REGULATION OF THE MINISTER OF LABOUR AND SOCIAL POLICY

of 1 February 1999

on the detailed rules for the payment of interest for late payment in the determination or payment of social security benefits

On the basis of art. 85 (1) 2 of the Act of 13 October 1998. o Social Security System (Dz. U. Nr. 137, pos. 887 and No 162, pos. 1118 and 1126) the following shall be managed:

§ 1. 1. The regulation lays down detailed rules for the payment of interest for the delay in establishing the right to cash benefits from social security or in the payment of the benefits to which the granting and payment are required by the Insurance Institution Social, hereinafter referred to as "the plant", and the payment of contributions.

2. The rules laid down in the Regulation for the payment of interest for late payment of social security benefits, hereinafter referred to as "interest", shall also apply to the calculation and payment of interest for the delay in the payment by the Department of Benefits he has been commissioned to pay him under separate international regulations or agreements.

§ 2. 1. Interest shall be paid for the period from the day following the expiry of the time limit for determining the right to benefits or their payment, provided for in the provisions laying down the rules for granting and paying the benefits-until the date of payment of benefits, taking into account paragraph 2-5.

2. The period of delay in establishing the right to benefits and their payment, for which the provisions laying down the rules for their award and payment provide for a time limit for the issuance of a decision shall be counted from the day following the expiry of the time limit for the decision.

3. The period of delay in establishing the benefits ordered to the Works to be paid out of the power of international agreements shall be counted from the day following the expiry of the deadline for the issuance of the decision, calculated from the date of impact from the foreign insurance institution full documentation and receivables.

4. The period of delay in the payment of periodic benefits shall be counted from the day following the fixed date of their payment.

5. The period of delay in the payment of pension benefits, commissioned to the Department for payment under the separate provisions, shall be counted from the day following the nearest due date of payment of those benefits, falling within 30 days of the impact to the Social Insurance Institution which has a decision to pay the benefit.

6. If the benefit is paid to the person entitled via the mail or the bank account, the day of payment of the benefits shall be the day of transfer of receivables to the post office or to the bank.

§ 3. The determination of interest payable for payment of interest shall be calculated by multiplying the amount of the late benefit by the number of days of delay and by the annual interest rate of interest and by dividing that product by 365.

§ 4. 1. Interest shall be paid out of office, including the payment of late delivery.

2. If the interest has not been paid together with the payment of the delayed benefit, the following shall be paid:

1) not later than the total of the payment of the benefit in the following period of its payment, when relating to the periodic benefit,

2) without delay, but not later than within 30 days when they concern the one-off benefit.

§ 5. [ 1] This Regulation shall enter into force on the day of its notification, with effect from 1 January 1999.
