of 27 July 1999

on the detailed rules and procedures for the issue of medical certificates, the model of the medical certificate and the medical certificate issued as a result of the review of the medical certificate of the Social Insurance Institution

On the basis of art. 59 (1) 14 of the Act of 25 June 1999. on social security benefits in the event of sickness and maternity (Dz. U. of 2010 Nr 77, pos. 512, of late. (d) the following shall be managed:

§ 1. 1. A medical certificate of temporary incapacity for work due to illness or the need for personal exercise by an employee of care of a sick member of the family, hereinafter referred to as the "medical certificate", shall be issued only after completion of the direct examination of the state of health of the insured or a sick member of the family.

2. When issuing an insured medical certificate of temporary incapacity for work due to illness, the state of health of the insured should be taken into account, taking into account the type and conditions of work.

§ 2. The medical certificate is issued by a doctor, dentist, senior feller or feller, for the period during which the insured state of health should refrain from working, but not longer than until the date on which it is necessary to It shall re-examine the health of the insured person.

§ 3. 1. The medical certificate shall be issued for the period from the day on which the examination was carried out, or from the day immediately following the day of the examination.

(1a) A medical certificate may be issued for a period commencing after the date of the examination, but not later than the fourth day following the day of the examination, if:

1. immediately after the day of the survey, the days off shall be free of work;

2) the examination shall be carried out during the period of the previously settled incapacity for work.

2. The medical certificate may be issued for a period of not more than 3 days prior to the day on which the survey was carried out, if its results show that the insured person in that period undoubtedly was incapable of work.

3. A medical certificate may be issued by a doctor to a psychiatrist for a period earlier than the one specified in the mouth. 2, in the event of a statement or suspicion of psychiatric disorders limiting the capacity of the insured person to assess his/her own conduct.

§ 4. 1. The medical certificate stating the period of stay of the insured in a stationary health care facility, hereinafter referred to as the "establishment", shall be issued no later than on the day of the writing of the insured from this establishment.

2. In the case of longer than 14 days of stay the insured person in the establishment shall be issued every 14 days in order to permit the payment of sickness benefit or remuneration for the duration of the illness.

3. A medical certificate stating the period of residence of the insured person in the establishment may be, at the request of the insured, issued also at a later date.

4. A medical certificate stating the period of incapacity for work after the end of the stay in the establishment shall be applied to § 3.

§ 5. 1. The doctor, dentist, senior feller or feller shall issue a medical certificate on the form, according to the model of Annex No. 1 to the Regulation.

2. In the case of insurance with two or more titles a doctor, a dentist's doctor, a senior feller or a feller issues, at the request of the insured, the appropriate number of medical certificates referred to in the mouth. 1.

2a. A medical certificate for another contributor to the benefit, confirming earlier case-law for another payer's incapacity to work, may be issued at the request of the insured, at a later date.

3. In the event of loss of the medical certificate referred to in paragraph. 1, the doctor who issued the lost certificate, at the request of the insured person, shall draw up a copy from the copy of this certificate.

§ 6. 1. After 30 days of incapacity for work leading the treatment, before issuing an insured medical certificate of further incapacity for work, assesses at the same time whether the health of the insured justifies the need for rehabilitation If this is the case, the application for therapeutic rehabilitation must be completed according to the formula set out in the separate provisions.

2. Not later than 60 days by the end of the period of the benefit of the doctor referred to in paragraph. 1, carry out the examination and assess whether the health of the insured person justifies:

1) (repealed);

2) the application for the establishment of the right to the rehabilitation benefit;

3) a request for a claim for the right to a pension for incapacity for work.

3. The doctor treating the treatment should inform the insured, during the course of the treatment, of the date of the examination referred to in the paragraph. 2.

4. The examination referred to in paragraph 1. 2, shall be carried out at the house of the insured, if he is obbed by the sick.

5. Pursuant to the results of the assessment referred to in paragraph. 1, your doctor treating:

1) (repealed);

2) issue a certificate of health for the purposes of social security benefits, informing the insured person of the need to immediately notify the application for the determination of the right to the rehabilitation benefit or the right to a pension for the incapacity to work.

§ 7. A medical certificate issued as a result of a check by a doctor of the Social Insurance Institution shall issue, after a direct examination of the insured person, on a form, the model of which is set out in Annex 2 to the Regulation.

§ 8. Repealed Regulation of the Minister of Health and Social Welfare of 17 May 1996. on the adjudication of temporary incapacity for work (Dz. U. Nr 63, pos. 302 and 1998 Nr 67, pos. 444) as regards the rules and mode of issue of medical certificates.

§ 9. The Regulation shall enter into force on the day of the announcement

1) Currently, the government administration-Social Security, Head of the Minister of Labour and Social Policy pursuant to § 1 (1) 2 point 2 of the Regulation of the Prime Minister of 18 November 2011 on the detailed scope of the action of the Minister of Labour and Social Policy (Dz. U. Nr. 248, pos. 1485).
