MOTION FOR RESOLUTION No. 71 /X

Considering that on December 16, 1990, it was adopted, within the framework of the

Community of Portuguese-speaking Countries (CPLP), the Orthographic Agreement of the Language

Portuguese in whose Article 3 is provided for the respective entry into force on January 1, 1994,

after deposited the instruments of ratification of all the contracting States;

Considering that Portugal has completed the internal process of approval of the Agreement

Orthographic of the Portuguese Language in August 1991 and proceeded to the deposit of the

respective instrument of ratification;

Considering that July 17, 1998 has been approved the first Modified Protocol

the Orthographic Agreement of the Portuguese Language, excluding from its Article 3 the date of entry

in force but maintaining the requirement of the deposit of the instruments of ratification of all

the contracting States;

Considering that in 2000 Portugal complied with the internal procedures of completion of the

first Modified Protocol;

Considering that at the V Conference of Heads of State and Government of the CPLP,

held in São Tomé on 26 and July 27, 2004 if it proceeded to the signing of the Agreement

of the Second Modified Protocol to the Portuguese Language Ortographic Agreement;

Considering that the Agreement of the Second Modified Protocol to the Orthographic Agreement

of the Portuguese Language establishes the entry into force of the Orthographic Agreement of the Language

Portuguese with the deposit of the third instrument of ratification, as well as the opening of the

Orthographic Agreement of the Portuguese Language to the accession of Timor-Leste;

Considering that the present Government has consulted, through the Camões Institute, the various

relevant entities in this regard, such as the Academy of Sciences of Lisbon, the Association

International of Lusitanists, the Portuguese Association of Writers and Booksellers, the

Portuguese Association of Linguistics, the Calouste Gulbenkian Foundation and the Union of

Portuguese Editors;

Considering that the Government will be mindful of the effects that the entry into force of the Agreement

Orthogs of the Portuguese Language may have in the publishing industry and, if necessary and

appropriate, will institute, coordinately with other CPLP countries, measures to support the

sector which, incidentally, has recently been crossing in Portugal a process of profound

reorganization;

Considering that, as for the application of the Portuguese Language Ortographic Agreement, the

Government to pursue a policy of safeguarding a no-rupture transition,

particularly at the level of the education system in general and, in particular, the teaching of the language

portuguese, with incidence in the national curriculum, curricular programmes and guidelines and

pedagogical, as well as with regard to textbooks and other resources

didactic-pedagogicos;

Considering that the entry into force of the Portuguese Language Ortographic Agreement in the

internal legal order will not interfere with the total freedom of creation at the level of the writing,

how they never interfered the previous orthographic code of 1911, inter-academic agreement

of 1931 and complimentary agreement of August 1945, this out of the Conference Luso-

Brazilian of that same year;

Considering that the Portuguese Republic fully assumes the previous commitments

and that it reiterates its interest in the rapid materialization of the objectives set out in the Agreement

Orthographic of the Portuguese Language.

Thus:

Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following motion for a resolution:

Article 1.

Approval

Approve the Agreement of the Second Modified Protocol to the Orthographic Agreement of the Language

Portuguese, adopted at the V Conference of Heads of State and Government of the

Community of Portuguese-speaking Countries (CPLP), held in São Tomé, at 26 and 27

of July 2004, the text of which, in the authenticated version in Portuguese language, publishes itself in

attachment.

Article 2.

Statement

1. The deposit, by the Portuguese Republic, of the instrument of ratification of the Agreement of the

Second Modiactive Protocol to the Portuguese Language Ortographic Agreement no

undermines the validity of the constant spelling of acts, standards, guidelines or

documents from public entities, cultural goods, as well as from

textbooks and other didactic-pedagogical resources, with official value or

legally subject to recognition, validation or certification, to the existing date.

2. Within the limit of six years after the deposit of the instrument of ratification of the Agreement

of the Second Modified Protocol to the Portuguese Language Ortographic Agreement, the

constant spelling of new acts, standards, guidelines, documents or of goods

referred to in the preceding paragraph or which are to be the subject of review, reissue,

reprint or any other form of modification, regardless of your

support, must conform to the provisions of the Orthographic Agreement of the Language

Portuguese.

3. The Portuguese State shall adopt the appropriate measures to safeguard a transition without

ruptures, particularly with regard to the education system in general and, in

particular, to the teaching of the Portuguese language with incidence in the national curriculum,

programs and curriculum and pedagogical guidelines.
