CREATES THE TECHNICAL SUPPORT UNIT WITH THE DSATS,

BY MEANS OF AN AMENDMENT TO THE RESOLUTION OF THE ASSEMBLY OF

REPUBLIC NO. 20/2004, OF February 16, 2004, STRUCTURE AND

COMPETENCES OF THE SERVICES OF THE ASSEMBLY OF THE REPUBLIC

The transparency of budget implementation and the provision of Public Accounts assume-

whether as two of the most important factors that can contribute to strengthening

of the credibility and confidence of economic agents and constitute the guarantee of good

operation of the mechanisms of political and financial surveillance, giving them

visibility in the framework of the commitments made by Portugal in the European Union.

Since 1993, they have been discussing the need to assign to the Assembly of the Republic

greater means and capacity to technically follow up with budgetary matters and

financial through the creation of a technical unit for the purpose, so the

Committee on Budget and Finance, in the use of the constitutional powers that are

conferred upon the Assembly of the Republic by Article 107 and (a) of the Article 162 para.

Constitution of the Portuguese Republic, in the sense of scrutinizing the budgetary implementation and

surveil the acts of the Government and the Public Administration, in particular those of incidence and

budgetary and financial impact, deliberates to propose to the Board of Directors, through

of the Secretary-General, pursuant to paragraph 2 of Article 27 of the Law No. 28/2003, from 30 of

July, the establishment of the Technical Support Technical Unit, by way of a proposal of

amendment to the Resolution of the Assembly of the Republic. 20/2004, published in the Journal of the

Republic, I Series A, No. 39, of February 16, 2004, adjoining a new article.

Thus, the Assembly of the Republic, pursuant to Article 161 (o) and paragraph 5 of the

article 166 of the Constitution and paragraph 2 of Article 27 of Law No. 28/2003, from 30 of

July, on a proposal from the Board of Directors, resolves the following:

1. A paragraph 3 to Article 7º and an Article 10º-A to the Assembly Resolution of the Assembly shall be postponed.

3. It is created, together with DSATS, for technical support to the specialist committee that

detains competence in budgetary and financial matters and under its

direct guidance, the Technical Support Technical Unit (UTAO)

Article 10º-A

Technical Support Unit

1 . It is incumbent upon UTAO to draw up studies and technical working papers on

public budgetary and financial management, in the context of the following subjects:

a) Technical analysis of the State Budget Law Proposal and its

changes;

b) Technical assessment on the General Account of the State;

c) Technical monitoring of budget implementation;

d) Technical analysis to the Revisions of the Stability and Growth Program;

e) Technical study on the budgetary impact of legislative initiatives

admitted, that the President of the Assembly of the Republic understands to submit to the

Specialized committee that detains competence in budgetary matters and

financial, pursuant to paragraph (d) of the paragraph. 1 of Article 17 of the RAR;

f) Other work which is determined by the committee

specialized to hold the competence in budgetary matters and

financial, or for this to be submitted by the President of the Assembly

of the Republic or by other specialized Commissions.

2. UTAO is comprised of 3 a to 5 technicians, to requisition or to hire us

terms of the Assembly Services Act and the Health of the Assembly Services

of the Republic (LOFAR) and too much applicable legislation.

3 . The UTAO operates in accordance with its Rules of Procedure, approved

by the President of the Assembly of the Republic, upon proposal of the

specialist committee that detains competence in budgetary matters and

financial.

4 . The specialist Commission that detains the competence in matter

budget and financial may submit to the approval of the President of

Assembly of the Republic, in accordance with Article 48º (3) of the LOFAR, the

hiring of studies to other entities, on subjects justifying

high degree of technical and scientific complexity.

2 . Before decorating three years on the entry into duties of the UTAO the Commission

specialized to hold the competence in budgetary and financial matters

carries out its assessment, taking into account the developed activity and costs

involved and presents proposal for maintenance, extinction or alteration, or in

terms of competences, both in terms of composition.
