APPROVES THE STATUS OF THE BLOOD DONOR

Exhibition of reasons

Blood is a precious and rare good, whose therapeutic use does not find yet today

alternative that allows your dispensation.

Every day, in every hospital and in many other health services, the blood-and the

its components and derivatives-are absolutely necessary and irreplaceable in the

treatment of many patients and in the most diverse clinical situations, whether medical or

surgical time, how many times avoiding a death and saving a life.

Currently, they are in increasing numbers the situations in which it is indispensable to resort to

use of blood, requiring larger volumes of blood available in the services of

health.

The availability of blood for therapeutic purposes depends solely on your

voluntary donation on the part of citizens. Without this generosity, without this godsend

altruistic and supportive, the country and the citizens would not have this important resource

therapeutic in the sufficient quantity to satisfy the daily needs in blood.

The available blood reserves in hospitals thus depend on the will and the

availability of citizens in donating their blood, in a beneficial and regular manner.

It is the responsibility of the State to disseminate, promote and encourage together with the population to

donations of blood and arrange your collection, treatment and management.

Society, all citizens, have a debt of gratitude towards the donors

blood volunteers.

It is, therefore, entirely justifiable that society, as a form of recognition of the

importance of voluntary and gracious donations of blood and to increase your number and

frequency, can assign blood donors some benefits when they resort to the

National Health Service, namely, the total exemption of moderating fees.

The consecration in the law of the Statute of the Blood Dancer, establishing rights and duties, is

a very important step to raise awareness, motivate and mobilize citizens for the

social and human value of voluntary blood donation, at the same time as materializing the

public recognition that, very legitimately, is due to all the donors of

blood.

Thus, in the applicable constitutional and regimental terms, the Deputies and Deputies of the

Left Block, present the following Draft Law:

Article 1.

Object

This Act approves the Statute of the Blood Donor, which is listed in the Annex to this Law,

of which it is an integral part.

Article 2.

Regulation

This Law shall be regulated by the Ministry of Health within 90 days

after its publication.

Article 3.

Entry into force

This Law shall come into force on the day following its publication.

Status of the Blood Dador

CHAPTER I

From the donor and the blood donation

Article 1.

Donor of blood

1-Dador of blood is the individual who voluntarily gives blood for therapeutic purposes.

2-Candidate a donor is the individual who presents himself in a blood harvesting centre and

declare to be your wish to donate blood.

3-Can donate blood to individuals who meet the minimum eligibility criteria.

Article 2.

Gift of blood

1-A blood donation is a civic, voluntary, beneficial and unpaid civil act.

2-A donation is considered to be regular when the donation antecedent has been effected in the

last two years.

3-Should the minimum time intervals between donations be respected, according to

the one established by the blood services.

CHAPTER II

Of the rights and duties of the blood donor

Article 3.

Rights of the blood donor

The donor or candidate the donor is entitled to:

a) To respect and safeguard your physical and mental integrity;

b) To receive accurate, understandable and complete information on all aspets

relevant related to the donations of blood;

c) Not to be discriminated against on the grounds of their ancestry, sex, race, religion, instruction,

economic situation, social condition or sexual orientation;

d) To the confidentiality and protection of your personal data;

e) To the public recognition;

f) To the exemption of the moderating fees in the access to benefits of the National Health Service

(SNS);

g) To be absent from your activities in order to give blood;

h) To the insurance of the donor.

Article 4.

Duties of the blood donor

Blood donors must provide to the blood harvesting centre all the

necessary information, responding with truth, awareness and responsibility to the

issues that are placed on it.

CHAPTER III

From the associations of blood donors

Article 5.

Associations of blood donors

1-Blood donors can freely and voluntarily constitute themselves in associations of

blood donors.

2-Blood donor associations are privileged partners in the promotion of the

rights and duties of blood donors, in the dynamisation of blood donation and in the

information and clarification of doubts about the donation of blood.

3-Blood donor associations collaborate with the official entities in the

campaigns for the promotion of donation and or of blood harvesting and in the definition of policies,

legislative measures and plans of activities related to the donation of blood.

4-Blood donor associations are free to group together or film in unions,

federations or confederations, of a local, regional, national or international scope, with

analogous purposes.
