In order to agree the Law on retribution with the program of increasing the standard of living adopted by the National Conference of the Party of December 1977, with the decisions of the plenary of the Central Committee of the Romanian Communist Party of March 1978, as well as and with the whole complex of measures relating to the improvement of economic and financial management and planning, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Article 1 Law no. 57 57 of 29 October 1974 is amended and supplemented as follows: 1. At the preamble, after paragraph 3, two new paragraphs are inserted, with the following contents: " Within the working-class self-management, the strengthening and widening of economic and financial self-management, the working staff in economic units are entitled, apart from retribution, to participate in the benefits made by the enterprise in which they conduct business. The system of retribution, including the participation in benefits of working people, ensures the direct, direct binding of the incomes of each of the contribution made and the concrete results obtained in work ". 2. Art. 1 shall read as follows: "" Art. 1. -(1) In the Socialist Republic of Romania, work is an honorary duty for all members of society. The right to work is a fundamental right of all citizens, guaranteed by the Constitution. Every citizen has the right and the duty to carry out a useful activity to society, which will provide him with the means of existence and spiritual development. Labour is the fundamental criterion of appreciation of the contribution of each person to the progress of society, a necessity for the formation, affirmation and multilateral development of the human personality. (2) Man's exploitation of man, the realization of income by appropriating the work of others are completely forbidden. No one can be repaid if they do not perform a socially necessary work and can only achieve income other than legal ones. Evading from work, parasitic living, making gains on other ways than through own work contravene the principles of ethics and equity, are incompatible with the very essence and goals of socialist society. (3) The working people, as owners of the means of production, goods of all the people, and, at the same time, of producers and beneficiaries of material and spiritual values, bear the full responsibility for direct and effective of each economic unit, for the judicious and efficient management of the goods entrusted to them for administration. Each enterprise has an obligation to obtain benefits from which to ensure its own development, contribute a certain share to the overall development of society and create the resources necessary to ensure the benefits of people work and cover expenses for meeting social-cultural needs within the general program of increasing the standard of living established by the party and the state. " 3. Art. 2 shall read as follows: "" Art. 2. -(1) National income, as a new value created in the industry, in agriculture and other branches, represents the source of the economic and social development of the country and the raising of the welfare of all National income is distributed for the economic and social development fund and for the consumer fund, in order to provide the necessary means for the intensive development of the production forces and for the continuous growth of income of working people (2) The Consumer Fund, which represents the share of the national income earmarked for the individual income earned by the members of the company on the basis of the work performed, as well as to cover the expenses that the company makes the needs of the entire population, lies with working people and their family members in the following ways a) retribution by quantity, quality and social importance of work, depending on the contribution to the development of material and spiritual production of the society; b) participation in the benefits, in relation to the contribution of each to the development of the respective enterprise and to the seniority c) social retribution enjoyed by working people from funds for education of all grades, health care, pensions, state child benefits, family aid, disability benefits, expenses for sending to spa treatment and rest, maintenance of nurseries, kindergartens, non-family homes, canteens, housing, as well as other social-cultural needs ". 4. Art. 3 shall read as follows: "" Art. 3. --(1) Retribution is based on the socialist principle of distribution by quantity, quality and social importance of work, depending on the contribution to the development of material and spiritual production of the whole society and the results obtained at work. (2) Retribution of work must ensure the material co-interest of those who work and the fair distribution of income from work. (3) The retribution fund shall be determined according to the value of net production, physical production or other specific tasks and shall be granted according to the socialist principles of retribution. In the total retribution fund at the level of the national economy, the fund related to the benefits of working people is also included. Retribution includes tariff retribution, allowances, prizes, bonuses and other rights provided by law for the work performed. (4) In order to ensure the continuous growth of the standard of living of working people, the retribution of all categories of personnel shall be increased periodically, in accordance with the provisions of the single national economic and social development plan of the country and corresponding to the increase in social work productivity and national income " 5. Art. 6 para. ((1) shall be completed at the first position and a new position and paragraph (2) shall be added as follows: "-realization and exceeding of physical production, of the net production value; -carrying out specific work tasks. (2) In determining the share of participation in benefits the council of working people will consider: a) the contribution of the working staff to the realization of the planned benefit and the obtaining of benefits b) tariff retribution; c) seniority in the establishment. " 6. Article 7, letter c) shall be completed with the following provisions: "-the granting of additions to retribution for exceeding physical production, the value of net production; -participation in the benefit obtained by the unit in which it operates; -the granting of rights from the social fund of the enterprise, the assignment of housing from the housing space under its administration, the participation in collective trips abroad, organized by the economic unit on the basis of realization and overtaking export ". 7. In art. 9 9, point c) is amended and added. c ^ 1), lit. c ^ 2) and a new paragraph (2), as follows: " c) the participation in benefits of working people in economic units; c ^ 1) annual awards for staff from state institutions and other units established by law; c ^ 2) prizes awarded during the year for outstanding achievements in the performance of tasks during that period, prizes for savings of materials and labor, as well as other limited rewards that are given to the staff of some sectors of activity for outstanding results achieved in the performance of certain specific objectives. (2) The tariff remuneration, as well as other income due, according to the law, to persons who work in the state socialist units are effective and are not subject to tax. The tax on the total retribution fund is borne by the socialist units. " 8. Article 10 shall be completed with a new paragraph (3), with the following contents: " (3) The Council of Labour men of each unit shall bear the full responsibility for the implementation of the socialist principles of retribution, for the management and use of funds intended for both production and production expenses. of consumption ". 9. Article 12 shall read as follows: "" Art. 12. -(1) The retribution forms are as follows: a) in agreement or by piece, when due retribution results from the multiplication of the tariff on the product unit or on the work with the number of products or works carried out. Depending on the concrete conditions of organization of work and the interest of stronger stimulation of quantitative or qualitative sides of the activity, the following variants of the agreement can be applied: -direct agreement, when the retribution made by the workers, established on the basis of tariffs on the product unit or on the work, is directly proportional to the quantity of products, works or other physical units executed; this form of retribution applies in the industry in relation to the number of pieces, meters, tons executed; in construction, in relation to the number of mc masonry, sqm carpentry, plasters; in agriculture, in relation to the number of hectares worked or animals cared for; in transport, in relation to goods-goods transported, as well as in other branches and activities where the measurement of work is can make individual on the basis of rules; -global agreement, when a working band, lot, site, farm assumes on the basis of a contract concluded with the unit of which it belongs, the obligation of execution within a certain period of a complete product, a physical object or a production established in physical units, for which it receives a global amount determined in relation to the workmanship required for the performance of the tasks provided for in The global agreement applies where the characteristics of the technological process require the collective team participation of working people in the realization of production tasks and where by technical-organizational measures specific to this form of retribution ensure greater labour productivity. In the industry it is applied for the realization of a complete product or work, in which one or more teams participate, or for obtaining a certain physical production; in construction it applies to the realization of a block of housing, industrial hall, bridge, electric line or other complete objects; in agriculture, for the realization of a certain production of cereals, meat, milk, vegetables or others. The contract includes the execution deadlines, the amounts due as retribution, the planned production expenses or the normal consumptions and other conditions. Due consideration shall be given in proportion to the performance of the production tasks, the observance of the expenditure, the time limits and the other conditions set out in the contract, without being capped. The implementation of the global agreement, the establishment of the due amounts, the granting of advances and the restitution of guarantees, as well as other necessary elements, shall be established-by branches of the national economy-by decree of the State Council. In the global agreement can work all categories of personnel of the subunit-section, workshop, site, lot and similar ones-, including its management frameworks. The foreman included in the global agreement band will receive the retribution in the same proportion as the average fulfillment of the tariff retribution of the workers in the led band, corresponding to the time worked within the approved working hours. The addition of the global agreement to the foremen is paid if the contracted production was carried out and the normal consumptions were observed. Engineers, subengineers and technicians who work in global agreement and lead working bands organized at the foreman level will receive the retribution of the position they are assigned in the same proportion as the average degree of retribution Pricing of the workers in the led band, corresponding to the time worked within the approved working hours The addition of the global agreement is paid if the contracted production has been achieved and the normal consumptions have been observed. The specialist and management staff, up to the level of a subunit, included in the global agreement band, will receive the retribution within the total retribution fund provided for in the contract for this staff, recalculated in relation to the degree of realization of the work or the contracted production. The amounts corresponding to the works executed monthly are paid in the form of an advance, from which a guarantee of 10-20 percent is retained. The payment of the withheld amounts is made at the end of the works, if the conditions and deadlines agreed in the contract have In case of non-compliance with the expenses, failure to meet other conditions stipulated in the contract, the addition of the agreement will be possible to reduce until cancellation, corresponding to the liability of each member of the band; -indirect agreement, when the staff directly serving several paid workers in the agreement-whose achievements are conditioned by the way they are served-receives the retribution in proportion to the average level of fulfilment of the norms carried out by those workers; -progressive agreement, according to which at a certain level of accomplishment of the pre-established tasks, the tariff per unit of product or per work is increased in certain proportions and which can be applied, exceptionally, in workplaces and in the conditions established by law; b) in directing or after time, when the tariff retribution established per hour, day or month is granted to the staff for the time actually worked on the full realization of the duties of service: -in workers, the duties of service shall be expressed either in the form of a daily or monthly production procedure, either in the form of concrete duties established on a specified service area, or in other forms specific to the branch, or work in which they work; -for technical, economic, other specialized, administrative, service and guard personnel, service tasks, duties and responsibilities shall be established concretely for each job and for each executor. The number of workers in this category of personnel must be determined on the basis of a scientific foundation, by normative and labor norms approved under the conditions established by law; c) the form of retribution on the basis of tariffs or percentage shares of the value of purchases, debauctions or service supplies, when the due income is calculated similar to the direct agreement, in proportion to the level of achievement of the tasks established for each worker. Tariffs and percentage rates are determined in correlation with the tariff retribution of personnel with similar duties and responsibilities; in overcoming or unrealising the tasks the income is, as in the case of retribution in the agreement, directly proportional to the level carrying out tasks. (2) In order to increase the efficiency of the activity both in the case of retribution in direct agreement and in directing, due retribution on the basis of quantitative indicators may increase or decrease depending on the fulfilment of 1-2 additional indicators, specific to that activity '. 10. Article 16 shall read as follows: "" Art. 16. -(1) The tariff remuneration of the workers shall be differentiated, for each category or function, on a basic level and two steps of retribution. (2) Through the retribution steps, within the framework category, the tariff retribution shall be differentiated according to the personal qualities of the workers, reflected in the results obtained in the work. (3) At the last qualification category, the workers with a high qualification, initiative, experience and seniority in the profession, who perform works of special and high precision technicality, provided in the last category of the signs Qualification pricing. (4) The number of workers who may be assigned to the latter category shall be 5-8% of the total number of skilled workers in that branch. Differentiation by branches within these limits and framing conditions shall be established by decree of the Council of State. " 11. Art. 17 para. (5) will have the following contents: " (5) Workers who qualify for other trades may be assigned, after completing the qualification courses, up to the category and stage they had, on the basis of practical test and verification of knowledge by the technical commission of framing and promotion of Workers. Art. 18 will have the following contents: "" Art. 18. -(1) The tariff networks shall be established by branches, subheadings or activities within the economy. (. The tariff remuneration shall be differentiated, in some branches or activities, on several levels of retribution, in relation to: a) complexity of the technological process b) the degree of technical endowment; c) the importance of the branch, subbramure or enterprise for the development of national economy d) the form of retribution used, in agreement or in directing. (7) The passing of the foremen to the upper gradations is made once a year, for no more than 40% of their total number, in compliance with the conditions of seniority provided by Law no. 12/1971 and the present law. " 15. Art. 24 will have the following contents: "" Art 24. -(1) The tariff remuneration of the technical, economic, other specialized, administrative, service and security personnel of all branches, subdivisions and economic and social activities shall be established on 41 classes of retribution. Article 29 (3) shall read as follows: " (3) The failure to organize units, with or without legal personality, shall be made, on the basis of the criteria provided in par. (2), at its establishment, by decree of the State Council. The change in the organization of the units will be possible-where appropriate-with the approval of the national single economic-social development plan. " 19. Art. 30 para. ((2) and (4) shall read as follows: " (2) The minimum allowance shall be granted to the management positions provided for by the allowance, and to the promotion of the staff, who has held such positions, in immediate senior management positions, a higher allowance shall be established by 5 to hundred than the previous one. The driving allowance can be gradually increased, between the limits provided by law, taking into account the personal qualities and seniority in the management positions of each. Allowances may be granted to the maximum limit representing more than 90 percent of the highest allowance to no more than 25 percent of the number of frames with the same functions or equivalent functions, calculated separately on total subordinate units and separately for the apparatus of ministries, other central bodies and county folk councils and the city of Bucharest. The driving allowance shall not be part of the tariff retribution, but shall be included in the calculation of the average retribution. ' " (4) The tariff remuneration of the management functions of the compartments and subunits within the units-head of service, head of production department, head office, workshop head and their equivalent functions-shall be established on a basic level and 6-7 gradations. The transition into the last gradation-the 6th or 7th gradation, the case dapa -will be done exceptionally, with the confirmation of the superior hierarchical organ of the unit. The minimum age of 2 years for the transition from the basic level to gradation 1 and 3 years for the transition from a lower to the immediate upper gradation can be reduced, for those who meet the conditions provided by law, with no more than 1/3, and the total reduction of the minimum age required for the transition to the last gradation within the same function may not exceed 1/5, according to Law no. 12/1971 . (2) ^ 1 The number of staff assigned to the last gradation shall not exceed 5-8% of the total staff assigned to the gradations within each unit. Differentiation on ministries or other central organs of the 5-8% percentage is made by the single national economic-social development plan. (2) ^ 2 In the case of units with limited number of personnel classified on gradations, to which by application of the provisions of par. ((2) results, annually, a number of less than 1 for the granting of gradations 5, 6 and 7, that percentage will be whole in the following years with the percentage related to those years, up to the level to ensure the possibility of passing into such a gradation. (2) ^ 3 The issuance of the gradations on Monday, as well as the corresponding funds, shall be established annually on ministries, other central bodies and county folk councils and the city of Bucharest, through the single national development plan economic-social ". 23. Art. 34 para. (1) will have the following contents: "" Art. 34. -(1) The promotion of personnel, in the positions of principal engineer, principal economist, principal technician, principal accountant, principal official and others equivalent, shall be made under the conditions provided by law. " 24. In art. 35 lit. b), after "foremen" will be added "operative personnel", and at lit. c), after "higher education" will be added "or by subengineers" and after "workers" will be added "operative personnel". 25. Art. 39 shall read as follows: "" Art. 39. -For each person, regardless of the position he holds in an enterprise, industrial plant, ministry, other economic units or institutions, taking into account the role of which he returns to his job or the position entrusted, the precise service tasks, the fulfilment of which is compulsory. Full tariff retribution-and, as the case may be, the driving allowance-shall be granted according to the performance of all the tasks entrusted, both of those arising from the plan of the unit or of the compartment in which that person works, as and his own work tasks. Within these indicators, the value of net production expressed according to the specificity of each branch, as well as physical production, will necessarily be introduced. At establishments having export plan tasks or receipts from international service benefits, one of the indicators on which the award of retribution is conditional will be the achievement of these tasks. (2) For the maisters, the technical, economic and other technical execution personnel, including the management, repaid in directing, from the wards, workshops, laboratories or other basic or auxiliary production subunits, the tariff retribution shall be granted depending on the achievement of their own work tasks, as well as in relation to the achievement of 2 to 4 plan indicators established at the level of the subunit or working group to which they belong or, where this is not possible, to the level of the section or the whole (3) For technical, economic and other technical personnel, including management, functional compartments, repaid in directing, the granting of tariff retribution shall be subject to the performance of own work tasks, the function performed. (4) The heads of the units are obliged to establish for each compartment and for each individual service tasks, in such a way as to ensure the proper measurement of work, rational use and balanced distribution of the tasks for all staff, with a view to repaying each person in relation to the actual work done. " 27. Art. 42 shall read as follows: "" Art. 42. -Retribution of the staff provided in art. 40 and 41 shall be appropriately dimunsed in the event of failure to perform their own work duties. " 28. Art. 44 shall read as follows: "" Art. 44. -(1) In case of exceeding the indicators or tasks provided for the staff paid after the time worked, the size of the addition of the tariff retribution in the economic units shall be: a) to the workers, 1% of the tariff retribution for each percentage exceeding the established work tasks; b) to the staff in the management of the unit, as well as to the foremen, technical, economic and other technical execution personnel and management personnel from the production subunits, 2% of the tariff retribution and, as the case may be, from the allowance of driving, for each percentage of exceeding the established indicators, take together. With the same percentages, the tariff retribution shall be reduced and, where applicable, the staff management allowance, in the event of the failure of the indicators or the tasks provided for. ((2) The increase or decrease of retribution, in relation to the fulfilment of the plan indicators, for the staff in the management of the economic units, for the foremen, the technical, economic and other technical execution personnel and the management personnel of the subunits of production, provided for in art. 41 41 para. ((1) and (2), shall be calculated at the end of each quarter. The amounts corresponding to the quarterly decreases in the whole of the indicators, resulting from the compensation with the additions calculated for the previous quarters, shall be retained in a staggered manner from due retribution over the next three months. The amounts corresponding to the addition due for exceeding the plan indicators shall be paid under the conditions provided in par. ((6). (3) The maximum adaos that can be established for exceeding the tasks arising from the plan of the unit or compartment in which they work, as well as the maximum reduction that can be applied in case of non-realization of these tasks, are 20% of the retribution due tariff for the time worked and, as the case may be, and from the driving allowance. (4) In the recovery of the non-realization, the amount with which the retribution has been reduced may be partially or totally restored depending on the effects of this failure and the duration of recovery. (5) In the case of indicators recoverable from previous periods, the addition to the tariff retribution for exceeding the plan tasks shall be determined only for the remaining excess after the compensation of the non-realisations. (6) At the end of the year, in relation to the level of fulfilment for the entire year of the indicators, the addition due or the corresponding reduction of the retribution for the staff provided in art. 41 41 para. ((1) and (2), making regularisation compared to the amounts retained during the year. The addition or annual reduction, as a whole of the established indicators, may not exceed the level of a monthly tariff retribution, including the driving allowance, where applicable. (7) For workers repaid in directing, the increase or reduction of the tariff retribution is made monthly, in relation to the degree of achievement of the established work tasks. " 29. Art. 45 shall read as follows: "" Art. 45 45-(1) In case of non-realization of the service tasks established for the workers and the other personnel, the individual decreases shall be established by the executive office of the council of the working people of the unit, taking into account the effects these non-achievements on the activity of the unit, as well as the degree of responsibility for each member of the labor collective, corresponding to the function performed. For the staff in the management of the unit, the reduction of the tariff retribution for the non-performance of their own work tasks shall be determined by the (2) If the non-performance of some of the tasks of the technical, economic or other technical personnel directly influenced the non-realization of other company plan indicators, the decreases applied to persons in the cause will be at least equal, in percentage, with those applied to the management of the unit for these non- ((3) The deductions applied to all categories of personnel for the non-performance of their own work tasks may reach up to 1/3 of the tariff retribution and the driving allowance, as the case may be, regardless of the function. Art. 46 shall read as follows: "" Art. 46. -(1) The amount due in accordance with the provisions of art. 12, 41, 42, and 43 technical, economic, other specialized, administrative, security and service personnel shall be provided from the retribution fund planned to the units for the retribution of these personnel, recalculated according to the regulations Legal. (2) It is prohibited to use the retribution fund for workers and foremen for the retribution of technical, economic, other specialized, administrative, service and security personnel. ((3) The way of determining the indicators according to which the tariff retribution is granted, the percentages of increase or decrease of retribution, in relation to the realization of these indicators, the proportion of the refund of the amounts with which it was reduced retribution to the recovery of non-realisations, as well as the criteria for determining the overtaking of the indicators that entitle to increase the retribution, are approved by decree of the State Council. In the same way, indicators or plan tasks will also be possible for some activities or units, to which the indicators and tasks nominated in the law are not applicable. " 31. Article 47 shall read as follows: "" Art. 47. -In the case of plan indicators the achievement of which is followed for periods of more than one quarter, monthly deductions of 5-20% of the tariff retribution and the driving allowance will be made, which shall be returned after the end of the period, in relation to the degree of achievement of the plan indicators ". 32. In art. 48 48 para. (2) the letter i) shall be added and paragraph 2. ((3) is amended as follows: "i) special weather conditions-fog, frost on the runway-which make it impossible to carry out flight schedules." "" (3) The heads of the units which, with all the measures taken, cannot ensure the normal functioning of the production process-due to the lack of raw materials, due to technological failures or other causes-are obliged to retain in the activity of base only the strictly necessary staff and assign the staff available to other activities or other units, in order to create the conditions for working people to use their work time in full. This staff has the obligation, in accordance with the provisions of the Labor Code, to perform the tasks entrusted to it, to be repaid by the units to which it operates, under the conditions provided by law. Until the distribution to other activities or other units, this staff will be able to receive 75% of the tariff retribution, for a period not exceeding 30 days, if during this time it remained at the disposal of the unit. " 33. Art. 49 para. (1) will have the following contents: "" Art. 49. -(1) For the management and execution personnel from the institutions financed from the state budget, including that from the apparatus of ministries, other central bodies and the county and county councils of Bucharest, granting the tariff fee and the driving allowance, as the case may be, shall be subject to the performance of the own work tasks, corresponding to the function performed, arising from the single national economic and social development plan or other acts normative, as well as from work plans and organization and functioning regulations. " 34. After art. 49 a new title "D1 PARTICIPATION IN BENEFITS OF WORKING PEOPLE" is introduced, and art. 50-57 will have the following contents: "" Art. 50. --(1) The benefit synthetically expresses the result of economic activity, the management of funds, the reduction of material expenses and the increase in labor productivity, characterizing the efficiency of the work of the economic units, the spirit of responsibility with which they use the funds entrusted by the company. (2) In relation to the results obtained, the workers, technicians, engineers, economists and other categories of worker personnel from economic units benefit annually from direct money and other material rights originating from benefits achieved. (3) The amounts due individually in the form of participation in benefits shall be established by the council of working people, under the conditions provided by law and shall not be capped. Article 51. -(1) The Fund for the participation of working people on benefits shall be constituted annually, at the disposal of the unit, on the basis of the economic results of the previous year, a) a share of the benefit made under the plan provisions, up to 3% on average on the economy. The share of the ministries, the other central bodies and the county and county councils of Bucharest is differentiated by the single national economic and social development plan; b) a share of up to 25% of the benefits over the plan obtained by reducing the material expenses and other production expenses; c) a share of up to 14% of the benefits over the plan obtained by exceeding the value of net production, as a result of exceeding physical production; d) a share of up to 8% of the benefits over the plan obtained in other ways, but not more than the quota established for the respective unit for participation in the planned benefit; e) a quota of up to 10% of the benefit over the plan obtained by the producer unit, in proportion to the excess of export, within the limit of 1,5% of the value of the exported export. The quotas for the establishment of the participation fund in relation to the value of the export over the plan shall be established by the single national plan of economic and social development, differentiated by the ministries, the other central bodies and the county folk councils and the city of Bucharest, as well as on relationships. (2) The breakdown by units of the allowances for the establishment of the participation fund for the benefit made under the plan provisions, as well as the establishment of the allowances from the benefits over the plan, shall be made, with the approval of the annual plan of the unit, by ministries, the other central bodies and the county folk councils and the city of Bucharest. (3) The producer units that exceed the export also benefit from funds in foreign currency within 2% of the foreign currency made over the plan, in order to organize collective trips abroad. The value in lei of the respective currency is borne from the fund of participation in benefits, made available to the enterprise, or partially or in full, by the beneficiaries of the trip. Foreign exchange funds for collective trips abroad are distributed directly to enterprises, within the framework of a quota from the total foreign exchange fund established by the single national economic and social development plan for tourism. Funds allocated to businesses can only be used for their working staff. Article 52. -(1) The Fund for the participation of the working people on benefits shall be granted in full on condition that the net production value is fulfilled, expressed according to the specificity of each branch, as well as the In the event of their failure, the participation fund shall be reduced by 1% for each percentage of non-realisation of the plan to each of these indicators, but not by more than 25% in total. (2) At the economic units to which, due to the specificity, no indicators related to the value of net production or physical production are planned, the national economic and social development plan will establish the indicators that reflect the basic activity according to which the full constitution of the fund for participation in benefits is conditional. Article 53. -For economic units organized at the factory level, exploitation or other similar units that have organization similar to that of enterprises, including production farms, agricultural mechanization departments, as well as for sub-units which process or industrialise plant or animal agricultural products from state agricultural establishments, the benefit-participation fund shall be granted independently of the results obtained on the whole of the establishment to which they belong, if they are highlight and separate the results of their own economic activity, respectively separate accounting. Article 54. -The Fund for participation in benefits shall be distributed by the general assembly of working people, in relation to the contribution made to the development of the unit and the seniority in the unit, a) at least 85% for the entire working staff of the establishment. In order to ensure the differentiation of the income of the working people in relation to the contribution made by a long activity in the undertaking, the individual amount of participation in the benefits shall be determined in relation to the tariff retribution, plus the old age and the driving allowance, where appropriate, corresponding to the time it was paid by the establishment; b) up to 5% for the greater stimulation of the distinguished staff with the title of leader in the competition and of the other working people who have made a special contribution to obtaining benefits over the plan. The amounts granted in this way are added to those due to the persons concerned, of the 85% share; c) up to 5% to cover the cost of collective excursions organized from funds in allocated currency, for persons who have made a special contribution to the realization and exceeding of export tasks; d) up to 5% to complete the fund for social actions. Article 55. -The Council of Labor People may reduce or not give the share of participation to the benefits of persons who, during the year, had deficiencies in their activity or committed disciplinary violations. The persons to whom, during the year, their employment contract was opened on their initiative-resignation-and those whose employment contract was opened by the unit on the basis of the provisions of art. 130 lit. i), j), k) and l) of the Labor Code, do not benefit from the share of participation in benefits for the year. Article 56. -The regulations regarding the participation of working people in benefits, contained in art. 50-55, is applied in industry, construction, agriculture, transport, scientific research, design and technological engineering, movement of goods and other branches of the national economy, according to the law. Article 57. -The working staff of the mining units and other units established by law shall benefit from annual awards, from a fund established according to the value of net production and the physical production carried out, as well as the intended benefit. The size of the quotas and the conditions for the establishment of the prize fund, as well as the distribution of the annual prizes, shall be established by decree of the State Council ". 35. After the title "E. Premial System", point 1 is amended and becomes: 1. Annual Awards ". 36. Art. 58 shall read as follows: "" Art. 58. -(1) The working staff in the apparatus of economic ministries and other central bodies coordinating the activity of certain economic branches shall benefit from annual awards. The annual prize pool is determined according to the results obtained by the totality of the economic units in subordination, based on a quota, established according to the provisions of art. 51 51 para. ((1) lit. a), for the net benefit made within the framework provisions of the central ministry or body. In case of overtaking the planned net benefit, the prize pool shall be increased by the same proportion as the fund for the participation of the working people on benefits for the whole of the subordinate economic units has increased, on average. The prize pool is granted in compliance with the conditions provided in art. 52 and shall be allocated to the working staff in relation to the tariff retribution, plus the seniority increase and the driving allowance, as the case may be, corresponding to the time as paid by the unit. The collective management body, which approves the annual awards, will be able to use up to 5% of the award fund to boost staff who have made a particular contribution to exceeding the planned benefits by the units. subordinate. The reduction or cancellation of the prizes is made under the conditions provided in 55. The financial coverage of the annual awards corresponding to the benefits carried out under the plan shall be ensured within the limit of the fund provided for this purpose in the expenditure plans of these bodies, and the increase of the prizes are ensured from the benefits over the plan made on their entire activity, after covering the other destinations established by law. (2) The working staff in the apparatus of the other ministries and central bodies, the one in the own apparatus of the executive committees of the county folk councils and of the city of Bucharest, as well as the working staff financed from the state budget, benefit from annual prizes from a fund that is constituted within the limit of the planned retribution fund, by applying a 1.5% quota on the retribution fund made annually. The prizes shall be awarded by the collective management body, in proportion to the tariff retribution, plus the seniority increase and the driving allowance, as the case may be, corresponding to the time it was repaid by the unit. The reduction or cancellation of these awards is made under the conditions laid down in 55. (3) At the self-funded state institutions the annual prize fund constituted according to the provisions of par. ((2) may be completed with a share of up to 16% of the net own income realized above those planned, under the conditions provided by the regulations in force. The total annual prize pool, thus increased, will not exceed 3% of the annual retribution fund of these units. The collective management body shall allocate the annual prize pool from the net income over the plan, in a differentiated manner, to the staff who contributed to their achievement, taking into account the contribution of each to the results obtained. (4) The working staff from new units under construction, from canteens, as well as from other economic units with similar activity, which are established annually by the single national economic and social development plan, benefit from annual awards in the conditions laid down by the decree of the Council of State. (5) The annual individual award granted according to the provisions of par. ((1)-(4), art. 132, 141 or 169 will not be able to be more than 3 monthly tariff repayments. " 37. In art. 59 59 para. (1), after "separate for workers" will be added "and foremen". 38. Art. 61 shall read as follows: "" Art. 61. -The totality of prizes that can be awarded individually during the year for outstanding results will not be more than 3 monthly tariff retributions. " 39. Art. 64 para. (2) will become art. 61 ^ 1, with the following contents: "" Art. 61 61 ^ 1. -For outstanding achievements in the framework of export, import and payment service operations in foreign currency, which represent a higher currency contribution and determine the improvement of the recovery rate, the working staff in the units economic, as well as the one in the apparatus of ministries, other central bodies and county folk councils and the city of Bucharest, can be awarded during the year from a fund established by the single national plan ". 40. Point 4 "Export prizes" and art. 64 64 para. ((1) shall be repealed. 41. Art. 65 will have the following contents: "" Art. 65. -(1) The distribution of the fund of participation in the benefits, of the annual prize fund awarded in the budget units, the organization of trips abroad from the funds allocated in foreign currency, as well as the establishment of the following persons to participate in them, shall be approved by the council of the working people of that establishment. The individual awards that are awarded during the year are approved by the management of the unit, agreed with the union committee. For persons in the management of the unit, the approval is given in all these cases by the management of the superior hierarchical body, agreed with the corresponding union body. ((2) The personnel who are responsible for the production of fatal accidents or who have caused invalidity or damage to the machinery and installations that cause significant damage do not benefit from participation in benefits or prizes. ((3) The methods of breakdown by units of the participation rates of the fund to participate in the benefits that are carried out within the plan and over the plan, training and distribution of funds to be awarded in foreign currency, the modalities of establishment and distribution of funds for annual prizes at budget units and savings prizes, specific forms of award for savings, as well as other limited awards or rewards, which are given to staff in some sectors of activity for the achievement of certain objectives specific, are established by decree of the State Council ". 42. Art. 68 will have the following contents: "" Art. 68. -(1) Staff working in jobs where, with all measures taken, there continues to be special conditions, it is entitled to a retribution increase. The categories of jobs with special conditions to which the increase may be granted, the net amount, the criteria for differentiating it, as well as the maximum number of working staff to whom this increase may be granted, shall be established annually by the plan unique national economic and social development. (2) Staff working on places with heavy working conditions may benefit from a higher net tariff retribution by up to 10%. Units and workplaces, personnel categories, percentages to increase tariff retribution, as well as the maximum number of worker personnel who may receive increased tariff retribution, shall be established annually by the single national development plan. economic-social ". 43. Art. 69 shall read as follows: "" Art. 69. -Non-otheric personnel operating at works of geological prospections and explorations, hydrological studies and research, topography, in some new or developing petroleum units, or from other units with similar conditions and non-public personnel on construction-assembly sites, as well as personnel belonging to other units that are sent to perform assembly work, commissioning to the objectives of particular importance, may be granted an increase in Tariff retribution. The units, the net amount of this increase by category of personnel, as well as the maximum number of working personnel who can receive the site increase, shall be established annually by the single national economic-social development plan. " 44. After art. 75 a new title "F1 OTHER RIGHTS" and 4 new articles, art. 75 75 ^ 1, 75 ^ 2, 75 ^ 3 and 75 ^ 4, with the following contents: "" Art. 75 75 ^ 1. -In addition to direct income, obtained on the path of retribution, including participation in benefits, working staff also benefit from: paid annual rest leave, weekly rest, measures for the protection of work, reference to rest and treatment balneoclimateric, aid for children, aid for incapacity for work, pensions, some specific rights for those who work at jobs with special conditions, as well as other rights provided by law. Article 75 ^ 2. -(1) The working staff working on jobs at which, with all the measures taken, there continue to be special working conditions, may benefit from the following rights: a) advantages in retirement, under the conditions established by law, for the working staff working in jobs falling within the first and second groups in relation to working conditions, complexity, higher demand and importance of work; b) additional rest leave; c) the reduced duration of working time, without the decrease of retribution; d) protective equipment for the prevention of occupational accidents and illnesses; e) work equipment; f) hygienic-sanitary materials; g) special food in order to increase the body's resistance h) other rights provided by the regulations in force for certain branches of activity. (2) The conditions and jobs to which the rights provided in par. (1) shall be established by decree of the Council of State. Article 75 ^ 3. -Labour people benefit from the right to receive housing from the housing stock built by the units, as well as the right to build their personal property housing, with state support. The attribution of housing or the approval of the construction of personal property dwellings is made by the council of working people together with the union bodies, under the conditions Article 75 ^ 4. -For the contribution made to the export, the working staff of the manufacturing units will be able to benefit from the participation in collective trips abroad, organized by enterprises on the basis of the currency received in relation to the overtaking export, under the conditions provided by the regulations in force ". 45. After the articles covered by the title "Other rights", a new title "F2 CONSTITUTION AND USE OF FUNDS FOR SOCIAL ACTIONS AT THE DISPOSAL OF THE ENTERPRISE" is inserted, as well as a new article, 75 ^ 5, with the following contents: "" Art. 75 75 ^ 5. -(1) In order to create conditions for the direct resolution of social actions related to the satisfaction of the requirements of working people, economic units have at their disposal funds for social actions. (. The Fund for Social Action shall be made up of: a) procurement of the planned benefit within the limits of the amounts provided for by this destination, established for each action according to the rules and regulations in force; b) a share of up to 5% of the fund for participation in benefits, constituted on the basis of the results of the previous year, according to the distribution established by the general assembly of working people; c) the amounts representing the contribution due, according to the law, by the working staff for sending to spa treatment and the rest and maintenance of children in the crèches and kindergartens operating under the respective units. (3) The Fund for Social Action at the disposal of the enterprise shall be used, under the law, for a) expenses for spa treatment tickets and rest; b) expenses of directing and food for nurseries and kindergartens operating in addition to economic units; c) expenses of directing and other expenses for canteens; d) expenses for maintenance and repairs and other expenses at workers ' homes for youth; e) expenses for the maintenance and operation of medical dispensaries within the economic units; f) other expenses established according to the law (4) The Council of Labour People may approve, for the distinguished staff with the title of lead in the competition, to grant treatment and rest tickets with a reduction of 50% of the contribution due by the beneficiary. The number of tickets that can be granted under these conditions will be no more than 10% of the total number of tickets distributed through the union. These reductions in contributions shall be covered by the amounts allocated from the Fund to participate in benefits in order to supplement the Fund for social actions. (5) Economic enterprises, as well as plants, for their own activity shall draw up annually a revenue and expenditure plan for funds for social actions, which shall be an integral part of their revenue and expenditure budget. It is subject, by the council of working people, to debate and approval, to the general assembly of working people. ((6) The savings resulting annually in the social action expenditure plan shall be carried over to the following year by the same destination. If the planned social action fund does not cover the expenditure incurred during the year, the difference shall be borne directly from the financial results of the unit. (7) At the economic units to which the revenues from the sources provided in par. (2) does not fully cover the expenses for social actions provided by law, the necessary amounts shall be provided from the funds allocated with this destination from the state budget ". 46. Art. 77 lit. a) will have the following contents: "" a) achieving and exceeding the value of the net production, of the physical production plan in the established assortments "; 47. Art. 78 para. Art. 80 will have the following contents: "" Art. 80. -(1) In industrial units, among the indicators in relation to which the tariff retribution is granted for the personnel in the management of the unit, shall be established on a mandatory basis: a) net production value; b) physical production on assortments. ((2) At the units of the electricity branch, instead of the indicators referred to in paragraph 1, the tariff retribution shall be granted, at the power plants, in respect of compliance with the daily chart of power available to the national energy system and with the specific net consumption planned for the production of energy and conditional on the realization of the degree of continuity planned in the supply of electricity and heat consumers, and at the power grid enterprises, in report on the compliance with the rules of technological consumption for transport and the distribution of electricity and conditioning of the degree of continuity planned in the supply of electricity consumers ". 49. Art. 91 para. (4) the last sentence shall read as follows: "Workers who work on cars and aggregates towed or worn, for the execution of agricultural works, shall be retrieved with 2/3 of the payment tariff established for agricultural mechanics." In the global agreement, the volume and conditions of the sale or service provision are foreseen, the benefit to be realized, the expenses that are made as well as other conditions or mutual obligations. The amounts due as retribution shall be ensured after all obligations (including amortisation) have been paid to the commercial or tourism business under which it operates. " 65. Art. 109 para. (1) shall be repealed and paragraph 1. ((2) and (5) shall read as follows: " (2) The management and technical execution staff, economic and other specialty of the retail, wholesale, public and tourism establishments, as well as the commercial activity of the units that also have a plan of purchases, entries in the state fund and services are retrieved in agreement directly in proportion to the degree of fulfilment of the sales plan, hotel supplies or tourism. At the management and execution functions in the commercial and tourism establishments, retribution shall be increased or reduced by 1% of the tariff retribution for each percentage exceeding or unrealisation of the planned benefit, within the limit of 8% of the the tariff retribution corresponding to the time worked ". " (5) In the case of independent work-related causes, retribution shall be carried out below the guaranteed minimum, for the staff in the movement of goods repaid on the basis of quotas, with the draw added to the bill and in direct agreement proportionally, it will be possible to ensure for no more than 2 months a guaranteed minimum of 75% of the tariff retribution. If further conditions are not created to ensure the guaranteed minimum, the heads of the units are obliged to take measures for the redistribution of personnel within the unit or in other units. The difference between the amounts due in relation to the volume of activity and the guaranteed minimum granted will be recovered in the next periods of the rights achieved above the tariff retribution ". 66. Art. 110 para. (5) will have the following contents: " (5) Apart from the participation in benefits and prizes awarded during the year for outstanding achievements, according to the general regulations, the staff of foreign trade enterprises can still benefit from prizes for the conclusion of export-import and service provision operations, which present a high currency-financial efficiency for the national economy, according to art. 61 61 ^ 1 ". 67. Art. 111 para. (1) will have the following contents: "" Art. 111. --(1) The way of framing of operational workers, the conditions for the application of higher or lower tariff rates, as well as the duties of commercial workers and the retribution classes in which they fall, the units and the jobs to which the operative staff and the workers in the activity of indoor trade and tourism are retrieved in directing, the rolling steps, the categories of units, and the use of the position of head warehouse-worker manager-and to other economic units other than those in the movement of goods, shall be established by decree of the Stat ". 68 68. " (3) In the activity of scientific research, technological engineering and design will be used mainly the form of retribution in global agreement, according to which a collective of researchers or designers assume the responsibility to perform and complete a research or a project, within a certain period, for which it receives a global amount, established in the contract, under the conditions provided by law. This form of retribution will apply in particular to the creation and introduction of new technologies or products into production, the improvement and modernization of existing ones, the design of investment objectives and will encompass the entire cycle research-design and production application of the results obtained until reaching the established parameters. The contract includes the deadlines, parameters or technical-economic indicators to be obtained, the quality conditions, the total amounts for retribution and other conditions. The amounts on works for the retribution of staff from research, technological engineering and design will be established, based on labor norms on physical units, by categories of works. Staff working in global agreement receive, during the execution of works, monthly advances representing 80% of the tariff retribution. Cumulative advances may not be more than 80% of the amount set on the work. When teaching the objectives of scientific research, technological development and design, the total amount established on the work is assigned to the members of the collective according to their contribution. From the amount due to each one is retained a part of 10% that is returned after the application in production or the entry into operation of the respective objective and the realization of the technical-economic indicators provided in the projects or in the technical documentation, and the other part, of 90%, shall be paid after the advances received have been decreased in advance, if the conditions laid down in the contract have been met. ((4) In place of deductions on the project or objective of scientific research and technological development, which are made until the parameters are reached, a fixed amount may be retained for the establishment of a guarantee representing up to a monthly tariff retribution, but not less than 20% of it. (5) Staff in the management of scientific research units, technological engineering and design-director, deputy directors, scientific secretary-is obliged, according to the regulations in force, to actually conduct research activity or design, at least: 50% the director, 60% the deputy director-general and the scientific secretary of the central institutes, 75% deputy directors and the scientific secretary from the other scientific research units and the design. For this activity it can be repaid in global agreement. In this case it will receive the part of the retribution corresponding to the time for the driving activity, the driving allowance, as well as the amounts due in global agreement that are approved by the higher hierarchical body. " 70. Art. 113 shall read as follows: "" Art. 113. -Research, technological engineering and design staff can benefit from a reward of up to 2% of the postcalculated economic advantages, carried out by the beneficiary units following the application in practice of the research results and Design. These advantages are calculated, once, in the first year from the attainment of the parameters provided, in relation to the savings to the investment funds, to the production costs, as well as to the resulting savings by replacing the imports of products or licenses. The way of determining the economic advantages, the reward that can be given to the staff in research, technological engineering and design, within the prescribed limit, as well as the conditions in which they are assigned to the staff, are approved by decree of The State Council. " 71. Art. 114 shall read as follows: "" Art. 114. -The staff in the research, technological engineering and design activity benefit from the participation in the benefits of the unit in which they operate, under the conditions provided for the other economic units. Art. 187 shall read as follows: "" Art. 187. -(1) The remuneration of the members of the agricultural production cooperatives is differentiated in relation to the function they perform in the cooperative and the results obtained in the production, using as a unit of measure the norm of work. Retribution can be made in money or money and in nature. With the agreement of the county general directorate for agriculture and food industry, the general assembly, depending on the economic and social conditions specific to each cooperative, may approve that, by exception, for some crops or works carried out, the retribution to be made only in nature. (2) The global agreement is the main form of retribution used in agricultural production cooperatives. (7) In order to exceed the value of the planned net production on the cooperative agricultural specialists and chief accountants, repaid by the state, may receive from the production agricultural cooperatives an additional retribution-prize-which represents the additional remuneration due to the President: -80-90% for chief engineers; -70-80% for chief accountants. In order to exceed the farm's planned production, the state repaid agricultural specialists, who serve as head of farm, can receive from the agricultural production cooperative an additional retribution of up to 2% of the overtaking; This additional fee is not subject to the results achieved by the cooperative as a whole. (8) For the performance of the office of president, vice president of production, head of farm or head of brigade, cooperative members, who are not repaid by the state, receive a monthly allowance from the state, by: -420-520 lei-for the president; -210-260 lei-for other functions. (9) Agricultural production cooperatives shall provide their members with a guaranteed income subject to the production levels or the volume of works provided for in the undertaking. The guaranteed income is granted up to 80-90% of the part in monthly money and 50% of the rights due in kind, after the harvest of the respective product, the difference will be paid at the end of the year, corresponding to the level of fulfilment Plan. In case of unrealisation of the plan, due rights shall be reduced (10) The maximum income that a member of the agricultural production cooperative may receive, when carrying out the tasks of the plan, may not exceed that of similar functions or trades in state agricultural enterprises with the same volume of activity, in the same working conditions and with the same results. (11) Cooperative members operating in animal husbandry, vegetable farming, viticulture, fruit growing, skilled and working in agricultural cooperatives in driver trades, road tractor driver, locksmith, electrician and others, as well as those who perform leadership and execution positions, who work permanently throughout the year and carry out their tasks, are repaid by the cooperative and have unannounced seniority in the same unit and in the same sector of activity, benefit from a seniority increase of 2-8% calculated on Monthly retribution. (12) Cooperative members working in the intercooperative economic associations benefit from all the rights provided for in the Statute of the Agricultural Cooperative of Production. The retribution in the intercooperative economic associations is made only in money, in global agreement, on labor bands or individually, with tariffs on the product unit or at 1000 lei production obtained, according to the norms in force. " 108. IV Chapter VII the movement of goods, shall be established by decree of the Council of State, the provisions of the law being amended accordingly. + Article 5 The name "technological design" in the law is replaced by "technological engineering". + Article 6 The amendments and additions provided for in this Law shall enter into force on 1 January 1979. + Article 7 Law no. 57 57 of 29 October 1974 , with the amendments and additions made by this law, shall be republished, giving to the chapters, articles and other subdivisions a new numbering and updating the names.
