On the basis of article. 42 paragraph 1. 4 of the Act of 17 May 1989 on guarantees of freedom of conscience and religion (OJ No 29, item 155, 1990, no. 51, item 297, no. 55, item 321 and No. 86, item 504, 1991, no. 95, item 425, with 1993 No. 7, item 34 and 1998 No. 59,. 375) are managed as follows :
§ 1. 1. a staff member belonging to a church or other religious, therefore, which the religious holidays are non-working public holiday days, a request for exemption from the work referred to in article 2. 42 paragraph 1. 1 of the law of 17 May 1989 on guarantees of freedom of conscience and religion (OJ No 29, item 155, 1990, no. 51, item 297, no. 55, item 321 and No. 86, item 504, 1991, no. 95, item 425, with 1993 No. 7, item 34 and 1998 No. 59,. 375), hereinafter referred to as "the law" should notify the employer at least 7 days before the date of the exemption. The employer shall notify the employee of the terms of working out of the exemption not later than 3 days before the date of the exemption.
2. The provisions of paragraph 1. 1 shall not apply in the case of religious holidays fall on a certain day each week. In order to allow the employee to circumvent these employer, at the request of the employee, shall be determined for the individual distribution of working time.
§ 2. 1. the pupil or student belonging to the Church or other religious, therefore, which the religious holidays are not business days public holiday free from work, throws a request for exemption from learning, as referred to in article. 42 paragraph 1. 1 of the Act, to school (another educational facility-education or nursing education) or higher education, hereinafter referred to as "the school", as adopted in the school at the beginning of the school year (academic) or in the course of the study, but not later than 7 days before the date of the exemption.
2. By providing an exemption from learning, school specifies at the same time, the alignment of educational backlog caused by relief.
§ 3. On behalf of the minor's request for exemption referred to in § 1 paragraph 1. 1 and § 2. 1, notify the parents or legal guardians.
§ 4. Repealed Regulation the ministries of labour and social policy and national education of 12 November 1990 on exemptions from work or study people belonging to churches and other religious societies in order to circumvent the religious holidays that are not statutory days free from work (Journal of laws No. 82, p. 481).
§ 5. This Regulation shall enter into force after 14 days from the date of the notice.
