MOTION FOR RESOLUTION No. 62 /X

Considering that trafficking in human beings constitutes a violation of human rights

and an offence to the dignity and integrity of the human being, and may lead to a situation

of slavery for the victims;

Recalling the statements of the Ministers of Foreign Affairs of the States

members on the occasion of the 112 th (14 and May 15, 2003) and 114. th (12 and May 13)

2004) Sessions of the Committee of Ministers, calling for enhanced action by the Council of the

Europe in the field of trafficking in human beings;

Having present the Convention for the Protection of Human Rights and Freedoms

Fundamental (1950) and its Protocols;

Having due regard to the United Nations Convention against Criminality

Transnational Organized and respective Additional Protocol that aims to Prevent, Suppress

and Santing the Trafficking of Human Serbs, particularly Women and Children,

with a view to strengthening the protection secured by these instruments and developing the

standards in them set out;

Attending that the present Convention constitutes the latest and complete instrument

international legal in this field, following the same strategy as others

already existing legal instruments, which aims to prevent and fight against trafficking in

human beings, protect the rights of victims by establishing a complete picture of

protection and assistance, as well as ensure effective investigations and procedures

and still promote international cooperation in this field;

Thus:

Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following motion for a resolution:

Article 1.

Approving the Convention on the Fight Against Trafficking in Human Beings of the Council

of Europe, open to signature in Warsaw, on May 16, 2005 and signed by

Portugal on the respective opening date, the text of which, in the authentic version in the languages

english and french, as well as the respective translation for Portuguese language, if

publish in attachment.

Article 2.

In accordance with Article 31 (2), the following Booking is formulated:

With respect to the powers provided for in points d) and e) of Article 31, the Republic

Portuguese declares that it will not apply the standards of competence established therein, in

virtue of Portuguese criminal law setting criteria of competence more

rigorous and comprehensive than those provided for in the above mentioned above. "
