Having taken into consideration that the Portuguese Republic is since September 7, 2003 part
in the Convention on Access to Information, Participation of the Public in the Process of
Decision making and Access to Justice in Environment Matter signed in Aarhus, na
Denmark, on June 25, 1998;
Admitting that this Convention does not establish the mechanism and modalities of the
public participation in decisions regarding the authorization of deliberate release in the
environment and the placing on the market of genetically modified organisms, having in
to ensure the prior and actual information and participation of the public prior to the taking
of the said decisions;
Recognizing the importance of integrated environmental deliberations in the
government decision-making processes and the consequent need for the
public authorities have correct, understanding and up-to-date information on
environment;
Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following proposal for a Resolution:
Approve the Amendment to the Convention on Access to Information, Public Participation in the
Process of Decision Making and Access to Justice in Environment Matter, adopted in
Almaty, on May 27, 2005, whose text, in the authenticated version in the English language, thus
as the respective translation for Portuguese language, if published in annex.
