PARTICIPATION OF THE ASSEMBLY OF THE REPUBLIC IN

PARLIAMENTARY ASSEMBLY OF THE MEDITERRANEAN

The region of the Mediterranean is, in essence, a crossing of cultures, a space of

dialogue, cooperation but also an area of tension and conflict. Today, more than

never, the Mediterranean region needs mechanisms of permanent dialogue,

deep and differentiated.

The establishment of the Parliamentary Assembly of the Mediterranean certifying the importance of the

creating a platform for political dialogue that enables the exchange of experiences

cultural, economic and social, with the aim to consolidate and deepen the

democracy, the rule of law and respect for human rights, safeguarding the

different cultures, civilizations and religious beliefs.

The Assembly of the Republic resolves, in accordance with Article 166º (5) of the Constitution,

the following:

Article 1º

Membership

The Assembly of the Republic adheres to the Parliamentary Assembly of the Mediterranean (APM) and

accepts its Statutes that are published, in translation for Portuguese language, in annex

to this resolution, without prejudice to the changes to be brought by the

procedure in it envisaged.

Article 2º

Delegation

1-A The participation of the Assembly of the Republic in the APM is ensured by a

Delegation.

2-A Delegation shall consist of five members, including a President and a Vice-

president.

3-Will be elected as yet three alternates who will replace the actual members in the event of

impediment.

4-A Delegation shall be pluripartisan, reflecting the composition of the Assembly of

Republic.

Article 3º

Competencies

1-A Delegation performs the tasks, exercises the powers and fulfills the obligations

provided for in the Statutes of APM.

2-The Chair of the Delegation directs his works and coordinates the performance of the

respective members.

3-In his absences and impediments, the president is replaced by the vice president.

Article 4º

Mandate

1-A Delegation is elected by the Assembly of the Republic at the beginning of each legislature and

for the period of this.

2-Members of the Delegation, if they are re-elected Members, shall keep in

functions until new election of her.

Article 5º

Health

The operation of the Delegation shall be governed by the provisions of Article 2 of the Resolution of the

Assembly of the Republic paragraph 5/2003 of January 22.

Article 6º

Standards applicable

The Delegation and its members comply with the applicable rules of the Rules of the

Assembly of the Republic and the Resolution cited in the previous article.

Statutes of the Parliamentary Assembly of the Mediterranean

Adopted by consensus on February 7, 2005, Nauplia (Greece) and to September 11, 2006, Amman (Jordan)

Nature and purpose

Article 1. The Parliamentary Assembly of the Mediterranean (hereinafter referred to as the Assembly) is the parliamentary institution that brings together the parliaments of all the countries of the Mediterranean Basin, in equal circumstances.

Article 2. 1. The Assembly is an autonomous institution endowed with legal personality. The Assembly was created by a decision of the national parliaments of the countries of the Mediterranean Basin. 2. The Assembly is based on the pioneering work carried out by the Inter-Parliamentary Union (UIP) through the process of the Conference for Security and Cooperation in the Mediterranean (CSCM), and maintains a privileged relationship with the UIP, to which it sends, to the title informative, a report of annual activities in the first quarter of the following calendar year.

Article 3. 1. The Assembly develops cooperation among its members, in its areas of action, promoting political dialogue and understanding among the target parliaments. 2. The Assembly deals with matters of common interest to encourage and strengthen, even more, trust among the Mediterranean states, to ensure regional security and stability and to promote peace. The Assembly also seeks to combine the efforts of the Mediterranean States in a true spirit of partnership with a view to its harmonious development.

Article 4.

The Assembly prepares and sends the member parliaments opinions, recommendations and other consultative texts that contribute to the achievement of their objectives.

Composition

Article 5. 1. Mediating application, the parliaments of the States of the Mediterranean Basin, Jordan, the Former Yugoslav Republic of Macedonia and Portugal are full members of the Assembly. 2. The parliaments of the geographically close countries of the Mediterranean or with interests common to those in the region, as well as active inter-parliamentary organizations in the area may, upon application, be invited to participate in the Assembly's work in the quality of associate members.

Article 6. 1. It shall be up to the Assembly to submit opinions, recommendations and other texts of advisory to national parliaments and to the governments of its members. 2. The national parliaments shall inform the Assembly about the measures taken to promote the implementation of the texts adopted.

Article 7.

All members and associated members of the Assembly shall make an annual financial contribution to the operation of it. Its value should be calculated by applying the scale of contributions (appended to these statutes) to the draft budget approved by the Assembly. The Associate Members of the Assembly shall make an additional annual contribution of a value fixed by the Assembly, aiming at the maintenance of its mannered fund.

Structure

Article 8. The structure of the Parliamentary Assembly of the Mediterranean is composed of the Assembly, the Bureau, three standing committees, the eventual commissions and the Secretariat.

Assembly

Article 9. 1. Unless otherwise decided, the Assembly meets annually in an ordinary session at the invitation of a member parliament. 2. The President of the Assembly convene extraordinary sessions of the Assembly the requirement of two thirds of its members.

Article 10. The member parliament that welcomes the meetings and / or activities of the Assembly shall ensure the entry into its territory of all representatives of the member parliaments and associated members.

Article 11. 1. The composition of the Assembly and its decision procedure shall be governed by the principle of equality among its members. 2. Delegations of the member parliaments to the Assembly sessions include at most five parliamentarians. 3. Delegations of the members shall be composed of parliamentary men and women.

Article 12. 1. The Assembly elects a president and four vice-presidents for a two-year term. 2. The Assembly elects a chairperson for each of the three standing committees for a two-year term.

Article 13. 1. The President of the Assembly opens, suspends and terminates the meetings, presides over the proceedings of the Assembly, ensures compliance with the Rules, grants the floor, submits the subjects to the vote, announces the results of the votes and declares the closure of the proceedings of the Assembly. Their decisions regarding these subjects are final and must be accepted without debate. 2. It shall be up to the President to make decisions on all cases that do not include in these Statutes, heard from the opinion of the Bureau, if necessary, or the requirement of the majority of the other members of the Bureau.

Article 14. 1. Each delegation shall be entitled to five votes, provided that at least two of its members are present in the vote. 2. In case only one delegate finds himself present, this one shall be entitled to one vote only.

Article 15. 1. The decisions of the Assembly shall be taken by consensus. 2. In the absence of consensus, the Assembly makes decisions by a majority of four fifths of the votes cast.

Article 16. 1. The proceedings of the Assembly shall be prepared by the Bureau. 2. The Bureau shall be composed of the President of the Assembly, by four Vice-Presidents and three Chairpersons of the Standing Committees.

Article 17. 1. Members ensure in the Bureau an equitable representation, by turnover, of the various regions of the Mediterranean. 2. The members strive to ensure that both genders are represented in the Bureau.

Article 18. 1. The Bureau, assisted by the Secretariat, shall have the function of taking all appropriate measures to ensure the effective organization and harmonious development of the Assembly's work in accordance with the Statute and the Regulations of the Assembly.

Standing committees

Article 19.

The proceedings of the Assembly are prepared by the standing committees that issue opinions and recommendations. The standing committees deal with the following issues:

From Commission for Political and Security Cooperation (First Commission): Regional Stability: relations between Mediterranean partners on the basis of eight principles (not recourse to threat or use of force, peaceful resolution of international litigation, inviolability of borders and territorial integrity of states, right of peoples to the self-determination and to live in peace in the respective territories within the internationally recognized and guaranteed borders, equal sovereignty of States and non-interference in internal affairs, respect for human rights, cooperation between states, execution of good faith of the obligations assumed under the law international), issues related to peace, security and stability, confidence-building measures, arms control and disarmament, respect for international humanitarian law, and fight against terrorism.

From Commission for Economic, Social and Environmental Cooperation

(Second Commission) :co-development and partnerships: globalization, economy, trade, finance, issues concerning indebtedness, industry, agriculture, fisheries, employment and migration, demographics, poverty and exclusion, human establishments, water and energy resources, desertification and defence of the environment, tourism, transport, sciences, technologies and technological innovation.

From Commission on the Dialogue of Civilizations and Human Rights

(Third Committee): mutual respect and tolerance, democracy, human rights, issues of gender, children, minority rights, education, culture and heritage, sport, media and information, and dialogue among religions.

Article 20.

Each member parliament has the right to participate in the proceedings of each of the three standing committees by making themselves represented by at least one member.

Article 21. 1. A group of special studies aimed at gender and gender equality issues is set up in the third committee. 2. To assist the three standing committees in the performance of their duties, the Assembly may set up other special study groups, tutelled by each committee.

Possible commissions

Article 22. 1. The Assembly may set up possible commissions to deal with specific subjects. 2. The Assembly, heard the opinion of the Bureau, deliberates on the proposals of the members of creation of one or more possible commissions.

Secretariat

Article 23. 1. The Assembly benefits from the services of a secretariat located in a Mediterranean country whose parliament is a member of the Assembly. 2. In the transitional period and while the Assembly does not have a secretariat of its own, the Secretariat of the Union Interparliamentary provides you with administrative support.

Amendments to the Statutes

Article 24. 1. Amendments to the Statutes shall be submitted to the Secretariat, in writing, at least three months before the meeting of the Assembly. The Secretariat shall, immediately, inform the Members of the Assembly of the proposed amendments. The appreciation of the amendments is automatically included in the agenda of the Assembly. 2. I hear from the opinion of the Bureau, the Assembly deliberates on these proposals by consensus.
