REGULATION OF THE MINISTER OF LABOUR AND SOCIAL POLICY

of 18 September 1998

on the types of disease justifying a reduction in the employment rate for persons with disabilities and the way in which they are reduced

On the basis of art. 21 (1) 7 of the Act of 27 August 1997. about professional and social rehabilitation and employment of people with disabilities (Dz. U. No 123, pos. 776 and No. 160, pos. 1082 and 1998 Nr 99, pos. 628 and No. 106, pos. 668) the following shall be managed:

§ 1. The diseases justifying a reduction in the employment rate for disabled people include:

1) Parkinson's disease,

2) multiple sclerosis,

3) paraplegia, tetraplegia, hemiplegia,

4) significant impairment of vision (blindness) and disbelief,

5) deafness and deafness,

6) the host of HIV and the AIDS virus,

7) epilepsy,

8) chronic mental illness,

9) mental impairment,

10. myasthenia gravis,

11) late complications of diabetes mellitus.

§ 2. [ 1] The employer shall reduce the employment rate of disabled persons referred to in art. 21 (1) 2 of the Act of 27 August 1997. of professional and social rehabilitation and employment of disabled persons, hereinafter referred to as "the Act", in the amount specified in art. 21 (1) 2 or paragraph 2a of the Act, with a rate determined according to the following formula:

WO = (3 x ZS + 2 x US) x 100% /ZOG,

where the meaning of individual symbols is as follows:

(1) WO-REDUCING INDEX,

(2) ZS-employment on a full-time basis for the work of workers who have been classified as having a significant degree of disability, who have been found to have a medical condition listed in § 1,

3. US-employment on a full-time basis for workers in the moderate degree of disability who have been found to have a medical condition listed in § 1,

4) ZOG-the employment of employees in total on the basis of the full working time

-subject to § 2a.

§ 2a. [ 2] An employer who is a state or non-state school higher, a higher vocational school, a public or a non-public school, a teacher training establishment or a care-educational or rehabilitation facility shall reduce the employment rate of the persons concerned. the disability referred to in Article 21 (1) 2 of the Act, in the amount specified in Art. 21 (1) 2b of the Act, a rate determined according to the following formula:

WOE = (3 x ZS + 2 x US) x 100% /ZOG + (3 x KZS + 2x KUS) x 100% /KOG,

where the meaning of individual symbols is as follows:

1. WOE-reduction index,

(2) ZS-employment on a full-time basis for the work of workers who have been classified as having a significant degree of disability, who have been found to have a medical condition listed in § 1,

3. US-employment on a full-time basis for workers in the moderate degree of disability who have been found to have a medical condition listed in § 1,

4) ZOG-the employment of employees in total on the basis of the full working time,

5) KZS-the number of pupils, pupils, students or listeners, learners or studying in the course of a given unit of the regulations of teaching or study, which are included in a significant degree of disability, in which the disease mentioned in § 1 has been found,

6) KUS-the number of pupils, students, students or listeners, learners or studying in the framework of generally applicable teaching or study regulations, which are classified as a moderate degree of disability, in which the disease mentioned in § 1 has been found,

7) KOG-the total number of pupils, students, students or students studying or studying within the general curriculum or study regulations in question.

§ 2b. [ 3] The reduced employment rate for people with disabilities is responsible for:

1) the difference between the employment rate of persons with disabilities in the amount specified in Art. 21 (1) 2 of the Act and the index established on the basis of § 2-in the case of employers referred to in art. 21 (1) 2 of the Act,

2) the difference between the rate of employment of persons with disabilities in the amount specified in Art. 21 (1) 2a of the Act and the index established on the basis of § 2-in the case of employers referred to in art. 21 (1) 2a of the Act,

3) the difference between the employment rate of persons with disabilities in the amount specified in Art. 21 (1) 2b of the Act and the indicator established on the basis of § 2a-in the case of employers referred to in art. 21 (1) 2b of the act.

§ 3. The Regulation of the Minister of Labour and Social Policy of 21 April 1992 shall be repealed. on the type of disease justifying a reduction in the employment rate of disabled persons and the rules and mods of its reduction (Dz. U. Nr 46, poz. 207).

§ 4. This Regulation shall enter into force on 1 January 1999.
