PRESIDENCY of the COUNCIL of MINISTERS resolution No. 131/X/4th 1 whereas the Council of Europe Convention on laundering, search, seizure and confiscation of the proceeds from Crime and the financing of terrorism, opened for signature in Warsaw on 16 May 2005, having been signed by Portugal on the same date; Recognising that this Convention meets the need felt in the Council of Europe to update the Convention on laundering, search, seizure and confiscation of the proceeds from Crime, of 1990, to expand their substantive regime preventing and restraining terrorist financing; Given that the Convention will meet the international standards in force relating to the prevention of money laundering and financing of terrorism, constitute a legal instrument of reference for the Member States of the Council of Europe. So: under d) of paragraph 1 of article 197 of the Constitution, the Government presents to Parliament the following: article 1 motion for a resolution Approving the Council of Europe Convention on laundering, search, seizure and confiscation of the proceeds from Crime and financing of terrorism, adopted in Warsaw, 16 May 2005, the text authenticated version in English and their translation into Portuguese language is annexed.

PRESIDENCY of the COUNCIL of MINISTERS resolution No. 131/X/4th 2 article 2 the Portuguese Republic formula, pursuant to the Convention referred to in the preceding article, the following declarations: a) for the purposes of article 17 of the Convention, the Portuguese Republic declares that this provision only applies to the categories of offences set out in the annex to the Convention on laundering , Detection, seizure and confiscation of the proceeds from Crime and the financing of terrorism, as defined by its legislation; b) the application of paragraph 2 of article 31 of the Convention is subject to the existence of bilateral or multilateral conventions on mutual assistance between the Portuguese Republic and the party of origin; c) for the purposes of article 33 of the Convention, the Portuguese Republic declares that the central authority is the Attorney General of the Republic, located in the Rua da Escola Politécnica, paragraph 140, 1269-269, Lisbon; d) for the purposes of article 35 of the Convention, the Portuguese Republic declares that requests and accompanying parts which are directed must be accompanied by their translation into Portuguese language or one of the official languages of the Council of Europe;



PRESIDENCY of the COUNCIL of MINISTERS resolution No. 131/X/3 and 4) for the purposes of article 42 of the Convention, the Portuguese Republic declares that the information or evidence provided by the Portuguese State may, without your consent, be used or transmitted by the authorities of the requesting party for the purpose of research or procedure other than those specified in the request.
