Proposal for Resolution No. 121 /X

Considering that alongside the accountability of the whole society, governments, communities

locals, social partners and civil societies in combating discrimination of people with

Disability provided for in the Convention on the Rights of Persons with Disabilities, is

instituted by this Optional Protocol an international monitoring system of the

application of the Convention, through which the Committee on the Rights of Persons with

Disability, created by the Convention and composed of independent experts, will analyse the

progress verified at the national level, based on submitted national reports

by the States Party;

Considering that this Optional Protocol innovatively recognizes the right of the

individuals or group of individuals to submit individual complaints to the Committee, which

investigates the situations of default with the aim of ensuring compliance with the

obligations established by the Convention;

Considering that the Optional Protocol thus constitutes yet another historical milestone in the

warranty and promotion of the human rights of all citizens and in particular of the

people with disabilities.

Thus:

Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following motion for a resolution:

Approve the Optional Protocol to the Convention on the Rights of Persons with

Disability, adopted in New York, on March 30, 2007, the text of which in the version

authenticated in the English language, as well as the respective translation into the Portuguese language, if

publish in attachment.
