Having regard to Article 27 of the Statute of the International Criminal Court for Ex-
Yugoslavia adopted by the United Nations Security Council in its Resolution n.
827, of May 25, 1993, pursuant to which the prison sentence of the persons by this
condemned should be complied with in a State designated by the International Court to
from the list of states that have expressed to the Security Council to their
availability to receive condensed persons;
Bearing in mind that the Portuguese Republic has adopted a law establishing standards on
the cooperation between Portugal and the International Criminal Courts for the Former Yugoslavia and
for Rwanda (Law No 102/2001 of August 25);
Considering that the Portuguese Republic has carried out a statement, in the terms of the article
27. of the Statute of the Court and of the Portuguese law, in which it manifests its availability
to receive persons convicted by the International Court for the purposes of implementing the
prison sentences.
Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following motion for a resolution:
Approves the Agreement between the Portuguese Republic and the United Nations on the Enforcement of
Sentences of the International Criminal Tribunal for the Former Yugoslavia, made in The Hague at 19 am
December 2007, the text of which, in the authenticated versions in the Portuguese and English languages, if
publishes in annex.
