Proposal for Resolution No 92 /XII

The Portuguese Republic is Party to the Convention for the Suppression of Unlawful Acts Against the

Safety of Maritime Navigation, adopted in Rome, to March 10, 1988 (Convention

SUA), approved, for accession, by the Resolution of the Assembly of the Republic No 51/94 of 12

of August and ratified by the Decree of the President of the Republic no. 66/94 of August 12.

The 2005 Protocol on the Convention for the Suppression of Unlawful Acts against the

Safety of Maritime Navigation, adopted in London, on October 14, 2005, this

open to subscription from February 14, 2006 to February 13, 2007, having the Republic

Portuguese signed the same on June 14, 2006. The Protocol came into force at 28 of

July 2010.

The 2005 Protocol on the Convention for the Suppression of Unlawful Acts against the

Safety of Maritime Navigation contemplates amendments to incriminating standards

statues in the initial text of the 1988 Convention, having its scope of application been

extended, as well as to the procedures to be adopted in a situation in which to be justified

intervention by the authorities or officials of the States Party.

The introduced amendments serve, inter alia, to the international conventions signed

and approved at a date later to the 1988 Convention, as is the case with the Convention on the

Prohibition of Development, Production, Storage and Use of Arms

Chemical and on its Destruction, of Paris, of 1993, of the International Convention for the

Repression of Terrorist Bombings to the Bomb, December 15, 1997, of the Organization

of the United Nations (UN), of the International Convention for the Repression of Acts of

Nuclear Terrorism, also of the UN, of April 13, 2005, and of the International Code

for the Protection of Ships and Port Facilities (ISPS Code), adopted by the

Conference of States Part of the SOLAS Convention of 1974.

The linking to this Protocol has been signalled as a priority in the framework

of various international forums of which the Portuguese Republic is a part in the areas of

maritime security and security against proliferation, and is a necessary condition for which

cesse the suspension of the deposit of the instrument of ratification of the 2005 Protocol on

to the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms

Located on the Continental Shelf, adopted in London on October 14, 2005,

approved, for accession, by the Resolution of the Assembly of the Republic No 100/2011 of 4 of

may, and ratified by the Decree of the President of the Republic No 48/2011 of May 4.

Thus:

Under the terms of the paragraph d ) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following motion for a resolution:

Approve the 2005 Protocol on the Convention for the Suppression of Unlawful Acts against

the Safety of Maritime Navigation, adopted in London, on October 14, 2005, whose

text, in the authenticated version in the English language, as well as the respective translation for language

Portuguese, if published in annex
