Law no. 40/1975 was published in the Official Bulletin no. 134 134 of 25 December 1975. In the Socialist Republic of Romania the breeding of animals is an activity of national interest, having a prominent role in supplying the population with meat, milk, eggs and other animal products and the industry with raw materials necessary to increase production of consumer goods. The edification of the multilateral socialist society developed in our country, the continuous increase in the standard of living and the consumption capacity of the population requires the lifting of the share of animal husbandry in agricultural production, by increasing livestock, improving their productive potential and improving the technologies for the efficient exploitation and valorisation of all feed resources. In order to achieve these objectives, the state creates conditions for the continuous development of animal husbandry, both in socialist agricultural units and in households, by allocating important investment funds to build of new zootechnical objectives, the granting of credits for the purchase of animals, by the classification of units with specialized personnel, the organization of specialized units in the production of breeding material, the import of animals from breeds perfected and the establishment of stimulating prices for animal production and for reproducers with high genetic potential. In order to fully capitalize on the existing pedoclimatic and social-economic conditions in different areas of the country, the Ministry of Agriculture and Food Industry together with the folk councils organize the zootechnical production in territorial aspect and are responsible for the production of livestock production. For the further development of animal husbandry, the Academy of Agricultural and Forestry Sciences, through the profile research units and higher agronomic educational institutions, participate in the work of elaboration and application of the most effective breeds improvement methodologies, the expansion of the use in the production facilities of the improved breeding material and the improvement of the growth technologies and are responsible for their application and realization on the areas and groups of Units assigned to them. In order to achieve these tasks, it is necessary to create a uniform legal framework for animal breeding, improvement and breeding. To this end, the Grand National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 Animal breeding + Article 1 Animal husbandry is an activity of national interest and aims to supply the population at the level of increasing consumption requirements and to cover the industry's raw material needs with products of animal origin. The development of animal husbandry is carried out according to the National Program for the development of animal husbandry and livestock production, the provisions of which are mandatory for all animal keepers. + Article 2 For the development of animal husbandry, the establishment of species share by geographical and administrative areas, the choice of breeds and the system of growth and exploitation, the Ministry of Agriculture and Food Industry and the executive committees of The county folk councils and the city of Bucharest will ensure the superior valorization of pastures and finesse, especially those in the hill and mountain area, as well as all the feed resources in agriculture, food industry and other activities of the economy. + Article 3 In order to continuously improve the supply of the population with livestock products and avoid the expenses caused by the transport of products from long distances, the Ministry of Agriculture and Food Industry together with the popular councils will ensures in each county the conditions necessary for the development of animal husbandry, covering their own consumption needs and to realize the availabilities established by the plan. + Article 4 In socialist agriculture, benefiting from the multilateral support of the state, the development of animal husbandry will be further oriented towards the concentration, specialization and integration of production and will be achieved by the construction of new units, rationally sized, and modernizing existing ones. + Article 5 Socialist agricultural units have the obligation to maintain in optimal conditions, in accordance with technical prescriptions, animal shelters, annex constructions and technical means provided and maintain in permanent working condition. technical equipment. The change of destination of zootechnical constructions or means of endowment is allowed only with the approval of the superior hierarchical organ. Livestock constructions with a value of over 200 thousand lei can not be removed from the animal production circuit except with the approval of the Ministry of Agriculture and Food Industry. + Article 6 The state supports the development of livestock in households, ensuring: -reproducers, through the communal mountain resorts; -semen and technical assistance for artificial insemination in animals, without payment; -technical assistance and financial means for the improvement and arrangement of natural grassland, in order to increase the feed resources;-the right to use, on favorable terms, pastures and finesse state property, as well as grazing forests, according to legal provisions -some types of feed for animals and products contracted with the state, under the conditions provided by law; -the granting of premiums for each heifer at the first calving; -technical guidance through professionals with specialist training, veterinary assistance and veterinary medicinal products; -credits, on favorable terms for breeders, in order to purchase production animals. The population of villages and cities can buy or take over on a contract basis, in order to increase and fattening, animals and birds from socialist agricultural units. + Article 7 To increase the contribution of households to the increase of vegetal and animal agricultural production and to ensure their own consumption needs with meat and other animal products, all rural and urban inhabitants holding agricultural land are obliged to cultivate them and to raise animals and birds. Agricultural land can only be owned by individuals who cultivate and grow animals and birds, under the conditions provided by law. The plant and animal production obtained in households will be used for the food needs of producers and their family members, and the quantities available will be able to be capitalized, under the conditions provided by law, to market or through contracting and procurement for the state fund. + Article 8 The committees and executive offices of the popular councils are responsible for the full and efficient use of agricultural land, as well as the realization of the plan of livestock and poultry flocks, of the creation of product resources livestock necessary to cover the needs of the population's own consumption in their area of activity, as well as to carry out the tasks of the contracting and delivery plan to the state fund of animals, birds, milk, eggs and other animal products. + Article 9 The executive committees of the county folk councils and the city of Bucharest will allocate and transmit annually to the offices and executive committees of the communal, city and municipal folk councils the plan indicators on the animals to be raised by households. Based on the plan tasks received, the offices and executive committees of the communal, city and municipal folk councils will draw up animal and bird breeding programs for each household within the administrative-territorial area, so that everyone can achieve the obligation to raise animals and birds. The number of animals and birds that can be increased by each householder for their own needs, sale at the market or for contracting or procurement is unlimited. The offices and executive committees of the communal, city and municipal folk councils will feature concrete tasks in the programs for each household, based on broad consultation of citizens, establishing the number of animals and birds, production and deliveries of animal products to the state fund, in correlation with the economic and social development tasks of territorial-administrative units. Accordingly, tasks of cultivation of all surfaces will be established, planting with fruit trees and shrubs, agricultural production that will also be obtained deliveries of vegetables, potatoes, fruits and other agricultural products to the state fund. Livestock and poultry development programmes are subject to the debate of the general assemblies of the inhabitants of the communes and become mandatory for all rural residents, after their adoption by the popular councils. + Article 10 The offices and executive committees of the popular councils will give households the necessary support to the development of their production base and will aim to ensure the necessary conditions for carrying out their tasks, to increase plant and animal agricultural production, for the realization of supplies to the state fund. To this end, the offices and executive committees of the popular councils will take the following measures: a) land in the property or use of the inhabitants and those from the administration of the offices or executive committees of the folk councils will be cultivated entirely with vegetables and potatoes, planted with fruit trees and shrubs, cultivated with fodder plants or other agricultural crops, according to the established programmes; b) Natural grasslands administered by the offices and executive committees of popular councils, as well as grazing land from the forest fund, will be distributed, according to the law, with priority to citizens who contract the delivery of animals and animal products to the state fund. The members of the agricultural production cooperatives shall benefit, apart from the measures provided for in the preceding paragraph, from the facilitations established by the general assembly of the agricultural cooperative, such as a) the prioritisation of volume and land-area feedingstuffs, for the production of fodder in the second crop, animal and livestock contractors; b) the assignment of the finesse areas, for the payment in kind, only to the herbivorous animal contractors or to their animal products. + Article 11 For socialist agricultural units, separate tasks will be established under the plan for the growth of piglets and chickens, to be sold to livestock farmers who contract the delivery of animals, animal products and birds to the fund. state. The socialist agricultural units are authorized to organize, in addition to their plan tasks, the production of chicken, piglets and homemade rabbits to hand over, together with some amounts of feed for growth and fattening, based on contract, to producers in households who have conditions of space, certain feed possibilities and have the necessary labour force. The retribution of the producers ' work will be carried out on the basis of tariffs established on the weight of fattened or increased animals, which were delivered to the state fund in the account of the respective agricultural unit, to the weights provided by + Article 12 The units of consumer cooperation will participate in the realization of tasks of raising livestock in households, by organizing breeding farms for sows and day-old chicks, in order to obtain products to be produced. sold to animal ridges. + Article 13 The Ministry of Agriculture and Food Industry, the National Union of Agricultural Cooperatives of Production and the Committee on the Issues of the People's Councils will take the necessary measures to ensure households with seeds and propagating material, with chemical fertilisers, with breed animals for the mount and with animal health assistance; they will also create possibilities for the rental or purchase, by households, of agricultural inventory and of agricultural machinery with animal traction and will ensure servicing with tractors and agricultural machinery for mechanized performance of the necessary works on the land used by these households. + Article 14 The socialist units that operate canteens, food establishments, tourist chalets and other such units are obliged to organize annexes for the breeding of animals and birds, by capitalizing on all domestic debris and other available resources, to cover, within the framework of established consumer rules, the needs of the state fund. + Article 15 In order to provide households with animals for growth and fattening, the Ministry of Agriculture and Food Industry together with the popular councils will take measures to increase the number of matas in these households. For the same purpose, they will support the organization of the production of piglets, chickens, as well as other species and categories of animals, both within households and in animal husbandry associations or through consumer cooperatives in Locality. Popular councils and agricultural bodies will support the establishment of animal breeding associations and their organization of actions related to the improvement of herds, the enhancement of livestock production, the improvement and use of grasslands, mechanization of works in animal husbandry, animal health protection and their protection, contracting and undoing of production. + Article 16 In order to ensure the feed needs for animals owned by socialist units and households, the Ministry of Agriculture and Food Industry together with the popular councils will organise feed production, ensure the development of the material base of the production of compound feeds and will follow the way of preserving and using all the feed resources, in accordance with the rules in force. + Article 17 The Ministry of Agriculture and Food Industry will develop technical rules for the growth and exploitation of animals, differentiated on growth systems, geographical areas and forms of ownership, based on the results obtained by the Profile research. These rules are mandatory both for socialist agricultural units and for households. + Chapter 2 Animal breeding + Article 18 The improvement of livestock, in the sense of increasing genetic potential, is carried out on the basis of the breeding programmes developed by the Ministry of Agriculture and Food Industry. The production and use of the breeding material is carried out under the animal husbandry programme and aims to meet the annual and prospective plans. + Article 19 By means of breeding, for the purposes of this law, it is understood: a) male reproducers and the male youth retained for control of their own performance; b) male and female youth retained for the testing of their parents or relatives in bovine, porcine, ovine, caprine, equine, pet and fur animals; c) female animals of the species taurine, in their entirety, and females of porcine, ovine, caprine, bubaline, equine, horse and fur animals, contained in the selection records and recognised on the basis of quality certificates; d) the lines and kernels of recognised birds, as well as hatching eggs and day-old chicks, which have been obtained from these lines or from combinations of lines selected for the production of hybrids; e) the nuclei of animals and birds used for the creation of new breeds, lines or hybrids; f) the semen used in artificial inbreeding and the zygoths used in the transplanting works. + Article 20 For the production, quality control and use of breeding material in animals, the Ministry of Agriculture and Food Industry, through its specialized bodies, bears responsibility and ensures: a) the organization and operation of the units producing the production material, through the permanent concentration of the elite animals in order to establish cores of the highest zootechnical value; b) the organization and functioning of the units and workpoints in which the testing is carried out after the performance for maintaining and perfecting the elite cores and for the provision of reproducers to the rest of the herds; c) the production of the types of fodder necessary for the units in which testing and selection works are carried out, according to the recipes required by their technology, in order to correctly highlight the genetic potential and the organization of feed production for the rest of the staff, at the level required by their productive potential; d) the inclusion in the official control of the production of the herds necessary to carry out the improvement works among the best animal cores existing in the socialist agricultural units and to the households, for the purpose of knowledge productive capacity of animals and identification of the most valuable specimens; e) State guarantee of the zootechnical quality of the breeding material, recorded in quality certificates issued after the official production control; f) enrolment in the state breeding books of specimens which, by the value of their performances, may contribute to the improvement of races; g) the management of the breeding stock and the breeding material, by their directed distribution, in order to satisfy the requirements of all areas and systems of animal husbandry; h) import of animals, birds, eggs and semen from the breeds and the improved types which may be used in the climatic and technological conditions of exploitation of the production units in our country, with the guarantee by exporters of their identity for specific communicable diseases; i) defending the health of livestock subject to selection by permanent provision of preventive and curative veterinary assistance, granted by own veterinary staff from the establishments holding them or from the constituencies Veterinary. + Article 21 The Academy of Agricultural and Forestry Sciences, through the subordinate research units, has the obligation and bears the responsibility for: a) the permanent improvement of the breeding methods and their programmes or instructions for their application; b) management of works for the creation of new breeds, types, lines or hybrids of animals and birds; c) the guidance of the works to study the adaptation capacity of the imported breeding material and the establishment of its use in the process of animal breeding; d) development and pursuit of the application of new technologies for the growth and exploitation of animals e) the production and delivery of breeding material with high genetic value, from its own animal holding units. + Article 22 The organization, management, coordination and guidance of actions for the production and use of animal breeding material are in charge of the Ministry of Agriculture and Food Industry and are carried out through specialized units that have as their object: a) the production, growth and maintenance of breeding animals with a role in the improvement of herds; b) the testing of the production material by its own performance or by the following c) propagation by breeding in clean or cross-bred breeding animals; d) the production, preservation and delivery of the semen for artificial inbreeding or of the zygoths used in the transplanting works. + Article 23 In order to highlight the productive potential of animals in specialized units, provided in art. 23, the forage will be made according to norms, rations and scientifically substantiated recipes, prepared by the research units and approved by the Ministry of Agriculture and Food Industry, applied only in the units with this specific activity. + Article 24 The Ministry of Agriculture and Food Industry organizes, leads and directs the works of appreciation and certification of the quality of the breeding material in animals, through the units that have as their object of activity the official control of production. The breeding and selection units also have the task of guiding and controlling how the use is made in the production sites of the selected breeding material, as well as to ensure the diffusion and trace the reproduction. it. In order to ensure accurate processing of the data resulting from the production control and increase the operativeness in the selection decision making, the republican breeding and selection unit will organize the automatic information processing system. Official production control refers to the recording of the performance of animals subject to selection, as well as to compliance with the conditions of maintenance, forage and care from the units that produce, test or receive in material use improved breeding. + Article 25 The quality of the breeding material and its value shall be attested by certificates of origin and productivity, issued by the county breeding and selection unit carrying out production control in animals. Certificates shall be issued only for animals which are registered by numbers or codes applied directly on one side of the body or by standardised shells. The animal registration system and the marking of the other breeding material shall be established by the Ministry of Agriculture and Food Industry. + Article 26 In order to improve livestock, the main method of growth in clean breed will be used. Multiplication of animals referred to in art. 20 lit. a) and f) will only be done by breeding in clean breed. The metisation and hybridization works, carried out in order to increase the productive capacity of animals and birds in the production units, will be conducted conducted, with the technical support and under the guidance of the units carrying out official control of production, based on fundamental scientific programs, prepared by the care of the Academy of Agricultural and Forestry Sciences, by the research units of profile and approved by the Ministry of Agriculture and Food Industry. + Article 27 Male reproducers-bulls, vieri, rams and studs-used in semen producing units, in the resorts and communal points of mount, as well as the entire herd of animals in the units contained in the provisions of art. 22 lit. a) and c), shall be subject annually to the creditworthiness and ranking. The organization and conduct of the creditworthiness works, the technical norms and the methodology for the appreciation of the breeding material will be established by the Ministry of Agriculture and Food Industry. For the control of the origin of the reproducers, the quality and sanitation of the semen, as well as for the appreciation of the production of the animals subject to official control, the republican breeding and selection unit will establish The Ministry of Agriculture and Food Industry, own laboratories that will also operate as laboratories of expertise. + Article 28 The approval of new breeds, types, lines and hybrids of animals, birds, bees and silkworms, which are carried out in the research and production units, as well as of households, shall be made by the Ministry of Agriculture and Industry Food, on the basis of the conclusions drawn from the analysis of the results obtained in the verification work endorsed by the Zoovet Council. The verification work shall be organised in the animal performance approval centres by the establishments carrying out the official production control and shall be carried out under the conditions laid down in the verification protocols drawn up together with the the central research unit, expanding on at least two successive generations. If deemed necessary, the same checks and cores of animals of the imported breeds or intended to be imported shall be subject to the same verification. + Article 29 In order to highlight and popularize the socialist agricultural units and breeders who are distinguished in the activity of increasing livestock value livestock, as well as in the use of a modern exploitation technology, the Ministry Agriculture and Food Industry and executive committees of the county folk councils and the city of Bucharest will organize, annually, exhibitions-animal and poultry competition with the establishment of the champions of the breed by county, by area and by country and with the granting of cash incentives, in objects and diplomas, within the limits of the funds they were allocated for this purpose. + Chapter 3 Organisation of animal breeding + Article 30 The breeding activity of animals has as its main objective the rational use of matas and prasila youth, the continuous increase in birth rates and the obtaining of more valuable products that express the improved genetic potential as following the work of improvement carried out. + Article 31 To carry out the tasks shown in art. 30, in the national single economic-social development plan, annual indicators of birth on animal species and counties will be established. Based on these indicators, the management of the socialist units will draw up, with the technical assistance of the specilists from the breeding and selection units, mounting plans and calving for the animals belonging to these units. For animals in households, the plan of staging and calving shall be drawn up by the local specialist staff, together with the animal keepers. + Article 32 Male reproducers may only be used after authorisation. The authorization of the use of male reproducers for natural mount is made by the county unit, and for artificial seeding, by the republican unit that carries out the official production control. Reproducers reached the age of monta for which the use was not authorized shall be subject to sterilization. + Article 33 The production of the breeding material shall be ensured as follows: a) male reproducers and the male youth intended to test their own performance will be produced by the units provided in art. 22 lit. a), b) and c), as well as by other socialist units or households, from animals included in the official production control, by nominated pairings; b) the male and female youth necessary for the testing of parents or collateral relatives will be produced by directed pairings, both in socialist agricultural units and in households, on the basis of contract concluded with the units within the to which testing works are organized, the holders having the obligation to deliver it at the date and under the agreed conditions; c) the female breeding material of the taurine species will be produced in the socialist agricultural units and in the individual households of its own prasila, and the female breeding material of the other species, provided in art. 19 lit. c), is produced in the socialist agricultural units or in the households of the animal population contained in the official production control; d) the cattle will be fully retained and increased for breeding. Livestock units for cow breeding will take measures to ensure, within existing spaces, sectors for the growth and separate care of cattle and heifers up to the mount. For all heifers will be provided with appropriate breeds, specific to the respective area, and only after calving in relation to the results obtained at the first production cycle will be made their selection for breeding or for reform. In exceptional cases, due to incurable conditions, which make them unfit for breeding, the cattle will be able to be slaughtered only with the approval of the veterinary inspectorate; e) the selected lines of poultry, hatching eggs and day-old chicks will be produced by the selection poultry units and by households, members of the breeders ' association, with the authorization of the establishment carrying out official control production; f) the cores intended for the creation of new breeds, types or lines shall be constituted in scientific research units and, exceptionally, in other agricultural units or households, under the control and guidance of the research unit in the framework of the Academy of Agricultural and Forestry Sciences; g) the semen for artificial inbreeding shall be produced as follows: -frozen semen and zigots for transplantation, in specialized units authorized by the Ministry of Agriculture and Food Industry; -the chilled and raw semen, until its replacement by frozen semen, in the county breeding and selection units or in subunits of artificial inbreeding; -semen for experimental works, in research units, on the basis of the annual thematic plan. The semen shall be delivered or circulated accompanied by an expedition bulletin issued by the producer unit, attesting its origin and quality. + Article 34 The breeding activity, through artificial insremembering, is organized by the county breeding and selection units or by state agricultural units, which respond to the proper functioning of the artificial insremembering points within their radius. activity. Artificial seeding operations will be carried out by zootechnical engineers and veterinarians who respond to the results of these works. Until the need for such staff, another staff, specially trained, can be used to carry out this activity, under the same conditions of responsibility. The right to make artificial insecurities is granted on the basis of an authorization issued by the county breeding and selection units. In the state agricultural enterprises and in the agricultural production cooperatives, the head of the farm is responsible for the production and artificial insemination activity. The completion of the monta and calving plan for animals in households are responsible for veterinarians and specialist staff who carry out artificial seeding. + Article 35 In localities where for one or more species the artificial seeding of animals is not practiced, the offices, respectively the executive committees of the communal, city and municipal folk councils, will organize communal mountain resorts, under the guidance of local staff with zootechnical or veterinary training and who have in their responsibility the plan of mounting and calving for animals in households. In the localities where the herd of cattle, sheep, goats, horses and pigs does not meet for the organization of a communal mountain resort, including in the localities where agricultural production cooperatives are organized, when the situation they require it, the offices, respectively the executive committees of the communal, city or municipal folk councils will set up monta points, with state property reproducers or with authorized reproducers belonging to households population. + Article 36 The use of the breeding material and its multiplication in the production units for the purpose of increasing the breeding animals shall be carried out in accordance with the breeding programme drawn up by the Ministry of Agriculture and Industry. Food, based on a unit methodology, corresponding to each breeding system and to each animal species. + Article 37 The Ministry of Agriculture and Food Industry, the executive committees of the county folk councils and the city of Bucharest and all animal keepers have the obligation to ensure the normal breeding process, in all animal species, with higher quality reproducers, according to established rules. The distribution of reproducers for the production of frozen or chilled semen and for natural mount is made annually by the Ministry of Agriculture and Food Industry, on the proposal of the Republican breeding and selection unit, on the basis of the need for creditworthiness. + Article 38 Reproducers of the taurine, ovine, porcine and equine species will be purchased exclusively from the breeds provided for in the zoning map and only from the units subject to official production control. The delivery of male reproducers is done with the technical assistance of the reproduction and selection county units in which to find out the supplier unit. The delivered reproducers will be accompanied by certificates of origin and productivity, as well as veterinary certificates. + Article 39 The financial means necessary for the procurement of breeding animals shall be constituted, for the state agricultural units, from their own circulating means, and to the other specialized units and to the popular councils, from the investment funds. In the cooperative agricultural units the breeding material is purchased from its own development fund and from long-term loans, in accordance with the legal norms in force. Semen, including zygoths, produced in establishments processing frozen semen, shall be delivered for a fee to the beneficiary units. The breeding and selection units pay the semen from budgetary funds under the conditions and at the prices to be determined by the Ministry of Agriculture and Food Industry, with the opinion of the Ministry of Finance, and disseminate it free of charge agricultural production cooperatives, intercooperative economic associations and households. + Article 40 Male reproducers tested after offspring, of the taurine species, are assimilated to fixed funds and are exempted from depreciation. Also, the other breeding animals assimilated to fixed funds, from specialized units under the Ministry of Agriculture and Food Industry and from popular councils, do not depreciate. + Article 41 In order to know at any time, on the breeds, the number and quality of the reproducers in the artificial insremembering or natural mount units and the other socialist units, as well as their right of use, the evidence of the reproducers will be Nominal: a) the republican breeding and selection unit will keep records of the taurines, stallions and imported rams, those used in the production of frozen semen, as well as those from the county breeding and selection units, the holding units are obliged to inform on the inputs and outputs of the reproducers; b) the county breeding and selection units will keep records of state property reproducers procured from the allotment funds of the counties, which they have in administration, and of the other reproducers authorized for the mount, regardless of property; c) socialist agricultural units and offices, respectively the executive committees of the communal, city and municipal folk councils will keep records of the reproducers from the endowment or assigned for temporary use. + Article 42 The specialized technical bodies, socialist agricultural units and households are obliged to maintain, in accordance with the technical norms developed by the Ministry of Agriculture and Food Industry, male and female breeding producers in conditions that ensure a high fecundity and prolificity, the prevention of miscarriages and loss of pregnant animals, fatality or after-calving mortality, as well as record and report correctly obtained products. Veterinarians and specialists in the units are obliged to take measures to prevent and treat breeding disorders in animals and to carry out the diagnosis of gestation, in accordance with the rules established by the Ministry of Agriculture and Food Industry. + Article 43 The Ministry of Agriculture and Food Industry together with the Ministry of Chemical Industry and other central bodies with tasks in ensuring the production of veterinary preparations and medicines will take measures to satisfy at all times, from domestic production, the need for biological and medicinal products to prevent and combat breeding disorders in animals. The treatment of breeding disorders in cattle from cooperative agricultural units and households is running free of charge. + Chapter 4 Liabilities and penalties + Article 44 Violation of the provisions of this law attracts disciplinary, material, civil, contravention or criminal liability, as the case may be. + Article 45 Constitutes crimes: a) the production of frozen semen outside approved establishments or reproducers for the use of which no authorisations have been issued; b) the dissemination of semen produced outside approved establishments or reproducers for the use of which no authorisations have been issued; c) the culpable dissemination of the semen produced under the conditions laid down in alit. b). The offences under lit. a) and b) shall be punished with imprisonment from 6 months to 5 years. The offence provided at lit. c) is punishable by imprisonment from one month to 2 years or with a fine. + Article 46 The declaration of untrue data on the origin, age, productive performance or health of the breeding material constitutes a crime and is punishable by imprisonment from 3 months to 2 years or with a fine. + Article 47 The execution of artificial innards of unauthorized persons constitutes a crime of exercising without right a profession and is punishable according to art. 281 of the Criminal Code. + Article 48 It constitutes contraventions to the provisions of this law the following facts, if they are not enjoyed in such incit conditions, according to the criminal law, constitutes a crime: a) refusal to perform animal husbandry tasks, established by the popular councils according to art. 9 9; b) non-compliance with the technical rules on numerical insurance of male reproducers used in natural mount, depending on the normal load of females; c) non-compliance with the plan of mating nominees for the production of reproductions, depreciation, unauthorized disposal or cutting, which cannot be justified by veterinary certificate, breeding material; d) the use of non-authorised male coins; e) change of destination of zootehic constructions in violation of provision of art. 5 5 para. 2 2 and 3; f) keeping the semen or hatching eggs in conditions which determine their impairment; g) failure to ensure individualisation or individualisation which creates doubt on the identity of animals subject to official control, of the animals used in the testing works of male reproducers, as well as of semen or eggs of incubation; h) the registration, at fault, in the zootechnical record, in the certificates on the quality of the breeding material or in the veterinary ones of erroneous data on the origin, age, productive performance, indications of quality of the semen or the health status of the breeding material; i) the use of monta or the refusal of sterilization of unauthorised males as reproducers. + Article 49 The contraventions provided in art. 48 48 shall be sanctioned as follows: -the contraventions provided in lett. a), b), c) and d), with a fine of 300 to 1,500 lei; -the contraventions provided in lett. e), f), g) and h), with a fine of 1,000 to 3,000 lei; -the contravention provided in lett. i), with a fine of 1,000 to 3,000 lei and confiscation of the animal. Contravention sanctions can also be applied to legal entities. Fines imposed on legal entities will be charged by them to guilty individuals. + Article 50 The finding of contraventions and the application of sanctions are made by the authorized ministry of agriculture and food industry, from the central apparatus of the ministry, from the breeding and selection units and from the apparatus of the county agricultural bodies and the city of Bucharest, as well as mayors. + Article 51 Provisions art. 48-50 are completed with those of Law no. 32/1968 establishing and sanctioning contraventions. + Chapter 5 Final provisions + Article 52 This law shall enter into force 60 days after the date of publication in the Official Bulletin of the Socialist Republic of Romania *).
