DRAFT law No. 91/X CREATES the ORDER of PSYCHOLOGISTS and APPROVE their status as Portuguese psychologists are a professional class of enormous social relevance. In recent decades, we have witnessed the taking over by the psychologists, an increasingly important role in key areas of the Portuguese society. Thus, a profession that for many years had great difficulties in being recognized, became little by little in a professional class needed and present in various sectors of activity. Psychologists play increasingly roles in countless situations, and are already part of the national health service. It is therefore high time to answer an ambition of psychologists with more than 20 years: the creation, as has happened in other countries, an order of psychologists. This order will be the regulatory organization of professionals of psychology in Portugal. Come this way to suppress a failure today, since at present there is an entity which regulates the practice of the profession of psychologist, nor to promote the existence of ethical rules on the exercise of this profession. This Bill creates the order of psychologists, and approves the respective Regulations. This order will be a public representative Association of the graduates in psychology who exercise the profession of psychologist, and will have legal personality, boasting scientific autonomy, disciplinary, administrative, financial and regulatory environment. The order will have as its mission to preserve and promote ethics, as well as the scientific, technical and social conditions of exercise of the profession of psychologist. To this end, in your status is provided for the elaboration by the order of a code of ethics, as well as various deontological principles and general duties, to respect for all psychologists. The order will have national, regional bodies and specialty colleges. The national agencies will be the Assembly-General, the National Directorate, the Chairman, the Board and the Audit Committee. The Regionals are the regional Assembly, the Regional Directorate and the Regional Sections. 2 So, in accordance with the rules and applicable constitutional, the undersigned, Members of the CDS-Partido Popular, have the following draft law: article 1 object is created the order of psychologists and pass your Statute annexed to this law, and which is an integral part.
Article 2 installation 1 National Commission. Until the first elections the order will be temporarily managed by a National installation Committee. 2. The installation Committee will be composed by the National direction of the Asociación Pro-order of psychologists Portuguese in Office at the date of approval of these statutes. 3. the Commission shall draw up a National rules of procedure Establishment which will spell out the minimum number of its elements, the form of co-optation of new elements and the operational procedures and decision-making. 4. The President of the Commission, the National Installation appointment of interim Chairman will be the Chairman of the Board of the Association Pro-order of psychologists Portuguese in Office at the date of approval of these statutes. 5. The order of the installation Committee will run National never exceeding two years from the date of approval of these statutes.
Article 3 competence of the installation Committee the Commission National National Installation: a) Accept subscriptions in Order in accordance with articles 4, 57, 63 and 91; b) Elaborate and update the general framework of psychologists; c) Drive order activity at national level in accordance with this Statute; 3 d) give advice and information to public and private entities, in order to undertake the tasks set out in article 4; and proceed with the convening of the first) elections pursuant to these regulations, until thirty days before the end of your mandate.
Article 4 Entry in the order 1. Psychology professionals with superior academic education and curriculum that integrates recognized training and practice in the area of psychology may, within twelve months of the approval of these statutes, requiring your registration in the order, for the purpose of article 4. 2. Acceptance of registration requires a two-thirds majority of the members of the National establishment.
Article 5 entry into force this law shall enter into force on the day of your publication.
4 ANNEX Status of the order of psychologists of the Portuguese chapter I Nature, mission and tasks article 1 Nature 1. The order of psychologists, further abbreviated designated by order, is the public representative of the Association Psychology graduates who, in accordance with the provisions of these bylaws and the applicable legal provisions, the profession of psychologist. 2. The order of psychologists has legal personality and enjoys scientific autonomy, disciplinary, administrative, financial and regulatory environment.
Article 2 Scope, Headquarters and delegations and Regional Sections 1. The order carries out its activities throughout the country. 2. The order has its headquarters in Lisbon, and may establish delegations and Regional Sections when it is necessary and appropriate for the pursuit of its mission.
Article 3 mission is the mission Order preserve and promote ethics, as well as the scientific, technical and social conditions of exercise of the profession of psychologist.
Article 4 Duties
In pursuit of its mission, the order: 5 a) Ensure compliance with the rules of professional ethics; b) set the level of professional qualification of psychologists, assign the professional title; c) Regulate the practice of the profession and defining the scope of the psychological Act; d) register of all psychologists; and) defend the rights and prerogatives of psychologists, promoting judicial procedure against those who use the title and carries on profession illegally; f) Exercise disciplinary jurisdiction exclusively on psychologists; g) prepare studies and give its opinion on any draft legislation that concern the exercise of the profession of psychologist; h) Create and regulate the professional specialties of psychology and pass the corresponding securities; I) Ensure respect for the legitimate interests of users in the services provided by psychologists, taking into account the rules of the code of ethics; j) Collaborate with schools, universities and other institutions in training graduate and postgraduate of psychologists; k) Organize, by itself or in collaboration with other institutions, specialization courses, improvement and recycling; l) to organize and promote the holding of congresses, conferences, symposia, seminars and similar activities; m) Provide scientific and technical collaboration requested by any public or private entities; n) Develop relations with similar associations, domestic or foreign, which may be part of unions and national and international federations; the) to ensure the dignity and prestige of the profession and promote solidarity among its members; p) perform other functions arising from law and the provisions of this Statute.
Article 5 Principles of operation the order acts by the respect of the principles of legality, equality, proportionality, justice, impartiality and of the Universal Declaration of human rights. 6 article 6 Insignia order are entitled to use emblem and seal own models to be adopted by the General Assembly, on a proposal from the Directorate.
Chapter II Organization of the order section I General provisions article 7 Territoriality and jurisdiction 1. The order has national, regional bodies and specialty colleges. 2. The powers of the organs are defined on the basis of national, regional or commodity specialty.
Article 8 national bodies Are national bodies of the order: a) the General Assembly; (b)) the National Directorate; (c)) the Chairman; (d) the Judicial Council); e) the Audit Committee.
Article 9 regional Agencies Are organs of the regional delegations: a) the Regional Council; 7 (b)) the Regional Directorate; c) Regional Sections.
Article 10 specialty Colleges In each specialty College there is a specialty Board.
Article 11 composition of the democratic principle is based on the direct participation of members of the order or, when this is not possible, in the election.
Article 12 Exercise of positions 1. Without prejudice to the payment for the order of any travel costs or specific tasks, as well as the following paragraph, the exercise of the positions of the bodies of the order is always free. 2. The members of the order who, for reasons of performance of their duties, to lose all or part of your work, entitled to reimbursement by the order, of the amount corresponding to regulatory conditions by the General Assembly.
Section II article 13 Elections electoral Table in the elections to the national bodies the General Assembly assumes the functions of electoral table and in the elections of the regional electoral table is the table of the regional Assembly. 8 article 14 Applications 1. The lists for the national and regional bodies are submitted to the President of the General Assembly; 2. Each list is signed by a minimum of 100 members, staff, to the national agencies and regional bodies, 30 and must include the names of all candidates for each of the organs, with the Declaration of acceptance. 3. The candidatures are submitted by 15 September of the year immediately preceding the three-year period.
Article 15 electoral roll 1-The electoral roll must be posted on the national and regional headquarters 45 days before the date of the completion of the electoral Assembly. 2-irregular or omission of registration on the electoral roll can any voter complaining to the electoral table in the 15 days following the posting, and decide the claim within 48 hours.
Article 16 1-Electoral Commission the Electoral Commission is composed of the Chairman of the general meeting and three representatives from each of the competing lists, and should start functions 24 hours after submission of applications. 2-the representatives of each of the competing lists must be indicated together with the submission of their applications. 3-the Electoral Commission: a) supervise the electoral process and resolve all issues arising in your field; b) Elaborate reports of irregularities detected and submit them to the electoral table; c) distribute between the different lists of candidates the use of means of support provided by the order. 9 Article 17 1 irregularities supply-the electoral table shall verify the regularity of the applications within five days following the close of the deadline for submission of application lists. 2-with a view to the supply of any irregularities found, the documentation is returned to the first Subscriber on the list, which should remedy it within three business days. 3-after the period referred to in the preceding paragraph without the regularization applications, should the electoral table reject them in 24 hours.
Article 18 1-ballot papers ballot papers are edited by order, by controlling the electoral table. 2-The ballot papers, as well as the application lists, are sent to all members of the electoral Assembly until 10 working days before the date set for the elections and are available on the site to vote.
Article 19 identity of electors voter identification is made through professional card and, in your absence, through identity card or any other identification with photo, accepted by the Bureau.
Article 20 Vote
1-the elections are by secret, direct and universal suffrage, exercised in person or, in terms of regulation, by correspondence. 2-Only members have the right to vote in the full enjoyment of their rights. 3-in the case of voting by correspondence is enclosed in superscript newsletter accompanied by letter signed by the voter and photocopy of the professional certificate. 10 4-the proxy voting is prohibited.
Article 21 election Date 1-elections for the national and regional bodies are held during the last quarter of the year immediately preceding the three-year period. 2-the date is the same for all organs.
Article 22 1 Mandates-holders of elective bodies are elected for a period of three years. 2-it is not allowed the re-election of holders of national or regional agencies for a third consecutive term, for the same functions. 3-the mandate and the manner of election of the holders of the Specialty boards are set out in regulations.
Article 23 polling stations For an election effect, are at least as many polling stations as many Regional delegations, in addition to the voting table in national headquarters.
Article 24 Complaints and resources 1-voters can submit complaints, on the grounds of irregularities in the election, which must be presented to the electoral table until three days after the close of the election. 2-the electoral table shall enjoy the complaint within 48 hours, being the decision communicated to the applicant in writing and posted at the headquarters of the order. 11 3-the decision of the electoral table appeal to the Judicial Council, within eight working days of the date on which the applicants had knowledge of the election Bureau decision. 4-the Judicial Council shall be convened by its President, to the effect, in eight days.
Article 25 financing of elections the order comparticipará of the cost of the elections with amount to be fixed by the Board.
Article 26 taking possession taking possession of all elected bodies occurs until a month after the elections.
Article 27 Resignation 1. All members shall enjoy the right to withdraw the mandate for which they were elected; 2. Any member of the order may request the temporary suspension of the exercise of the corresponding functions, for duly substantiated reasons, the period of suspension may not exceed six months. 3. The resignations or suspensions of the mandate should be communicated to the Presidents of the respective agencies, as well as the President of the General Assembly. 4. The exception to the previous point Chairman's resignation should be presented only to the President of the General Assembly. 5. The resignation of more than half of the members elected to a particular organ, after all the substitutions have been made by their respective substitute members elected, requires the holding of elections to the respective organ.
Section III national bodies 12 article 28 General Assembly make up the General Assembly all members of the order.
Article 29 Responsibilities of the General Assembly the General Assembly shall: a) elect and dismiss, in accordance with the provisions of this Statute, to your Table, the National Directorate, the Judicial Council and the Audit Committee; b) discuss and vote on the annual budget of the order, where the allocation of revenue and expenditure at national and regional level; c) deliberate on all matters relating to the activity of the order or that are within the scope of their statutory powers; d) approve the creation of professional specialties of psychology, upon a proposal by the National Directorate, as well as ratify the installer of the respective committees, schools, access conditions and their electoral regulations; e) Assign, on a proposal from the national leadership, the quality of corresponding member, Benefactor or honorary order; f) resolving on the creation or extinction of the regional delegations; g) fixing the value of the share to be paid by members, on a proposal from the National Directorate; h) Enjoy and vote on the report and accounts of the National Executive; I) discuss and approve proposals for amendments to the statutes. j) decide on any subject that is not understood in the specific competence of other organs.
Article 30 Operation 1. The General Assembly meets ordinarily:) for the election of the Bureau of the General Assembly, the National Directorate, of the Council and of the Supervisory Board; 13 (b)) To the discussion and the vote on the report and accounts of the National Directorate. 2. The General Assembly brings together extraordinarily, whenever the circumstances so advise and your President to call for your initiative or at the request of the Board, of any of the Regional Directions or a minimum of 100 members. 3. If the scheduled time for the beginning of the General Assembly is not present at least half of the full members, the Assembly will start its functions 1 hour later, with the presence of any number of members. 4. The General Assembly aimed at discussion and vote on the report and accounts of the National Directorate, will take place by the end of the month of March in the year immediately to its exercise.
Article 31 Call 1. The General Assembly is convened by the Chairman by notice your postcard sent to each Member at least 15 days in advance of the date designated for the conduct of the Assembly. 2. The notice of meeting shall include the agenda and the venue of the meeting.
Article 32 Table the table of the General Assembly is composed of a President, two Secretaries and two vowels.
Article 33 National Directorate the Directorate is composed of a President who is the Chairman, two Vice Presidents, a Treasurer and an odd number of vowels, at least five.
14 article 34 Competence
It is up to the National Directorate: a) Accept entries or send cancel them, at the request of or by decision of the Judicial Council; b) Elaborate and update the register of all psychologists; c) Propose the creation of the professional specialties of psychology, propose the installation of specialty colleges commissions and to submit to the approval of the General Assembly access conditions, rules of procedure and each electoral college of speciality; d) to implement the resolutions of the General Assembly; e) drafting and approving regulations; f) Driving national activity of the order; g) to promote and coordinate installation activities of Directorates and Regional Sections; h) Provide directly or through commissions set up to this end, advice and information to public and private entities, within the framework of the tasks of the order; I) Collect the revenue and the expenditure provided for in the budget; j) prepare and submit to the General Assembly the report of activities, the annual accounts and the budget.
Article 35 1 Operation. The National Directorate meets ordinarily once a month and extraordinarily whenever convened by your President. 2. The National Directorate may only deliberate validly when are present more than half of its members. 3. Decisions shall be taken by a simple majority of the members present, featuring the President of casting vote.
Article 36 15 Chairman the Chairman is the President of the National Directorate.
Article 37 Powers the Chairman: a) represent the order in court and outside it, in particular before the organs of sovereignty and community and international organizations; b) Chair with a casting vote, the National Directorate; c) Execute and enforce the resolutions of the National Directorate and other national bodies; d) Exercise the powers of the National Executive in cases of recognised urgency or in situations where such jurisdiction is delegated; and Ensure the normal operation) of the Order in respect of the law, the Statute and its regulations. f) Designate the Vice-President to replace him in his absences and impediments article 38 1 Binding. Article 40 the Council Court Judicial Council is composed of five members and assisted by a legal adviser, being one of its members Chairman and the remaining vowels.
Article 41 the Council Jurisdictional Competence: a) ensure compliance with the law, the statutes and the internal regulations, whether on the part of the organs of the order, either on the part of all its members; b) give an opinion on the proposals for regulations; c) Instruct and judge all disciplinary proceedings initiated to members; d) Prepare minutes of its meetings.
Article 42 Operation 1. The Judicial Council meets at the seat of the order when summoned by your President. 2. Decisions shall be taken by a majority, the President of a casting vote.
Article 43 supervisory board the Supervisory Board consists of a Chairman and two members.
Article 44 17 Competence the Supervisory Board: a) Examine and formulate an opinion on the annual accounts to be submitted by the National Direction to the General Assembly; b) provide the national leadership to understand suggestions of interest; c) inspect the minutes drawn up in meetings of the National Executive; d) Prepare minutes of its meetings.
Section IV article 45 Regional regional assemblies 1. The creation of regional assemblies depends on the needs created by the continuation of the activities of the order of psychologists, whose geographical area of action will appear in rules of procedure. 2. Each Regional Assembly is composed of all the members in the order whose professional domicile is situated in the geographical area covered by the Regional Delegation.
Article 46 Regional Table meetings of the Regional Council is composed of a President and two Secretaries.
Article 47 Regional Assembly is responsible for Competence: a) Elect to your table; b) Enjoy the activity plan and budget report presented by the Regional Directorate; c) deliberate on Regional Affairs; d) deliberate on any matter that is not understood in the 18 remaining specific skills regional bodies; e) Elaborate minutes of regional assemblies.
Article 48 1 Operation. The Regional Assembly meets ordinarily for the election of its Bureau and to discussion of the report on the activities of the Regional Directorate. 2. The Regional Meeting brings together extraordinarily at the initiative of the President or at the request of the Regional Directorate or one-tenth of the members of their delegation. 3. The Regional Meeting for discussion and vote on the report on the activities of the Regional Directorate is held until the end of the month of March in the year immediately to its exercise.
Article 49 Regional Direction Regional direction is composed of a President and an even number of vowels at least two.
Article 50 Jurisdiction the Regional Directorate: a) represent the order in its geographical area, in particular vis-à-vis public authorities which exercise assignments, whenever mandated for this purpose by the National Directorate; b) to implement the resolutions of the General Assembly and the Regional Assembly and the guidelines of the National Executive; c) exercising delegated powers by the National Directorate; d) Driving the regional activity of the order; and) give advice and information; f) implement the budget to the Regional Directorate; 19 g) managing Regional Services; h) prepare and submit to the Board the National report and the annual accounts; I) Prepare minutes of its meetings.
Article 51 Regional Sections
1. The Board may create Regional Sections in geographical areas of sharp specificity, in that if you don't justify the creation of regional delegations. 2. The National Directorate sets out the functions of each section and appointing a responsible to establish and preside over your section. 3. each year the management of Regional Directorate the Section the plans of activities and the annual activity reports for approval.
Section V Specialty Colleges article 52 1 Specialties. Specialty schools could be created whenever a particular matter to be considered as having scientific and technical characteristics, the importance of which involves a specialization of knowledge or professional practice. 2. Each school shall consist of all the members to be recognized such specialty.
Article 53 installation Committee 1. Whenever you form a specialty College National Directorate appoints an installation Committee composed of a President, a Secretary and three vowels, to draw up a proposal of the access conditions and rules of procedure and the election to submit to the approval of the General Assembly. 20 2. Approved the conditions of access and the rules of procedure and the Election Commission formed to create the registration of psychologists which comply with the conditions prescribed for the award of the title of specialist and then initiate the election process.
Article 54 1 Specialty Board. Each specialty College is directed by a Board of specialty, composed of a President, a Secretary and three vowels elected for three years by the members of their specialty, in accordance with regulation approved by the National Directorate itself. 2. The President has at least five years.
Article 55 the Council of Specialty Competence: a) propose to the National Executive the criteria for the award of the title of psychologist specialist; b) Assign the title of psychologist specialist in the field of their professional practice of psychology; c) Elaborate and keep updated the general framework of psychologists experts; d) promote scientific and professional relations nationally and internationally in each specialty; and ensure the scientific appreciation) technical and professional of its members; f) Prepare minutes of its meetings.
Chapter III section I Registration 21 Members article 56 1 Requirement. The role of the professional title, your use, and the practice of the profession of psychologist, in any sector of activity, depends on Order, sign-up as full member. 2. Foreigners resident in Portugal who have academic and professional qualifications equivalent to those of Portuguese citizens for the exercise of the profession of psychologist, in accordance with the applicable international legal provisions and are subject to registration in the order.
Article 57 Entry 1. Going on regional delegations, the inscription is made on professional psychologist's domicile. 2. The entry in the order can only be refused on grounds of lack of legal qualifications for the practice of the profession, while safeguarding the expulsion provided for in point (d)) the number 1 of article 79. 3. Registration in the order can be made in any of the specialties recognized by the order.
Article 58 Professional 1 Ballot. With the acceptance of the registration is issued professional ballot signed by the Chairman. 2. The ballot will have the Professional model to adopt in the General Assembly.
Article 59 suspension and Cancellation 1. The order shall be suspended: (a) members) Are subject to a disciplinary measure of suspension; b) For your initiative, your Regional Delegation, require the suspension; 22 c) members in a situation of incompatibility with the exercise of the profession of Psychologist. 2. Is canceled the subscription in Order to members that:) to be subject to a disciplinary measure of expulsion; b) stop exercising, voluntarily, the occupation, and who appear before the your Regional Delegation. 3. The penalty of suspension of registration for more than six months and unsubscribing can be imposed by judicial decision, preceding prosecution.
Article 60 non-payment of the non-payment of dues for a period exceeding one year, in accordance with the set by regulation, implies the suspension of rights provided for in article 67, the constant (c)).
Section II article 61 Categories categories of members the order has members, correspondents, honorary and benefactors.
Article 62 members Are admitted as members all graduates in psychology engaged in the profession in accordance with these regulations.
Article 63 23 corresponding members Are admitted as corresponding members: a) Portuguese citizens graduates in psychology engaged in the activity your abroad; b) members of foreign associations which confer counterparts equal treatment to members of the order.
Article 64 honorary members 1. Honorary members shall be accepted as the natural or legal persons who, exercising or having exercised the activity of recognised public interest and contributed to the dignity and prestige of the profession of psychologist, are considered worthy of such a distinction. 2. honorary membership is conferred by the proposal presented by the National Directorate and approved by the General Assembly.
Article 65 meritorious Members 1. Are admitted as members benefactors natural or legal persons who, having provided monetary contribution or equity in favor of the order are considered worthy of such a distinction. 2. honorary membership is conferred by the proposal presented by the National Directorate and approved by the General Assembly.
Section III rights and obligations of members article 66 rights of members
Constitute rights of members: a) the practice of the profession of psychologist; b) Be supported in order to defend their rights and interests; 24 c) Be informed of all the studies, dispositions and opinions relating to the exercise of the profession; d) Require the assignment of levels of qualification, as well as titles of expertise; e) Suggest and discuss the creation of specialties; f) Benefit of editorial activity and use the services offered by order: g) Elect and be elected to the organs of the order; h) participate in the activities and exercise any functions under the order, in accordance with the staff regulations; I) Participate and benefit from the social, cultural, recreational activity and scientific order.
Article 67 duties of members Constitute obligations of the effective members: a) scrupulously respect the principles laid down in the code of ethics; b) pay commissions and working groups of the collaboration they are requested; c) contribute to the good reputation of the order and seek to expand your sphere of influence; d) performing the functions for which they are appointed; and) comply with and enforce the resolutions of the bodies of the order; f) Pay the quotas and other regulatory burden; g) Update professionally; h) Acting jointly to defend the collective interests of members of the order.
Article 68 rights and obligations of corresponding members 1. Constitute rights of corresponding members the laid down in (c)) and (f)) of article 67. 2. Obligations of corresponding members as laid down in (a)) and (c)) of article 68.
69 Article 25 rights of honorary members honorary members the law Constitutes factored in (c)) of article 67.
Chapter IV Financial Regime article 70 Recipes Are recipes of the order; a) quotas paid by its members; b) proceeds from the sale of its publications; c) Donations, inheritances, bequests and grants; d) income from goods which are assigned; and) revenue from activities and projects; f) other revenue from own goods or provide services.
Article 71 Expenses Constitute costs of the Order of installation and personnel expenses, maintenance, operation and all the necessary to achieve its objectives.
Article 72 exemption from costs, preparation and justice tax the order is free of expense, preparation and tax justice in any case to intervene.
Chapter V disciplinary Regime 26 article 73 1 responsibility principle. The members of the order respond disciplinary proceedings pursuant to these regulations and disciplinary regulations. 2. disciplinary liability is independent of the civil and criminal liability.
Article 74 disciplinary jurisdiction over the exercise of disciplinary action is the responsibility of the Councils, the Board and the National Directorate.
Article 75 disciplinary Infringement 1. Disciplinary offence is considered any action or omission that consists of willful or culpable violation by any member of the order, of the duties laid down in the staff regulations, the code of conduct or regulations. 2. Any natural or legal person may inform the order of acts likely to constitute disciplinary offence committed by registered psychologist.
Article 76 the disciplinary liability 1. Disciplinary offences prescribe within five years of the Act or of the final act in the event of continuing practice. 2. If the offences constitute criminal offences are provided simultaneously in the same period that the criminal proceedings, if this is higher. 3. The disciplinary responsibility also prescribes, since the participation to any body of the order of the infringement committed, does not start the competent disciplinary procedure within a period of five months.
27 article 77 cessation of disciplinary responsibility to disciplinary responsibility remains during the period of suspension of the order, and does not cease with the request for cancellation of the registration, or expulsion, for previously committed offences.
Article 78 disciplinary Penalties 1. Disciplinary penalties are as follows: a) warning; b) censorship registered; c) Suspension up to a maximum of six months; d) Expulsion. 2. The penalty referred to in (a)) is applied to the Member that disrespecting any instruction or order that it be given for any one of the organs. 3. The penalty provided for in subparagraph (b)) is applied to a member who commits a disciplinary offence in the event of gross negligence or reincida in the infringement referred to in the preceding paragraph. 4. The penalty provided for in subparagraph (c)) is applied to a member who commits a disciplinary offence which seriously affects the dignity and prestige of the profession. 5. The penalty provided for in point (d)) is applied to a member who commits a disciplinary offence which also constitutes crime punishable with imprisonment exceeding two years or when reincida in the infringement referred to in the preceding paragraph. 6.
