of the fine shall be made by minutes concluded by the mayor or persons empowered by him, as well as by the officers and subofficers of militia. The provisions of this Article shall be supplemented Law no. 32/1968 establishing and sanctioning contraventions. + Chapter 5 Final provisions + Article 38 Within the projects of systematization of localities will be considered the possibility of making new monuments, as well as the enhancement of existing monuments that represent the historical and fighting past of the people. It is forbidden to make markets or green spaces around social-cultural objectives, by demolishing existing constructions. + Article 39 The realization of urban and rural traffic arteries shall be financed from the investment funds allocated through the plan to the folk councils, as well as from other resources provided by law. The works for the realization of streets that ensure access to state economic units and contribute substantially to the realization of technological transport and their production plan can be financed from the funds of the respective units. + Article 40 The expenses necessary for the maintenance and repair of traffic arteries shall be financed from the local budget, as well as from other resources provided by law. + Article 41 Work on the construction, modernization, maintenance and repair of traffic, urban and rural arteries, can also be carried out through the monetary and working contribution of citizens, according to the law. + Article 42 Executive committees or, as the case may be, the executive offices of the popular councils are responsible for ensuring the conditions of permanent use and in good conditions of the circulation arteries, the cleanliness of the streets, the preservation and maintenance of the facilities Technical-publishing and household, road signs and plantations, training in these actions the population of the localities. + Article 43 The provisions of this law apply to the sections of national and county road in crossing the localities, in so far as Road law no. 13/1974 does not otherwise. + Article 44 Annexes 1 to 8 are an integral part of this Law. + Article 45 Provisions art. 12 lit. c) of the Road Law no. 13/1974 is repealed. + Article 46 This law shall enter into force on 1 January 1976. *) Note
