Proposal for Resolution No 76 /XII

The International Commission of the Civil State (CIEC) is an intergovernmental organization

which aims to promote international cooperation on civil status and to perfect the

operation of the national services affected in this field.

In view of the said end, the CIEC organises and keeps up to date the acquis de

documentation of a legislative and jurisprudential nature relating to the right of the various

Member States, in matters of the condition of persons, family and nationality, provides

to the respects states information, and proceeds from studies and legal work,

particularly to the elaboration of recommendations or project of conventions that target no

only to harmonize the provisions in force in the Member States, but also to perfect the

good practices of the services which, in the same states, have their post the subjects of the

marital status.

The Portuguese Republic has become a part of the CIEC with the approval of its statutes, by the

Decree No. 563/73 of October 27, published in the Journal of the Government , I Series, No. 252, of

October 27, 1973, whose Notice was published in the Journal of the Government , I Series, n. 274, of 23

of November 1973.

The evolution of the Law derived from the European Union in civil status and the growing

simplification of procedures for acceptance of certain public documents in the

European Union, including the mutual recognition of documents and the civil status of the

people, led to that that many of the initiatives promoted by CIEC lost relief,

staying the vast majority of the conventions of this outdated organization and its scope and

scope of progressively emptied action.

Analyzed the said developments, the legislative densification of the European institutions and the

enhanced cooperation among States in the CIEC's acting matters, it was concluded that the

Portuguese Republic to cease its participation in the International Commission of the State

Civil.

Portugal's withdrawal from CIEC will still meet the need for a management

balanced and judicious of the contributions due by the Portuguese Republic, in the

General Budget of the State, for participation in international organizations, having in

view the reduction of its overall value.

Thus:

Under the terms of the paragraph d ) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following proposal for a Resolution, with a request for priority and

urgency:

Approve the recess, on the part of the Portuguese Republic, to the statute of the Commission

International of the Civil State (CIEC), constituted by the Protocol signed in Bern at 25

from September 1950, by the Financial Regulation approved in Paris, to September 27

of 1951, by the Additional Protocol concluded in Luxembourg, to September 25, 1952,

by the Agreement by exchange of letters, of October 31, 1955 between the CIEC and the Council of the

Europe, by the Regulation adopted in Montreux, on September 5, 1963, and by the Agreement

by exchange of letters, of October 28, 1969 between CIEC and the Hague Conference of

Private International Law.
