EXPLANATORY MEMORANDUM the purpose of Adjoining law approving the Decree nr. 387/1972 for modifying the Decree nr. 141/1967 on military pensions and State additional pension, published in the Official Gazette, part I, no. 113 of 20 October 1972.
As a result of the approval of the principles to increase pensions by the National Conference of the Communist Party in 19-21 July 1972, the Executive Committee of the Central Committee of the Communist Party of the established appropriate measures required to amend or supplement certain provisions of Decree No. 141/1967 on military pensions and supplementary pension.
To this end, it has issued Decree No. 287/1972, in which have been established, mainly the following: increase the percentage of some) calculation of pensions for military;
(b) the granting of pension) pension for parents, brothers and sisters are held account-in addition to the other conditions laid down by Decree nr. 141/1967-and on condition that the issue in question to have been dependent on the person who died. Also, the survivor's pension is granted only if and as long as the issue is not an employee, a member of a cooperative craft or to exercise a profession or craft on their own;
c) for granting survivor's pension payable to the spouse or spouse without children, married to a retired with pension service that subsequently died, is claimed and on condition that the duration of the marriage to have been at least 5 years before she got sick of death; If the breadwinner's death was due to an accident of any kind or contracting an illness worsened during the times and because of his military service, or an occupational disease, the survivor's pension is granted irrespective of the duration of the marriage;
d minimum amounts) amendment to pensions to make them agree with the new amounts resulting from the increase that took place on 1 November 1972;
correlation between the amount of pensions, e) which will be granted after 1 November 1972, with pensions increased at that time, so that, in similar conditions of retirement, new retirees to provide retirement benefits in amounts at least equal to those resulting from the increase.
Since the rules contained in Decree No. 287/1972 have force of law, they were submitted to debate and adopt the great National Assembly, in accordance with article 5. 64 paragraph 2 of the Constitution.
National Assembly of the Socialist Republic of Romania adopts this law.
The sole article approving the Decree nr. 387/1972 for modifying the Decree nr. 141/1967 on military pensions and supplementary pension.
This law was passed by the National Assembly at its meeting on 28 December 1972, with the unanimity of the votes cast by those deputies present at the session of 429.
