REGULATION OF THE MINISTER OF ECONOMY AND LABOUR 1)

of 27 July 2004

on training in the field of occupational health and safety 2)

On the basis of art. 237 5 the Act of 26 June 1974. -Labour Code (Dz. U. 1998 r. No 21, pos. 94, z późn. 1. 3) ) The following shall be managed:

§ 1. The Regulation shall specify:

1. detailed rules of training in the field of occupational health and safety, hereinafter referred to as "training";

2) the scope of the training;

3) requirements for the content and implementation of the training programmes;

4) the way of documenting the training;

5) cases in which employers or employees may be exempted from specific types of training.

§ 1a. [ Statutory definitions] [ 1] Whenever there is a regulation in the regulation:

1) instruction-this shall be understood by this form of training of a duration of not less than 2 hours, enabling to obtain, update or supplement the knowledge and skills relevant to the performance of the work and to behave in the establishment of the work in a manner consistent with the rules and principles of occupational health and safety;

2) the organisational unit carrying out training activities in the field of occupational health and safety shall be understood to mean:

(a) a lifelong learning establishment, a practical training centre, a centre for training and vocational training,

(b) post-secondary school,

(c) a research and development unit, a higher school or other scientific establishment,

(d) an association whose statutory objective is the activities related to occupational health and safety,

(e) a legal or natural person pursuing an educational activity under the rules laid down in the provisions on freedom of establishment if they carry out training activities in the field of occupational safety and health;

3) course-it is understood by this form of training with a duration of not less than 15 hours, consisting of theoretical and practical classes, enabling to obtain, update or supplement knowledge and skills within the scope of health and safety at work;

4) didactic preparation-this is understood by the completion of education or training that prepares the process of training in the field of occupational safety and health in a way that ensures high efficiency, taking into account, suitable for specific groups of trainees and types of trainings: organisational forms and methods of training and teaching means;

5) guided self-education-it is understood by this form of training enabling to obtain, update or supplement knowledge and skills in occupational safety and health, on the basis of materials provided by the organizer training, in particular when using mail, the internet, while ensuring consultation with persons meeting the requirements for lecturers;

6) a seminar, which is understood by this form of training, with a duration of not less than 5 hours, enabling to obtain, update or supplement knowledge and skills in the field of occupational safety and health.

§ 2. 1. The employer shall provide the employee with an anal, suitable for the type of work performed, training, including the transfer of information and instructions concerning the occupied job position or the work performed.

2. In the event of the work being carried out on the premises of the employer's employer's work by another employer, the employer shall ensure that the employee is informed about the risks to safety and health while working in the area. § 3. The training shall provide participants with:

1. to familiarize yourself with the factors of the working environment that may pose a threat to the safety and health of workers at work and with appropriate measures and preventive measures;

2) knowledge of regulations and rules of health and safety at work to the extent necessary to perform work in the establishment of work and on a specific job position, as well as related to the work of duties and responsibilities in the field of safety and hygiene work;

3) acquire the skills to perform work in a safe manner for themselves and other persons, to conduct emergency situations and to provide assistance to the person who succumb to the accident.

§ 4. 1. [ 2] The training can be organized and conducted by employers or, on their behalf, by organizational units conducting training activities in the field of occupational safety and health.

2. Training of persons who are employers, employees of the bhp service and instructors and lecturers of occupational health and safety issues shall be conducted by the organisational units referred to in paragraph. 1.

§ 5. [ 3] The employer organising and conducting the training and the organisational unit conducting the training activities in the field of occupational health and safety, hereinafter referred to as the 'training organisers', shall ensure that:

1) programmes of specific types of training designed for specific groups of posts;

2) instructors ' training programmes in the methods of instructing the instructors-in the case of conducting such training;

3) lecturers and instructors with a resource of knowledge, professional experience and teaching preparation ensuring the proper implementation of the training programmes;

4. adequate local conditions for the conduct of training activities;

5. the didactic equipment necessary for the proper implementation of the training programmes;

6) the proper course of training and the keeping of documentation in the form of programs of training, class logs, examination protocols and register of issued attestaments.

§ 6. The training shall be carried out as initial training and recurrent training.

§ 7. 1. [ 4] Pre-training programmes and recurrent trainings, setting out detailed topics, forms of implementation and duration of training, for each group of posts shall be developed by the employer or in consultation with the employer-the organisational unit conducting training activities in the field of occupational safety and health, on the basis of framework training programmes.

2. Training programmes should be adapted to the types and conditions of work performed by the participants of the training, and their implementation should ensure that the requirements of § 3 are met.

3. Training programmes, on the basis of which the current training of employees, should be kept by employers.

4. Framework training programmes are set out in Annex No 1 to the Regulation.

§ 8. Initial training shall be carried out in the form of an instruction in accordance with the programmes designed for each group of posts and shall include:

1. general initial training, hereinafter referred to as "general instruction";

2. initial training at the workplace, hereinafter referred to as the 'post-instruction'.

§ 9. 1. The general instruction should provide the participants with an understanding of the basic health and safety regulations contained in the Code of Work, in the collective labour agreements or in the regulations of work, with the rules and principles of occupational safety and health at the workplace, as well as the rules for providing first aid in the event of an accident.

2. An instruction set should provide training participants to familiarize themselves with the factors of the working environment on their job positions and occupational risks related to the work performed, ways to protect against the dangers that they may have cause these factors, and methods to safely work in these positions.

§ 10. 1. General instructions shall be held, prior to the admission to work, newly recruited employees, students at the employer's student apprentiment, and students of vocational schools employed for the practical instruction of the profession.

2. [ 5] A general instruction shall be carried out by an employee of the occupational health and safety service, the person performing the job at the employer's task, or the employer who himself carries out such tasks, or an employee appointed by the employer with a knowledge resource and skills to ensure proper implementation of the instructional programme, with an up-to-date attestation of the completion of the required training in the field of occupational safety and health.

§ 11. 1. A post-instruction manual shall be carried out before being allowed to perform work in a specific position:

1) a worker employed on a labour-employed capacity and another where there is exposure to health, burdensome or unsafe factors;

2. an employee transferred to the post referred to in point 1;

3) a student holding the practical instruction of the profession and a student holding a student's practice.

2. An employee who performs work on a number of job positions should have a position instruction at each of these positions.

3. In the event of entry into the post referred to in paragraph. 1 point 1, changes in the technical and organisational conditions, in particular changes in the technological process, changes in the organisation of work stations, introduction to the use of substances with adverse health or hazardous effects, and new or When changing tools, machines and other devices, the employee in this position is a position instructor that prepares him to safely perform the work under changed conditions. The subject and duration of the position instruction should depend on the type and extent of the changes made.

4. The duration of the instruction of a position shall be dependent on the professional preparation of the worker, the previous seniority, and the type of work and the hazards of the job at which the employee is to be employed.

5. A post-instruction manual shall be carried out by the employer appointed by the employer or by the employer, if those persons have the appropriate qualifications and professional experience, and are trained in the methods of conducting the instruction. being a position.

6. A post-instruction manual shall end with a test of knowledge and skills in the field of work performed in accordance with the rules and principles of occupational safety and health, which is the basis for allowing the worker to perform work on the specified positions.

§ 12. 1. The stay of the general instruction and the instruction of the position of the employee shall be confirmed in writing in the pre-training card, which shall be kept in the employee's personal files.

2. The model of the initial training card is set out in Annex No. 2 to the Regulation.

§ 13. 1. [ 6] Employer who, in accordance with art. 237 11 § 1 of the Act of 26 June 1974. -The Labour Code performs the tasks of occupational health and safety services, before taking these tasks, is training carried out in the form of a course or seminar according to the programme developed on the basis of the framework programme set out in Part III Annex 1 to the Regulation.

2. From the training referred to in paragraph. 1, is exempt from an employer who meets the qualification requirements for occupational safety and health services specified in the regulations on occupational health and safety.

§ 14. 1. recurrent training shall aim to update and establish knowledge and skills in the field of occupational safety and health and to familiarse participants with new technical and organisational arrangements in this field.

2. Recurrent training shall take place:

1) persons who are employers and other persons directing employees, in particular managers, masters and brigades;

2. workers employed in the working positions;

3) engineering and technical staff, including designers, machine constructors and other technical devices, technologists and organisers of production;

4) employees of occupational health and safety services and other persons performing tasks of this service;

5) administrative and office workers and others not mentioned in points 1 to 4, whose nature of the work involves exposure to health, burdensome or dangerous factors or with health and safety responsibility.

§ 15. 1. [ 7] The recurrent training of workers employed in the working positions shall be carried out in the form of an instruction, not less than once every 3 years, and at the posts on which the work is carried out particularly dangerous, at least once a year.

2. The periodic training of the persons mentioned in § 14 par. Points 1 and 3 to 5 should be carried out in the form of a course, seminar or self-study not less than once every 5 years and, in the case of administrative and office workers, at least once every six years.

3. The employer shall determine, after consultation with the employees or their representatives, the frequency and duration of the training of the temporary staff employed in the specified positions, taking into account the type and conditions of the execution of the work in these positions.

4. The first recurrent training of persons employed in the posts mentioned in § 14 par. Article 2 (1) shall be carried out within a period of up to six months after the start of the work in those posts and on the persons employed in the posts referred to in § 14 (1). 2 points 2 to 5-within a period of up to 12 months from the start of the work in those positions.

5. From the periodic training referred to in paragraph. 4, a person may be exempted who:

1. shall submit a current certificate of the required recursion training at that time in another employer;

2) during that period, the recurrent training required for a person employed in a post belonging to another group of posts, if his programme takes into account the thematic scope required by the recurrent training programme in force in the new position of work.

§ 16. [ 8] 1. The training referred to in § 13 par. 1, and recurrent training shall end with an examination of the assisting of a participant in the training of knowledge covered by the training programme and the ability to perform or organise work in accordance with the rules and principles of occupational safety and health.

2. Egzamin is carried out before the commission appointed by the training organizer.

3. Confirmation of completion with the result of the positive training referred to in § 13 paragraph. 1, and the periodic training is a certificate issued by the organizer of the training. A copy of the certificate shall be kept in the personal file of the training participant.

4. Model of the certificate referred to in paragraph 3, is set out in Annex 3 [ 9] to the Regulation.

§ 17. Completion during the period referred to in § 15, training, education or training related to the apprentiment, apprentiment or promotion of professional qualifications, taking into account the periodic training programme required for the the specified position of work shall be deemed to be equivalent to such training.

§ 18. This Regulation shall enter into force on 1 July 2005. 4)

2) The provisions of this Regulation shall be implemented by the provisions of Directive 89 /391/EEC of 12 June 1989. on the introduction of measures to improve the safety and health of workers at the workplace (Dz. Urz. EC L183, 29.06.1989).

4) This Regulation was preceded by the Regulation of the Minister of Labour and Social Policy of 28 May 1996. on the detailed rules for training in the field of occupational health and safety (Dz. U. Nr 62, poz. 285), retained in force on the basis of art. 19 of the Act of 14 November 2003. on the amendment of the Act-Labour Code and the amendment of some other laws (Dz. U. Nr. 213, pos. 2081).

FRAMEWORK TRAINING PROGRAMMES

l. Framework Programme for General Instruction

1. Objective of training

The purpose of the training shall be to familial the employee in particular with:

(a) basic health and safety provisions contained in the Labour Code, in collective agreements or in the working regulations,

(b) the rules and rules on health and safety at work in force at the establishment concerned,

(c) the rules on first aid in the event of an accident

2. The training participants Training is intended for all persons who start work in a given establishment.

3. Method of organisation of training

II. The framework of the position of the post-instruction

1. Objective of training

The purpose of the training is to obtain by the employee

(a) information on the environmental factors of the work in the workplace and in its immediate surroundings and of the occupational risks associated with the work carried out,

(b) knowledge and skills relating to ways of protection against accidents and health risks in normal operation and in emergency conditions,

(c) knowledge and practical skills in the safe execution of the work entrusted to it.

2. Training participants

The training is intended for workers newly recruited on workers ' positions and others where there is exposure to health, burdensome or dangerous factors, for workers transferred to such workers positions, and in the case of a change in the technical and organisational conditions, i.e. in the event of a change in the technological process, changes in the organisation of work stations, the introduction of substances with harmful or hazardous effects and new or changed tools, machinery and other equipment. The training is also intended for students in student trainees and students taking practical instruction in the profession.

3. Method of organisation of training

The training should be carried out in the form of an instruction-in the position on which the instructed staff will be employed, on the basis of a detailed programme developed by the training organizer.

Training should take into account the following steps:

(a) an instructor's initial interview with an instructor,

b) show and explanation by the instructor of the whole work process to be carried out by the employee,

(c) the probation of the worker's work process when the instructor has corrected the means of carrying out the work,

(d) the self-employed work of an instructor under the supervision of an instructor

(e) verification and assessment by the instructor of the manner in which the worker is working.

If the staff member carries out the work in different positions, the training should take into account all the types of work that will be part of the employee's duties.

The way in which the training is carried out and the duration of each of its parts should be adapted to the professional preparation and seniority of the worker's work and the risks arising from the work carried out by the staff member.

III. Framework programme for the training of employers carrying out occupational health and safety services

1. Objective of training

The aim of the training is to obtain by participants training knowledge and skills in the scope of:

(a) the identification and analysis of occupational hazards and the assessment of the risks associated with these risks,

(b) carrying out checks and assessments of health and safety at work, including compliance with the rules and principles of the bhp,

(c) to organise projects aimed at providing workers with safety and health protection;

(d) methods of eliminating or reducing the impact on workers of the factors harmful to health and hazardous,

(e) the establishment of circumstances and causes of accidents at work and occupational diseases, as well as the identification of the necessary preventive measures,

(f) methods and organisation of training in the field of occupational safety and health,

(g) the popularization of occupational safety and health problems.

2. Training participants

The training is intended for employers, who on the basis of art. 237 11 § 1 of the Labour Code will be carried out at the job premises of the occupational health and safety service.

3. Method of organisation of training

The training should be organised in the form of a course or seminar-taking into account exercises and using appropriate teaching aids, in particular films, boards, film to display information, computer programs, materials for exercises. Participants of the training should also receive materials to assimilate the problem covered by the training programme (e.g. scripts, legal regulations, practice sets with instructions, sets of checkpoints).

IV. Framework programme for the training of employers and other staff members

1. Objective of training

The aim of the training is to update and supplement the knowledge and skills in particular from the scope of:

(a) the assessment of the risks involved in the work processes and the risks associated with those risks,

(b) shaping safe and hygienic working conditions,

(c) the protection of workers from the risks associated with the work carried out.

2. Training participants

The training is intended for:

(a) employers, including those directing public undertakings, companies, private undertakings, offices, cooperatives,

(b) other persons directing employees (masters, foreigners, department managers, and other organisational cells).

3. Method of organisation of training

The training should be organised in the form of a course or seminar or guided self-education, based on a detailed training programme developed by the training organiser. During the training it is necessary to use appropriate didactic measures, in particular films, film to display information, boards. The participants of a training course in the form of a guided self-education should receive materials to assimilate the problem covered by the training programme (e.g. scripts, legal provisions, sets of checkpoints).

V. Master training programme for the temporary staff of workers employed in the working positions

1. Objective of training

The aim of the training is to update and supplement the knowledge and skills in particular from the scope of:

(a) the rules and principles of occupational safety and health at work,

(b) the risks associated with the work carried out and methods of protection against those risks,

(c) proceedings in the event of an accident and in situations of danger

2. Training participants

The training is intended for people employed in the workplaces.

3. Method of organisation of training

The training should be organised in the form of an instruction-based on a detailed program developed by the training organizer.

The training should be provided by instructing the job as well as lecture, talk, film, discussion of the circumstances and reasons characteristic (for the work performed by the participants of the training) accidents at work and conclusions prophylactic.

VI. Periodic training programme of engineering and engineering staff

1. Objective of training

The aim of the training is to update and supplement the knowledge and skills in particular from the scope of:

(a) the identification and assessment of hazards occurring in the work processes,

(b) the organisation of work and workplaces in accordance with the requirements of occupational safety and health and ergonomics,

(c) methods of winding up or reducing the risks of factors occurring in the working environment.

2. Training participants

The training is intended for employees of engineering and technical work establishments, in particular designers, constructors, technologists, production organizers. In the completion of the groups of employees, the similarity of the work carried out by the participants should be taken into account.

3. Method of organisation of training

The training should be organised in the form of a course or seminar or guided self-education, based on a detailed training programme developed by the training organiser. During the training it is necessary to use appropriate didactic measures, in particular films, boards, film to display information. The participants of a training course in the form of a guided self-education should receive materials to assimilate the problem covered by the training programme (e.g. scripts, legal provisions, sets of checkpoints).

VII. Framework programme for the training of occupational health and safety professionals and persons performing the duties of this service

1. Objective of training

The aim of the training is to update and supplement the knowledge and skills in particular from the scope of:

(a) legal provisions on health and safety at work,

(b) the analysis and assessment of the risks and methods for assessing the risks associated with these risks,

(c) the organisation and methods of shaping safe and hygienic working conditions, as well as helping to address the difficult health and safety problems of the work.

2. Training participants

The training is intended for employees of occupational health and safety services and persons performing tasks of this service.

3. Method of organisation of training

The training should be organised in the form of a course or seminar or guided self-education, taking into account exercises and using appropriate teaching aids, in particular films, boards, film to display information, computer programs, exercise materials. The participants of a training course in the form of a guided self-education should receive materials to assimilate the problem covered by the training programme (e.g. scripts, legal regulations, practice sets with instructions, sets of checkpoints).

1. Objective of training

The aim of the training is to update and supplement the knowledge and skills in particular from the scope of:

(a) an assessment of the risks associated with the work performed,

(b) methods of protection against threats to the health and safety of workers,

(c) shaping working conditions in a manner consistent with the rules and principles of occupational safety and health,

(d) in the event of an accident and emergency situations.

2. Training participants

The training is intended for administrative and office staff, including those employed in the operation of screen monitors, as well as employees of health facilities, schools and other educational establishments, research units and other workers whose nature of the job involves exposure to health, burdensome or dangerous risks or with health and safety responsibilities.

3. Method of organisation of training

The training should be organised in the form of a seminar or course or guided self-study, based on a detailed programme developed by the training organiser.

During the training it is necessary to use appropriate didactic measures, in particular films, boards, film to display information.

The participants of a training course in the form of a guided self-education should receive appropriate materials to assimilate the messages and skills covered by the training programme (e.g. scripts, regulations, control questions sets).
