MINISTER OF LABOUR AND SOCIAL POLICY 1)
of 30 April 2008
on the conditions of remuneration for the work and the granting of other work-related benefits for workers employed in certain state budget units
On the basis of art. 77 3 § 1 of the Act of 26 June 1974. -Labour Code (Dz. U. 1998 r. No 21, pos. 94, z późn. (d) the following shall be managed:
§ 1. [ 1] 1. The provisions of the Regulation shall apply to employees employed in:
1) Volunteering Huftins of Labour, hereinafter referred to as "OHP",
2) (repealed),
3) The Social Partnership Centre "Dialog",
4) The Main Library of Work and Social Security,
5. The Center For Human Resources Development,
(5a) Centre for European Projects,
5b) Government Centre for Security,
6) ministerial centres of training, training and improvement of staff, which are created by the authorities of government administration,
7) canteens and employees ' boufeats,
8) intime houses,
9. Training and leisure centres,
10) establishments carrying out printing and publishing activities,
11) voivodship teams for the adjudication of disability,
(12) other than those mentioned in points (1) to (10) of the State budget units to which the separate provisions are not applicable
-hereinafter referred to as 'units'.
2. The provisions of the Regulation shall not apply to the Director (Chief), Deputy Director (Deputy Commandant) and Chief Accountant of units, with the exception of § 12 and 13 and professional qualifications which are set out in Annex No. 3 to the Regulation.
§ 2. It shall be established:
1. tables of monthly rates of basic salary which are set out in Annex No 1 to the Regulation;
2. a table of rates of function allowance, which is set out in Annex 2 to the Regulation;
3) the tables of posts, grades and professional qualifications of the employees, which are set out in Annex No. 3 to the Regulation.
§ 3. When the Regulation refers to the lowest basic salary, it is understood by the lowest basic salary in the first grade, fixed in the tables of the monthly rates of basic salaries in question. Article 2 (1)
§ 4. A part-time employee shall be entitled to a basic salary and other components of remuneration in proportion to the working time specified in the contract of employment.
§ 5. Hourly rate:
(1) the basic salary resulting from the personal grade of the employee, as defined in the monthly rate, and
(2) resulting from the lowest basic salary
-it shall be determined by dividing the monthly wage rate by the number of working hours per month in which the working hours are working.
§ 6. 1. An employee with a post associated with the management of the team and the legal adviser shall be entitled to a functional allowance.
(2) A functional allowance may be granted to a worker other than that mentioned in the paragraph. 1, the coordinating performance of the specified tasks, employed as a post for which a functional allowance is provided for in the tables referred to in the tables referred to in paragraph 2 (3), except that the maximum rate of that allowance shall be reduced by two rates.
§ 7. 1. In the event of periodic increase in the scope of duties or the assignment of additional tasks, or due to the nature of the work or the working conditions, the employer may grant to the employee a special allowance.
2. The special allowance shall be granted for a limited period of time and, where appropriate, for an indefinite period.
(3) The special allowance shall be paid in the amount of the funds available to be paid, up to a maximum of 40% of the total basic salary and the employee's function allowance.
§ 8. 1. An employee who has been permanently employed in a shift work system shall be entitled to an allowance for each hour of work:
1) on II change-at the rate of 10%,
2) to III change-in the amount of 20%
-the hourly rate of basic salary.
2. At night, an employee who is employed at night shall be entitled to a salary for each hour of night work of 20% of the hourly wage rate, but not lower than the allowance set by the article. 151 8 § 1 of the Act of 26 June 1974. -Labour Code.
(3) In the event of an allowance for work for the third shift and the allowance for night work allowance, one of those allowances shall be the benefit of the worker.
§ 9. 1. An employee shall be entitled to a servant allowance of 5% of the monthly basic salary after 5 years of work. This supplement is increased by 1% for each next year of work, to reach 20% of the monthly basic salary after 20 and more years of work.
2. All previous completed periods of employment and other periods if, by virtue of separate provisions, they are included in the period of work on which the entitlement depends are to be included in the periods of employment entitled to the allowance for the elaboration of the years of employment personnel.
In the event of a simultaneous stay in more than one employment relationship, one of those periods shall be included in the period of work entitling to the allowance for the reel of the years.
3. (repealed).
4. An allowance for a servant shall be entitled to a worker for the days for which he is paid, and for days of absence from work due to incapacity to work as a result of illness or the need for personal care of a child or a sick member. families for which the employee receives social security benefits from this title.
5. An allowance for the service of the years shall be paid on the date of payment of the remuneration:
1) from the first day of the calendar month following the month in which the employee acquired the right to the supplement or higher rate of the allowance, if the acquisition of the law occurred during the month;
2. for a given month, if the acquisition of the right to the supplement or to the higher rate of the allowance occurred on the first day of the month.
§ 10. 1. A bonus fund may be created as part of the funds available for remuneration.
(2) The amount of the premium fund and the conditions for granting and paying the premium shall be determined by the establishment of the award procedure.
§ 11. Within the framework of the funds available, an award fund may be set up for the purpose of rewards for the specific achievements of professional work, which may be made available to the employer.
§ 12. 1. The employee, subject to the paragraph. 2, shall be entitled to the Jubilee Award at the level of:
1) 75% of the monthly salary-after 20 years of work;
2) 100% of the monthly salary-after 25 years of work;
3) 150% of the monthly salary-after 30 years of work;
4) 200% of the monthly salary-after 35 years of work;
5) 300% of the monthly salary-after 40 years of work.
2. An employee employed on 1 July 1996. in a plant carrying out printing and publishing activities:
1) after having worked without interruption 15 years in this plant shall have a jubilee prize of 75% of the monthly salary;
2) shall have a jubilee award in the amount of:
(a) 75% of the monthly salary-after 25 years of work,
(b) 100% of the monthly salary-after 30 years of work,
(c) 150% of the monthly salary-after 35 years of work,
(d) 200% of the monthly remuneration-after 40 years of work,
(e) 250% of the monthly remuneration-after 45 years of work,
(f) 300% of the monthly remuneration-after 50 years of work.
3. Employee employed after 1 July 1996 in a plant conducting a printing and publishing activity, it acquires the right to the jubilee prize at the amount specified in the paragraph. 1.
4. The period of entitlement to the jubilee prize shall include all previous completed periods of employment and other periods if, by virtue of separate provisions, they are included in the period of work on which the entitlement depends. personnel.
5. In the event of a simultaneous stay of more than one employment relationship, one of these periods shall be included in the entitlement to the jubilee prize.
6. The worker shall acquire the right to the jubilee prize on the day of the expiry of the period of entitlement to this award.
7. The payment of the jubilee award shall be made immediately after the employee acquisitions the right to this award.
8. The basis for calculating the jubilee award shall be the remuneration of the employee at the date of acquisition of the right to the prize, and if it is more favourable to the employee, the remuneration of the employee on the date of payment. If the employee has acquired the right to the jubilee prize, being employed in a different time dimension than on the date of payment, the basis for calculating the award shall be the remuneration of the employee at the date of acquisition of the right to the jubilee prize. The Jubilee Award shall be calculated in accordance with the provisions in force for the purpose of determining the cash equivalent for holiday leave.
9. In the event of termination of the employment relationship in connection with the transition to the disability pension for the incapacity to work or to retire to the employee who is not less than 12 months old to acquire the right to the jubilee prize, counting from the date of termination of the employment relationship, this award shall be paid on the date of termination of the employment relationship.
(10) If, on the date of the entry into force of the provisions introducing the advance into the periods of entitlement to the employee's benefits, the periods of periods which are not so far passed, the period entitling the worker to two or more jubilee prizes shall be completed, he only pays one prize-the highest one.
11. An employee who on the date of entry into force of the provisions referred to in the paragraph. 10, has a period longer than required for the jubilee prize of a given degree, and within 12 months from that day elapses the period entitling it to acquire the jubilee prize of a higher degree, the lower prize shall be paid in full, and on the day of acquisition the right to a higher reward-the difference between the amount of the higher prize and the amount of the prize
12. The provisions of the paragraph. 10 and 11 shall apply accordingly if, on the date on which the employee documented his right to the jubilee prize, he was entitled to a higher degree of reward and when the employee of the law would be acquired within 12 months of that day.
13. In determining the right to the jubilee award of the employee who was employed in the unit on 1 July 1996, and before that date, he acquired the right to the jubilee award, taking into account the periods subject to the period included in the period of time the work of the jubilee award on the basis of the provisions in force before that date shall be subject to the entry into force on the basis of the previous rules.
14. The employee who took up employment in the unit after 1 July 1996, acquires the right to the jubilee award on the principles set out in the paragraph. 4-12, irrespective of the prior acquisition of the right to the jubilee prize for a given period of work.
§ 13. 1. An employee who meets the conditions giving entitlement to a pension for incapacity for work or a pension whose employment relationship has ceased in connection with the transition to an annuity or a pension shall be entitled to a one-off payment of the following amount:
1) one month's salary-if he has been employed for less than 15 years;
2. two months ' remuneration, after the work of at least 15 years;
3) a three-month salary-after the work of at least 20 years.
2. When determining the periods entitling to a one-off payment, the provisions in force for the fixing of periods entitling to the allowance shall be applied for the duration of the period of the years.
3. The one-time monetary deduction shall be calculated in accordance with the rules in force for the purpose of determining the cash equivalent for holiday leave.
4. An employee who has received a one-time monetary check may not reacquire the right to it.
§ 14. A staff member employed in a canteen, a staff booklet or a home in time shall be entitled to use free or partially paid meals under the conditions laid down in Annex 4 to the Regulation.
§ 15. The employer may, in justified cases, shorten the worker's period of work required for the job in question, excluding the posts for which the prescribed period of work is laid down in separate rules.
§ 16. An employee who does not have the professional qualifications provided for in the position of his/her position on the date of entry into force of the Regulation may continue to be employed in that post.
§ 17. The remuneration of the staff member employed in the unit on 1 June 2008, determined on the basis of the provisions of this Regulation, shall not be lower than the remuneration of the person employed before that date.
§ 18. The monthly rates of basic remuneration laid down in Annex No 1 to the Regulation shall apply to the remuneration due from 1 January 2008.
§ 19. They are hereby repealed:
1) Minister of Labour and Social Policy of 12 July 1996. on the principles of remuneration for the work and the granting of other benefits related to the work for employees of the volunteer Hufców Labour (Dz. U. No 94, pos. 431, of late. zm.), with the exception of § 9, 10 and 12, which are repealed with effect from 31 May 2008;
2) the Minister of Labour and Social Policy of 12 July 1996. on the principles of remuneration for the work and the granting of other work-related benefits for employees employed at the Eastern Studies Centre (Dz. U. Nr 86, pos. 391, of late. zm.), except § 8, 9 and 16, which are repealed with effect from 31 May 2008;
(3) The Minister of Labour and Social Policy of 18 July 1996. on the principles of remuneration for the work and the granting of other work-related benefits for workers employed in certain units of the state budget sphere (Dz. U. Nr 97, pos. 453, of late. zm.), except § 8, 9 and 18 and Annex No. 6, Part I (I). 1 point 1, which shall be repealed with effect from 31 May 2008
§ 20. The Regulation shall enter into force on the day of the announcement, with the exception of § 7, which shall enter into force on 1 June 2008.
1) The Minister of Labour and Social Policy heads the government administration-work, pursuant to § 1 paragraph. 2 point 1 of the Regulation of the Prime Minister of 18 November 2011 on the detailed scope of the action of the Minister of Labour and Social Policy (Dz. U. Nr. 248, pos. 1485).

Annex 4. [ TERMS OF USE FREE OR PARTIALLY PAID MEALS]
Annex No 4
CONDITIONS FOR THE USE OF FREE OR PARTIALLY PAID MEALS
I. Workers in temporary housing
1. Meals shall be entitled to the following staff in temporary homes:
1) employees of the kitchen and waiters-free of charge;
(2) workers of house-houses not listed in point 1, for the payment of 50% of the rate of the workers ' feeding rate.
2. The daily rate of feeding for the employee of the house in time shall be 60% of the rate valid for the holidaymakers, broken down by:
1) breakfast-12%;
2) lunch-30%;
3) dinner-18%.
3. With the meals referred to in the mouth. 1, the employee may use:
1) at the time of the work at home in an 8-hour working time-with two meals issued at that time; in the case of an extended working time the employee is entitled to meals issued during those working hours;
2) in the run-up to the summer and winter season, inter-seasonal or inter-turnate breaks, lasting no more than 7 days-with two meals (breakfast, lunch);
3) in days free from work and during the illness, lasting no longer than 3 days-with two meals (breakfast, lunch).
4. With meals consumed outside the hours of work, the employee may use the conditions of full payment of the employee's rate of nutrition.
5. Positions for employees can be used in a common kitchen, but separately settled for employees and separately for the holidaymakers.
II. Staff employed in canteens and workers ' booklets of canteens
1. An employee who is directly employed in the preparation of meals in a canteen or a staff bookcase shall be entitled to two meals on the terms of the payment during the days of the work.
2. The payment of the employee referred to in the paragraph. 1, shall be 50% of the value of the raw materials used to prepare meals calculated at retail prices.

The amendment came into force on 1 June 2013.
[ 2] On the basis of § 2 of the Regulation of the Minister of Labour and Social Policy of 12 December 2014. amending the Regulation on the conditions of remuneration for the work and the granting of other work-related benefits for employees employed in certain state budget entities (Journal of Laws item. 1939) in the period from 1 January 2015. until 31 December 2015 the following monthly rates of basic salary for employees of the Centre for Informatics Education shall be used:
