1 PROPOSAL of law No. 223/X explanatory memorandum to this law transposes to the internal legal order the directive no. 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications, and Council Directive 2006/100/EC of 20 November 2006 adapting certain directives in the field of free movement of persons as a result of the accession of Bulgaria and Romania, establishing the rules applicable to the recognition of professional qualifications acquired in another Member State of the European Union by a national of a Member State wishing to exercise, on the national territory, as self-employed or as an employee, a regulated profession subordinated according to national legislation and not covered by other specific arrangements. Those directives are also applicable to non-Member States of the European Union are signatories to the agreement on the European economic area, pursuant to decision of the EEA Joint Committee No 142/2007 of 26 October 2007 amending Annex VII (mutual recognition of professional qualifications) and Protocol 37 to the EEA Agreement. Thus, facilitates the exercise of the right of establishment and freedom to provide services in a number of activities, creating a system that allows the recognition of diplomas, certificates and other evidence of formal qualifications, as well as the recognition of professional experience in activities in which it is considered enough pursuit qualification during a reasonable period of time and recent enough. The arrangement provided for in the draft also covers the recognition of qualifications obtained outside the European Union by Member State national, provided that the initial recognition on the professions concerned complies with the minimum training conditions laid down.

2 to promote the uniform application of the regime provided for in this law, is created a coordinating entity that will have as fundamental mission to coordinate the national authorities competent to issue or receive evidence of formal qualifications and other documents or information. The Directive 2005/36/EC repeals and replaces several previous directives on the recognition of professional qualifications. For this reason, the revocation of qualifications governing the recognition of professional qualifications, unifying its regime. The project corresponding to this law was published, for public appreciation, in the Reprint of the labour and Employment Bulletin No. 6, of 3 October 2007. The opinions have been considered in this context, having been amended accordingly some aspects of the draft submitted for public consultation. Account has been taken of the corrections however made to the text of the directive and its annexes, as well as the changes introduced by Regulation (EC) No 1430/2007 of 5 December 2007. Were heard the Government organs of the autonomous regions. So: under d) of paragraph 1 of article 197 of the Constitution, the Government presents to the Assembly of the Republic the following Bill: chapter I General provisions article 1 subject-matter and scope 1-this law carries out the transposition into domestic law of Directive 2005/No. 36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications and Directive No. 3 2006/100/EC of 20 November 2006 adapting certain directives in the field of free movement of persons, by reason of accession of Bulgaria and Romania, establishing the rules applicable in the national territory, the recognition of professional qualifications acquired in another Member State of the European Union by national of a Member State wishing to exercise as self-employed or as an employee, a regulated profession subordinated not covered by other specific arrangements. 2-the scheme referred to in paragraph 1 shall also include the recognition of qualifications obtained outside the European Union by Member State national, and the initial recognition concerning the professions referred to in section III to respect the minimum training conditions there laid down. 3-the recognition of professional qualifications enabling the holder to exercise on the national territory the profession for which he is qualified in the home Member State under the same conditions as the professionals who have acquired the qualifications in that territory. 4-for the purposes of this law, the profession which the applicant intends to carry out is the same as for which is qualified in the home Member State if the activities covered are comparable. 5-the provisions of this law shall be without prejudice to the need for compliance with the requirements of diverse nature of professional qualifications, which are provided for in legislation applicable to access or maintenance in the exercise of economic activities. 6. this law is applicable to European Union national and nationals of non-Member State of the European Union which is party to the agreement on the European economic area, pursuant to decision of the EEA Joint Committee No 142/2007 of 26 October 2007 amending Annex VII (mutual recognition of professional qualifications) and Protocol 37 to the EEA Agreement. 7-references to the European Union set out in this decree-law shall be construed


4 as references also to the European economic area, taking into account the decision referred to in the preceding paragraph. Article 2 definitions for the purposes of this law: (a)) ' competent authority ' means a body empowered by a Member State to send or receive evidence of formal qualifications and other documents or information, as well as to receive applications and take the decisions referred to in this law; b) "Manager of an undertaking" means the person who performs or has exercised, in company of the sector of activity concerned, one of the following functions: i) a manager of an undertaking or branch; II) Replacement of the Manager of an undertaking where that post involves responsibility equivalent to that of the Chairman; III) table top with commercial or technical functions, responsible for one or more departments of the undertaking; c) «Member State of establishment ' means the Member State where the applicant is legally established to practise the profession corresponding to qualifications; d) ' home Member State ' means the Member State where the qualifications were acquired; e) «adaptation», the exercise, in the national territory, of a regulated profession under the responsibility of a qualified professional, and the stage is accompanied by additional training, in accordance with the rules that establish the your system, including the evaluation; f) ' professional Experience ', the effective exercise of the profession concerned and lawfully in a Member State;

5 g) "regulated education and training» training specifically geared to the pursuit of a given profession, that consists of a cycle of studies, eventually completed by professional training, professional traineeship or professional practice, and the structure and level of which are determined by regulations of the Member State concerned or monitored or approved by the authority designated for that purpose; h) ' regulated profession ' means the activity or group of professional activities access, exercise or one of the modes of pursuit depend directly or indirectly from the ownership of certain professional qualifications, and in particular, a form of exercise the use of a professional title limited to holders of a given professional qualification; I) «aptitude test ' means the test on the professional knowledge of the applicant for the purpose of assessing your fitness to practise a regulated profession, carried out by the competent national authorities pursuant to rules established by them, and prior to your implementation be communicated to the applicant on the list of subjects, including the rules governing professional ethics and conduct, which are part of the required training for the profession in question and which are not covered by any of the evidence of formal qualifications submitted; j) «professional qualifications» qualifications attested by evidence of formal qualifications, Declaration of competence, as referred to in point (i))) (a) of article 9, or professional experience; l) ' title of training ', the diploma, certificate or other evidence of formal qualifications issued by a competent authority of a Member State, certifying vocational training received mainly within the European Union, and also any evidence of formal qualifications issued outside of this scope, since your holder has, in the profession, a duly certified professional experience of at least three years in the territory of the Member State which initially recognized the title; m) ' self-employed ', the liberal professional or other person who performs the work your on your own, not being linked to any 6 entity by an employment contract. CHAPTER II article 3 service delivery principle of freedom to provide services 1-subject to the provisions of articles 4 to 6, can provide services freely in the national territory the professional legally established in another Member State to practise the profession in question and, in the case of the profession not to be regulated in the Member State of establishment, professional in this to have exercised for at least two years during the previous 10 years. 2-the professional service provider, hereinafter referred to as service provider, shall be subject to legal or regulatory standards on professional conduct, directly linked to professional qualifications, in particular those relating to the definition of the profession, the use of titles and serious professional errors directly and specifically related to the defence and security of the consumer, including disciplinary provisions applicable to professionals who pursue the same profession in that territory. 3-the application of the provisions in this chapter depends on the temporary and occasional nature of the provision, evaluated case-by-case basis and taking into account, inter alia, duration, frequency, periodicity and continuity of the same provision. 4-the competent authorities shall formulate, as far as possible, the General rules to be observed when the assessment referred to in paragraph 1, taking into account the experience of each authority regarding regulated professions that are under your responsibility. Article 4 exceptions to national rules 1-the service provider is not subject to authorization for the exercise of the profession, nor the registration with or membership of an organization or a professional body, without prejudice to the provisions laid down in the following paragraphs.


7 2-the service provider shall be deemed to have been entered in the corresponding public association to the occupation exercised, in particular for disciplinary purposes, of the initiation of the provision. 3-for the purposes of the preceding paragraph, the competent authority, if does not correspond to the respective public association, sends the copy of the Declaration referred to in the following article or your renewal and, when profession is covered by article 6 or by section III of chapter III, the Declaration is accompanied by a copy of the documents provided for in paragraph 1 of the following article. 4-the service provider does not have to subscribe to a public social security body to settle with a principal insurer, the Auditors relating to the activities carried out for the benefit of persons covered by an insurance system and should inform that body in advance or, in an emergency, after the completion of the provision of services. Article 5 prior Declaration on movement of the service provider-1 during the first movement to the national territory, the service provider shall inform in advance the competent authority as to the profession in question by means of a written declaration in accordance with the model that is adopted, accompanied by the following documents: (a) Proof of the nationality of the service provider); b) certificate stating that the service provider is legally established in a Member State for the purpose of practising the profession in question and who is not, at the time of issue of the certificate, forbidden, even if temporarily, of the exercise; c) evidence of formal qualifications; d) in the cases referred to in the last part of paragraph 1 of article 3, any means of proof that the service provider has exercised the profession in question for at least two years during the previous 10 years;

8 e) certificate of criminal record for criminal convictions in the case of occupation is required who engaged in the national territory. 2-the Declaration is valid for one year and is renewed for subsequent services, being, in this case, the join of the documents referred to in the preceding paragraph, if there has been change in the situations attested. Article 6 prior verification of qualifications 1-during the first provision of services, in the case of regulated profession with impact on public health or safety specified in the lists to be published pursuant to paragraph 1 of article 51 and who do not benefit from automatic recognition under section III of chapter III, the competent authority shall, prior to verifying the professional qualifications of the service provider to the extent necessary to avoid serious damage to the health or safety of the service recipient due to a lack of professional qualification of the service provider. 2-When the professional qualifications of the service provider have substantial divergence regarding the training required in the national territory, so that may result injury to the health or safety, the service provider can demonstrate that it has acquired the required knowledge and skills, in particular by means of an aptitude test. 3-within 30 days following receipt of the prior statement and the documentation it attaches, the competent authority shall inform the applicant, as the case may be: a) the verification of conformity; (b)) the verification of substantial divergence; (c)) the fact that the circumstances of the investigation involve the extension of the deadline to decide for another 30 days. 4-when the substantial divergence, the applicant may choose to join additional relevant information or process providing aptitude test, and 9 that the final decision on the verification must be, in any case, taken within 60 days from the receipt of the documents referred to in the preceding paragraph. 5-the beginning of the service is to take place within 30 days of the decision referred to in subparagraph (a)) of paragraph 3 or the expiry of the period of 60 days referred to in the preceding paragraph. 6-If the competent authority should decide within the time limits indicated in paragraphs 3 and 4, shall be deemed to have accepted the claim of the applicant. Article 7 information to be provided to the recipient of the service 1-in cases where the provision is carried out under the professional title of the Member State of establishment or under the title of training of the service provider, the service provider shall provide the recipient of the service the following information: a) If the service provider is registered in a trade or other similar public register , the register in which is registered and the registration number, or equivalent means of identification contained in that register; b) if the activity is subject to authorisation in the Member State of establishment, the name and address of the competent supervisory authority; c) the professional association or similar body with which the service provider is registered; d) the professional title or, failing that, the evidence of formal qualifications of the service provider and the Member State in which that title has been granted; e) If the service provider undertake an activity subject to value added tax, the relevant information about this scheme; f) insurance or other form of guarantee liability for acts arising out of the occupation. 2-the provisions of paragraph e) of the preceding paragraph shall not apply to nationals of non-Member State of the Union that is party to the agreement on the European economic area.


10 CHAPTER 3 right of establishment section I General system for the recognition of evidence of formal qualifications article 8 scope 1-this scheme applies to all professions which are not covered by sections II and III of this chapter and shall apply subsidiarily to the professions covered by these sections, where the applicant does not meet the conditions for the recognition of qualifications in them. 2-this regime also applies to holders of evidence of formal qualifications referred to in the last part of paragraph l) article 2 article 9 levels of professional qualifications and supporting titles 1-for the purposes of recognition pursuant to this section, the professional qualifications and titles that prove are grouped according to the following levels: a declaration of competence) or certificate issued by the authority of the home Member State competent for this purpose taking into account, alternatively: i) A formation which does not match a certificate or a diploma within the meaning of article 6(1)(b))), or a specific examination without prior training, or full-time pursuit of the profession in a Member State for three consecutive years or for an equivalent period on a part-time basis in the last 10 years; II) General training the primary or secondary level that to your holder general knowledge; b) certificate stating one of the following cycles of secondary education: 11 i), supplemented by a course of study or professional training other than those referred to in point (c)) or by the probationary or professional practice required in addition to that course; (ii) technical or professional), possibly supplemented by a course of study or professional training as referred to in point (I) above, or the probationary or professional practice required in addition to that course; c) a Diploma certifying successful completion of any of the following: (i)) training at a level of post-secondary education other than as referred to in points (d)) and e), with the duration of at least one year or for an equivalent period on a part-time basis, which is particularly conditioning, as a general rule, the completion of the secondary course required for access to university education or higher or completion of an equivalent training to secondary level , as well as the professional training which may be required in addition to that post-secondary course; II) in the case of regulated professions mentioned in annex II to Directive 2005/36 Nr./EC, as amended by article) of part V of the annex to Council Directive 2006/100/EC and by Council Regulation (EC) No 1430/2007 of 5 December 2007, training with a special structure there referred to, which is equivalent to the level of training referred to in the previous paragraph and that with a comparable professional level prepare also the forming for a comparable level of responsibilities and functions. d) Diploma certifying successful completion of training at post-secondary level of with a minimum duration of three years and not exceeding four years, or an equivalent period on a part-time basis, given in establishment of higher education or another establishment which offers the same level of training, as well as the professional training which may be required in addition to the post-secondary course; e) Diploma certifying successful completion of a post-secondary course of at least four 12 years or an equivalent period on a part-time basis, in establishment of higher education or another establishment which offers the same level of training and, if applicable, the completion of the professional training required in addition to the post-secondary course. 2-is equated with proof of title one of the qualifications referred to in paragraph 1, including the level in question, any evidence of formal qualifications or set of evidence of formal qualifications issued by a competent authority of a Member State, to attest to training received in the European Union that is recognised by that Member State as equivalent level and conferring the same rights and the same preparation as regards the exercise of a particular profession. Article 10 conditions for recognition-1 When, in the national territory, the exercise of a regulated profession is subject to possession of specific professional qualifications, the competent authority allows your Office to the applicant who holds the Declaration of competence or evidence of formal qualifications required by another Member State to practise the same profession which:) Have been awarded by authority of a Member State competent for this purpose; b) Prove the level of professional qualification at least equivalent to the level immediately below that required in the national territory, from those referred to in the previous article. 2-the practice of the profession is also allowed the applicant to have exercised the regulated profession full-time for two years during the previous 10 years in another Member State than the regulation, since that has one or more declarations of competence or one or more qualifications, which must: a) have been issued by authority of a Member State competent for this purpose; b) Prove the level of professional qualification at least equivalent to the level


13 immediately below that required in the national territory, in accordance with the previous article; c) prove the preparation for the practice of the profession concerned. 3-the two years ' professional experience referred to in the preceding paragraph are not required when the applicant's qualifications declare regulated education and training corresponding to one of the levels of qualification referred to in paragraph 1 (b))) of the preceding article, being the training referred to in annex III to the Directive 2005/36/EC, as amended by Regulation (EC) No 30/2007 the Commission December 5, 2007, considered regulated level formations referred to in point (c)) of the same article. 4-for the purposes of paragraph 1 (b)) of paragraphs 1 and 2, when in the national territory the exercise of the profession depend on a title attesting to training at higher education or university level with a duration of four years, it is considered immediately below the formation level referred to in point (c)) of the preceding article. 5-it is also allowed to practice in the national territory to a professional qualification which, although not corresponding to the requirements of the regulations in force in the Member State of origin, this recognizes as valid for the practice of the profession, the title of acquired rights. Article 11 adaptation period and aptitude test 1-Without prejudice to the provisions of the following article, the competent authority shall decide on the need for the applicant to carry out an adaptation for a maximum period of three years or an aptitude test, in the following cases: a) If the length of training provided for in paragraphs 1 and 2 of the preceding article is less than in at least one year required by national legislation for the profession in question; b) training materials cover substantially different from those required by the national law for the profession in question;

14 c) If, under national legislation, the regulated profession encompass one or several activities that have no match in the same profession in the home Member State and for which specific training is required with respect to matters other than those covered by the qualification substantially proven. 2-for the purposes of paragraph 1 (b)) and c) of the preceding paragraph, considered to be substantially different matters essential to the practice of the profession, for which the duration and content of the training of the applicant present substantial differences with regard to the training required by national legislation. 3-for the purposes of paragraph 1, the competent authority shall consider whether the professional experience gained by the applicant in the EU or outside it is likely to offset, in whole or in part, the differences in training, as well as the appropriateness of the duration of the internship to the abolition of the same differences. 4-in the situations referred to in paragraph 1, it is up to the applicant to choose between the adaptation period and the aptitude test, except as provided in the following paragraph. 5-the competent authority decides to justifiably cases where, for a given profession, must be performed adaptation period or aptitude test, taking into account the degree of knowledge of the national law necessary for the regular exercise of the profession. 6-the provisions of the preceding paragraph shall apply to cases where the evidence of formal qualifications obtained outside the European Union, pursuant to the final part of paragraph l) article 2 article 12 common platform 1-for the purposes of this article, "common platform" a set of criteria which, in relation to particular regulated profession, let consider substantial differences identified between compensated the training requirements in at least two-thirds of the Member States, including all that regulate the profession in question 15, bearing in mind the duration and content of training. 2-Each common platform is approved by the Committee referred to in paragraph 2 of article 52-3 in situations referred to in paragraph 1 of the preceding article, if the applicant's professional qualifications satisfy the requirements of the common platform, is excused the frequency of training or aptitude test. Section II recognition of professional experience article 13 professional experience requirements 1-exercise in national territory of an activity referred to in annex I, which is regulated by the requirement of General knowledge and skills, is allowed to the applicant to have exercised in another Member State, in accordance with the following articles. 2-the nature and the duration of the exercise and, where appropriate, the prior training of the applicant are proven by a document issued or considered valid by the competent authority of the Member State of origin. Article 14 Activities in list I of annex I 1-Can exercise any activity on the list I of annex I to the professional who have exercised by one of the following periods: a) Six consecutive years as self-employed or as a manager of an undertaking; b) Three consecutive years as self-employed or as a manager of an undertaking, provided that to operate have previous training of at least three years; c) Four consecutive years as self-employed or as a manager of an undertaking, provided that to operate have previous training of at


16 not less than two years; d) Three consecutive years as self-employed, providing you have exercised the activity as an employed person for at least five years; and) five consecutive years as Senior Executive, including three years with commercial functions or other technical functions and being responsible for one or more departments of the undertaking, provided that, for the activity in question, has previous training of at least three years. 2-in the cases referred to in (a)) and (d)) of the preceding paragraph, the pursuit of the activity shall not have ceased more than 10 years at the time of the submission of the complete dossier by the applicant to the competent authority. 3-the training referred to in paragraph 1 (b)), (c)) and e) of paragraph 1 should be attested by a certificate recognised by the Member State of origin or considered valid for this purpose by a competent professional body. 4-the provisions of paragraph e) of paragraph 1 shall not apply to activities of barbers, the Group ex 855 CITES nomenclature. (international standard classification of activities of all branches of economic activity). Article 15 the activities in list II of annex I 1-Can exercise any activity contained in list II of annex I to the professional who have exercised by one of the following periods: a) Five consecutive years as self-employed or as a manager of an undertaking; b) Three consecutive years as self-employed or as a manager of an undertaking, provided that to operate have previous training of at least three years; c) Four consecutive years as self-employed or as a manager of an undertaking, provided that to operate have previous training of at least 17, two years; d) Three consecutive years on a self-employed basis as self-employed or as a manager of an undertaking, provided that it has exercised the activity as an employed person for at least five years; and) five consecutive years as employee, since to operate have previous training of at least three years; f) Six consecutive years as employee, since to operate have previous training of at least two years. 2-in the cases referred to in (a)) and (d)) of the preceding paragraph shall apply the provisions of paragraph 2 of the preceding article. 3-the training referred to in paragraph 1 (b)), c), and) and f) of paragraph 1 should be attested by a certificate recognised by the Member State of origin or considered valid for this purpose by a competent professional body. Article 16 Activities in list III of annex I 1-Can exercise any activity contained in list III of annex I the professional that has exercised by one of the following periods: a) Three consecutive years as self-employed or as a manager of an undertaking; b) Two consecutive years as self-employed or as a manager of an undertaking, provided that to operate have previous training; c) Two consecutive years as self-employed or as a manager of an undertaking, provided that it has exercised the activity as an employed person for at least three years; d) Three consecutive years as employee, since to operate have previous training.

18 2-in the cases referred to in (a)) and c) of the preceding paragraph shall apply the provisions of paragraph 2 of article 14 3-the training referred to in paragraph 1 (b)) and d) of paragraph 1 should be attested by a certificate recognised by the Member State of origin or considered valid for this purpose by a competent professional body. Section III Recognition on the basis of coordination of minimum training conditions Subsection I General provisions article 17 principle of automatic recognition 1-the competent authorities shall recognise evidence of formal qualifications of doctor with basic training and specialised doctor, nurse responsible for general care, dental and dentist, veterinarian, pharmacist and architect, constants , respectively, of 1.1 points, 1.2, 2.2, 3.2, 3.3, 4.2, 6.2 and 7 of annex II which comply with the minimum training conditions laid down, as appropriate, in articles 21, 22, 28, 31, 32, 35, 41 and 43, for the purpose of exercise by the applicant in the territory of the same activities that holders of corresponding qualifications issued in Portugal. 2-The diplomas to recognize under the preceding paragraph must have been issued by the competent national authorities and be accompanied, where appropriate, the certificate referred to in points 1.1, 1.2, 2.2, 3.2, 3.3, 4.2, 6.2 and 7 of annex II. 3-the preceding paragraphs shall not affect the acquired rights referred to in articles 19, 24, 30, 34, 36 and 46 4-the competent authority recognizes, for the pursuit of the activities of general medical practitioner under the national health service, evidence of formal qualifications referred to


19 in point 1.4 of annex II, granted by another Member State in accordance with the minimum training conditions laid down in article 25 without prejudice to the provisions of article 27-5 the competent authority recognizes the evidence of formal qualifications as a midwife referred to in annex II, point 5.2, granted by another Member State, subject to compliance with the minimum conditions of qualification set out in article 37 and the criteria laid down in article 38 , with safeguarding the acquired rights referred to in articles 19 and 6-40, the competent authority is not obliged to recognize evidence of formal qualifications referred to in section 6.2. Annex II to the establishment of new pharmacies open to the public, considering as such the pharmacies open less than three years from the date of entry into force of this law. 7-to be recognised pursuant to paragraph 1, the evidence of formal qualifications as an architect referred to in point 7 of annex II concern the formation not started before the reference academic year indicated in that annex. 8-the pursuit of the professions of doctor, nurse responsible for general care, dental practitioner, midwife, pharmacist and veterinary surgeon, is dependent on the possession of evidence of formal qualifications referred to in points 1.1, 1.2, 1.4, 2.2, 3.2, 3.3, 4.2, 5.2 and 6.2 of annex II, certifying that the applicant has acquired the knowledge and skills listed, as appropriate, in paragraph 4 of article 21 paragraph 8 of article 28, paragraph 4 of article 31, paragraph 4 of article 35, paragraph 5 of article 37 and paragraph 4 of article 41 9-after the change, by the Committee referred to in article 52, paragraph 2, of the knowledge and skills referred to in the preceding paragraph, with a view to your adaptation to scientific and technical progress, is weighted the need to change national regulations concerning the training and conditions of access to professions concerned. Article 18 provisions 1 training-the training referred to in articles 21, 22, 25, 28, 31, 32, 35, 37, 41 and 43 could have been gained in a part-time Member State authorize and ensure that the overall duration, level and quality of such training is not lower than those of 20 full-time training. 2-Must be provided education and training so that people who complete the studies are aware of the progress made in the context of their profession to the extent necessary to maintain a safe and efficient job performance. Article 19 acquired rights 1-Without prejudice to the acquired rights specific to each of the occupations, when the evidence of education and training: a doctor that allow access to the activities of doctor with basic training and specialised doctor, nurse responsible for general care, dental and dentist, veterinary surgeon, midwife and pharmacist, obtained in another Member State, do not comply with the training requirements laid down in articles 21 , 22, 28, 31, 32, 35, 37 and 41, the competent authority recognizes as sufficient evidence of formal qualifications issued by that Member State, to the extent that attest to training commenced before the reference dates laid down in points 1.1, 1.2, 2.2, 3.2, 3.3, 4.2, 5.2 and 6.2 of annex II and be accompanied by a certificate stating that your holder effectively and lawfully exercised the profession in question for at least three consecutive years during the last five preceding the issuance of the certificate. 2-the provisions of the preceding paragraph shall apply to evidence of formal qualifications of doctor with basic training and specialised doctor, nurse responsible for general care, dental and dentist, veterinary surgeon, midwife and pharmacist obtained in the former German Democratic Republic which does not satisfy the minimum training requirements laid down in articles 21, 22, 28 , 31, 32, 35, 37 and 41, from proving training commenced before: a) 3 October 1990 for doctors with basic training, nurses responsible for general care, dental practitioners, dental specialists, midwives, pharmacists and veterinarians; b) 3 April 1992 for medical experts.

21 3-Without prejudice to paragraphs 1 to 3 of article 34, the competent authorities shall recognise evidence of formal qualifications of doctor with basic training and specialised doctor, nurse responsible for general care, veterinary surgeon, midwife, pharmacist and architect granted by the former Czechoslovakia, or referring to training commenced before 1 January 1993 in the Czech Republic or in Slovakia provided that the authorities of these Member States make sure that these titles have, in your territory, the same legal value of the securities granted by them. 4-the competent authorities shall recognise evidence of formal qualifications of doctor with basic training and specialised doctor, nurse responsible for general care, dental and specialist dental, veterinary surgeon, midwife, pharmacist and architect, or granted by the former Soviet Union, or in respect of training commenced in Estonia, before 20 August 1991 in Latvia, before 21 August 1991, and in Lithuania, before 11 March 1990, since the authorities of these Member States make sure that these titles have, in your territory, the same legal value as the qualifications granted by them. 5-the competent authorities shall recognise evidence of formal qualifications of doctor with basic training and specialised doctor, nurse responsible for general care, dental and specialist dental, veterinary surgeon, midwife, pharmacist and architect, granted by the former Yugoslavia or in respect of training commenced in Slovenia before 25 June 1991, whenever the authorities of that Member State certify that these titles have in your territory, the same legal value of the securities granted by them. 6-the certification referred to in paragraphs 3 to 5 must be accompanied by an attestation issued by the authorities of the Member States referred to therein, stating that the applicant has exercised in your territory in the activities in question, effectively and lawfully been engaged for at least three consecutive years during the last five preceding the issue of the certificate. 7-the competent authorities shall recognise evidence of formal qualifications issued by another Member State and relating to formations of doctor, nurse responsible for


22 general care, dentist, midwife and pharmacist that do not match the names listed for that Member State in points 1.1, 1.2, 1.3, 1.4, 2.2, 3.2, 3.3, 4.2, 5.2 and 6.2 of annex II, provided they are accompanied by a certificate issued by the competent authorities or bodies, certifying that the said diplomas show a formation as , respectively, the provisions of articles 21, 22, 25, 28, 31, 32, 35, 37 and 41 and which are considered by the Member State which issued it as equivalent to those whose names are listed in the said Annex II points. 8-the holders of evidence of formal qualifications as a Bulgarian "фелдшер" (feldsher) not entitled to recognition under this law, such as doctors or nurses responsible for general care. Article 20 implementation of the General system of recognition 1-without prejudice to the provisions of this section, the recognition of qualifications concerning the professions covered by the general scheme provided for in section I in the following cases: a) in respect of doctor with basic training, specialised doctor, nurse responsible for general care, dental practitioner, dentist, specialist veterinarian , midwife, pharmacist and architect, in case the applicant does not satisfy the requirement of effective and lawful professional practice referred to in articles 19, 24, 30, 34, 36, 38, 40 and 46; b) in the case of the architect, in the case of the applicant possess evidence of formal qualifications other than one listed in point 7 of annex II; c) in the case of doctors, nurses, dentists, veterinarians, midwives, pharmacists and architects holding evidence of formal qualifications and should have undergone the training leading to the obtaining of a title referred to in points 1.1, 2.2, 3.2, 4.2, 5.2, 6.2 and 7.1 of annex II only for the purposes of recognition of expertise concerned, without prejudice to the 23 paragraph 1 of article 17 and articles 19 and 24; d) in the case of nurses responsible for general care and specialised nurses holding evidence of formal qualifications and specialized vocational subject to training leading to obtaining a title referred to in point 2.2 of annex II, if the applicant wishes to recognition in another Member State in which the activities in question are carried out by specialised nurses without training for nurses responsible for general care; and) with regard to specialised nurses without training for nurses responsible for general care, if the applicant wishes to recognition in another Member State in which the professional activities are pursued by nurses responsible for general care, specialised nurses without training for nurses responsible for general care or specialised nurses holding evidence of formal qualifications and have undergone the training leading to the attainment of one of the securities referred to in point 2.2 of annex II. 2-the provisions of paragraph 5 of article 11 shall apply in the cases referred to in subparagraphs (a) and (b))) of the preceding paragraph, as well as in the following cases: a) The cases referred to in point (c)) of the same paragraph, in the case of doctors and dentists; (b)) The cases referred to in point (e)), where the applicant seeks recognition in a Member State in which the professional activities are pursued by nurses responsible for general care or specialised nurses holding evidence of formal qualifications and have submitted to the training leading to the obtaining of the evidence of formal qualifications referred to in point 2.2 of annex II. Subsection II Doctor article 21 24 basic medical training 1-admission to basic medical training depends on possession of a diploma or certificate providing access to studies in universities. 2-the basic medical training shall comprise a total of at least six years of study or 5500 hours of theoretical and practical training at a university or under the supervision of a University. 3-For applicants who have commenced their studies before 1 January 1972, the training referred to in the preceding paragraph may include university-level practical training of six months, made the whole time under the guidance of the competent bodies. 4-the basic medical training shall provide an assurance that the applicant has acquired the following knowledge and skills: a) adequate knowledge of the sciences on which medicine is based, as well as good understanding of the scientific methods including the principles of measuring biological functions, the evaluation of scientifically established facts and the analysis of data; b) adequate knowledge of the structure, functions and behaviour of healthy and sick human beings, as well as relations between the State of health of the human being and your physical and social environment; c) adequate knowledge of materials and clinical practice to give a coherent view of mental and physical diseases under the prevention, diagnosis and therapy and of human reproduction; d) suitable clinical experience under appropriate guidance in hospitals. Article 22 specialist medical training 1-admission to specialist medical training depends on successfully completion of six years of study or 5500 hours within the framework of the training course referred to in the previous article, during which have been acquired adequate knowledge


25 of basic medicine. 2-the specialist medical training shall comprise theoretical and practical training at a University, a university hospital or a health care establishment recognized for this purpose by the competent bodies, which ensure that the minimum duration of specialist medical training courses listed in point 1.3 of annex II shall not be lower than the periods set out therein. 3-the training is full time under the guidance of the competent bodies and involves the participation of the applicant in all the medical activities of the Department where it takes place, including periods of emergency, so that the candidate take the practical and theoretical training all your professional activity, which should be adequately remunerated, in accordance with the law. 4-the grant of a title of specialist medical training depends upon the possession of one of the titles of basic medical training referred to in point 1.1 of annex II. Article 23 Names of specialist medical training 1-The evidence of formal qualifications as a specialised doctor referred to in article 17 are those who, being issued by the competent authorities indicated in point 1.2 of annex II, satisfy, for the specialist training in question, to designations in force in different Member States, set out in point 1.3 of the annex. 2-update the point 1.3 of annex II may be carried out by the Committee referred to in paragraph 2 of article 52 through the introduction of new medical specialities which are common to at least two fifths of Member States. Article 24 acquired rights specific to medical experts-1 the competent authority may require the medical experts whose part-time specialist medical training has governed by laws, regulations and administrative provisions in force at the date of 20 June 1975 and who have started your 26 training of specialists until 31 December 1983 that their evidence of formal qualifications be accompanied by a certificate attesting that your holder exercised effectively and lawfully in the activities in question for at least three consecutive years during the last five prior to the issuance of this certificate. 2-the competent authority recognizes the title of specialist doctor issued in Spain to physicians who have completed before 1 January 1995 1 specialized training which does not satisfy the minimum training requirements laid down in article 22, if that title is accompanied by a certificate issued by the competent Spanish authorities certifying that the applicant got approved in the examination of specific professional competence carried out pursuant to Royal Decree No. 1497/99, in order to verify whether the applicant possesses a level of knowledge and skills comparable to that of doctors who possess evidence of formal qualifications in specialized medicine listed in points 1.2 and 1.3 of annex II, in so far as it refers to Spain. 3-The Member States which have repealed laws, regulations or administrative provisions concerning the issue of titles of specialist medical training referred to in paragraphs 1.2 and 1.3 of annex II and took measures for the benefit of their nationals in respect of acquired rights, recognize to nationals of other Member States the right to benefit from the same measures, provided that their qualifications have been issued before the date from which no longer send your qualifications to the specialization concerned. 4-for the purposes of the preceding paragraph, the dates of repeal of these provisions are set out in point 1.3 of annex II. Article 25 specific training in general medical practice 1-admission to specific training in general medical practice depends on successfully completion of six years of study, within the framework of the training course referred to in article 21 2-the specific training in general medical practice for the titles to recognize 27 must meet the following requirements: a) If the title has been issued before 1 January 2006 , lasts for at least two years full-time; b) with regard to qualifications awarded after the date referred to in (a), lasts for at least three years full-time. 3-When the cycle of training referred to in article 21 a practical training given in an approved hospital or that has the proper equipment and general services to general medical practice or in an approved general medical practice or in an approved centre where doctors provide primary care, the duration of the practical training may be included up to a maximum of one year in the duration provided for in subparagraph (b)) of paragraph 2, in cases where the duration of specific training in general medical practice was two years on 1 January 2001. 4-the specific training in general medical practice shall be full-time under the guidance of the competent bodies and has a particularly practical nature. 5-the practical training must meet the following requirements: a) be done during a period of at least six months in an approved hospital possessing appropriate equipment and services and, for the same period minimum, as part of an approved general medical practice or in an approved centre where doctors provide primary care, and may also, subject to the minimum periods referred to above , taking place in another establishment or approved health structure to take care of general medicine, for a maximum period of six months; b) Be carried out in conjunction with other health establishments or structures dealing of general medicine; c) Include the participation of the applicant in the professional activities and responsibilities similar to those of people who work.


28 6-the emission of specific training in general medical practice depends upon the possession of one of the titles of basic medical training referred to in point 1.1 of annex II. 7-the competent authority may grant the diplomas referred to in point 1.4 of annex II the doctors who, not having obtained the training provided for in this article, have another additional training attested by evidence of formal qualifications attesting knowledge of level qualitatively equivalent to those resulting from the training provided for in this article, provided that the applicant has acquired a background in general medicine at least six months within the framework of a general medical practice or a centre in which doctors provide primary care, in accordance with paragraph 5. 8-in the cases referred to in the preceding paragraph, the competent authority determines, inter alia, the extent to which the additional training already acquired by the applicant, as well as your professional experience may be taken into account to replace the training provided for in this article. Article 26 pursuit of the professional activities of general practitioners Without prejudice to acquired rights, the exercise of the activities of general medical practitioner under the national health service, depends upon the possession of evidence of formal qualifications listed in point 1.4 of annex II, the competent authority may however authorize the your exercise by the applicant whose specific training in general medical practice is in progress. Article 27 acquired rights specific to general practitioners 1-Without prejudice to other provisions relating to acquired rights, the competent authority recognizes as acquired the right to exercise the activities of general medical practitioner under the national health service without the evidence of formal qualifications as listed in point 1.4 of annex II, to the doctors who holds this right at the reference date referred to in point under the provisions applicable to access to 29 professional activities of doctor with basic training, and that on that date established in the national territory, having benefited from the provisions of article 17 or article 19 2-for the purposes of the preceding paragraph, the competent authority issuing the favor of doctor holder of rights acquired, and your request , a certificate certifying the right to exercise the activities of general medical practitioner under the national health service without the evidence of formal qualifications as listed in point 1.4 of annex II. 3-the competent authority recognizes the certificates referred to in the preceding paragraph, which are issued in other Member States, giving them identical effects in the national territory, to evidence of formal qualifications awarded by itself and which allow the exercise of the activities of general medical practitioner under the national health service. Subsection III nurse responsible for general care article 28 training for nurses responsible for general care 1-admission to training for nurses responsible for general care depends on a general education of 10 years, attested by a diploma, certificate or other evidence issued by the competent bodies of a Member State or by a certificate of approval in entrance examination the equivalent nursing schools. 2-the training of nurses responsible for general care shall be made full-time and includes, at least, the programme point 2.1 of annex II. 3-the training of nurses responsible for general care shall comprise at least three-year course or 4 600 hours of theoretical and clinical, with the coordination of the entire program of study of the responsibility of the institutions providing training, whose minimum theoretical must constitute at least a third and the clinical training at least , half. 4-Notwithstanding the previous paragraph, can be granted partial waivers to the applicant to the extent of other equivalent formations that you purchased.

30 5-for the purposes of this article: (a)) «theoretical», the part of nursing training whereby the nurse acquires the knowledge, understanding and professional skills needed to plan, dispensing and evaluating overall health care, training provided by the teaching staff of nursing care, as well as by other competent persons in nursing schools and other educational establishments designated by the institution responsible for training; b) ' clinical instruction ' shall mean the part of nursing training whereby the nurse learns within a team and in direct contact with an individual in good health or ill, or a community, planning, dispense and evaluate comprehensive nursing care, on the basis of acquired knowledge and skills, learning, likewise, not only to work in a team , but also to direct it and organize the overall nursing care, including health education for individuals and small groups in a health institution or community. 6-the clinical education is delivered in hospitals and other health institutions and in the community, under the responsibility of teachers and nurses with the cooperation and assistance of other qualified nurses, without prejudice to other qualified professionals can be integrated into the teaching process. 7-the nurse participates in the activities of the departments concerned, provided that such activities contribute to your training and to learn to assume the responsibilities that require nursing care. 8-the training of nurses responsible for general care aims to ensure the acquisition of the following knowledge and skills: a) adequate knowledge of the sciences on which general nursing is based, including sufficient knowledge of the organism, physiological functions and behaviour of people, in good health or ill, as well as of the relationship between the State of health and the


31 physical and social environment of the human being; b) sufficient knowledge of the nature and ethics of the profession and of the General principles on health and their care; c) adequate clinical experience, chosen by your training value and under the guidance of qualified nursing personnel in places where the number of qualified staff and equipment are appropriate nursing care to the patient; d) Ability to participate in the training of health personnel and experience of working with such personnel; e) experience working with other professionals in the health sector. Article 29 pursuit of the professional activities of nurses responsible for general care the professional activities of nurses responsible for general care are pursued under the professional titles set out in point 2.2 of annex II. Article 30 acquired rights specific to nurses responsible for general care 1-When the General rules regarding acquired rights referred to in article 19 are applicable to nurses responsible for general care, in the activities to be taken into consideration for your application should be included full responsibility for the planning, organisation and administration of nursing care to the patient. 2-as regards the evidence of formal qualifications of nurses responsible for general care obtained in Poland, only the following rules shall apply: a) in the case of titles granted before 1 May 2004 or that match the formation that was initiated in Poland prior to that date and which does not satisfy the minimum training requirements laid down in article 28 the competent authority recognizes as sufficient 32 evidence of formal qualifications of nurses responsible for general care, as follows, provided that they are accompanied by a certificate stating that the trader concerned has exercised effectively and lawfully been engaged in the activities of nurse responsible for general care, including full responsibility in the field of planning, organisation and administration of nursing care during the periods specified below:  at least three consecutive years during the last five prior to the date of issue of the certificate, in respect of the evidence of formal qualifications as a nurse licensed (dyplom licencjata pielęgniarstwa ');  at least five consecutive years during the past seven prior to the date of issue of the certificate, in respect of the evidence of formal qualifications as nurse sanctioning post-secondary studies carried out in a medical vocational school (dyplom pielęgniarki albo pielęgniarki «dyplomo-wanej»). b) the competent authority also recognises the qualifications of nurses granted in Poland the nurses who have completed training before 1 May 2004 which does not satisfy the minimum training requirements laid down in article 28, when supported by a Bachelor diploma obtained based on the special program update, provided for in article 11 of the Law of 20 April 2004 amending the Act on professions of nurse and midwife and other legal acts (Official Gazette of the Republic of Poland of 30 April 2004, no. 92, point 885) and regulation of the respective Ministry of health of 11 May 2004 on the detailed conditions of teaching given to nurses and midwives who have a secondary school certificate (final exam — «matura») and graduates ' high schools ' medical or vocational schools to form health nurses and midwives , (Official Gazette of the Republic of Poland of 13 May 2004, no. 110, point 1170), in order to verify that the person concerned has a level of knowledge and skills comparable to 33 of the nurses that have the qualifications that relate to Poland in point 2.2 of annex II. c) as far as the evidence of formal qualifications awarded by Romania before 1 January 2007 or that matches the training commenced in that Member State before the date, when they are not satisfied the minimum training requirements laid down in article 28, recognized the title that proves formal qualification as general care nurse (Certificat de competenţe profesionale asistent medical generalist of) with post-secondary education obtained in postliceală şcoală as long as it is accompanied by a certificate stating that the applicant exercised effectively and lawfully been engaged in the activity in question for at least five consecutive years during the seven years prior to the issuing of licences and that the exercise of that activity implied the full responsibility in the field of planning, organization and delivery of nursing care to patients. Subsection IV Dentist article 31 basic dental training 1-admission to basic dental training depends on possession of a diploma or certificate providing access to studies in universities or higher institutes of a Member State who have a level recognised as equivalent. 2-basic dental training shall comprise a minimum of five years of theoretical and practical studies full time at a university or Institute of higher learning of equivalent level or under the supervision of a University, corresponding at least to the programme from the point 3.1 of annex II. 3-the lists of subjects set out in point 3.1 of annex II may be updated by the Committee referred to in paragraph 2 of article 52, for adaptation to scientific and technical progress,


34 without entail the variation of the national regulations concerning the training and conditions of access. 4-basic dental training shall provide an assurance that the applicant has acquired the following knowledge and skills: a) adequate knowledge of the sciences on which dentistry is based and a good understanding of scientific methods, including the principles of measuring biological functions, the evaluation of scientifically established facts and the analysis of data; b) adequate knowledge of the Constitution, Physiology and behaviour of healthy and sick individuals, as well as the influence of the physical and social media on the State of health of the human being, in so far as these factors affect dentistry; c) adequate knowledge of the structure and function of the teeth, mouth, jaws and adjoining tissue, healthy and sick, as well as their relations with the State of general health and physical and social well-being of the patient; d) adequate knowledge of clinical disciplines and methods, providing a coherent picture of anomalies, lesions and diseases of the teeth, mouth, jaws and adjoining tissue, as well as the preventive aspects, diagnostic and therapeutic dentistry; e) suitable clinical experience under appropriate guidance. 5-the training referred to in the preceding paragraph confers the skills necessary for carrying out all activities involving the prevention, diagnosis and treatment of anomalies and diseases of the teeth, mouth, jaws and adjoining tissue. Article 32 specialist dental training 1-admission to specialist dental training depends on successfully completion of five years of theoretical and practical studies in the framework of the training course referred to in the preceding article 35 or possession of the documents referred to in articles 19 and 34 2-the specialist dental training shall comprise theoretical and practical instruction in a University in a care center, teaching and research centre or, where appropriate, in a health care establishment approved for that purpose. 3-The specialist dental courses have a minimum duration of three years and shall be carried out under the supervision of the competent authorities or bodies, implying the personal participation of the dental practitioner candidate to be a specialist in the activity and in the responsibilities of the establishment concerned. 4-the minimum period of training referred to in paragraph 1 may be amended by the Committee referred to in paragraph 2 of article 52 on the adaptation to technical and scientific progress. 5-the issue of the title of specialist dental training depends on the possession of evidence of formal qualifications of dental base referred to in point 3.2 of annex II. Article 33 pursuit of the professional activities of dental practitioners 1-the professional activities of dental practitioners are pursued under the professional titles set out in point 3.2 of annex II. 2-the profession of dentist assumes the training referred to in article 31 and constitutes a specific profession distinct from other medical professions, specialized or not. 3-the exercise of the profession of dentist presupposes the possession of evidence of formal qualifications referred to in point 3.2 of annex II, or the equivalent to that referred to in articles 19 and 34-4 the dentist must be enabled, in General, to pursue the activities of prevention, diagnosis and treatment of anomalies and diseases of the teeth , mouth, jaws and adjoining tissue, in compliance with the regulations and the standards of conduct that govern the legal profession in the reference dates referred to in point 3.2 of annex II.



Article 34 36 acquired rights specific to dentists 1-for the purposes of the pursuit of the professional activities of dental practitioners under the qualifications listed in point 3.2 of annex II, the competent authority shall recognise evidence of formal qualifications as a doctor issued in Italy, Spain, Austria, Czech Republic, Slovakia and Romania to applicants who have started the training of your doctor until the reference date stated in that Annex for each of these Member States as long as the securities are accompanied by a certificate issued by the competent authorities, stating that if the following conditions are fulfilled: a) the applicant has exercised in the Member State concerned, effectively, lawfully and principally, the professional activities of dental practitioners for at least three consecutive years during the last five preceding the issuance of the certificate; b) the applicant is authorized to carry out the said activities under the same conditions as the holders of evidence of formal qualifications referred to, for that Member State in paragraph 3.2 of annex II. 2-the requirement laid down in point (a)) of the preceding paragraph is not chargeable to the applicant that had utilization in studies with a duration of at least three years, whose equivalence to the training referred to in article 31 is attested by the competent authorities of the Member State concerned. 3-with regard to the Czech Republic and Slovakia, evidence of formal qualifications obtained in the former Czechoslovakia benefit from identical to the granted to recognition evidence of formal qualifications issued by those Member States, in accordance with the conditions laid down in the preceding paragraphs. 4-the competent authority recognise evidence of formal qualifications as a doctor issued in Italy to the applicant who has started medical university training after 28 January 1980 and 31 December 1984 up, provided that those securities are accompanied by a certificate issued by the competent authorities of that State


37 member attesting that the following conditions are fulfilled: a) the approval of the applicant on specific aptitude test carried out by the competent Italian authorities with the purpose to verify the level of knowledge and skills comparable to that of holders of the title of constant training, to Italy, from point 3.2 of annex II; b) exercise by the applicant, in Italy, effectively, lawfully and principally, of the professional activities of dental practitioners for at least three consecutive years during the last five preceding the issuance of the certificate; (c)) the applicant be authorized to engage in or carry on already effectively, lawfully and principally and under the same conditions as the holders of evidence of formal qualifications as a constant, for Italy, from point 3.2 of annex II, the professional activities of dental practitioners. 5-the requirement laid down in point (a)) of the preceding paragraph is not chargeable to the applicant that had utilization in studies with a duration of at least three years whose equivalence to the training referred to in article 31 is attested by the competent Italian authorities. 6-the provisions of the preceding paragraph shall apply to the applicant who has started medical university training after 31 December 1984, since three years of study have been initiated before 31 December 1994. Subsection V veterinarian Article 35° formation of 1 veterinarian-veterinary medical training shall comprise a minimum of five years of full-time theoretical and practical, in a University, in a higher Institute of equivalent level or under the supervision of a University, corresponding at least to programme 38 point 4.1 of annex II. 2-the lists of subjects referred to in point 4.1 of annex II can be updated, by the Committee referred to in paragraph 2 of article 52, for adaptation to scientific and technical progress, without amendment of the national legislation concerning involve training and conditions of access to the profession. 3-the acceptance of veterinarian training depends on possession of a diploma or certificate providing access to studies in universities, colleges or equivalent level. 4-the formation of veterinarian ensures that the applicant acquired, with the appropriate level, the following knowledge and skills: Knowledge of the sciences on which) based medical veterinary activities; b) Knowledge of the structure and functions of healthy animals, of your creation, your playing, your hygiene in General, as well as of your feeding, including the technology involved in the manufacture and preservation of foods corresponding to their needs; c) knowledge in the field of the behaviour and protection of animals; d) Knowledge of the causes, nature, development, effects, diagnosis and treatment of animal diseases, considered individually or in groups, and, in particular, knowledge of the diseases transmissible to man; and) knowledge of preventive medicine; f) knowledge of the hygiene and technology involved in the production, manufacture and putting into circulation of animal foodstuffs or animal origin intended for human consumption; g) Knowledge with regard to the laws, regulations and administrative provisions relating to the matters mentioned above; h) clinical experience and practice under proper guidance.

39 Article 36° acquired rights specific to veterinary surgeons Without prejudice to the provisions of paragraph 4 of article 19, the evidence of formal qualifications as veterinary surgeon awarded by Estonia before 1 May 2004 or that match training commenced in this country before that date are recognised when they are accompanied by a certificate stating that the applicant exercised effectively and lawfully been engaged in in the territory of that Member State, the activities in question for at least five consecutive years during the seven years prior to the issuance of the certificate. Subsection SAW Midwife article 37 1 midwife training-the training of midwives shall comprise at least the entirety of one of the following formations: the) specific training of midwives, full-time, with the duration of at least three years of theoretical and practical studies comprising at least the programme point 5.1 of annex II (I); b) specific training of midwives, full-time, with a duration of 18 months comprising at least the programme point 5.1 of annex II, to the extent that it has not been given equivalent education within the framework of training for nurses responsible for general care (via II). 2-the institutions providing midwife training are responsible for the coordination of theoretical and practical education of the whole programme of studies. 3-the lists of subjects set out in point 5.1 of annex II may be updated by the Committee referred to in paragraph 2 of article 52, for adaptation to scientific and technical progress, without implying the change of national regulations concerning the training and to


40 conditions of access to the profession. 4-access to training as a midwife depends, as appropriate, of the following requirements: a) in the case of subparagraph (a)) of paragraph 1, conclusion at least the 10 first years of general education; b) in the case of (b)) of paragraph 1, the possession of one of the evidence of formal qualifications of nurses responsible for general care referred to in point 2.2 of annex II. 5-the midwife training ensures that the trainee has acquired the following knowledge and skills: a) adequate knowledge of the sciences on which the activities of midwives are based, particularly obstetrics and gynaecology; b) a thorough knowledge of biological functions, Anatomy and Physiology in the field of obstetrics of the newborn, as well as knowledge of the relationship between the State of health and the physical and social environment of the human being and of your behavior; c) adequate clinical experience obtained in establishments approved under the guidance of qualified staff in obstetrics; d) adequate understanding of the training of health personnel and experience of working with these guys; and) adequate knowledge of the professional ethics and professional legislation. Article 38 arrangements for recognition of evidence of formal qualifications as a midwife 1-evidence of formal qualifications as a midwife referred to in annex II, point 5.2 benefit from automatic recognition laid down in article 17, if they match one of the following criteria: a) qualifications as a midwife of at least three years full-time, shall be subject to possession of a diploma, certificate or other evidence of formal qualifications conferring access to universities or higher education or ensuring an equivalent level of knowledge;

41 b) training as a midwife of at least three years full-time, followed by professional practice for two years and certified in accordance with the following paragraph; c) training as a midwife of at least two years or 3600 hours, full-time, shall be subject to possession of evidence of formal qualifications of nurses responsible for general care referred to in point 2.2 of annex II; d) training as a midwife of at least 18 months or 3000 hours, full-time, shall be subject to possession of evidence of formal qualifications of nurses responsible for general care given in point 2.2 of annex II, followed by professional practice for a year and certified in accordance with the following paragraph. 2-the certificate referred to in paragraph 1 (b)) and d) of the preceding paragraph shall be issued by the competent authority of the Member State of origin and proves that the applicant, after obtaining evidence of formal qualifications, exercised satisfactorily, in a hospital or health care establishment approved for that purpose, all the activities of a midwife during the corresponding period. Article 39 pursuit of the professional activities of midwife 1-without prejudice to the provisions of the following paragraph, the activities of midwives defined by each Member State are pursued under the professional titles set out in point 5.2 of annex II. 2-the competent authority shall ensure that midwives are at least entitled to exercise the following activities: a) inform and advise properly in the field of family planning; b) Diagnose pregnancy, normal pregnancy watch and performing the tests necessary for the monitoring of the evolution of normal pregnancy; c) Prescribe or advise the examinations necessary for the earliest possible 42 diagnosis of pregnancy; d) establish programmes of Parenthood preparation and complete preparation for childbirth including advice on hygiene and nutrition; and) Watch the mother during labour and monitoring the condition of the foetus in utero by the appropriate clinical and technical means; f) deliver normal in case of head presentation, including, if necessary, the episiotomy, and delivery in the case of breech presentation, in an emergency situation; g) Detect in mother or son telltale signs of anomalies that require medical intervention and assist this in case of intervention, take emergency measures if necessary in the absence of the physician, in particular the manual removal of the placenta, possibly followed of uterine manual review; h) examine and watch the newborn, take all initiatives that impose if necessary and, where appropriate, the immediate resuscitation; I) take care of mother, watching the puerperium and give all the advice needed to treat newborn, ensuring you the best conditions for development; j) Perform the treatment prescribed by the doctor; l) draw up the reports required. Article 40 acquired rights specific to midwives 1-the evidence of formal qualifications as a midwife issued by a Member State before the date of reference mentioned in point 5.2 of annex II, which satisfy the minimum training requirements provided for in article 37 and corresponding to the situations referred to in article 38 that, pursuant to its paragraph 2, required certificates of professional practice , is approved by the competent authority when it is accompanied by a certificate stating that the holder has exercised effectively


43 and lawfully the activities in question for at least two consecutive years during the five preceding the issuance of the certificate. 2-the provisions of the preceding paragraph shall apply to evidence of formal qualifications as midwife in the territory of the former German Democratic Republic which attest to training that was initiated before 3 October 1990. 3-as for titles granted in Poland, are applicable in this regard only the following provisions: a) the titles granted before 1 May 2004 or that match training commenced in Poland before that date, which does not satisfy the minimum training requirements laid down in article 37, are recognized by the competent authority when they are accompanied by a certificate stating that the applicant has exercised in the territory of that State and effectively and lawfully midwifery activities during the following specified periods: i) in the case of evidence of formal qualifications as midwife licensed (dyplom licencjata «poloznictwa»), at least three consecutive years during the five preceding the date of issue of the certificate; II) in the case of evidence of formal qualifications as a midwife certifying post secondary studies completed medical vocational school (dyplom poloznej «»»), at least five consecutive years during the seven prior to the date of issue of the certificate. b) evidence of formal qualifications as a midwife to who has completed training before 1 May 2004, which does not satisfy the minimum training requirements laid down in article 37, are recognized by the competent authority provided that they are supported by a Bachelor's degree obtained on the basis of a special program update, provided for in article 11 of the Law of 20 April 2004 amending the Act on professions of nurse and midwife and other legal acts (Official Journal of 30 April 2004 No 92, 44 point 885), and regulation of the respective Ministry of health of 11 May 2004 on the detailed conditions of teaching given to nurses and midwives who have a secondary school certificate (final exam — «matura») and graduates ' high schools ' medical or vocational schools to form health nurses and midwives (Official Gazette of 13 May 2004, no. 110, point 1170), in order to verify that the person concerned has a level of knowledge and skills comparable to that of midwives who possess the qualifications laid down to Poland, in point 5.2 of annex II. 4-the competent authority recognizes the diplomas, certificates and other evidence of formal qualifications as a nurse-midwife ("asistent medical obstetrică-ginecologie") granted by Romania before 1 January 2007 which does not satisfy the minimum training requirements laid down in article 37, provided that they are accompanied by a certificate stating that the applicant exercised effectively and lawfully been engaged in the activity in Romania for at least five consecutive years during the seven years prior to the issuance of the certificate. Subsection VII article 41 Pharmaceutical pharmaceutical training 1-admission to pharmaceutical training depends on possession of a diploma or certificate providing access to studies in University or Institute of higher learning establishment in a Member State of an equivalent level. 2-the evidence of formal qualifications as a pharmacist attests to a formation of at least five years, at least, understands: a) four years of theoretical and practical education, full-time and taught at a University, in a higher Institute of equivalent level or under the supervision of a University;

45 b) Six months training course in pharmacy open to the public or in a hospital, under the guidance of its pharmaceutical service. 3-the training cycle referred to in the preceding paragraph comprise, at least, the programme point 6.1 of annex II, and the lists of disciplines contained therein be updated by the Committee referred to in paragraph 2 of article 52, for adaptation to scientific and technical progress, without implying the change of national regulations concerning the profession regarding the training and conditions of access. 4-the formation of pharmacist ensures that the applicant acquired, with the appropriate level, the following knowledge and skills: Knowledge of medicines and the) substances used in their manufacture; b) knowledge of pharmaceutical technology and the physical test, chemical, biological and microbiological testing of medicinal products; c) knowledge of the metabolism and the effects of medicinal products and of the action of toxic substances, as well as the use of medicinal products; d) Knowledge to assess the scientific data relating to medicines to, based on them, provide appropriate information; and) adequate knowledge of the legal and other requirements associated with pharmaceutical activities. Article 42 pursuit of the professional activities of a pharmacist 1-the activities of a pharmacist are those whose access and exercise are subject, in one or more Member States, a vocational qualification and only carried out by the holder of evidence of formal qualifications referred to in section 6.2 of annex II.

2-the competent authority ensures that the holder of evidence of formal qualifications in pharmacy, University-level equivalent, which satisfies the conditions of the previous article,


46 is enabled, at least, for the access to and the exercise of the activities mentioned below, subject, where appropriate, of supplementary professional experience requirement: a) preparation of the pharmaceutical form of medicinal products; b) Manufacture and control of medicinal products; c) control of medicines in drug testing laboratory; d) storage, preservation and distribution of medicinal products at the wholesale stage; and) Preparation, testing, storage and distribution of medicinal products in pharmacies open to the public; f) Preparation, testing, storage and distribution of medicines in hospitals; g) dissemination of information and advice on medicines. 3-where, in a Member State, access to one of the activities of a pharmacist, or your Office, depend, in addition to evidence of formal qualifications referred to in section 6.2 of annex II, of supplementary professional experience, the competent authority shall recognise as sufficient proof that experience a certificate issued by the competent authority of the home Member State, attesting that the applicant in it he referred to activities during the same period. 4-the recognition referred to in the preceding paragraph shall not apply to the two years of professional experience required by the Grand Duchy of Luxembourg for the grant of State license of pharmacy open to the public. 5-the Member State which, on 16 September 1985, have open contest to provide evidence intended to select, from among the professionals referred to in paragraph 2, the owners of new pharmacies whose creation has been decided within the framework of a national system of geographical distribution, can, by way of derogation from paragraph 1, maintain such a contest and he submit who has evidence of formal qualifications in pharmacy listed in item 6.2 of annex II or that the provisions of Article 19 Subsection VIII 47 article 43 Training of architect Architect 1-training of architect comprises at least four years of full-time study, or six years of study of at least three full time in University or equivalent education institution. 2-the training referred to in the preceding paragraph must be attested by the approval of an examination of university level and have the main element architecture, keeping the balance between the theoretical and practical aspects and ensuring the acquisition of the following knowledge and skills: (a)) capability to design architectural designs that satisfy aesthetic and technical requirements; b) adequate knowledge of the history and theories of architecture and the related arts, technologies and human sciences; c) knowledge of the fine arts and your influence on the quality of architectural design; d) adequate knowledge of urban design, planning and skills related to the spatial planning process; e) ability to grasp the relations between, on the one hand, the man and the buildings and, on the other, between the buildings and the your environment as well as the need to relate buildings and the spaces between them according to needs and human scale; f) Understanding of the profession of architect and your role in society, in particular, developing projects that take account of social factors; g) knowledge of the methods of investigation and preparation of the specifications of the project;

48 h) knowledge of the problems of structural design, construction and civil engineering related to the design of buildings; I) adequate knowledge of physical problems and technologies and of the function of buildings so as to provide them with internal conditions of comfort and protection against the climate; j) technical capacity that allows designing buildings which meet the requirements of users, within the limits imposed by the cost and construction regulations; l) adequate knowledge of the industries, organizations, regulations and procedures involved in the implementation of projects under construction and in the integration of plans in planning. 3-the knowledge and skills referred to in point 7 of annex II can be updated, by the Committee referred to in paragraph 2 of article 52, for adaptation to scientific and technical progress, without implying the change of national regulations concerning the training and conditions of access to the profession. Article 44 Exceptions with regard to the training of architect 1-Without prejudice to the provisions of the preceding article, shall be regarded as satisfactory, in accordance with article 17: a) the training of three years in the "Fachhochschulen" in the Federal Republic of Germany, on 5 August 1985, which satisfies the requirements laid down in the preceding article, and give access, in this State, the activities referred to in the following article , carried out under the professional title of architect, since completed for a period of four years of professional experience in the same State, evidenced by certificate issued by the professional order in which the applicant is registered; b) training in social programmes or part-time university studies which satisfies the requirements laid down in the previous article and which is attested by the approval of an examination of architecture of university-level studies


49 is equivalent to the final examination referred to in the previous article, obtained by professionals who work in the field of architecture there are at least seven years, under the supervision of an architect or architects Office. 2-For the purposes of point (a)) of the preceding paragraph, the professional order must establish in advance that the work carried out by the architect architecture constitute sufficient evidence of all the knowledge and skills referred to in the previous article, and should the certificate be issued according to the procedure applicable to the inscription on the professional order. Article 45 pursuit of the professional activities of an architect 1-for the purposes of this Act, the professional activities of an architect are the activities under the professional title of architect. 2-fulfils the conditions required for the exercise of the activities of an architect, under the professional title of architect, who is authorised to use that title pursuant to law assign to the competent authority of a Member State may grant this title to nationals of Member States who have distinguished by the quality of its achievements in the field of architecture. 3-the professional activities of an architect are attested by a certificate issued by the Member State of origin. Article 46 acquired rights of architects-1 the competent authority recognise evidence of formal qualifications as an architect referred to in annex III certifying training commenced at the latest, during the academic year of constant reference to that annex, even if they do not meet the minimum requirements laid down in article 43 2-Are also recognised certificates issued by the competent authorities of the Federal Republic of Germany attesting that evidence of formal qualifications issued from May 8 from 1945 by the competent authorities of the German Democratic Republic 50 are equivalent to the corresponding headings laid down in annex III. 3-Notwithstanding the provisions of paragraphs 1 and 2, the competent authorities recognize, for the purpose of taking up and pursuit of the professional activities of an architect, certificates granted by Member States which have adopted rules on access to and the exercise of the activities of architect on the following dates: (a) Austria, Finland and Sweden), on 1 January 1995; b) Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia on 1 May 2004; c) the other Member States, on 5 August 1987; d) Iceland and Norway, on 1 January 1994; e) Liechtenstein, 1 May 1995. 4-the certificates referred to in the preceding paragraph shall certify that your holder was allowed to use the title of architect, no later than the date of reference, and that he effectively and according to the rules established in the activities in question for at least three consecutive years during the five years prior to your issue. Section IV common Provisions article 47 establishment procedure for the recognition of professional qualifications 1-the application for recognition must be submitted to the competent authority accompanied by the following documents: a) proof of the nationality of the applicant; b) evidence of formal qualifications giving access to the profession in question and, in cases where the relevant professional experience, same document; c) in the case of recognition of professional experience, 51 document stating the nature and duration of the activity issued by the competent authority of the Member State of origin; d) in cases where the exercise of the profession depend on the absence of reprehensible behaviour that affects this exercise, or absence of insolvency, or absence of lack of grave professional misconduct or criminal offence, proof of completion of any of these requirements issued by the competent authority of the Member State of origin or, in your absence, proof of the applicant's statement that meets the requirements in question , made under oath or, where appropriate, made by solemn way before the competent body of the Member State of origin; e) If the exercise of the profession depend on the verification of requirements relating to physical or mental health of the applicant, same document required in the Member State of origin or, in your absence, issued by the competent authority of that State; f) If the exercise of the profession depend on the verification of the financial capacity of the applicant or of civil liability insurance, the statement issued by bank or insurer in another Member State. g) in the case of recognition on the basis of coordination of minimum training conditions, the competent authority may request the applicant who, in addition to evidence of formal qualifications, certificate from the competent authority of the home Member State confirmed that the title corresponds to the provisions of section III of this chapter. 2-the documents referred to in points (a) to (d)) f) of the preceding paragraph shall, at the time of your presentation, have been issued not more than 90 days. 3-the competent authority shall notify the applicant of receipt of the application and, where appropriate, request missing documents within 30 days. 4-application for authorization for the exercise of a regulated profession must be decided within 90 days, extendable for another 30 days in cases covered by


52 sections I and II of this chapter. 5-the decision or lack of decision within the time limit laid down is likely to appeal under domestic law. 6-When the title matches the training received in whole or in part in a Member State other than that in which it was issued, the competent authority may, in case of doubt, check with the competent body of the Member State in which the title was issued if this allows you to exercise, on the territory of the latter, the same profession which the applicant wishes to engage in the national territory. 7-the national authority issues the evidence as to the requirements laid down in points (a) to (d)) and e) of paragraph 1 within 60 days. 8-When, in the national territory, the attestation of professional experience cannot be made by the competent authority, by notary, by means of suitable documents, particularly those relating to employment status of the applicant vis-à-vis the social security and tax administration. 9-if in doubt justified, the competent authority shall ask the competent authority in the Member State concerned to confirm the authenticity of the certificate or evidence of formal qualifications issued in that State and, where appropriate, confirmation that the applicant satisfies, in respect of any of the professions contemplated in section III of this chapter, the minimum training conditions set out respectively in articles 21 , 22, 25, 28, 31, 32, 35, 37, 41 and 43 Chapter IV procedures for the exercise of the profession Article 48 linguistic knowledge in the course of the procedure of recognition of professional qualifications, the competent authority verifies that the applicant has the knowledge of the Portuguese language are necessary for the exercise of the profession concerned.

53 article 49 1 use of the professional title-in the provision of services on national territory, the provider uses the professional title of the Member State of establishment, with the following exceptions: a) If the professional title exists in the Member State of establishment, the provider uses the title of training in one of the official languages of that State; b) in the cases referred to in section III of chapter III, or when the qualifications have been verified in accordance with article 6, the provider uses the professional title used in the national territory. 2-on the right of establishment, when the use of the professional title relating to one of the activities of the profession in question is regulated, nationals of other Member States authorised to practise a regulated profession under the provisions of section III of chapter III, uses the professional title in the national territory corresponds to that profession and, if there is, its abbreviation. Article 50 use of academic title 1-Without prejudice to the provisions of the previous article, the professional can use any academic title obtained in the Member State of origin and, if any, its acronym in Portuguese language, followed by the name and location of the establishment or examining Board which awarded it. 2-When the academic title of the home Member State can be confused, in the national territory, with any title requiring additional training not obtained by, the competent authority may require the use of that title by properly to avoid confusion. Chapter V implementing powers and administrative cooperation article 51 54 1-competent Authorities The competent national authorities for the recognition of professional qualifications in relation to the various sectors of activity, in accordance with this law, are designated by order of the Minister or Ministers responsible for each sector, which must specify the regulated professions covered under their jurisdiction. 2-the authorities referred to in paragraph 1 must: a) collaborate with the homologous entities from other Member States, in particular by providing all the information provided for in this law; b) switch with homologous organizations of other Member States the relevant information concerning serious circumstances likely to have consequences for the pursuit of the professions covered by this law, including those relating to disciplinary or penal sanctions, the lawfulness of the establishment or good conduct of the service provider; c) Ensure the exchange of information necessary for the preparation and consideration of complaints by a recipient of a service against your provider and to the communication of the result of the same to the applicant. Article 52 Coordinator 1-competent national authorities are coordinated by an entity to which promote the uniform application of this scheme and gather all useful information to this end, in particular concerning the conditions for access to regulated professions in the Member States. 2-the Coordinator ensures the national representation on the Committee assisting the Commission for the recognition of professional qualifications. 3-the coordinating entity promoting the notification to the Commission of the laws, regulations and administrative provisions to be adopted within the framework of section III of chapter III, including that in respect to the evidence of formal qualifications referred to in articles 43 to 46, are also notified the other Member States.


55 4-competes to the Coordinator to oversee on the information system designated as a contact point, which has as its functions:) Provide to citizens and entities counterparts in the other Member States the information necessary for the recognition of professional qualifications, in particular on national regulation of the profession, including the rules governing professional ethics and conduct, as well as information on labour law and social security; b) support the citizens who wish to pursue the profession in another Member State in efforts to obtain the information referred to in the preceding paragraph, in cooperation, where appropriate, with counterpart authorities and the competent authorities for recognition in the host Member State. 5-the rules governing the coordinating entity consists of special legislation. Article 53 the protection of personal data the entities involved in the process of recognition of qualifications shall ensure, in accordance with the law, the protection of the personal data to which they have access. Chapter VI final provisions article 54 Count counting deadlines deadlines relating to administrative procedures provided for in this law is made under the code of administrative procedure. Article 55 set Standard-1 following diplomas are hereby repealed: a) Decree-Law No. 320/87, of 27 August, which transposes to the internal legal order the Directive 77/453/EEC of 27 June 1977, the Council of the 56 communities in the field of freedom of establishment and freedom to provide services in Portugal by nationals of other Member States on the activities of nurses responsible for general care; b) Decree-Law No. 322/87, of 28 August, which transposes to the internal legal order the directive 80/155/EEC of 21 January 1980, the Council of communities in the field of freedom of establishment and freedom to provide services in Portugal by nationals of other Member States on the activities of expert nurses in obstetric and maternal health nursing; c) Decree-Law No. 326/87 of 1 September, which regulates the procedures to which the Portuguese State is bound in the face of the European communities on the right of establishment and freedom to provide services in respect of activities of doctors; d) Decree-Law No. 327/87, of 2 September, which transposes to the internal legal order Nos. B-practical Education and clinical training this training is delivered under proper guidance:  advising of pregnant women, involving at least 100 pre-natal examinations;  supervision and care of at least 40 women in labour;  Implementation by the student of at least 40 deliveries; When this number cannot be reached because of a lack of women in labour, can be reduced to at least 30, provided the student participate, in addition to those in 20 births;  active involvement in deliveries of breech presentation. In case of impossibility due to an insufficient number of deliveries of breech presentation, should be carried out a simulation training;  practice of episiotomy and initiation into suturing. Initiation shall include theoretical instruction and clinical exercises.
