Decree-law No. 380/2007 of November 13

"Approves the bases of the grant of the funding, design, project, construction, conservation, exploitation, requalification and enlargement of the national road network"

The publication of Decree-law No. 380/2007 of November 13, which "approves the bases of the granting of the funding, design, project, construction, conservation, exploitation, requalification and enlargement of the national road network", represents an attack unacceptable to the national interest and the integrated development of the country, mortgaging for the future the strategic infrastructure that is the national road network. The creation of a new, insolithic concept-the Future National Road Network-is still the illegitimate determination that avenues to be built will necessarily be in line with this new model of exploitation, based on the capacity for self-funding of this company, which, as history has been demonstrating, falls back on users, aggravating the already too many economic burdens of the Portuguese population, and, irresponsibly, forcing future generations to pay for the current PS Government options and to the liberal economic model that they want to impose on the force of the aggravation of the injustices social and with the price of the lowering of the standard of living of who less can and less has. The decree-law under consideration determines that the concessionary company of the national road network is solely responsible for the necessary financing for the development of all the activities that constitute the object of the concession; and that the State is not subject nor assume any responsibility with regard to the necessary financing for the development of the activities integrated into the grant-financing, conservation, operation, requalification and enlargement of the tracks that integrate the Network National Road, as well as the design, project, construction, financing, conservation, exploration, requalification and enlargement of the tracks that integrate the Future National Road Network. It is, in a strategic matter for the development of the country, of a policy of disaccountability of the state, enshrined in a form of law that is for the absolutely unacceptable CFP. The Prime Minister lied to the MPs and the Portuguese, when he stated in the State Budget debate at the Plenary Session of the past day 6 in response to the CFP, that " the Minister of Finance has already explained, at the meeting of the Budget and Finance presentation of the State Budget for 2008, that it is all budgeted in this Budget, and it is public. The public company has changed in nature, but it continues to be public! It does not come out of the budget perimeter, it is all in the State Budget and has not yet been set the deadline for the concession ! ", getting to the point of reiterating, in the same debate," the deadline may be up to 99 years, but it may be smaller! That's why I said the deadline is not fixed. ".

The Decree-Law ora published provides, in its Chapter IV, Base 10, that "the concession expires at 24 pm on the December 31, 2099". The approval in Council of Ministers took place on September 27, and on that date it was signed by the Prime Minister, and Ministers of Finance and Public Works. The non-inclusion by the Government, in the State Budget proposal for 2008, of financial transfers to the Highways of Portugal has already been the option that this degree comes to realize the transformation of a fundamental public service into a business, determining that this company will negotiate freely with any funders, putting into question the very concept of public service that this diploma says it intends to observe. This decision, alongside the norm mandating that the dealership should privilege public-private partnerships, comes to pave the way for entry into the public sector network of the national road network of the economic groups of the construction and management sector of motorways. This diploma is a real blank check for companies and for financial capital, to whom this Government has delegated the responsibility of one of the main structuring axes of national development. In these terms, under the provisions of Article 162 (c) and Article 169 of the Constitution of the Portuguese Republic and still to (h), Article 4º (1) and Article 189 of the Rules of the Assembly of the Republic, the deputies below Signed, of the Parliamentary Group of the CFP, come to apply for Parliamentary Appraisal Of Decree-law No. 380/2007 of November 13, which " approves the bases of the grant of financing, design, design, construction, conservation, exploitation, requalification and enlargement of the national road network ".
