Exhibition of Motives

Council Directive No 2006 /100/CE of November 20, 2006 introduces

amendments to several Directives in the context of the free movement of persons by virtue of accession

from Bulgaria and Romania. Some changes focus on the so-called Directives

"lawyers" (Directive No 77 /249/CEE and Directive No 98 /5/CE), both of which are transposed to

the national legal planning by the Statute of the Order of Lawyers.

As such, it appears necessary, to ensure compliance with the said Directive,

promote an amendment to Article 196 of the Status of the Bar Association

(recognition of the professional title), which conforms to the way in which it is written

"lawyer" in the mother tongues, recognizing in this way the Bulgarian lawyers and

romanians and allowing the exercise of their profession in Portugal.

It was heard the Order of the Lawyers.

Thus:

Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following proposal for a law:

Amendment to Law No. 15/2005 of January 26

Article 196 of the Statute of the Order of Lawyers, adopted by Law No. 15/2005, of

January 26, as amended by Decree-Law No. 226/2008 of November 20, passes to

following wording:

They are recognized in Portugal, in the quality of lawyers, and as such

authorized to exercise the respective profession, in the terms of the articles

subsequent, the persons who, in their respective member countries of the Union
