The development and accelerated modernization of material production require strengthening the role of the foreman in the organization and management of the production process, uninterrupted increase of its contribution to the maximum use of economic efficiency of resources materials and human, to the systematic identification and use of labor productivity growth reserves, continuous improvement of product quality level, mobilization of worker collectives for exemplary performance of tasks, in consistent with the objectives of the single national economic development and social. To that end, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 Role and place of the foreman in production + Article 1 (1) The master is the organizer and the direct leader of the working group entrusted and responsible for the production activity and the realization of its plan tasks. The foreman has in subordination a number of workers established by normative and, as the case may be, heads of teams or brigadier who respond to the tasks of collective work. (2) The master participates directly, together with the subordinate workers, at the production process and belongs to the category of productive technical personnel. + Article 2 The foreman is directly subordinated to the head of the workshop, to the section chief or to other leaders of production compartments, depending on the organizational form of the unit. The foreman collaborates with the unit's production or functional compartments in the problems related to the performance of the plan tasks, as well as with the designers and technologies for the modernization of production processes, the introduction into manufacturing of new products and technologies and continuous improvement of production quality. + Chapter 2 Duties and responsibilities of the foreman + Article 3 (1) The master is obliged to ensure the rhythmic realization of the tasks of the plan that return to the working band entrusted and to take all measures of scientific organization of production and work. To this end, the foreman responds to: a) the production of the production schedule, the assortments and the stipulated deadlines; b) the organization of each job and the preparation of the manufacturing conditions; the distribution of works on each team, the brigade and the executors; the supervision of the execution of operations throughout the works; c) the organization of supply on each job with raw materials, materials and semi-finished products and insurance with drawings, technological chips and other technical documentation, as well as with tools, devices and measuring devices and control necessary for the execution and verification of works, operations, products and services; d) full use of production capacities, use with maximum efficiency of machinery, machinery and installations, prevention and elimination of interruptions or deficiencies in their operation; e) the introduction and extension of modern methods of production and work, application within the working band of inventions and innovations and support of initiatives in the field of technical progress and mechanization of manual operations; f) the classification in the norms of consumption of raw materials, materials, energy and fuel established for each landmark, subassembly and product; recovery and superior recovery of waste, judicious management of all material goods; g) the performance of the work tasks on each worker and the entire formation and operative reporting to the superior hierarchical head of the stage of the production schedule, taking over the band's tasks from the previous exchange and teaching tasks to the next exchange, specifying the objectives to be pursued. (2) The master has the obligation to participate directly in the realization of a certain volume of products or works, through the execution of complex operations, assembly works, maintenance, repairs, adjustments and maneuvers of the machinery, the pursuit of the measuring equipment and control, as well as other operations that require high qualification and experience, ensuring through this the use of the entire work capacity of the working band he leads. + Article 4 The foreman is responsible for ensuring the quality of the products or works carried out within his working band and is obliged to take measures for: a) rigorous compliance by the executors of manufacturing technologies and instructions on the operation and maintenance of means and tools of production; training of workers in subordination on the way of carrying out the works, the direct execution of operations or manoeuvres with a high degree of difficulty, until their appropriation by the subordinate workers, the carrying out of the production activity in hygienic-sanitary and veterinary conditions provided by law; b) the verification and operative resolution of the referrals of the subordinate workers on the qualitative characteristics of the raw materials, materials and tools used in manufacturing, which do not meet the standards, technical norms or notebooks tasks; c) permanent control of the quality of operations, works and products carried out by the workers of the working band, in order to ensure the qualitative parameters provided in the technical documentation, as well as in order to prevent deviations from prescriptions to them; the preservation of the quality of the products during their handling, packaging and storage at work; d) stop the operation of operations and manufacture in case of serious deviations from the quality norms, informing about it the hierarchical leader; e) the organization of the debate within the labor collective of cases of violation of the quality norms, the causes of the rejects and the measures to avoid them; the establishment of the culprits for the production of scrap or decried products. + Article 5 In the field of ensuring the increase of labor productivity, application of labor norms and retribution by quantity and quality of work, the foreman responds to: a) the elaboration and application of measures from the labor productivity growth program, on jobs and on the working group as a whole; ensuring the complete use of the working day by all workers of the working band; b) the creation at each workplace of the technical and organizational conditions provided for in the documentation that was the basis for the establishment of the norms and norms of work; c) participation in the operational work of labour, rigorous application of labour standards and permanent pursuit of their fulfilment by the subordinate workers; adoption of measures to eliminate the causes that determine the unrealisation of labour standards d) elaboration of proposals for improving labour standards in accordance with the modifications of the established technical and organizational conditions; e) the application of the forms of retribution established for the working band; f) application of the provisions of the law on the establishment of the retribution of workers working in agreement or directing and granting it on condition of carrying out their own work tasks and provisions on increasing or diminishing retribution individual due under the collective agreement, depending on the actual contribution of each member of the band to the works; g) scheduling of holidays, taking into account the needs of the production and the interests of the staff, in compliance with the legal norms + Article 6 The foreman has the responsibility for carrying out the production activity in full security and for the full realization of the labor protection measures. To this end, the foreman shall take measures to: a) training of workers in the formation and supervision of strict enforcement of regulations on labor protection, labor hygiene and fire prevention and extinguishing rules; regular repetition of the training and verification of the appropriation by the members of the band; b) ensuring the safety devices of work and protective equipment provided in the specific rules of each job; displaying instructions and boards on safety and labor protection at all workplaces and warning signs of dangerous places; c) the operation of machinery, machinery and installations in conditions of complete safety for all personnel; d) the pursuit of the work of labor protection and fire prevention, provided in the enterprise program for his band; stopping the work in case of danger to labor security, with the announcement of the hierarchical chief; prohibition participation in the work of drunk workers, fatigue, or without appropriate protective equipment; e) the first aid in the event of an accident, the immediate announcement of the higher hierarchical bodies; the removal of the causes of danger-generating f) continuous improvement of hygienic-sanitary conditions of work; referral of causes that lead to environmental pollution and their prevention as well as for the prevention of accidents and professional illnesses. + Article 7 In the field of continuous lifting of the professional qualification of the staff in the working band at the level of the requirements of technical progress and education in the spirit of the socialist discipline of work, the foreman responds to: a) the supervision and guidance of each worker in order to acquire the knowledge and skills necessary to perform in good conditions the production tasks; training at the workplace of young workers in order to raise the qualification and their professional development; b) appropriation by members of the working group of regulations on the technological and labour order and discipline, of the prescriptions for the operation and maintenance of installations, machinery and machinery, as well as the rules of handling, transport and storage of raw materials and products; c) training of the workers of the working band in order to acquire the advanced work procedures carried out by the leading workers and to create the conditions for their application; d) organization of the practice in the production of students and students assigned to the working group he leads; e) creating the conditions for attending qualification courses or forms of improvement of professional training by the workers he proposed to attend these courses; improving the content of training courses for the workers in his work band and the proposal to complete the qualification and refresher programs. + Article 8 The foreman has the duty to participate in the organization of the socialist competition and the monthly meetings of the trade union groups and to act together with their offices for the foundation and realization of the commitments in the competition. During the monthly meetings, the foreman reports on how to achieve the production tasks, including the commitments made and the stage of solving the proposals of the working people, presents the tasks of the production program of the band working for the next period and submits to the debate the measures necessary for + Article 9 Failure to meet the foreman of the duties established by this law and his own tasks shall, as the case may be, entail his disciplinary, administrative, material or criminal liability. + Chapter 3 Rights of the foreman + Article 10 In his capacity as leader of the working group, the foreman has the right to give provisions to the subordinate workers, directly or through the heads of team or brigade; the provisions of the superior hierarchical heads or of the technical control bodies to workers in a working band, are given through the foreman who leads it. In exceptional cases, when the foreman is missing and the necessities require urgent action, the hierarchical head can give direct provisions to the workers, with the obligation to inform him as soon as he returns to work. + Article 11 In order to carry out the tasks of the working band, the foreman has the right to allocate the personnel to the teams, brigades and jobs; framing, transferring or undoing the employment contract for the members of the working band leads, is done only with the consent of the foreman. + Article 12 (1) For outstanding achievements obtained at work by subordinate staff, the foreman, in consultation with trade union and youth organizations, shall establish the following incentives: a) verbal or written thanks for special achievements; b) designation of workers who will be able to be declared highlighted or leaders in competition; popularization at the honor panel of the unit. (2) The resolution by the management of the housing applications and other social problems of the subordinate workers will be done in consultation with the foreman. ((3) The registration of the workers in the examination for promotion into higher categories of qualification, the awarding of retribution steps, the awarding of workers for outstanding achievements during the year from the funds intended for this purpose and the granting of other Material rewards that are established by the management of the unit will be made with the consent of the + Article 13 (1) In order to strengthen the order and discipline at work, to avoid and eliminate deviations from the norms established in the regulations of interior order, the foreman, in consultation with trade union and youth organizations has the right to apply the following sanctions a) reprimand; b) warning; c) withdrawal of a retribution step for up to 3 months. (2) For more serious misconduct, the foreman proposes to the hierarchical heads the application of other sanctions, according to + Article 14 In order to increase the co-interest in the performance of assigned tasks and to obtain special results in production, the foreman benefits from: a) the granting of a tariff fee, duly established with the responsibility and role it has in production, which will be in all cases superior to that of the workers of the led working band. For this purpose, only workers whose tariff retribution is inferior to that of the foreman can be included in the labor bands. The maistrii promoted among the workers, the team heads or the brigade, will be classified with the tariff retribution established according to art. 24 24 (4) of Law no. 57/1974, taking into account the retribution of employment as a worker, including the tariff allowance received for the management of a team or brigade; b) retribution in global agreement, together with the led working band. In this case, the foremen are awarded the retribution in the same proportion to the degree of fulfilment of the tariff retributions of the workers within the led working band, corresponding to the time worked. The full award of the addition of agreement due to the foreman is provided with the condition of carrying out the contracted production tasks, as well as his duties as a formation leader. In case of non-realization of these tasks, the reduction of the agreement, until the cancellation, shall be determined by the collective management body of the establishment; c) awarding for outstanding achievements in work, provided by art. 59 59 of Law no. 57/1974, is made from the prize pool constituted by applying the quota of up to 1% on the retribution fund planned for foremen and workers on the entire unit. + Article 15 The foreman is part of the right of the technical commission for the framing and promotion of workers and can be elected to the collective management bodies of the unit. + Chapter 4 Obligations of collective management bodies of establishments + Article 16 The collective management bodies of the economic units are obliged to take all measures to create the conditions necessary for the foreman to fulfill his role in the production process and to ensure, through the workshop head, the section chief or by unit compartments, the following: a) the distribution of the production schedule at least 5 days before the beginning of the month, with the specification of the plan tasks regarding the assortments, quantities and deadlines, the number of workers, the retribution fund and the labor norms, the indicators of quality, consumption indices and the coefficient of rebutts admitted, indications for the use of machinery, machinery and installations; b) technological training, technical documentation, raw materials and materials, tools, devices and verifiers, measuring and control equipment; means of storage and internal transport, according to plan tasks; establishment concrete dispatcher obligations or technical assistance that engineers, subengineers and technicians in the ward have to support the work of the foreman; c) organization and execution, according to the program of maintenance and repair works of the machine, machines, installations and equipping with work security devices; d) precise establishment within the activity of rationalization of the system of record and calculation, of the tasks of the execution personnel in the section, workshop or other compartments of the unit, which has powers to support the activity of the foreman, in so that they carry out as few works as possible and have the necessary data for the management and control of the quantitative and qualitative realization of the planned production; e) information and consultation of the foreman on decisions adopted at the level of the management of the unit or section, in the problems concerning the work of the f) the participation of the foreman in the elaboration of production programs and the application of technical and organizational measures undertaken within the workshop or section of which he belongs and who regard the band he leads; g) completion of the organization and functioning regulation of the unit and the job description with the tasks of the foreman, specific to the branch or technology of the workplace. + Chapter 5 Framing, training and professional improvement of the foreman + Article 17 The foreman is selected from the ranks of highly qualified workers and technicians with long experience in production, in the specialty and with the professional training provided by law, who enjoys in the collective in which he works professional, political and moral authority and proves that he is a good organizer of production and work. + Article 18 (1) The occupation of the foreman function shall be done by competition, in which candidates who prove leadership and organization capacity can participate and are: a) graduates with a diploma of the school of foremen or other equivalent schools in that specialty; b) highly qualified workers, graduates of high schools or vocational schools, at least 10 years old as skilled workers in that specialty and are assigned to the last or penultimate category of framing from the network the tariff of the branch; c) technicians at least 10 years old in the production sectors, in the field for which they participate in the competition. (2) Graduates with diploma of schools of foremen can participate in the competition organized by other enterprises only after fulfilling the obligations established by the addendum to the unit that recommended them at school. (3) In order to register for the competition, the persons referred to ((1) lit. b) and c), will present the recommendation of the work collectives in which they work, endorsed by the office of the company's working people council. + Article 19 (1) The contest for the position of foreman is held before the commission for the framing and promotion of technical, economic, other specialized and administrative personnel in the enterprise, established according to the legal provisions regarding the classification and the promotion of the work of the staff from the state socialist units. ((2) The contest consists of samples given in the form of practical and written works, for the verification of professional knowledge in the field of organization of production and work, quality norms of products, norms of safety technique, as well as verification of the correct execution of complex, technology-specific works used in that undertaking. (3) The office of the council of working people or, as the case may be, the head of the unit will frame or promote as a foreman who, besides the results obtained at the competition, is appreciated for the best achievements in production (4) Persons classified on the basis of the contest for the position of foreman shall be subject to a 30-day trial period. If, at the end of this period, that person has proved appropriate, the promotion will be final from the start date of the test period. If during the trial period, the person has not proved that he can cope with his/her duties, he will be placed in the previous position or another equivalent. + Article 20 (1) Maistrii promoted under the conditions provided in art. 18 18 (1) lit. b) and c), have the obligation to graduate from the school of maistri-seral education, in the next 5 years after their appointment to the office. (2) The same obligation also has the masters who until the date of entry into force of this law had to complete a special course of foremen. Persons promoted to positions of foremen, before this date and who have completed a special course of foremen, are not subject to the obligation provided for in the previous paragraph. (3) Persons assigned to positions of foremen, before the date of entry into force of this law, will be able to continue to occupy the respective functions under the conditions provided by art. 68 68 of Law no. 12/1971, regarding the employment and promotion of personnel from state socialist units. + Article 21 (1) The professional training of the foremen is carried out through schools of foremen operating with daily education and seral education. (2) The duration of studies in the schools of foremen is one year to one and a half years in the day and two years in the seral education. (3) In the day education, half of the schooling time will be affected by the practice in production, during which time students will actually work on the most important machines and installations in the respective sectors of activity, as well as aid of Foremen. (4) The nomenclature of specialists preparing through schools of foremen and the duration of studies at the day and evening education shall be established by decree of the State Council. (5) The annual tuition plan is approved by the decision of the Council of Ministers, at the proposal of the Ministry of Education and Education, with the consent of the State Planning Committee, the Ministry of Labour and the Ministry of Finance and with the consultation ministries and other central and local bodies that organize schools of foremen. + Article 22 (1) The schools of foremen shall be organized by enterprises and other socialist organizations, by ministries and other central bodies, as well as the executive committees of the county folk councils and of the city of Bucharest, which are responsible for preparation of the workforce. (2) The schools of foremen function, as a rule, in school groups, together with profile high schools and vocational schools. In localities where such school facilities are not organized, maistri schools can operate as self-contained units. (3) In the schools of foremen, training courses are organized for several specialties. Depending on the needs of foremen you can also organize classes of students with two specialties. (4) The management of the schools of foremen, the provision of the technical-material basis, the organization and conduct of the instructive-educational process, as well as its control and guidance are carried out under the conditions and by the law school facilities in the high school education. (5) The schools of foremen are subordinated to the Ministry of Education and Education, as well as to the ministries and other central bodies and local bodies, which organize them and have the obligation to provide specialized guidance, didactic-material basis and the specialized frameworks necessary to conduct the instructive-educational process. + Article 23 (1) Admission to the schools of foremen is based on competition, which is organized and carried out under the conditions established by the Ministry of Education and Education, in consultation with the other central bodies and local bodies. (2) The recruitment of candidates for admission to the schools of foremen shall be made among the graduate workers of high schools or vocational schools, at least 8 years old in production, in the last or in the penultimate category of framing, with long experience in production, having priority those who have fulfilled the position of team leader, who enjoy professional, political and moral authority and are good organizers of production and work. ((3) The candidates will have the recommendation of the labor collective in which they work, including the foreman, endorsed by the office of the council of the working people of the enterprise from which they come. For each post of foreman required, enterprises will propose at the entrance exam at least two candidates. (4) The Maistrii promoted among the workers and technicians, who have the obligation to graduate from the school of foremen according to the provisions of art. 20 (1), will be admitted to the schools of maistri with the seral education, without competition, within the approved school plan. (5) After admission to the schools of foremen-education of the day-each student will conclude with the undertaking an addendum to the employment contract by which he undertakes to work in this enterprise as a foreman for a minimum period of 5 years, after graduation school. + Article 24 (1) Through the instructive-educational process, the maistri school provides students with the knowledge of management and scientific organization of production and work, as well as the knowledge on the most modern techniques and working technologies, measuring equipment and control, operation, regulation, maintenance and repair of machinery, machinery and installations, labor protection, economic and labor law, specific to the field of activity for which they are preparing. (2) The Ministry of Education and Education responds to the content of the instructive-educational process and approves the educational plans, programs and school textbooks, in consultation with ministries and other central and local bodies that organize schools of foremen. School programs and textbooks are developed by ministries and other central and local bodies that organize schools of foremen, together with the Ministry of Education and Education and periodically improve, based on the new achievements of science, Contemporary technique and pedagogy. + Article 25 (1) The conclusion of the studies of the school of foremen is done by graduation examination, which consists of the students ' support of the project or diploma work; the theme of the project or the work is established in consultation with the enterprises for which they prepare students. (2) Persons who pass the graduation exam of the school of foremen receive the graduation diploma of this school. (3) Those who do not pass the graduation exam have the right to repeat it only once in one of the following school year sessions. Until the promotion of the graduation exam they remain in production at the jobs in which they worked before following the school of foremen or in another similar job. + Article 26 (1) During their studies, students of schools of foremen benefit from material and educational support. The forms of material support and studies shall be established by decree of the State Council. (2) The expenses for covering the rights provided in par. (1) shall be borne by the units for which the students are prepared, from the funds provided for in the plan for the schooling of (3) Students from the day education who are expelled in the course of schooling, have the obligation to return the amounts representing the tuition expenses, established according to the regulations in force. (4) The obligation to refund the amounts representing the tuition expenses also have the students of the school of foremen-teachers of the day-who are rejected at the graduation exam within the term provided in art. 25 (3), as well as graduates who refuse to comply with the undertaking for which they have prepared or leave the workplace before the expiry of the period provided for in the addendum to the employment contract. + Article 27 If the school of mistri-seral education-is located in another locality than the production unit from which the students come, they will be posted, during schooling, to other units of the same profile, which are based in the locality that works school. During the posting, the students are repaid by the unit to which they are posted, benefiting from the rights established according to art. 26 26 (1). + Article 28 (1) If, for lack of posts, the graduates of the schools of foremen cannot be assigned as foreman to the unit that recommended them, it is obliged to allow them to register for the competitions for filling the positions of foremen organized by other units, and in case of success, to grant them the transfer in the interest of the service, without the need to approve the superior hierarchical organ of it. (2) In order to carry out the transfer, the graduates of the schools of foremen will be assigned to production on the jobs in which they worked before following the school of foremen or in other similar jobs, in the enterprise with which they concluded Additional documents to the employment contract. + Article 29 (1) The Maistrii have the duty to perfect their professional training, through the permanent and systematic appropriation of the latest knowledge in the field of management and organization of production and work, as well as from the field of specialty in which they work. Companies have the obligation to ensure conditions for each foreman to follow periodically-at least every 5 years-or whenever the needs of production require it, an organized form of improvement. (2) The improvement of the professional training of the foremen is organized, as a rule, by the enterprises in which they operate. For some categories of foremen, which will be determined by the ministries, the other central and local bodies through annual plans and programs, the improvement will be organized by the industrial plants or the refresher centers of these organs. (3) The objectives, content and forms of improvement of the professional training of the foremen shall be determined by each enterprise or industrial plant, according to the regulations in force. + Article 30 (1) The main forms of improvement of the preparation of foremen and the verification of the level of professional knowledge and the ability to continue to perform the position of foreman are as follows: a) refresher courses lasting up to one year, organized within the enterprise, in other enterprises or in refresher centers, with partial removal from work; b) personal refresher programs, with regular verification of assimilated knowledge. ((2) Perfection can be done, as the case may be, and by: a) internships in other enterprises in the country; b) internships abroad, when they are provided under contracts or agreements concluded with other countries. (3) The completion of the forms of improvement in the paragraph (1) will be made, as the case may be, on the basis of theoretical and practical samples, works and exams under the conditions established by law, with the issuance of certificates. + Chapter 6 Promotion as main foreman + Article 31 The foreman who achieves outstanding results in production, has political-professional qualities verified in practice, meets the training conditions provided in art. 18 and is at least 5 years old as a foreman or in other technical positions, has the right to apply for the exam or competition for promotion as main foreman, within the limits of available posts. + Article 32 (1) The main master is an immediate function superior to that of foreman in terms of professional training and retribution and has all the duties, responsibilities and rights established by this law for the position of foreman. (2) The main master will be assigned the most complex working band under the organizational and technological report. (3) If the production is not organized on workshops and the section has at least eight working bands on an exchange, the main foreman may receive the task to coordinate a number of at least four bands effectively run by a foreman. Also, if some units work in shifts, but have not constituted wards or workshops on each exchange, the main foreman, can receive the task to coordinate the work of several exchanges. + Article 33 The promotion as head of workshop and other production management positions, specific to some branches, is mainly made from the main foremen, in compliance with the minimum training and seniority conditions, provided by Law. + Chapter 7 Normative de maistri si maistri principal + Article 34 (1) The number of master and principal foremen on each establishment shall be established on the basis of normative formation of working formations led by a foreman of exchange. (2) The rules of formation of the working parties will establish the minimum number of workers, as well as one or two parameters that characterize the activity area or production capacity of the facilities, aggregates or machinery served by formation, differentiated according to the degree of technical endowment of the workplace, the surface or the levels served and by other factors specific to some technologies or production branches. (3) The limits on the minimum number of workers who constitute the working party led by a foreman of exchange, by branches of productive activity, shall be established by decree of the State Council. + Article 35 (1) Unified norms on branches, subdivisions and groups of units with similar profile, shall be elaborated in compliance with the limits provided in art. 34 (3) and approved by ministries, other central and local bodies, with the opinion of the Ministry of Labor and the agreement of the Central Council of the General Union of Trade Unions in When applying these normative the management of the unit will specify the number of workers in the formation, so that a rational degree of employment of the working time of the foreman and the capacity of inclusion and realization of the tasks of production. (2) The number of principal foremen may be no more than one in three positions of foremen, provided in the state of functions. (3) In the framework of measures to rationalize the personnel, the units of units are obliged to ensure as a priority the number of positions of foremen necessary for the production, according to the provisions of the structure in force. (4) Engineers and sub-engineers during the production period may be used as aid of the foreman or may receive the task of running a working band, exercising the duties and responsibilities of the foreman function. + Chapter 8 Final provisions + Article 36 The ministries, the other central bodies and the executive committees of the county and county councils of Bucharest, as well as the councils of the working people of plants and enterprises are required to take the necessary measures to increase permanent the role of the foreman in the organization and direct management of the production and its contribution to the performance of the plan tasks of each economic unit. + Article 37 The provisions of this law also apply in economic units subordinated to the Ministry of National Defence and the Ministry of Interior, as well as in cooperative and public units. + Article 38 This law shall enter into force 30 days after its publication. On the date of entry into force, the Decision of the Council of Ministers no. 1061/1959 on the lifting of the role of foremen in production, the Type Regulation on the duties of the foremen approved by the Decision of the Council of Ministers and the Central Council of Trade Unions 876 876 of 1 July 1960, the provisions relating to the schools of foremen of Law no. 11/1968 on education in the Socialist Republic of Romania and the Decision of the Council of Ministers no. 125/1963 on the rights of students of maistri schools-evening courses, as well as any provisions contrary to this law. -------------------------------------
