Proposal for Resolution No 93 /XII
The Protocol No 11 to the Convention on the Safeguard of Human Rights and Freedoms
Fundamental, it was signed in Strasbourg, on May 11, 1994, it was approved for
ratification by the Resolution of the Assembly of the Republic No 21/97 of May 3 and ratified
by the Decree of the President of the Republic No 20/97 of May 3, having the instrument of
ratification was deposited on May 14, 1997, and entered into force on November 1
of 1998.
The said Protocol restructures the control mechanisms of the European Convention of the
Human Rights, replacing the Commission and the European Court of the Rights of the
Man by a single European Court of Human Rights on a permanent basis.
This restructuring made it necessary to establish the privileges and immunities
granted to the judges of the European Court of Human Rights in the exercise of their
functions.
This made, it was deemed necessary to adapt and consolidate, in a single text, of the
Fourth and Fifth Protocols to the General Agreement on the Privileges and Immunities of the
Council of Europe. It was thus drawn up the Sixth Protocol to the General Agreement on the
Privileges and Immunities of the Council of Europe, which it enshrines, in a single document,
the provisions of the Fourth and Fifth Protocols that is applicable to the new Court, such as
established by Protocol No 11 to the said Convention.

Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following motion for a resolution:
Approve the Sixth Protocol to the Agreement on Privileges and Immunities of the Council of the
Europe, open for signature in Strasbourg, on March 5, 1996, whose texts, in the
certified versions in the English and Portuguese languages, if they publish in attachment.
