Proposal for Resolution No 10 /XII
The Portuguese Republic and the Republic of Peru have been promoting a deepening
of its bilateral relations, which translates into the intensification of dialogue in various areas of
common interest.
The Treaty on the Transfer of Condensed Persons between the Portuguese Republic and the
Republic of Peru, signed in Lima, on April 7, 2010, is yet another example of this
cooperation, with the object of the promotion and deepening of cooperation between
Portugal and Peru in the area of Justice.
The Treaty makes it possible to transfer a convicted person on the territory of one of the
countries for the territory of the other for it to comply, or continue to comply, a
sentencing that was imposed on him by sentence carried forward on trial, contributing, by this
via, for the social reinsertion of the convicted persons in the State of origin. The request for
transfer can be requested either by any of the countries or by the person themselves
doomed, thus allowing nationals of both countries to comply with the sentence
deprivation of freedom in its originating social environment.
It is thus of particular importance to proceed with the approval of the treaty.
Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following proposal for a Resolution:
CHAIR OF THE COUNCIL OF MINISTERS
Approve the Treaty on the Transfer of Sentenced Persons between the Republic
Portuguese and the Republic of Peru, signed in Lima, on April 7, 2010, the text of which
certified versions in the Portuguese and castelian languages, it publishes in attachment.
