Article 29 in the area of production, has the following main tasks: (a) arrange for the rhythmic) plan for the production of the components under conditions of high economic efficiency;

Article 30 in the commercial field, has the following main tasks: a. k) meets, according to the law, the function of general external supplier;
  

l) also meets and other duties stipulated by the law in respect of economic, foreign trade and international economic cooperation, as well as other regulations in this area.

f) establishes time limits for carrying out the valuation of the underlying assets on an annual basis; examines and adjudicates disputes between enterprises subordinate to heritage and settles disputes of an amount below the 1000 lei where subordinate enterprises are responsible for payment;
  

g) organizes the preventive financial control in accordance with the law, shall organize and control Fund Manager on the materials and money to the enterprises subordinate units and components;
  

h) sets the prices and tariffs in compliance with legal skills and; controls and is responsible for the method of calculating prices and tariffs, as well as harmony between product quality and prices;
  

I) redistribute available funds from the enterprises subordinated fixed units and components within the competence;
  

j) meets, and also other duties stipulated by law in the field of finance, prices and tariffs, financial control and accountability.
  


Article 32 in the field activities of personnel, has the following main tasks: (a) the application of the criteria) is organizing scientific selection, training, employment and promotion personnel worker; deals with the formation of the time frames along with educational institutions;
  


b) sets and ensure staffing in anticipation, on trades and specialities, taking into account the specific nature, requirements and the development of co-ordinated;
  

c) shall draw up the insurance plan and preparation of the workforce through qualification courses, with or without removal of production practice at the workplace, high schools, vocational schools, apprenticeship instructors, schools and others on the basis of its own proposals and those received from subordinate d) undertakings shall draw up the plan for improving the preparation of personnel according to the rapid development of technical progress and scientific management requirements of production and labor;
  

e) organizes training courses for skilled worker, practice in the workplace, schools, professional schools, and the schools of foremen and others based on the tuition plan and within the limits of funds allocated by the plan; organizes and tracks production practice of pupils and students and internship practicing high school graduates in co-operation with educational institutions; organize, according to the law, improving the preparation of personnel in the field of activity of the plant and the problems of leadership and organization;
  

f) ensure the physical basis of school establishments, equipping laboratories, workshops and workplaces for students ' practice, as well as specialized teachers;
  

g) ensure the application of legal provisions concerning the recovery works after the quantity and quality of work, and apply the material forms of stimulation of staff worker law, ensuring the close correlation of the retributiei with the results;
  

h) take steps to organise the activity of the State secrets defense staff worker within the plant, subordinate enterprises and establishments;
  

I) establishes measures and observance of labour discipline and pursues the use of full time work in all units of the plant;
  

j) take measures to improve working conditions and rational use of the workforce; organises and pursues social actions of the plant as a whole regarding the establishment of crèches, kindergartens, canteens, accommodation, solving the problems of health care, as well as providing the necessary material base of cultural-sportive actions;
  

k) ensure keeping records of plant personnel and pension units;
  

l) ensure that all necessary measures for retraining through the work of persons who have committed misconduct and violations of the norms of social coexistence and the laws of the country;
  

m) also meets and other duties stipulated by the law with regard to employment and promotion in employment, education, improvement of the preparation of personnel recovery works, worker and other regulations in this area.
  


Chapter 3 economic units ' Leadership Article 33 Staff worker in each unit socialist State carries responsibility for heritage entrusted management and economic results achieved in the drive. On the basis of the principle of workers ' self-management Socialist democracy and every man of labor in his capacity as a participant in the management of national wealth, responsible in front of the team for their own job tasks and, together with the whole team, for the good of the General activity of the unit. Also, every worker has the right to rule on all questions affecting the smooth operation of business, to say their opinion on how the operate unit organs and to make proposals for improvement of the work of the entire unit.
The Constitution of the Socialist Republic of Romania devote the role of Communist party policy leading to force the entire society. Organizations of the Socialist Unity Party of each control of the economic and social life, seek and carry out controls in good conditions of tasks arising from the programmes of economic and social development.


Article 34 the State Leadership of the Socialist Unity is achieved on the basis of the principle of collective leadership, and through the direct participation of working people from debating and resolving economic and social activity of the unit, in the preparation and realization of measures necessary for carrying out the tasks of the plan for improving conditions of work and life of the whole community.
The organs through which leadership is exercised, collective enterprises, plants and other socialist establishments are: General Assembly of the Council of the working people, working people and the Executive Office of the Board of the working people.


Section I the organisation and functioning of the working people's Enterprise Council Article 35 Council of working people is constituted by the frames of liability of party and State, specialists with high experience, elected representatives of the working people. In establishments where working people working from all Council naţionalitatilor inhabiting belong and working people belonging to these naţionalitati. Depending on the size and complexity of the enterprise, the Council comprises 15 people working up to 35 persons and has the following composition: a) Chairman, is appointed Secretary of the party's organization;
  

b) first Vice-President, a position he is appointed Director of the enterprise;
  

c) Vice President, he is appointed Chairman of the syndicate;
  

d) Vice-President, position in which he was elected a representative of the working people, worker working directly in production;
  

(e)) Vice-President, a position he is appointed Secretary of the Union of Communist Youth Organization;
  

f) members:-Deputy Directors or, as the case may be, the Chief Engineer and the Chief Accountant;
-Head of technical quality control compartment;
-women's Commission and President of the enterprise;
-the heads of some bins work, leaders of the most important sections, workshops, factories, construction sites, as well as highly qualified professionals and science.
The members of the working people from all of these frameworks are appointed by the organ to which it is subordinated to the undertaking on the basis of proposals by the General Assembly of the working people; the members of the working people from the outside undertaking shall be appointed with the agreement of the leadership of the unit:-7 up to 17 representatives of the working people elected every two years during the General meetings of working people, of all workers, instructors, technical staff, and other specialty; at least 75 percent of the number of representatives of the working people will be workers and foremen who work directly in the production.
Enterprises with large numbers of women, Chairperson of the women's Commission will be appointed and the Deputy Chairman of the Council of the working people.
Total number of persons on the Board of the working people, and the number of representatives of the working people, are established by the General Assembly of the working people, according to the annex. 1 to this law and taking into account the volume and complexity of production, territorial dispersion, as well as other specific factors.


Article 36 The businesses that operate within multiple counties, councils working people have the following composition: a) Chairman, is appointed Director of the enterprise;
  

b) Vice-President, a position he is appointed Secretary of the party organization in the most representative;
  

c) Vice President, a position in which it is designated one of the Deputy Directors or chief engineer of the enterprise, where he is assistant director;
  

d) members:-the members of the working people as referred to in art. 35 lit. f);
the Union's Committee on the Council or Committee of the Trade Union delegate units without trade union committees;
-Secretary of the Union of Communist Youth Organization from that unit.
The businesses that operate in the territorial units scattered, but within a single County Council working people is the one set out in art. 35. In special cases, for some businesses or institutions who in coordinating their socialist legal units located in the same County, together with the ministries of County party Organization's opinion, with economic and social councils, may decide to organize the working people of the respective units, according to the provisions of paragraph 1. 1 of this article.


Article 37 the working people of the Enterprise Council has the following powers: to draw up five-year plans) and in compliance with the indicative annual levels and norms established by the central plan; approve the plan's breakdown of units;
  

b) in justified cases, according to the requirements and possibilities, changes in annual production tasks in natural units "that make up the Group of products that is approved through the national plan's unique agreement with beneficiaries and provided that the total annual burden from the product groups in question, as well as indices established by the plan and budget;
  

c) periodically and respond to how are operated, maintained and repaired the fixed funds and take measures in order to ensure a more rational uses;
  


d) develops the budget of income and expenditure and approve the balance sheet; examines the evolution of profitability and accumulation, spending and stock structure of material values and take action for use with maximum efficiency of production;
  

c) approve the organisational structure based on uniform rules for the structure and structures; approves the regulation of organization and operation of the enterprise and the rules of procedure of the Council of working people; employment creation and decides levels of organization of the production sections, workshops, leading, lots or other similar units, based on the methodology approved grading by the Decree of the State Council; approve measures for improvement of the informational system, for mechanization and automation of data processing;
  

f) establishes the program development and review of the rules and norms of local labour, as well as the programme of measures to increase labour productivity and submit them for approval to the General Assembly of the working people;
  

g) organizes the preparation, promotion, employment and improvement in the work of the staff worker;
  

h) discuss and rule on the proposals for appointment of new frames: technical director, Deputy director and chief engineer or production, commercial Deputy director, Chief Accountant and other frameworks which occupy leadership positions;
  

I) decides the employment and dismissal of staff of plants, factories, and other facilities, which have a leading similar units, as well as heads of Department and service;
  

j) ensure that all the measures for knowledge and application of laws, decisions of the party and State; ensure material conditions and supports the work of lifting the level of Socialist consciousness in order to develop an attitude for work, defense and public property management, citizen education of working people;
  

k) examines the performance of the tasks incumbent upon the Unit regarding the reeducation through labor and sanctioning persons who have committed misconduct and violations of the norms of social coexistence and the laws of the country;
  

l) develop with the Union Committee, collective labour contract and submit it for approval to the General Assembly; analyzes the performance of its provisions periodically, the implementation of measures for the protection of labour, to combat pollution of the environment; be allocated housing space;
  

m) examines how to achieve measures relating to conditions of work and life of the working people and improving them;
  

n) ensure the establishment and the use of the Fund for the construction of housing and other social investments, in which the goal:-controls the execution of the permanent stage construction of housing;
-organise the construction of housing for its own purposes or incurs such works with enterprises;
-randomized, along with trade union bodies, housing from housing and sets its staff receive credits which are set out in the construction of private housing;
-organise the management of the housing stock of the enterprise;

a establishment and use of) approve Fund for social action; approve the provision of treatment and rest tickets with discount for staff with the most important title in Socialist challenge;
  

p) approve, along with Trade Union Committee, the rules of procedure;
  

r) designating the members of the Executive Council of the working people;
  

s) periodically analyzes the way in which the Executive Office of the Council the working people bring to fruition the tasks conferred on it by law, and the decisions adopted by the working people;
  

s) analyzes and presents on the occasion of the General Assembly of the working people how have met financial and economic indicators on the enterprise, and determines measures for achieving full recovery;
  

t) meets any other duties stipulated by law, and the tasks set out by the General Assembly of the working people or by the collective leadership of the unit to which it is subordinated to the enterprise.
  


Article 38 the Executive Bureau of the Council of the working people of the enterprise consists of 5 up to 11 members. The number of members of the Executive Bureau shall be approved by the General Assembly of the working people, and the nominal component, by the working people.
The Executive Office shall be composed of the Director of the company, which performs the function of Deputy Chairman, directors or, as the case may be, the Chief Engineer, Chief Accountant, and other leading cadres and specialists within the company, appointed by the Council of the working people from all its members.
Participate in the meetings of the Executive Office, usually the Secretary of the party organization.
The debate concerning the main problems of economic tasks, as well as those relating to the rights and obligations of working people, participate in the Union's Chairman, Secretary of the Union of Communist Youth Organization and President of the women's Commission.


Article 39 of the Executive Council of working people has the following main tasks: to) organize the tasks and aims of plan, sections, workshops and other sectors of activity; approve the breakdown by months of quarterly plan and establishes measures for the use of the full capacity, the rational use of the workforce and of working time;
  

b) sets out the technical and organisational measures and ensuring their application in order to accomplish the tasks of the plan, mobilization of all reserves and exploit economic potential and enhancement of enterprise;
  

c measures to end) sets of economic contracts and ensure the delivery of the products at the time limits set in the contracts;
  

d) regulates the supply of raw materials and necessary materials before beginning the production process;
  

e) analyse and take measures for the fulfilment of the plan of rhythmic export-import, timeliness of delivery and other obligations provided for in the contracts, raising the efficiency of foreign trade activity;
  

f) examines the work done regularly to ensure the quality of products; take steps to maintain the manufacturing of products with only technical parameters and quality of existing products, upgrading, product uptake and new technologies, the introduction of the fast research concluded; seeks full of valorization and reusable materials resulting from the manufacturing process by the departments and workshops set up for production of consumer goods;
  

g) approve material which meets the hinges position of Coordinator; approve the rules of consumption of raw materials and fuels for the activities which are not prepared by departmental rules or republican character;
  

h) change-in duly justified cases-tasks of the annual and quarterly plan of sections, workshops and other production units in compliance with the level of approved indicators, total per year and quarters, as well as the economic obligations resulting from contracts concluded;
  

I approve, within the limits) set by law, economic and technical documentation and purchase equipment for investments referred to in the plan; approve purchase machinery which are contained in the global investment plan and are not listed under a general estimate;
  

j) called, according to the law, the Commission of reception of investment targets, according to the competences of investments; approve commissioning and measures for carrying out technical-economic indicators investments from its competence of approval;
  

k) establishes measures for the organisation of scientific production and labor and ensure this activity continuously and systematically in nature; adopt the program of studies on improvement of organization and management and ensure its fulfillment;
  

l) in commercial units as well as those that provide services to the population, analyses and adopt measures to improve the level of population, completion and provision of services for the population, plan of receipts in cash, reduce spending, more efficient use of the technical-material basis of trade and provision of services, the introduction and expansion of modern forms of serving, diversification of the network organizing advertising actions, and commercial advertising, capitalizing on the efficiency of the household goods and raw materials;
  

m) examines how how is managing assets, take measures to ensure the integrity of the respective unit heritage and sets out measures, within the limits of legal competencies, to recover damage public property;
  

n) approve the total amount of expenditures may be made on account of higher production costs for advertising and advertisement; approve discharge of subtracting from the stock gaps observed in materials inventory over legal norms and shifting their production costs in cases when shortages are not due to a fault, as well as other damages, as provided by the laws;
  

a) with the agreement of the beneficiary sets, prices and tariffs on the products and services of the competence of the enterprise, as well as additions or bonificatii, according to legal regulations;
  


p) approve, according to the law, the tariff remuneration and other rights of employment, staffing, payroll, staff worker in the undertaking thereof; nominates the personnel can receive bonuses for special conditions and classification in groups I and II in order to work, the retirement bonuses dock, within the limits of the criteria approved by the hierarchically superior body; approve promotion steps and personnel unit and gradations reducing the minimum age required for promotion, according to legal regulations;
  

r) approve the employment and dismissal of personnel management were not referred to in art. 37 lit. I) with the consent of the interested bodies; approve the transfer in the interests of the service without the opinion of the hierarchically superior organ for the execution of the enterprise; for specialized staff with preparation of educational, health and other sectors of the economy to which the law of domain provides the opinion of the Ministry coordinator, transfer to the interests of the service will be done with this opinion;
  

disciplinary sanctions), the conditions and cases stipulated by law, leading cadres of plants, factories, construction sites, for groups and other similar units, as well as heads of departments and services;
  

s) approve, with confirmation of the hierarchically superior body, a plan for granting staff worker at retributiei which were not established such indicators;
  

t) approve, with the consent of the Trade Union body of the enterprise, the rules and regulations of local employment;
  

t) ensure the proper application of the rules of labour protection, to combat environmental pollution, prevention and firefighting; establishes measures for the improvement of working conditions, elimination of harm, so as to avoid the maximum possible supply of heavy work and harmful;
  

u) ensure compliance with the legal conditions for the proper operation of canteens and social measures-cultural people working in the unit;
  

v) analyse and take measures for the integration of socio-professional young graduates of the different forms of vocational training and higher education graduates are in the period of internship;
  

x) submit reports to the Council on how the working people who were brought to fruition the decisions taken;
  

y) meets any other prescribed duties and tasks set by the working people of the company.
  


Article 40 members of the Executive Bureau of the Council of the working people are responsible for the proper management and use of all material and financial means of the establishment and observance of the legal provisions in the adoption of decisions of any kind.
Members of the Executive Bureau of the Council of working people have, according to the labour code, the collective liability for damage caused through the fault of their unit; liability of members of the Executive Office for decisions adopted does not exclude the liability of the Director and Chief accounting officer.
The commitment of expenditure and monetary unit is done according to the law, only by the Director and Chief Accountant.
Director and accounting officer shall be responsible for the observance of contractual and financial plan, measures are taken to ensure the integrity of the public property, development and efficient management of goods entrusted with the obligation to refuse, in accordance with the law, any operation that violates laws of heritage.


Article 41 Director assure current enterprise enterprise carrying out the decisions of the Council brings to working people and its Executive Bureau, as well as the tasks set by the organ to which it is subordinated to the enterprise, in which purpose: to ensure the achievement of) all the indicators of the enterprise from the single national economic and social development and State budget, raising the sides of qualitative production good organization, production and labor, raising of economic efficiency of the activity of the undertaking, the creation of appropriate conditions for the entire staff worker;
  

b) regulates in order to improve product quality, to approve the technical rules, organizes technical quality control on the manufacturing phases, ensuring the technical documentation for the development of new products and upgrading existing ones, as well as the appropriate means of measurement and control;
  

c) regulates for supplying the appropriate rhythmic, requirements of the manufacturing process, raw materials, materials, fuels and energy; ensure that measures taken to reduce consumption of raw materials, materials, elimination of non-productive expenditure, optimizing value stocks;
  

d) in collaboration with suppliers of graphic machinery and installations for investments in competence of approval of the enterprise;
  

(e) approve plans for transport) with his own means, and is responsible for their proper use and take action in order to avoid transport neeconomicoase;
  

f) ensure and be responsible for the organisation of preventive financial control, internal financial control, hierarchical control current and operative inventory of heritage;
  

g) ensure that measures relating to the integrity of the assets of the undertaking have been approved and public property damage recovery;
  

h) approve the compensation of the shortcomings with the ins in inventory, according to legal norms; sets time limits for performing the annual inventory of property;
  

I) establishes, on the basis of the organizational structure and the rules of organization and operation, mode of work and collaboration between compartments of the functional structure and production; organizes control tasks and monitor the implementation of the measures;
  

j) fall and release from Office the staff running the unit and other staff that is not provided for in the collective bodies competence;
  

k) ensure control tasks and monitor the implementation of the measures; ensure all staff know the worker party rulings and regulatory acts aimed at unity and ensure that activity very closely;
  

l) ensure that the principle of collective work in the work done by the Executive Office; ensure that each Member of the Executive Bureau to actively participate in solving the problems, to perform the tasks that are assigned to them;
  

m) ensure operative members of the working people and the Executive Office on the activities of the unit, the main problems to be resolved and the measures taken.
  


Article 42 the enterprise Director engages the drive into relations with legal entities and individuals, as well as in judicial bodies. It also can give power of attorney representation for that purpose and other frames in that undertaking.


Article 43 working people under the direction of Council, the enterprises of production and, where appropriate, into its other units are organized and function the following committees: Committee on labour productivity growth and organization of production and labor; The Commission for the quality of production and economic efficiency; The Committee on development, investment and technical progress; Commission for the supply, sales, and import-export; The Commission for the proper management and defense of public property; The Commission for Social Affairs; The Commission for the training and professional development, employment and promotion in the work.
Enterprise also operates according to the law, the Council of money of the company. Within companies, advising councils working people, operates court workers councils. The powers, organization and functioning of workers ' councils of law shall be determined by law.


Article 44 panels fields are designed to support the collective management body of the company in adopting and implementing the measures necessary for carrying out the tasks of the plan, the growth of qualitative sides of production and increase the economic efficiency of the entire activities. In carrying out the tasks delegated to them, works closely with committees of the compartments and initiates actions to mobilize working people in carrying out the tasks of a neighborhood plan. The main tasks of the committees are laid down in Annex areas no. 2 to this law.


Article 45 panels fields operate as public bodies, consists of 3 to 11 members and are driven by a member of the Board of the working people. Of these committees belong to highly qualified workers and long experience in manufacturing, foremen, heads of Department or workshops, technicians, engineers, economists and other specialized staff appointed by the General Assembly of the working people.
Domain committees working on the basis of concrete programmes of action in accordance with the duties and tasks set by the working people.


Section II-of the organisation and functioning of the Council of working people from the Central Article 46 Council of the working people of the plant, depending on its size and complexity, includes 33 up to 53 members and consists of: a), position in which President is appointed Director general of the plant;
  


b) Vice-President, a position he is appointed Secretary of the Party Committee of enterprise structure which comprises Central; at the stations in this function will be appointed Party Secretary of the organization most representative of the undertaking;
  

c) Vice President, a position in which it is designated one of the directors-general mangers; at the stations in this function will be designated one of the directors of the plant;
  

d) members:-Directors of Central, Chief Engineer and Chief Accountant;
Vice-Presidents of the working people, the Presidents of the executive offices and other leading cadres from the subordinate units and components businesses, appointed by the management of the hierarchically superior to the proposal of the Director general of the plant;
-3 to 10 members, specialists within the plant and outside the Administration, teachers, people of science, representatives of the financial and banking bodies and other frames with long experience and high qualifications; hierarchically superior organ of the plant, on the proposal of the Director-general, sets out the number of such members and appoints them; the members of the working people from outside the station is called with the consent of the management unit to which they belong;
-5 up to 15 representatives of the working people, workers and craftsmen, of the main enterprise subordinate or components of power plant units, elected every two years during the General Assemblies of the people working in these establishments;
-Chairman of the trade union organizations of the plant.
The number of representatives of the working people shall be determined by the General Assembly on the working people. Undertakings of which will be elected representatives of the working people shall be determined by the Central Union of trade unions together with the branch, with the consent of the County party Committee in the County in which the enterprise operates.


Article 47 The Board meetings of the plant working people debating upon some issues of particular importance for the whole of its activity, such as approval of the plan, the balance of studies on development in perspective, the profiling and specialisation of production units of the plant, will attend the party organizations and Secretaries, directors and Chairmen of committees of trade unions from businesses and other units of the power plant.
The debate in the Council of the working people of the plant has some issues relating to the activity of an enterprise subordinate plant will be invited and Secretary of the party organization, the Union's Director, Chairman and Secretary of the Union of Communist Youth Organization of the enterprise.


Article 48 the Council of working people of the plant has the following functions: to approve the five-year plans) and the annual central in compliance with norms and indicative levels plan received from the State Planning Committee together with ministries; approve the plan's breakdown of subordinated enterprises and units components and establishes the measures necessary for their realization;
  

b approve subordinate enterprises) and changes in the structure of component units the range that make up products or groups of products shall be approved by the plan, as determined by the requirements of domestic consumption and justified by the performance of duties respecting the export total load foreseen for the groups concerned and the production volume and currency balance laid down in the plan year and quarters and without modifying the core indicators set by the plan and the central budget;
  

c) approve plan of scientific research, technological development and the rapid introduction of technical progress in production, as well as projects to improve the leadership of the Organization, production and labor;
  

d) approve measures for profiling and specialization of units;
  

e approve the takeover at the level) of the plant of some powers in the field of scientific research, design, investment, supply and disposal of products, training and improvement of personnel which is laborer warrant to exercise centralized economic, as well as the extent to which the enterprises subordinated to exercise the powers set out in chapter I;
  

f) approve budgets for revenue and expenditure on power plant; debate on the economic and financial activity periodically and determines its improvement measures; approve the economic and financial situation of the enterprises subordinated to; approve the participation shares of enterprises subordinated to cover the costs of the plant; approve the total amount of expenditures may be made on account of higher production costs for advertising and advertisement; sets the component units to have sub settlement at the Bank, depending on the specific findings of their activity;
  

g) approve the organisational structure of the plant elaborated on the basis of uniform rules of structure; approves the regulation of organization and operation of the plant, the rules of procedure and the rules of procedure of the Council of working people;
  

h) propose the establishment and employment levels of organizational units without legal personality-factories, factories, farms and other similar ones; employment creation and decides levels of organization of the sections, workshops, leading, and lots of other similar units within the production units;
  

I regularly analyzes and answers) of how the work of knowledge, employment, promotion and improvement of the preparation of cadres; ensure necessary training of new targets to be brought into operation;
  

j) determines the number of technical staff, economic, professional and other administrative units and enterprises subordinate components within the limit of the job and the salary approved in compliance with uniform rules for the structure and maximum personnel of the weightings laid down; adapts, between activities, number of staff and remuneration Fund, in compliance with approved staffing ratios;
  

k) discuss and rule on the proposals for appointment of the new cadre of management: general manager, deputy general director, technical director, CFO, managing director, Chief Engineer, Chief Accountant and other frameworks which occupy leadership positions;
  

l) Decides, in accordance with the law, employment and dismissal of the Director or of the driver from the subordinate enterprises and other components. For large and complex enterprises subordinated to the ministries, other central organs of State executive committees or councils, the appointment and dismissal of the Director shall be made with the consent of the Minister or of the driver thereof and with the opinion of the bodies concerned;
  

m) examines how to achieve measures relating to conditions of work and life of the working people and improving them;
  

n) ensure the establishment and the use of the Fund for the construction of housing and other social investment;
  

a) determines how the formation and use of the Fund for social action; approve the provision of treatment and rest tickets with discount for staff with the most important title in Socialist challenge;
  

p) examines the performance of the plant during the tasks delegated to them from the decisions of the party and of the normative acts in force regarding the reeducation through labor, and the sanctioning of individuals who commit misconduct and violations of the norms of social coexistence and the laws of the country;
  

r) designating the members of the Executive Council of the working people;

s) approve making overtime in agreement with the Trade Union branch, within the limits permitted by law;
  

s,), according to the law, internship for exceptional training cadres who occupy leadership positions, with the exception of people in management;

t) approve the number of specialists subordinate enterprises and other components;
  

t) approve use of the reserve of the Fund plan staffing and the number of staff, established at the level of the plant;

u) approve the program of insurance, training and retraining of the workforce, within the limit of tuition and funds provided for in the single national economic and social development;
  

v) decides the employment and dismissal of the heads of services, heads of Department and managers of other compartments of the plant structure; approve the employment and dismissal of Deputy Directors or chief engineers, Chief accountants and other leaders on the enterprises subordinated to functions; approve the transfer in the interests of the service for the execution of the plant staff without the opinion of the superior bodies; for specialized staff with preparation of educational, health and other sectors of the economy, the interests of the service transfer will be made with the opinion of the Ministry coordinator respectively, according to the law;
  

x measures on insurance) approve working conditions and lives of working people and improving them; directs, coordinates and controls the performance of labour protection measures;
  

y) submit reports to the Council the working people on how to fulfill the decisions taken;
  

z) meets any other prescribed duties and tasks set by the working people of the plant.
  


Article 51 article 40 shall apply accordingly to the members of the Executive Bureau of the Council in the framework of the working people.


Article 52 the Director general ensures the current leadership and bring to fruition the decisions of the Council of the working people, the Executive Bureau of the general meeting of working people and tasks set by the organ to which it is subordinated. e) ensure measures to improve the management and organisation of production and labour, the development and implementation of studies and projects of the Organization;
  

f) ensure control of economic and financial activity and management of fund units; responsible for taking the necessary measures to ensure the integrity of the public property, proper management of funds and materials, the observance of Socialist discipline and give legal provisions within the limits of competences, to recover damage public property; approve transfer of fixed assets among enterprises of the plant;
  

g) approve the lists of products, goods, packaging and materials that meet the conditions of the subordinated units in compensation, according to legal norms;
  

h) approve domain delegarile on hierarchical steps and bins of work based on the organizational structure and the rules of organization and operation of the plant;

At the meetings of the working people in enterprises will participate in a Council representative of the working people of the plant or the body to which it is subordinated to the enterprise.

t) decides on dismissal of personnel in the unit's leadership that have serious deviations from the illustrious discipline, ethics and the rules of equity which give evidence of the Socialist or lack of responsibility in the implementation of the plan; between meetings of the plenary of the General Assembly, the decision shall be taken by the assemblies of the people working on the wards, workshops or other similar production units will be subject to confirmation at first towards the General Assembly of the working people on the entire unit.

If the General Assembly does not confirm depending on the frames referred to. p) and appropriate bodies), they were called or, where appropriate, are obliged to take measures to replace them within a maximum period of 30 days.

Article 66 the number of elected representatives of the people working for the general assemblies on the Enterprise shall be determined by the Committee, together with the Council of Trade Union of the working people, depending on the number of staff worker and concrete possibilities of the respective Assembly.
Representatives of the working people for the General Assembly shall be elected for a period of one year. In the event of failure of the plan, as a result of their own failure or in the event of disciplinary committed by representatives of the working people in the period for which they were elected, those concerned will be cancel and replace the assemblies of the people working on the wards sectors, workshops, farms, construction sites, of which they were elected.


Article 67 general assemblies in enterprises shall be convened in ordinary sessions semi-annually, the Union Committee, in agreement with the Council of working people. General meetings may be convened in the course of the year, for the examination of projects of normative documents of general interest subject to public debate or legislative acts concerning the improvement of the Socialist units.
In units with seasonal activity, general meetings will be held at the beginning and conclusion of the campaigns.


Article 68 General Assembly of people working on the Central Council shall consist of the members of the working people of the plant, and people's councils in the enterprises and establishments subordinate components or their executive offices, as well as of representatives of the working people of the second plant, whose number shall be determined by the management together with the trade union organizations of the Commission power plant units.

Article 84 Plants and businesses, remains titular of direct administration, can inzestra, since its Foundation, economic units without legal personality with fixed assets and can equip with working capital necessary for the conduct of the activity, setting and how to use them.


Article 85 Units components of plants and businesses can have independent operative, sub, eligible for bank loans, can have economic and financial relations, within the limits of competences set by the managements of the plant or establishment to which they belong. Heads of units components can enter into contracts with individuals and legal entities, on the basis of the authorization of a representative central or firm date.
Factories, plants, work groups and other similar units without legal personality have their own plan and budget of revenue and expenditure, part and parcel of the plan and budget of the enterprise or plant. These units can be used and the position of Chief Accountant, if rules on specific structure otherwise.

Provisions relating to the organisation and functioning of the Councils of the working people and of their executive offices, established businesses, apply properly and economic entities without legal personality as referred to in the preceding paragraph.
Where such units are not made up of party organizations, the Secretary of one of the party organizations in the unit, established by the hierarchically superior body of the party, meets the President of the Council of the working people.

Organization of work in establishments which have the facilities, equipment and machines with continuous operation or high hazard industries in mining, chemistry, metallurgy, mine, petroleum, construction, electrical and thermal energy, building materials, wood industry, pulp and paper and other sectors, must ensure the uninterrupted deployment of production processes according to the system of work; observance of technological discipline strictly with all the rules of order and discipline, preventing any crashes, explosions, fires or other accidents.
In fulfilment of the work, the staff of establishments referred to in paragraph 1. 1, regardless of the function, answer directly the strictness of rules relating to the conduct of production processes, ensuring law and order in the workplace, retention and removal of any situations that would endanger the life and health of people times uninterrupted and complete safety of installations, equipment and machinery belonging to the unit.


Article 92 Staff worker who works on plant, machinery or machinery with continuous or high degree of danger in service is required to know the characteristics of constructive and functional, to comply strictly with the rules of operation and technical maintenance and the rules of safety and fire prevention, to ensure permanent surveillance equipment as well as avoiding any accidental damage or disruption.

Article 94 units with continuous fire or having installations with high degree of danger, people who provide technical assistance on the Exchange, as well as those which are authorized to dispose the stopping or putting into service of installations shall be established by decision of the unit's head.


Article 95 Managements units which have the facilities, equipment and machines with continuous operation or high hazard responsible for taking all necessary measures for the proper organisation and conduct of the manufacturing process, in full safety, permanent machinery for monitoring, checking and control points command, observance of all technologies operating rules maintenance, repairs, labor protection, fire prevention, training of personnel, the strengthening of profound order and discipline, the systematic control of the organisation duties by each laborer, avoiding any accidental interruption of production, punish those who violate service obligations.
The regulations of operation of installations and equipment, ensure the Organization and leadership of the manufacturing processes at each place of employment, shall be drawn up in conformity with the technical documentation and is approved by the hierarchically superior body of the unit, after acquiring them by collective management body.


Article 96 economic Ministries responsible along with power plants and enterprises subordinated by taking all necessary measures for the operation under conditions of complete safety of installations, equipment and machinery, avoiding damage, fire, explosions or other accidents, technical compliance with the work regime, strengthening law and order and discipline in the work, penalizing any deviations from established rules.


Article 97 of the Rules of the specific discipline of personnel with continuous fire or who plant, machinery times cars with high degree of danger, obligations and responsibilities devolving upon the said staff shall be laid down by Decree of the State Council.

f) members:-Deputy Directors and Chief Accountant;
-women's Commission and President of the Institute or Centre; institutes and centres with large numbers of women, Chairperson of the women's Commission will be appointed to the position of Vice President of the Scientific Council;
-Heads of laboratories, workshops, or other departments working compartments, highly qualified specialists, as well as people of science within the establishment or from outside it.
Scientific Council members from all of these frameworks are appointed by the hierarchically superior body, on the basis of proposals by the General Assembly of the working people; members of the Scientific Council of the Institute or centre shall be appointed with the agreement of the leadership of the unit to which they belong;
-7 up to 17 representatives of the working people elected every two years during the General meetings of working people from reaching researchers, engineers, economists, designers, technicians, workers, instructors or other personnel worker in the unit; at least 75% of the number of representatives of the working people are going to be scientists, engineers, technicians, workers, foremen and other specialized personnel working directly in the work of scientific research, design and production of Institute or centre.
The number of people in the Scientific Council, as well as the number of representatives of the working people, are established by the General Assembly of the working people within the limits laid down in paragraph 1. 1 and taking into account the number of staff of the unit, the volume and complexity of the task.


Article 100 of the Scientific Council of the Institute is organised in a similar way with councils working people from Central and consists of 35 up to 53 people, having the following composition: a) Chairman, is appointed Director general of the Institute;
  


b) Vice-President, a position he is appointed Secretary of the Party Committee of one of the institutes falling in the central Institute;
  

c) Vice President, a position in which it is designated one of the Deputy Directors of the Institute;
  

d) members:-the directors of the institutes, centres and other units in the central Institute;
-Chairman of the Institute's Union whose structure is constituted by the central Institute;
-Secretary of the Union of Communist youth organisation of the Institute structure which is central Institute;
-representatives of the Ministry, other central organs concerned, other frames with the liability of the partners directly to the work of the Institute;
-5 up to 15 representatives of the working people-workers, trainees, researchers, engineers, designers, specialists from other units or components of profile-elected General assemblies.
The number of people in the Scientific Council, as well as the number of representatives of the working people, are established by the General Assembly of the working people. The units of which will be elected representatives of the working people shall be determined by the central Institute together with the Union of trade unions of the branch, with the consent of the County Committee of the party in whose territory the works Institute.


Article 101 At meetings of the Board of the central Institute in debating upon matters of particular importance for the whole of its activity will be participating in party organizations and Secretaries, directors and Chairmen of committees Union central Institute units components sle.
The debate in the Scientific Council of the Institute of central issues relating to the work of the Institute in the central Institute will be invited and Secretary of the party organization, the Union's Director, Chairman and Secretary of the Union of Communist youth organisation of the Institute in question.

Chapter 8 Organizing and functioning of ministries, other central organs of State and local bodies of State administration, as well as State institutions subordinated to article 103 ministries, other central organs of State executive committees or offices of the popular councils, are organized and function according to the law.
Ministries and other central organs of State assure the entire activities of the branch or field for which they have been set up and carries the responsibility for the work of the power plants, businesses and other subordinated units directly.
Committees and the executive offices of the popular councils, lead and direct the activity of economic units and subordinated institutions and law controls the economic activity of republican interest in the administrative-territorial unit in which it works.


Article 104 the leadership of ministries and other central bodies of State administration are carried out according to the law, on the basis of the principle of labour and collective leadership, as well as the laws governing the Organization and functioning of the Ministry or the central organ concerned.


Under article 105 of the ministries, other central organs of State as well as the popular councils, can set up Socialist units with or without legal personality, in the fields of education, health, science, culture and art, social assistance, administration and other sectors whose costs, as determined by the plan cover from its own revenue and, where appropriate, from the State budget , hereinafter referred to as the table of contents of this Act state institution State institutions. The establishment of republican interest is done by Decree of the State Council, and those of local interest, through decisions of the Councils of the County and city folk.

Article 106 State institutions is to arm it with the fixed assets corresponding to the activity which it carries on, draw up the budget of revenue and expenditure of the accounts, to bank accounts, have money and have economic and legal relations with other units, according to the rules laid down in the specific regulations.
Provisions of art. 5 of this law relating to the fixed funds shall apply, as appropriate, and State institutions.


Article 107 State institutions subordinated to ministries, other central bodies of State administration and the popular councils are holding plan for indications they are assigned and shall be responsible for fulfilling them.

Article 109 State institutions Expenses shall be covered from their own income, as provided by law, or by the State budget within the limits of the amounts approved and in relation to the realization of the tasks set by the plan.
State institutions may use to conduct their activity and widening material resources and money received from legal or natural persons, if necessary, by transfer or in the form of donation, in compliance with the legal provisions relating to these categories of patrimonial transmissions.
The heads of State bodies with legal personality are authorising officers by taking functions and responsibilities established by law.


Article 110 Powers of State bodies shall establish their act of establishment, according to the objectives that we have achieved and are detailed in their rules of organization and operation, drawn up according to the law.


Article 111 article. 106-109 of this Act shall apply accordingly to the other ministries and central organs of the State.


Article 112 chapter III of this law shall apply and State institutions, according to their specificity.
Collective governing bodies may have different names; According to rules or regulations established by the structure of the Act for the establishment of a central body or institution: leadership councils, boards of Directors, management or other collective designations. Also, by law or by Decree of the State Council, may establish for the units in a particular area of activity, a component of the collective leadership of that provided for in chapter III of this law.
Representatives of the working people will be chosen from all staff who participate in worker directly at achieving specific activity of the institution in question, in accordance with the objects of it. Also, the working people of health care institutions, publishers, and other theatrical social institutions, of culture and Arts will be part of the working people and representatives of workers, foremen, other specialists or working people-the Socialist administrative-territorial jurisdiction in which they operate their respective institutions.


Article 113 The State institutions with a small number of people working, collective organs shall comprise between 5 and 9 members, as follows: of which: number of staff of the institution, state the number of members in the governing body and representatives of the labour collective Number of people up to 30 5 2 31-60 5-7 2-3 from 61-100 7-9 3-4 Board working people will have a component preşedinţe , a first Vice-President, a Vice-President who is President of the trade union organization and members.

In these State institutions with small numbers of people working bodies of the executive offices of collective leadership are made up of 3 to 5 members.


Chapter 9 final provisions the provisions of article 114 concerning the Socialist state enterprises also apply to other economic units having industry-specific names or branch belonging, which are organized and operated according to the legal regulations concerning Socialist state enterprises enterprises with small numbers of people working on collective management body shall be set up according to the provisions of art. 113. According to the specifics of activity at these economic units will be able to organise, in agreement with the hierarchically superior body, only some of the committees referred to in article 1. 43 of this law.


Article 115 the provisions in force concerning the leadership of the Socialist units have their own rules will change according to the provisions of this law and taking into account the specifics of their activity.
The design institutes and centres will be working people councils and their executive offices.
The number of members of the people's councils working in design institutes and centres shall be determined according to the provisions of art. 99 of this law.


Article 116 law No. 11 of 21 October 1971 concerning the Organization and leadership of the Socialist state establishments, Decree nr. 435 of 6 august 1973 for modifying the Decree nr. 162/73 laying down uniform structure for economic units, become law. 68/73, Council of State Decree No. 154 of 7 June 1976 concerning the change of some organs of the collective leadership of the Socialist state establishments, chapter II of Decision C.C. of the Communist Party and the Council of Ministers No. 2097 on 24 September 1968 in respect of the scientific councils of the research institutes, as well as any other provisions contrary to this law are hereby repealed.

e) organizes study and elaboration of projects or proposals for improvement of production and organization of work, which ensure: enhancing the use of areas of the undertaking; rational location of sections, workshops, equipment and work places; optimize manufacturing flow; the introduction of modern methods of programming, launching and tracking of production; judicious use of production capacities; the rational organization of work shifts; optimization of manufacture; the use of computers in the management of production processes; the rational organization of maintenance activities, repair and transport;
  

f) analyse and make proposals for improving the organizational structure of the enterprise, on the basis of uniform rules on the structure, near-production management, reducing the number of hierarchical levels, the establishment of precise duties and responsibilities for each bucket work, efficient information system and framework of relationships within the unit; the introduction of modern methods of management at all levels;
  

g) check how are complied with and apply uniform structure, rules and norms for all categories of staff and inform the Council of working people over the established deficiencies;
  

h) initiates the action for jobs, workshops or sections; seeks and supports the implementation of measures;
  

I) attend the elaboration and application of the rules of scientific fundamental work in all areas of activity, aiming at ensuring consistency between them, the degree of Government Emergency Ordinance Nr.77/2009 technique and the level of organization of production and labour in the undertaking;
  

j) debate of the thematic plans of studies and prospect on issues of organization, as well as program development and review of the rules and norms of labor and working people they submit to the Council for approval;
  

k) seeks to mobilize action and initiates work collectives at the implementation of the measures laid down for the rational organization of workplaces, including labor and productive use of your time and complete the work of all categories of staff;

The Commission for the quality of production and economic efficiency the Commission for production quality and economic efficiency operates on the basis of the work programme approved by the Council of working people and has the following main tasks: to analyse and periodically) seeks quality level of production; propose measures to improve the quality of products and services, capitalizing on the upper part of raw materials, fuels and energy;
  

b) participate in designing programs to improve the quality of raw materials, semi-finished products, finished products and submit them for approval by the governing body; pursues them;
  

c) analyzes and tracks how the heads of Department leaders, workshops, and other rulers of working to fulfil their obligations to ensure the conditions necessary for material and technical quality of the products, the production process according to the manufacturing technologies and control; inform the task force leadership unity over the established deficiencies;
  

d) puts into discussion groups of working people from sections, workshops and job causes deviations from the norms of quality, technological discipline and take action together with the leaders, the heads of workshops and wards for their elimination;
  

e) shall ensure that the quality control of products and services to be performed and the workers who run them, leaders and other leaders of the production process; organises debates relating to the development and improvement of the qualitative parameters of products and services;
  

f) propose measures for the improvement of technological control programmes in line with technical progress, with the quality and efficiency of economic growth; organise exchanges of experience, roundtables, symposia with a view to highlighting existing reserves to increase economic efficiency and product quality;
  


g) analyse and inform the leadership of the unit on how staff performs his duties to technical product quality control on all stages of manufacture; adherence to technological programmes for the control of quality of products, the existence of insurance, with measure and control; propose measures to ensure the necessary technical assistance to production process on each Exchange;

l) initiates actions to raise teams for raising the quality of production, improving manufacturing technologies and increasing economic efficiency of all activities;
  

m) examines periodically all activity undertaken in the enterprise in order to ensure product quality and increasing economic efficiency in sections, workshops and jobs; collective management body shall inform on the results and propose improvement measures;
  

n) any other duties set out meets the regulations and those established by the working people.
  

The Committee on development, investment and technical progress Committee for development, investment and technical progress operates on the basis of the work programme approved by the Council of working people and has the following main tasks: to elaborate studies on increasing) the efficiency of investments and examines the possibilities of use of existing production capacities to minimise areas constructed, achieve technological flows corresponding to the requirements of efficiency in the operation of the objectives set out in the plan;
  

b) analyzes and seeks how to meet deadlines for commissioning and to achieve the projected parameters to new investment objectives;
  

c) supports in terms of technical and technological realization of economic and technical indicators for new production capacity;
  

d) participate in designing programs for the introduction of technical progress, the rational use of fuel and energy, the uptake of new products; debate programs developed and you submit to the Council the working people; organize activities for the mobilization of work collectives, the implementation of measures contained in programmes approved;
  

e) participate in analysing and advising on economic and technical documentation thanks to include technical solutions enabling an efficient as well as higher;
  

f) periodically and inform the governing body over the collective tasks of assimilation of new products and equipment, introduction of new technological processes and improving existing ones, mechanization and automation of production and reduction of specific consumption;

Commission for the supply, sales, and import-export formats for sourcing, and export-import carries out its activity on the basis of the work programme approved by the Council of working people and has the following main tasks: (a) to mobilize actions) organises the work collectives in judicious management of raw materials from the land and from import, reducing imports by use of internal resources, the expansion of inlocuitorilor of raw materials and materials reusable material resources, harnessing, use and movement of packages;
  

b) examines and proposes measures for optimizing supply-activities, operational control of the shipments and deliveries, improving relationships with suppliers and customers;
  

c) supports the work of redistributing stockpiles of raw materials, fuels and those with slow motion and preintimpinare formation of stocks of finished products, without moving, slow-moving or supranormative;
  

d) heightens the debate on issues related to improving the supply of raw materials, fuels and energy, tools, devices and production sections, checkers and other required workshops and workplaces to quality conditions;
  

e) analyzes and proposes measures for the improvement and rationalisation of inland freight, handling, packaging, storage, loading-unloading to ensure rational use of the premises for the storage, movement and expansion of pachetizarii, paletizarii and containerizarii;
  

f) participate in the establishment of production assortment structure corresponding to market requirements;
  

g) check how Load Balancing balances and, if necessary, make proposals for the loading capacity for ensuring resources approved by scales;
  

h) examines the special problems of material and technical supply from domestic production and from imports and proposes appropriate measures for ensuring timely production, with necessary technical base;
  

I participate in drafting proposals) regarding the actions of cooperation and forms of external marketing;
  

j) mobilize heightens for achieving export plan rhythmic approved under the terms of the required quality and with maximum efficiency;
  

k) check how it organizes the export production to adapt market requirements;
  

l) check how contractual obligations are fulfilled, the export consignments, preparation and leadership over the established deficiencies in personnel activity;
  

m) meets any other duties stipulated by law and those in charge of the Council of the working people.
  

The Commission for the proper management and defense of public property, the Commission for the proper management and defense of public property operates on the basis of the work programme approved by the Council of working people and has the following main tasks: (a)) controls how how are maintained and repaired cars, equipment, facilities and other fixed assets, if their operation is done in accordance with the provisions of the technical regulations and the instructions of specific work and propose measures to eliminate the irregularities observed;
