DRAFT law No. 171/X amendment of law No. 21/85 of 30 July (STATUTE of JUDICIAL MAGISTRATES) explanatory memorandum it is necessary to protect the situation of judges residing in the autonomous region, relating to the payment of air transport between these locations and the superior courts in which they are or are placed to ensure your equality in respect of Judges residing in the Mainland. The articles 17, paragraph 1, point (c)) and 8, paragraph 3 of the Statute of judicial magistrates, predict that judges are entitled to free use of public transport, land and river within the area of jurisdiction in serving, or from this to the place of your residence (authorized). Since there is no land transport or inland waterways to the autonomous regions, the judges who reside and have your life Center and to join in a Superior Court, are a clear situation of inequality, before any judge residing in the continental Portuguese territory, in view of the high costs of travel by air. As the current regime, a resident judge in the autonomous regions to join in a higher court, with the costs of commuting to weekly sessions (necessarily by air), practically pay to serve. And any other judge residing in any other point of the continent – possibly even harder – access has guaranteed free use of transport. Article 2 the provisions of subparagraph (d)) of article 17 shall take effect on the date of entry into force of the State budget for 2008. Adopted in Plenary Session of the Legislative Assembly of Madeira, on 8 November 2007.
