DRAFT law No. 91/X CREATES the ORDER of PSYCHOLOGISTS and APPROVE their status as Portuguese psychologists are a professional class of enormous social relevance. In recent decades, we have witnessed the taking over by the psychologists, an increasingly important role in key areas of the Portuguese society. Thus, a profession that for many years had great difficulties in being recognized, became little by little in a professional class needed and present in various sectors of activity. Psychologists play increasingly roles in countless situations, and are already part of the national health service. It is therefore high time to answer an ambition of psychologists with more than 20 years: the creation, as has happened in other countries, an order of psychologists. This order will be the regulatory organization of professionals of psychology in Portugal. Come this way to suppress a failure today, since at present there is an entity which regulates the practice of the profession of psychologist, nor to promote the existence of ethical rules on the exercise of this profession. This Bill creates the order of psychologists, and approves the respective Regulations. This order will be a public representative Association of the graduates in psychology who exercise the profession of psychologist, and will have legal personality, boasting scientific autonomy, disciplinary, administrative, financial and regulatory environment. The order will have as its mission to preserve and promote ethics, as well as the scientific, technical and social conditions of exercise of the profession of psychologist. To this end, in your status is provided for the elaboration by the order of a code of ethics, as well as various deontological principles and general duties, to respect for all psychologists. The order will have national, regional bodies and specialty colleges. The national agencies will be the Assembly-General, the National Directorate, the Chairman, the Board and the Audit Committee. The Regionals are the regional Assembly, the Regional Directorate and the Regional Sections. 2 So, in accordance with the rules and applicable constitutional, the undersigned, Members of the CDS-Partido Popular, have the following draft law: article 1 object is created the order of psychologists and pass your Statute annexed to this law, and which is an integral part.

4 ANNEX Status of the order of psychologists of the Portuguese chapter I Nature, mission and tasks article 1 Nature 1. The order of psychologists, further abbreviated designated by order, is the public representative of the Association Psychology graduates who, in accordance with the provisions of these bylaws and the applicable legal provisions, the profession of psychologist. 2. Article 4 Duties


In pursuit of its mission, the order: 5 a) Ensure compliance with the rules of professional ethics; b) set the level of professional qualification of psychologists, assign the professional title; c) Regulate the practice of the profession and defining the scope of the psychological Act; d) register of all psychologists; and) defend the rights and prerogatives of psychologists, promoting judicial procedure against those who use the title and carries on profession illegally; f) Exercise disciplinary jurisdiction exclusively on psychologists; g) prepare studies and give its opinion on any draft legislation that concern the exercise of the profession of psychologist; h) Create and regulate the professional specialties of psychology and pass the corresponding securities; I) Ensure respect for the legitimate interests of users in the services provided by psychologists, taking into account the rules of the code of ethics; j) Collaborate with schools, universities and other institutions in training graduate and postgraduate of psychologists; k) Organize, by itself or in collaboration with other institutions, specialization courses, improvement and recycling; l) to organize and promote the holding of congresses, conferences, symposia, seminars and similar activities; m) Provide scientific and technical collaboration requested by any public or private entities; n) Develop relations with similar associations, domestic or foreign, which may be part of unions and national and international federations; the) to ensure the dignity and prestige of the profession and promote solidarity among its members; p) perform other functions arising from law and the provisions of this Statute.

Article 5 Principles of operation the order acts by the respect of the principles of legality, equality, proportionality, justice, impartiality and of the Universal Declaration of human rights. 6 article 6 Insignia order are entitled to use emblem and seal own models to be adopted by the General Assembly, on a proposal from the Directorate.

Chapter II Organization of the order section I General provisions article 7 Territoriality and jurisdiction 1. The order has national, regional bodies and specialty colleges. 2. The powers of the organs are defined on the basis of national, regional or commodity specialty.

Article 8 national bodies Are national bodies of the order: a) the General Assembly; (b)) the National Directorate; (c)) the Chairman; (d) the Judicial Council); e) the Audit Committee.

Article 9 regional Agencies Are organs of the regional delegations: a) the Regional Council; 7 (b)) the Regional Directorate; c) Regional Sections.

Article 10 specialty Colleges In each specialty College there is a specialty Board.

Article 11 composition of the democratic principle is based on the direct participation of members of the order or, when this is not possible, in the election.

Article 12 Exercise of positions 1. Without prejudice to the payment for the order of any travel costs or specific tasks, as well as the following paragraph, the exercise of the positions of the bodies of the order is always free. 2. Article 25 financing of elections the order comparticipará of the cost of the elections with amount to be fixed by the Board.

Article 27 Resignation 1. All members shall enjoy the right to withdraw the mandate for which they were elected; 2. The resignations or suspensions of the mandate should be communicated to the Presidents of the respective agencies, as well as the President of the General Assembly. 4. Article 30 Operation 1. The General Assembly meets ordinarily:) for the election of the Bureau of the General Assembly, the National Directorate, of the Council and of the Supervisory Board; 13 (b)) To the discussion and the vote on the report and accounts of the National Directorate. 2. The General Assembly brings together extraordinarily, whenever the circumstances so advise and your President to call for your initiative or at the request of the Board, of any of the Regional Directions or a minimum of 100 members. 3. If the scheduled time for the beginning of the General Assembly is not present at least half of the full members, the Assembly will start its functions 1 hour later, with the presence of any number of members. 4. The General Assembly aimed at discussion and vote on the report and accounts of the National Directorate, will take place by the end of the month of March in the year immediately to its exercise.

Article 31 Call 1. The General Assembly is convened by the Chairman by notice your postcard sent to each Member at least 15 days in advance of the date designated for the conduct of the Assembly. 2. The notice of meeting shall include the agenda and the venue of the meeting.

It is up to the National Directorate: a) Accept entries or send cancel them, at the request of or by decision of the Judicial Council; b) Elaborate and update the register of all psychologists; c) Propose the creation of the professional specialties of psychology, propose the installation of specialty colleges commissions and to submit to the approval of the General Assembly access conditions, rules of procedure and each electoral college of speciality; d) to implement the resolutions of the General Assembly; e) drafting and approving regulations; f) Driving national activity of the order; g) to promote and coordinate installation activities of Directorates and Regional Sections; h) Provide directly or through commissions set up to this end, advice and information to public and private entities, within the framework of the tasks of the order; I) Collect the revenue and the expenditure provided for in the budget; j) prepare and submit to the General Assembly the report of activities, the annual accounts and the budget.

Article 35 1 Operation. The National Directorate meets ordinarily once a month and extraordinarily whenever convened by your President. 2. The National Directorate may only deliberate validly when are present more than half of its members. 3. Decisions shall be taken by a simple majority of the members present, featuring the President of casting vote.

Article 36 15 Chairman the Chairman is the President of the National Directorate.

Article 37 Powers the Chairman: a) represent the order in court and outside it, in particular before the organs of sovereignty and community and international organizations; b) Chair with a casting vote, the National Directorate; c) Execute and enforce the resolutions of the National Directorate and other national bodies; d) Exercise the powers of the National Executive in cases of recognised urgency or in situations where such jurisdiction is delegated; and Ensure the normal operation) of the Order in respect of the law, the Statute and its regulations. f) Designate the Vice-President to replace him in his absences and impediments article 38 1 Binding. Article 42 Operation 1. The Judicial Council meets at the seat of the order when summoned by your President. 2. Decisions shall be taken by a majority, the President of a casting vote.

Article 43 supervisory board the Supervisory Board consists of a Chairman and two members.

Section IV article 45 Regional regional assemblies 1. The creation of regional assemblies depends on the needs created by the continuation of the activities of the order of psychologists, whose geographical area of action will appear in rules of procedure. 2. Each Regional Assembly is composed of all the members in the order whose professional domicile is situated in the geographical area covered by the Regional Delegation.

Article 46 Regional Table meetings of the Regional Council is composed of a President and two Secretaries.

Article 51 Regional Sections

Article 55 the Council of Specialty Competence: a) propose to the National Executive the criteria for the award of the title of psychologist specialist; b) Assign the title of psychologist specialist in the field of their professional practice of psychology; c) Elaborate and keep updated the general framework of psychologists experts; d) promote scientific and professional relations nationally and internationally in each specialty; and ensure the scientific appreciation) technical and professional of its members; f) Prepare minutes of its meetings.

Chapter III section I Registration 21 Members article 56 1 Requirement. Article 62 members Are admitted as members all graduates in psychology engaged in the profession in accordance with these regulations.

Article 63 23 corresponding members Are admitted as corresponding members: a) Portuguese citizens graduates in psychology engaged in the activity your abroad; b) members of foreign associations which confer counterparts equal treatment to members of the order.

Article 64 honorary members 1. Honorary members shall be accepted as the natural or legal persons who, exercising or having exercised the activity of recognised public interest and contributed to the dignity and prestige of the profession of psychologist, are considered worthy of such a distinction. 2. honorary membership is conferred by the proposal presented by the National Directorate and approved by the General Assembly.

Article 65 meritorious Members 1. Are admitted as members benefactors natural or legal persons who, having provided monetary contribution or equity in favor of the order are considered worthy of such a distinction. 2. honorary membership is conferred by the proposal presented by the National Directorate and approved by the General Assembly.

Section III rights and obligations of members article 66 rights of members

Chapter IV Financial Regime article 70 Recipes Are recipes of the order; a) quotas paid by its members; b) proceeds from the sale of its publications; c) Donations, inheritances, bequests and grants; d) income from goods which are assigned; and) revenue from activities and projects; f) other revenue from own goods or provide services.

Article 71 Expenses Constitute costs of the Order of installation and personnel expenses, maintenance, operation and all the necessary to achieve its objectives.
