DRAFT RESOLUTION NO. 200 /X

ON THE INITIATIVE " UNITED PARLIAMENTS TO FIGHT

THE DOMESTIC VIOLENCE AGAINST WOMEN "

1-The Council of Europe deliberated, at the Warsaw Summit, of May

2005, organize a trans-European campaign of " Fight against violence over the

women, including domestic violence ", which will run from November 2006 to

March 2008.

2-A Parliamentary Assembly of the Council of Europe, deliberated, at its session

of June 28, 2006, associate with the campaign through the initiative " Parliaments

United In Combating Domestic Violence ".

3-A Assembly of the Republic claims to be sympathetic to this important

campaign, and manifests itself committed to the search for the best answers to such serious

problem, making use of all the means at its range, in articulation with the

Parliamentary Assembly of the Council of Europe.

4-Thus, the Deputies and the Deputies, the undersigned, present, in the

applicable constitutional, legal and regimental terms, the following draft resolution:

Considering that:

1. Domestic violence is the fruit of an asymmetric relationship of power between

women and men and as such do not know social, geographical boundaries,

economic, age and cultural;

2. Domestic Violence constitutes a violation of Human Rights, of the

freedom and the self-determination of women.

3. Athena the context of family intimacy in which it normally manifests itself and

develops, the fight against Domestic Violence requires an alliance of efforts,

either at the national level, or at the international level;

4. The personal, family, professional and social impact arising from an environment of

domestic violence is huge, and it also hits, with special gravity, the

children and the elderly;

5. Notwithstanding the work developed by nongovernmental organizations to the

long years and the progress verified at the level of prevention, a major

number of women continues, still, to be the victim of acts of violence

domestic;

6. Violence against women brings, for the whole of society, elevated

costs, specifically, in the areas of health, justice and social security;

7. The environment of violence in the family tends to reproduce in future generations;

8. The combating of domestic violence against women contributes to construction

of a more just and respectful society of fundamental human rights.

The Deputies and Deputies to the Assembly of the Republic, associate with the

campaign launched within the framework of the Council of Europe on violence against the

women, including domestic violence and, as a result, enrolled the combat to

such a phenomenon as a priority of its political agenda, both at the level of representation

national, as from the constituencies, in the sense that domestic violence cannot

be tolerated.

Thus, they assume the commitment to:

a. Assessing the existing legal framework regarding violence

domestic with the aim of updating it, through the necessary and

indispensable changes, in line with the good practices of several

countries and the experience of non-governmental organizations;

b. Promoting a culture of conscientiousness of the victims to their

rights, and of the potentiating conduct of acts of domestic violence,

as well as strengthening measures to protect the victim and suppression of the

aggressor;

c. Ensuring the achievement of studies necessary for the analysis,

understanding and combating the phenomenon of violence;

d. Developing all efforts for the awareness of women

victims of domestic violence, for the recognition of their condition and

of your rights;

e. Divulgar the knowledge of the phenomenon, for better awareness of

all the actors involved, for a better identification and combat to the

domestic violence;

f. Ensuring the evaluation of the support policies for victims, and well the

relating to the aggressors, within the framework of parliamentary powers;

g. Appeal to the Portuguese people in the sense of greater accountability

collective, with a view to the prevention and combating of violence against the

women.
