of 2 November 2006

on the method of determining the remuneration for holiday holidays and cash equivalents for the period of untapped leave of academic teachers

On the basis of art. 153 (1) 2 of the Act of 27 July 2005. -Law on higher education (Dz. U. 2012 r. items 572, late. (d) the following shall be managed:

§ 1. [ Exemptions from benefits to be taken into consideration for the purpose of determining the remuneration for the time of holiday leave] The remuneration for the duration of the annual leave of the academic teacher shall be determined by taking into account the remuneration and other benefits of the employment relationship, excluding:

1) one-time or non-periodic payments for the performance of a particular task or for a specific achievement, including reviews;

2) remuneration for the time of readiness to work and for the time not hinged by the outage worker;

3) remuneration for the time of holiday leave;

(4) cash equivalents for the period of untapped leave;

5) jubilee awards;

6) the prizes referred to in art. 155 (1) 1 and 2 of the Act of 27 July 2005. -Law on higher education;

7. pension or disability pension;

(8) an additional annual salary;

(9) remuneration for the duration of the incapacity for work as a result of illness or isolation in relation to an infectious disease;

(10) the remuneration and compensation of the academic teacher in the event of termination of the employment relationship.

§ 2. [ Remuneration components specified in monthly stakes in fixed amounts and components specified as a percentage of these rates] The remuneration components specified in the monthly fixed rate and the components of remuneration set out as a percentage of these rates shall be taken into account in the amount due in the month of use by the academic teacher's leave rest.

§ 3. [ Salary Components Variables] Variable remuneration components, such as:

1) remuneration for work in oversized hours,

2) allowance for work carried out under conditions harmful to health or burdensome,

3) the additional remuneration referred to in the regulations on the rewarding of academic teachers, for:

(a) participation in the work of recruitment proceedings,

(b) participation in the health, prophylactic and diagnostic activities carried out by the veterinary departments of agricultural universities,

(c) directing and caring for student professional practices

shall be included in the calculation of the remuneration for holiday leave on the basis of the salary to which the academic teacher acquired the right during the 12 months preceding the month of leave, hereinafter referred to as 'the basis for the dimension', and, if the academic teacher before the leave was employed at a university less than twelve months-on the basis of the remuneration for that period.

§ 4. [ Change of remuneration rules or the rate of remuneration rates] Where the remuneration rules or the rates of remuneration referred to in paragraph 3 have been amended during the period from which the assessment is based, before the academic teacher commences a holiday or a month of use, the this leave, the basis of the dimension shall be re-determined taking account of these changes.

§ 5. [ Remuneration for one day of holiday leave] 1. The remuneration for one day of holiday leave in part determined on the basis of the components of remuneration specified in the monthly stakes at a fixed rate and the components of remuneration determined percentage of these rates shall be calculated by dividing the sum of those ingredients eligible for the month of the use of the leave by 21. The calculated salary for one day of holiday leave will be multiplied by the number of days of this holiday.

2. The remuneration for one day of holiday leave in the part determined on the basis of variable components of remuneration shall be calculated by dividing the basis of the dimension determined in accordance with § 3 and 4, by 251 days. If an academic teacher is employed for less than 12 months, the basis of the assessment shall be divided by the number of working days in the period of his employment. The calculated salary for one day of holiday leave will be multiplied by the number of days of this holiday.

§ 6. [ Remuneration for holiday holidays] The remuneration for the annual leave of the academic teacher is the sum of the remuneration in part determined on the basis of the components of the remuneration specified in the monthly stakes at a fixed rate and the components of the remuneration specified as a percentage from these rates, calculated in accordance with the provision of § 5 par. 1, and the remuneration in part determined on the basis of variable components of remuneration, calculated in accordance with the provision of § 5 par. 2.

§ 7. [ Cash Equivalent for the period of untapped leave] 1. The cash equivalent for the period of unused holiday leave shall be determined by applying the rules applicable to the calculation of the remuneration for the holiday leave.

(2) To determine the cash equivalent for the period of unused holiday leave, account shall be taken of the remuneration components fixed at the monthly rates at a fixed rate and the components of the remuneration determined as a percentage of those rates at the time of the unspent holiday period. the amount due to the academic teacher during the month in which he acquired the right to that equivalent.

§ 8. [ Application of the Regulation] The Regulation shall apply to the setting of remuneration for holiday and cash equivalents for the period of untapped holiday leave to which the academic teacher has acquired the right from 1 September 2006.

§ 9. [ Entry into force] The Regulation shall enter into force three days after the date of the announcement. 2)

1) The Minister of Science and Higher Education heads the government administration department-higher education, based on § 1 par. 2 point 2 of the Regulation of the Prime Minister of 22 September 2014 on the detailed scope of the action of the Minister of Science and Higher Education (Dz. U. Entry 1259).

2) This Regulation was preceded by the Ordinance of the Minister of National Education of 2 October 2001. on detailed rules for setting the remuneration for the annual leave of teachers of academics and the cash equivalent for the period of untapped leave (Dz. U. Nr 121, poz. 1301), which expired on 1 September 2006. in relation to art. 275 (1) 2 of the Act of 27 July 2005. -Law on higher education (Dz. U. No 164, pos. 1365).
