DRAFT RESOLUTION NO. 66 /XI

Participation of the Assembly of the Republic in the Parliamentary Assembly of the

Community of Portuguese-speaking Countries (AP-CPLP)

The Community of Portuguese-speaking Countries (CPLP) is the multilateral venue

privileged for the deepening of mutual friendship, political concertation-

diplomatic and cooperation between its member countries.

In 2008, by the Resolution of the Assembly of the Republic No. 30/2008 of July 23,

have been enshrined, in the national legal order, the amendments to the Statutes of the CPLP,

specifically, considering the Parliamentary Assembly of the CPLP the body that brings together the

National parliaments of the Member States (art. 8º of the Statutes).

The establishment of the Parliamentary Assembly of the Community of Countries of Language

Portuguese (AP-CPLP), whose constitutive assembly proceeded in April 2009, in

Sao Tome and Principe, asseverates the importance of the institution of an organ that, by gathering

the representations of all the Parliaments of the Community, which substantiate the

election results of the legislative elections of the respective countries, constitutes a space

of political dialogue that facilitates the exchange of cultural, economic and social experiences,

with the aim of consolidating and deepening democracy, the rule of law and the

respect for human rights.

At its first meeting, the AP-CPLP approved its Statute and Rules

(attachments).

Thus, I present to the Assembly of the Republic, in the regimental terms, the following

draft resolution:

Article 1.

Membership

The Assembly of the Republic adheres to the Parliamentary Assembly of the Community of Countries

Portuguese Language (AP-CPLP) and accept its Statute and its Rules, which if

publicize in annex to this resolution, without prejudice to the amendments to it

be introduced by the procedure in them.

Article 2.

Delegation

1-A participation of the Assembly of the Republic in the Parliamentary Assembly of the

Community of Portuguese-speaking Countries (AP-CPLP) is ensured by the

President of the AR and by a national delegation (national group).

2-A The national delegation (national group) is composed of five effective members,

including a President and a Vice President.

3-A National Delegation (national group) is composed also of five members

alternates, which will replace the actual members in the event of hindrance.

4-A The national delegation (national group) should be pluripartisan, reflecting the

composition of the Assembly of the Republic.

Article 3.

Competencies

1-The President of the AR is a member of the Conference of Presidents of Parliaments and of the

Plenary of the Parliamentary Assembly.

2-A National Delegation (national group) is a member of the Parliamentary Assembly and

performs the tasks, exercises the powers and fulfils the obligations laid down in the

Resolution of the Assembly of the Republic paragraph 30/2008 of July 23 in the Statutes and

in the Rules of the Parliamentary Assembly of the Community of Countries of Language

Portuguese.

3-The President of the national delegation (national group) directs his works and

coordinates the performance of the respective members.

4-Whenever the President of the AR attend the meetings of the Parliamentary Assembly

takes over, by inherence, the chair of the Portuguese Delegation.

5-In his absences and impediments, the President of the national delegation (group

national) is replaced by the Vice-President.

Article 4.

Mandate

1-A The national delegation (national group) is elected by the Assembly of the Republic in the

beginning of each Legislature and for the period of this.

2-The members of the national delegation (national group), if they are re-elected

deputies, hold on to duties until further election.

Article 5.

Health

The operation of the national delegation (national group) shall be governed by the provisions of the

article 2 of the Resolution of the Assembly of the Republic No 5/2003 of January 22.

Article 6.

Standards applicable

The national delegation (national group) and its members meet the standards

applicable of the Rules of the Assembly of the Republic and of the Resolution referred to in the article

previous.
