Proposal for Resolution No 13 /XIII
The ratification of Protocol No 15, which amends the Convention for the Protection of Rights
Human and Fundamental Freedoms, open for signature in Strasbourg, on June 24
of 2013, under the aegis of the Council of Europe, is an important advance in the matter of the
international protection of Human Rights.
The present Protocol complements the protection already provided for in the Convention for the Protection of the
Human Rights and Fundamental Freedoms, containing provisions that strengthen the
doctrine of the margin of appreciation of States, while prolonging the age of
exercise of the mandates by the judges of the European Court of Human Rights (TEDH),
prevent the opposition to the return of cases to the Full Court, reduce the time limit of
complaint submission from six to four months, and simultaneously eliminate the criterion of the
examination by the internal court in the event of an absence of material injury.
That being the case, Protocol No 15 comes to strengthen the legal mechanisms already in place in the framework
of TEDH, contributing to greater speed of the processes, coherence of its
jurisprudence and stability of the mandates of its Magistrates.
Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following motion for a resolution:

To approve Protocol No 15 amending the Convention for the Protection of Human Rights and
of Fundamental Freedoms, open for signature in Strasbourg, on June 24, 2013,
whose text in the English-language authenticated version and respect translation in Portuguese language,
are published in attachment.
