Decree-Law No. 3/2008, of January 7

The Decree-Law No. 3/2008 of January 7, which sets out the specialized supports to be provided

in preschool education and the basic and secondary education of the public sectors,

particular and cooperative, has been approved by the Government with scant public discussion, without

what entities that have for many years been studying the subjects connected to the Special Education

had been ausculated.

At the same time, doubts are being expressed about the practice of using the

International Classification of Functionality (CIF) of the World Health Organization

(WHO) in the signage of children with special educational needs (NEE).

The Decree-Law No. 3/2008 of January 7 institutes the CIF-WHO as a basic instrument in the

signalling and forwarding of children with NEE. However, CIF is applied in the

our schools about two years ago, with the results that are of all known:

fewer supported children, children who have to stay at home because they stopped having

support in school. There are still situations in which children with a high degree of

deficiency, which before they had supports, ceased to have it.

The way the Government is proposing to set up reference schools, by simply ignoring

the network of schools of the special education that the country has, must also be the subject of

reflection.

In these terms, under the provisions of Article 162 (c) and Article 169 of the

Constitution of the Portuguese Republic and still of Articles 4 (º1) (h) and 189 of the

Rules of the Assembly of the Republic, the Deputies undersigned, of the Group

MP from the PSD, come to apply for Parliamentary Appreciation Of Decree-Law No. 3/2008,

of January 7, which sets out the specialized supports to be provided in preschool education and

in the basic and secondary teaches of the public, private and cooperative sectors.
