EXPLANATORY MEMORANDUM In order to ensure a uniform and improved regulation of civil defence, the Law on Civil Defence in the Socialist Republic of Romania was adopted. In order to better correspond to the content of the activities organized for the protection of the population and material goods, as well as to limit and liquidate the consequences of air attacks, natural disasters and catastrophes, actions to which participate all socialist organizations and citizens, in the law the name "civil defense" is used instead of the "local anti-aircraft defense". According to the provisions of the law, the organization of civil defense in the Socialist Republic of Romania is based on the conception of the Romanian Communist Party regarding the defense of the homeland, the revolutionary conquests of socialism, by the entire people. To this end, the obligations of all citizens, state bodies, socialist units and public organizations to participate in the implementation of civil defense measures were provided in accordance with the Constitution and laws of the country. In order to create the appropriate organizational framework for carrying out civil defense tasks that return to state and public bodies and organizations, all citizens of the homeland, in the law are regulated: the purpose, missions and organization of civil defense; protection of the population and material goods; limitation and liquidation of the consequences of the attacks in the air and the consequences produced by natural calamities and catastrophes; the duties of the ministries, the other central organs and the local government bodies on the application of defence measures Civilian. The law takes into account the concrete conditions and peculiarities of the territory of our country, the changes in the economic and social development of the counties, localities and socialist units, the development of the technical-material basis of to them, as well as the experience of civil defence. The provision of material and financial means, as well as other measures necessary to carry out the civil defence activity, are to be regulated by decree of the State Council. LEGE on civil defence in the Socialist Republic of Romania The civil defense is based on the conception of the Romanian Communist Party regarding the defense of the homeland, the revolutionary conquests of socialism, by the entire people. In accordance with the Constitution and laws of the country, all citizens, men and women, without distinction of nationality, have the obligation to actively participate in all actions aimed at ensuring the smooth conduct of economic and social activity, protection of citizens and material goods, in times of war and in other special situations. To this end, the entire population is called to participate in the implementation of civil defense measures, each citizen having the duty to fully acquire the necessary knowledge to be able to fulfill, under any conditions, the tasks I'm coming back to the civil defense In order to carry out civil defence measures, state bodies, socialist units, public organizations are obliged to ensure the protection of the population, the integrity of machinery and other material goods, as well as the normal conduct of the production process. In order to create the appropriate organizational framework for carrying out civil defense tasks that return to state and public bodies and organizations, all citizens of the homeland, The Great National Assembly of the Socialist Republic of Romania adopts this law: + Chapter 1 General provisions + Article 1 Civil defense, part of the national defense system, is based on the conception of the party and the state of defense of the homeland by the entire people. Civil defence must ensure the preparation of the population, territory and economy for the normal conduct of economic, political and social activities, as well as for the protection of citizens and material goods of any nature, in time of war and other special situations. + Article 2 All citizens of the homeland, men and women, regardless of nationality, have the obligation to prepare themselves in order to know the rules and measures of civil defense, to participate, in case of need, to carry out all actions for protection population and goods, to ensure the normal conduct of economic, political and social life. + Article 3 The civil defense measures are carried out in accordance with the other measures of preparation for the defense of the country, according to the decisions of the Defense Council of the Socialist Republic of Romania and the orders of the Supreme Commander The transition to the application of civil defence measures in special situations shall be decided by the Defence Council on the proposal of the Minister of National Defence + Article 4 Civil defence has the following main missions: a) preparation for civil defence of citizens and civil defence formations; b) protection of citizens against the effects of mass destruction weapons and ordinary weapons, by individual means, housing, dispersal and evacuation; c) protection of material goods of any kind, by dispersal, evacuation, masking, camouflage and other technical and organizational measures to help ensure the uninterrupted operation of economic units in special situations; d) prevention of population and working personnel from localities and socialist units on the danger of attacks in the air, by notification and alarm; e) limiting and liquidating the consequences of air attacks, participation in restoring the production capacity of socialist units; f) identification, neutralization and asanation of the territory of the remaining unexploded ordnance; g) the participation of military units and civil defence formations in the actions of localization and removal of the consequences caused by natural calamities and catastrophes. + Article 5 The Ministry of National Defence organizes, leads and coordinates the application of measures to protect the population and material goods, the preparation of citizens, as well as the realization of other civil defense activities in counties, localities and in Socialist units. + Article 6 Ministries, other central bodies, local bodies and socialist units are required to ensure the protection of subordinate working personnel, machinery and aggregates, as well as to take the necessary measures to ensure deployment. normal production process and other economic and social activities. + Chapter 2 Civil defence organisation + Article 7 The Minister of National Defence is the head of civil defence in the Socialist Republic of Romania, having the task of leading, directing and controlling the civil defence activity, in accordance with the Defence Council of the Socialist Republic of Romania and with the orders Supreme Commander of the Armed Forces. The Ministry of National Defence is organizing the Civil Defence Command. + Article 8 Ministers, heads of other central bodies and socialist units are the heads of civil defence in these bodies and units. Civil defence chiefs referred to in par. 1 and 2 lead and coordinate the civil defense activity in the socialist bodies and units or, as the case may be, from counties, municipalities, cities and communes. + Article 9 At the ministries, the other central organs, the committees and executive offices of the popular councils, as well as the socialist units, are organized civil defense formations, specialized civil defense commissions and major defense states. Civilian. + Article 10 Civil defence bands shall be organised for the purpose of participating in actions to limit and liquidate the consequences of attacks in the air, as well as the consequences of natural disasters and disasters. In civil defence bands are employed persons able to work, men aged from 20-60 years and women from 20-55 years, who are not part of other forms of training for the defense of the homeland. + Article 11 Civil defence commissions are organized for the purpose of studying and applying civil defence measures on different specialties, sanitary, transmission-alarm, shelter-housing, antique protection, electrotechnics and the like. + Article 12 The major states of civil defense are organized for the purpose of guiding and coordinating the activity carried out by civil defense bands and commissions, by the entire population. + Article 13 The organization of the bands, commissions and major states of civil defense is established by decree of the State Council. + Article 14 In order to achieve civil defence measures, citizens have the following obligations: a) to participate in the preparation for civil defence, in order to acquire the knowledge and skills necessary for this activity; b) to carry out all the measures established by the civil defence bodies, in time of peace or war; c) to participate in actions to limit and liquidate the consequences of attacks in the air, to locate and eliminate the consequences caused by natural disasters and catastrophes; d) to participate in the realization of shelters of collective interest, as well as to the arrangement of sheltering spaces to the construction or on the land personal property; e) to procure, for a fee, the mask against gas and the antique sanitary kit. + Article 15 The preparation for civil defense is executed according to the programs developed by the Ministry of National Defence, as well as the specialized topics prepared by the ministries and the other central bodies. The training for civil defence is attended by the bands, specialist committees, major states and civil defence chiefs, patriotic guards, youth training detachments to defend the homeland, civil firefighting bands, voluntary sanitary formations and Red Cross sisters, working staff from socialist units, students, students, other categories of citizens, as well as personnel from the military units and formations of the Ministry of National Defence and the Ministry of the Interior. + Article 16 At ministries and other central bodies, in counties, in localities and socialist units, exercises and civil defense applications are organized periodically, according to the training provisions approved by the Minister of National Defence. + Chapter 3 Protection of the population and material goods + Article 17 The protection of the population and material goods against the effects of mass destruction weapons and ordinary weapons shall be ensured by a set of measures consisting of: notice and alarm, sheltering, dispersal and evacuation, masking, camouflage and other technical and organisational measures. + Article 18 Measures to protect the population and material goods are differentiated, in relation to the category of localities, as well as according to the importance of socialist units, units and military formations. The division of localities by category, as well as the civil defense measures that are executed in peacetime and in special situations, are established by decree of the State Council. + Article 19 The notification and alarm of the population and working personnel from localities and socialist units about the danger of attacks in the air shall be ensured by the Civil Defence Command and the major civil defence states. The notification and alarm of the population about the occurrence of natural disasters and catastrophes are made by the major civil defense states, based on the decision of the civil defense chiefs of the affected counties, localities and socialist units. + Article 20 To reduce the effects of attacks in the air, the dispersal and evacuation of a part of the staff of ministries, other central organs, local bodies and socialist units, categories of citizens, material goods, as well as the objects belonging to the national cultural heritage. The Ministry of National Defence presents, for approval, the Council of Defense of the Socialist Republic of Romania proposals for the realization, in peacetime, of shelters for civil defense. + Article 23 The protection of the population and material goods against the contamination effect of mass destruction weapons shall be ensured on the basis of the measures established by the Ministry of National Defence together with the other ministries and central bodies as well as with executive committees of the county folk councils and the city of Bucharest. + Chapter 4 Limiting and liquidating the consequences of attacks in the air and the consequences of natural disasters and disasters + Article 24 The actions to limit and liquidate the consequences of the attacks in the air are carried out and are conducted on the basis of the provisions of the civil defense chiefs of the counties, localities, and + Article 25 The actions to limit and liquidate the consequences of the attacks in the air participate: military units of the Ministry of National Defence and the Ministry of Interior, depending on their missions and situation; civil defence formations; militia; civil firefighting bands; subunits of patriotic guards and youth training detachments for the defense of the homeland; voluntary sanitary formations and Red Cross sisters; working staff from socialist units; students, students and other able-bodied citizens. + Article 26 Military units and civil defence bands participate in the removal of the consequences caused by natural calamities or catastrophes, to the restoration of production capacities affected by air attacks, to the extinction of fires in the major objectives. + Article 27 The ministries, the other central bodies, the executive committees of the county folk councils and the city of Bucharest and the socialist units that carry out works on the lands where there are indications that there are unexploded munitions will take measures to ensure compliance with the rules of occupational safety technique, developed by the Ministry of National Defence. The organs and units provided in par. 1 will carry out with the working staff in subordination, as well as with the population, training activities on the prevention of accidents in the actions of asanation and demining of ammunition. + Chapter 5 Duties of ministries, other central bodies and local bodies of the state administration on the application of civil defence measures + Article 28 The ministries and other central bodies, as well as the executive committees of the county folk councils and the city of Bucharest, exercise the following tasks: a) develop and carry out the necessary measures for the uninterrupted operation of subordinate units, in times of war and other special situations, in order to ensure the normal conduct of economic, political and social activities; b) organizes and executes, with the worker personnel and their own technical means, the limitation and liquidation of the consequences of the attacks in the air, the consequences caused by natural disasters and catastrophes, the restoration of the production capacities of the socialist; c) carry out, on the basis of plans drawn up in peacetime, the measures to protect the working personnel and material goods; d) execute, on the basis of the topics established with the agreement of the Ministry of National Defence, studies, scientific research, manufacturing documentation, design and experimentation, in order to improve the measures and improve the means of civil defense; e) follow, to the design and execution bodies, the application of the legal norms on the arrangement of housing spaces for civil defense and their maintenance by beneficiaries; f) ensure the dispersion and evacuation of hard working personnel and important material goods; g) ensure the prevention, protection and preparation of the population in areas that may be affected by nuclear and chemical accidents as a result of the activity of subordinate units, holders of radioactive sources and chemicals; h) informs the Civil Defence Command and the major county civil defence states and the city of Bucharest about the situations of natural calamities and catastrophes: floods, earthquakes, snow, landslides, large fires, explosions, nuclear accident, infection as a result of damage to installations with harmful substances, to ensure timely intervention with military units and civil defense formations. + Article 29 The Ministry of National Defence directs and coordinates the application of measures to protect the population and material goods to all socialist organs and units, throughout the country. The Minister of National Defence presents to the Council of the Socialist Republic of Romania reports and proposals on the main measures of organization and material insurance of civil defence and subjects them for approval dispersal and evacuation of the population. + Article 30 The Ministry of Interior provides the necessary measures to maintain order in localities, conduct in specific conditions the movement of vehicles and pedestrians, guard the assets of socialist units and citizens during the air alarm, actions to disperse and evacuate, to limit and liquidate the consequences of attacks in the air, as well as respect by citizens and socialist units of civil defence rules and measures. + Article 31 The Ministry of Health, together with the committees and executive offices of the popular councils, carries out the medical-health assistance of citizens in conditions of war and ensures the supply of the necessary assortments and quantities of equipment and medical instrumentation, blood and substitutes, medicines, biopreparations and other means necessary to provide medical assistance. + Article 32 The Ministry of Transport and Telecommunication ensures the stability of transport and telecommunications in time of war, as well as the necessary measures for railway, car and naval transport in the action of dispersal and evacuation, transport of the injured, as well as the telecommunications links for the realization of civil defence activities. + Article 33 The Ministry of Electricity ensures the stability and uninterrupted operation of the national energy system in time of war, takes measures to restore it in case of destruction or damage and ensures the necessary electricity sources taking actions to limit and liquidate the aftermath of the attacks in the air. + Article 34 The Ministry of Agriculture and Food Industry establishes and ensures the application of measures for the protection of animals, crops, feed, cereals and food; takes measures to ensure the assortments and quantities of equipment, medicines and biopreparations, necessary in times of war, for the purpose of carrying out veterinary and phytosanitary actions. + Article 35 The committees and executive offices of the county folk councils, of the city of Bucharest, municipal, city, and communal ensure the continuity of the operation of the communal household networks, of roads and bridges, for the purpose of normal economic, political and social activities in time of war; lead actions to limit and liquidate the consequences of air attacks, consequences caused by natural calamities and catastrophes; ensure the participation of the population in the preparation for civil defense. + Chapter 6 Final provisions + Article 36 The provision of material and financial means, as well as other measures necessary to carry out civil defence activity, shall be established by decree of the State Council. + Article 37 The ministries and other central bodies will develop, with the agreement of the Ministry of National Defence, specific regulations on the execution of civil defence measures. --------------------------
