DRAFT RESOLUTION No. 1434 /XII/4.

Recommends to the Government the weighting of incentives for urban reconversion

of the urban areas of illegal genesis specifically the admissibility of

application of the planned tax regime for urban rehabilitation, with the

adaptations that show necessary.

Exhibition of Motives

The Parliamentary Groups of the Social Democratic Party, the CDS-People's Party and

of the Socialist Party, complying with the provisions of Article 2 (1) of the Law n.

79/2013, of November 26, which provides that the " (...) the Law No. 91/95, of 2 of

september, should be reviewed by December 31, 2014 ", but that this one must" (...) be

preceded by the identification of the existing legal constraints concerning the

process of reconversion of urban areas of illegal genesis ", took the initiative

of presenting the Law Project No. 829 /XII/4 th, which Proceeds to the fifth amendment to the Act

n ° 91/95 of September 2 establishing the excecional regime for conversion

urbanisity of urban areas of illegal genesis and defines the terms applicable to the

regularization of urban areas of illegal genesis during the time period in it

established .

The aforementioned Law Project has firmed up in the findings of the Working Group

constituted by deliberation of the Committee on the Environment, Territory Planning

and Local Power to February 12, 2014 whose scope and object was the Identification of the

Existing Legal Constraints Regarding the Process of Reconstruction of the

Urban Areas of Legal Génese (AUGI) , and aimed to respond, to that extent, to the

improvement of the legal regime in question allowing for consecration of solutions of

greater streamlining and simplification and making the conversion procedure more

celere.

Complementarily, the auscultation carried out by the Working Group at

numerous entities and actors in the process of reconversion has further enabled

affer the existence of another type of embarrassment that, directly or indirectly,

hinder the process of reconversion and that, without prejudice to the responsibility of the

respect interveners, should merit careful consideration in the sense of their

reduction.

From this made, and mindful of the social concern that this matter integrates, the present

Draft Resolution recommends to the Government the weighting of solutions and

incentives for the urbanistic conversion of urban areas of illegal genesis

specifically the admissibility of application of the tax regime provided for

urban rehabilitation, with the adaptations that show necessary.

In these terms, under the applicable legal and regimental provisions, the

Deputies under signed from the Social Party Parliamentary Groups

Democrat and the CDS-Popular Party present the present Project of

Resolution:

The Assembly of the Republic resolves, in accordance with the provisions of paragraph 5 of the article

166. of the Constitution of the Portuguese Republic, recommend to the Government that

proceed to the assessment of the possibility of applying to the urban areas of genesis

illegal the relevant existing tax benefits for urban rehabilitation,

with the adaptations that show necessary.
