MOTION FOR RESOLUTION No. 25 /X

Bearing in mind that the Portuguese Republic and the Kingdom of Norway enjoy excellent

bilateral relations and which, with the entry into force of the EEA Agreement, on January 1 of

1994, the relations in social security between the two states have become

regulated by Council Regulation (EEC) No 1408/71 of June 14 and by the

Council Regulation (EEC) No 574/72 of March 21;

Considering that both states recognize the need to establish a

agreement governing residual aspects of an administrative nature on health,

permitted by the Community Social Security Regulations, having in view

simplify and standardize procedures of the Portuguese and Norwegian institutions,

particularly pertaining to benefits in kind and administrative controls and

doctors;

Thus:

Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the

Assembly of the Republic the following motion for a resolution:

Under the terms of the paragraph i) of Article 161 and of the f) of Article 165 (1) of the

Constitution, the Assembly of the Republic approves the Agreement between the Portuguese Republic

and the Kingdom of Norway on Renpronunciation to Reimbursement of Relative Expenses to Pressure

in Species Granted in the Terms of Chapters I and IV of Title III of the Regulation

(EEC) No 1408/71 of the Council of June 14, 1971, signed in Oslo, in 24 of

November 2000, the text of which, in the authentic versions in the Portuguese languages and

Norwegian, it publishes in annex.

AGREEMENT

About Waiving the Reimbursement of Expenses Relative to Presents in Species

Granted in the Terms of Chapters I and IV of Title III of Regulation (EEC) No.

1408/71 of the Council, of June 14, 1971

The Government of the Portuguese Republic

and

The Government of the Kingdom of Norway

Considering Article 29º of the EEA Agreement of May 2, 1992 and its Annex VI;

Considering the provisions of paragraphs 3 of Articles 36º and 63º of Regulation (EEC) No

1408/71 of the Council of June 14, 1971 in paragraphs 6 of Articles 93º, 94º, 95º and

also in Article 105º (2) of Council Regulation (EEC) No 574/72 of 21 of

March 1972, which allows you to establish other refund modalities or waive

to the reimbursement relating to benefits in kind granted pursuant to Chapters I and

IV of Title III of Regulation (EEC) nº1408/71 and administrative controls and

doctors, respectively;

Desiring to facilitate the administrative tasks of the Portuguese institutions and

Norwegian;

They agreed in the following:

Artigo1º

1. For the purpose of application of this Agreement,

a) "Regulation" means Council Regulation (EEC) No 1408/71 of 14 of

June 1971, relating to the application of social security schemes to the

salaried workers to self-employed persons and members of their

family moving within the Community, in the last applicable wording

between the Contracting Parties;

b) "Implementing Regulation" means the Regulation (EEC) No 574/72 of the

Council of March 21, 1992 laying down the modalities of application of the

Regulation (EEC) No 1408/71 on the application of safety schemes

social to salaried employees, to self-employed persons and members

of their family moving within the Community, in the last wording

applicable among the Contracting Parties;

2. Other terms and expressions used in this Agreement have the meaning that they are

assigned in the Regulation, the Enforcement Regulation or the national legislation,

depending on the case.

Article 2º

The competent authorities of the two Contracting Parties waive the refund

of the expenses incurred by an institution of a Contracting Party on account of the

institution of the other Party with the benefits in kind granted in the terms of the

provisions of Article 19º , in paragraphs 1 (1) (a) and 3, in their conjunction with paragraph 1, para.

(a) of Article 22º, Articles 25º, 26º, 28º, 28º A, 31, 52, 52 and in paragraph 1 (a)

article 55º of the regulation.

Article 3º

The competent authorities of the Contracting Parties waive the reimbursement of

expenditure on the administrative and medical checks referred to in Article 105º (l) of the

application regulation.

Article 4º

In the cases referred to in Article 2º of this Agreement, the institution of the place of

residence of the person concerned is considered to be the competent institution.

Article 5º

1. This Agreement shall enter into force on the first day of the month following that of the last

notification of the fulfilment of the formalities required for the purpose by the order

legal of each of the Parties.

This Agreement shall produce effect on the date on which the Regulation and Regulation

from Implementation to enter into force in relations between Portugal and to Norway.

2. The present Agreement may be denounced by any of the Contracting Parties, by

written, three months in advance, counted from the date on which the other

Part receive the notification.

under henvisning til EØS-avtalen av 2. mai 1992, artikkel 29, Vedlegg VI nr 1 og 2, og

til artiklene 36 nr. 3 og 63 nr.3 i Rådsforordning (EØF) nr. 1408 /7l av 14. juni 1971, til

artiklene 93 nr. 6, 94 nr. 6, 95 nr. 6 og til artikkel 105 nr. 2 i Rådsforordning (EØF) nr.

574/72 av 21. mars 1972, som gir adgang til å avtale andre refusjonsordninger eller gi

avkall på refusjon for naturalytelser tilstått etter Forordning 1408/71 og administrativ

kontroll og medisinske undersøkelser, med sikte på en forenkling av administrative

oppgaver for portugisiske og norske institusjoner, har blitt enige om følgende:

Aftikkel I

1. I denne overenskomst betyr

a. "Forordningen"

Rådsforordning (EØF) nr. 1408/71 av 14. juni 197l om anvendelse av

trygdeordninger vedrørende arbeidstakere, selvstendige naeringsdrisell og leaders

familiemedlemmer sound flytter innenfor fellesskapet, med of bestemmelser sound

enhver tid kommer til anvendelse mellom de to kontraherende parter,

b. "Gjennomføringsforordningen"

Rådsforordning (EØF) nr. 574/72 av 21. mars 1972 sound fastsetter reglene for

gjennomføring av Rådsforordning (EØF) nr. 1408/71 om anvendelse av

trygdeordninger vedrørende arbeidstakere, selvstendig naeringsdrisell og leaders

familiemedlemmer sound flytter innenfor Fellesskapet, med of bestemmelser sound

enhver tid kommer til anvendelse mellom de to kontraherende parter.

2. Andre ord og uttrykk som er benyttet i denne overenskomst, har den mening de

alt etter omstendighetene er tillagt respektivt i forordningen,

gjennomføringsforordningen eller nasjonal lovgivning.

Artikkel 2

Begge kontraherende parters kompetry myndigheter gir avkall på refusjon av utgifter

påført institusjonen til den ene kontraherende part på vegne av institusjonen til den

andre kontraherende part for naturalytelser tilstått etter artikkel 19, artikkel 22 nr. 1 (a)

og nr. 3, jfr.nr.l (a), artiklene 25, 26, 28, 28a, 29, 31 og 52 og artikkel 55 nr. 1 (a) i

forordningen.

Artikkel 3

Utgifter til administrativ kontroll og medisinske undersøkelser som nevnt i artíkkel 105

nr. 1 i gjennomføringsforordningen, skal ikke refunders mellom de to kontraherende

parters kompetry myndigheter.

Artikkel 4

I de tilfellene som er nevnt i artikkel 2 i denne overenskomsten, skal institusjonen på

vedkommendes bosted anses som den kompetry institusjon.

Artikkel 5

1. Denne overenskomst trer i kraft den første dag i den måneden som følger etter

måneden for siste underretning om at alle vilkår som er satt for dette formål i de

respect parters lovgivning, er oppfylt.

Overenskomsten får virkning fra samme dag som forordningen og

gjennomføringsforordningen får anvendelse i forholdet mellom Portugal og Norge.

2. Hver kontraherende part kan skriftlig si opp overenskomsten med tre måneders

varsel, regnet

fra den dato den annen part mottar underretning om dette.

Utferdiget i ....... den ....... i to eksemplarer, på portugisisk og norsk, som begge har

samme

gyldighet.
