On the basis of article. 59 paragraph 1. 15 and art. 61 paragraph 1. 3 of the Act of 25 June 1999 on the benefits cash social insurance sickness and maternity benefits (Journal of laws of 2010 # 77, item 512 and # 225, poz. 1463 and 2011 # 113, item 657 and # 149, poz. 887) are managed as follows: § 1. The regulation sets out the evidence and patterns of certificates which the grant and payment of social insurance benefits in the sickness and maternity benefits.

§ 2. 1. evidence which forms the basis for the grant and payment of the social insurance sickness benefits is the insured person a certificate of the payer contributions: 1) exposed to printing SOCIAL SECURITY with-3, a specimen of which is set out in annex 1 to the regulation, in the case of an insured person who is an employee;

2) exposed to the printing of SOCIAL SECURITY with the-3a, a specimen of which is set out in annex 2 to the regulation, in the case of an insured person who is not an employee, excluding the insured person referred to in paragraph 3;

3) exposed to printing SOCIAL SECURITY with-3b, a specimen of which is set out in annex 3 to the regulation, in the case of an insured person performing non-agricultural activities, the insured person works with non-agricultural activities and cleric.

2. the provision of paragraph 1. 1 shall apply mutatis mutandis to the grant and payment of the social insurance benefits, compensatory allowance, maternity allowance in the amount of maternity allowance and care allowance.

§ 3. The evidence which forms the basis for the grant and payment of the social insurance sickness benefits for the period of incapacity for work per after termination of title insurance is a statement by the person making the claim containing the information to stop and take gainful activity which is the title for compulsorily or voluntarily medical insurance or providing entitlement to benefits for the period of incapacity for work due to illness, alleging that the right to a retirement or disability pension for incapacity for work , unemployment allowance, pre-retirement allowance, pre-retirement or teacher's compensation benefits, social insurance is mandatory at niepodleganiu farmers referred to in the legislation on social insurance of farmers, submitted for printing of SOCIAL SECURITY with a-10, a specimen of which is set out in annex 4 to the regulation.

§ 5. § 6. Provision of § 5 within the scope of the obligation to translate into the language of the Polish do not apply to certificates issued within the territory of the Member States of the European Union, the Member States of the European free trade agreement (EFTA) parties to the agreement on the European economic area or the Swiss Confederation and the States parties to international agreements in terms of social security, which is the Republic of Poland, in the official languages of these countries.

§ 7. 1. If the incapacity for work arose as a result of an accident on the way to work or with work, and the insured person shall be entitled to sick pay from more than one title, proof of which is the basis for the grant and payment of sickness allowance in the amount of 100% of the calculation basis is a copy of the card case, on the way to work or from work confirmed by the payer contributions for compatibility with the original.

2. If the incapacity for work results from the consequences of the previously recorded accident on the way to work or from work, the proof of which is the basis for the grant and payment of sickness allowance in the amount of 100% of the calculation basis is a medical certificate issued on an ordinary print, stating the relationship this incapacity for work of an accident on the way to work or from work.

2. Proof of which is the basis for the grant and payment of the social insurance to provide rehabilitation exercise for the period after termination of sickness insurance is in addition to the Declaration referred to in paragraph 3.

§ 9. Proof of which is the basis for the grant and payment of maternity allowance for a period of time determined the provisions of the labour code as a period of maternity leave is: 1) a medical certificate issued on an ordinary printing specifying the expected date of childbirth – for the period before birth;

2) reduced copy of the child's birth or a copy certified by the payer of the allowance to be in conformity with the original – for the period after giving birth.

§ 10. 1. evidence which forms the basis for the grant and payment of maternity benefit for the birth of a child during the stay abroad is: 1) the certificate of a foreign establishment or a foreign physician specifying the expected date of confinement and which meet the conditions laid down in § 5 paragraph 1 – for the period before birth;

2) reduced copy of the child's birth or foreign child's birth certificate or a copy certified by the payer of the allowance to be in conformity with the original – for the period after giving birth.

2. the provision of paragraph 6 shall apply mutatis mutandis.

§ 11. 1. If sickness insurance stopped during pregnancy due to the bankruptcy or liquidation of the employer, the evidence underpinning the granting and payment of maternity allowance for the period after termination of this insurance are: 1) the medical certificate issued on an ordinary print stating the State of pregnancy during the period of employment;

2) certificate or other document confirming the termination of employment due to the bankruptcy or liquidation of the employer;

3) shortened copy of the child's birth or a copy certified by the payer of the allowance to be in conformity with the original.

2. If sickness insurance has terminated as a result of the termination of employment in violation of the law, the evidence underpinning the granting and payment of maternity allowance for the period after termination of this insurance are: 1) the medical certificate issued on an ordinary print stating the State of pregnancy during the period of employment;

2) final decision of the Court to terminate the employment relationship in violation of the law;

3) shortened copy of the child's birth or a copy certified by the payer of the allowance to be in conformity with the original.

§ 12. 1. the Evidence underpinning the granting and payment of maternity allowance for a period of time determined the provisions of the labour code as a period of leave under the terms of maternity leave for adoption of a child for upbringing and apply to a court to request adoption are: 1) the Declaration of the insured, when the child has been adopted in education;

§ 13. The evidence underpinning the granting and payment of maternity allowance to exercise in the event of termination of the employment relationship worker during pregnancy due to the bankruptcy or liquidation of the employer and the inability to provide other employment are: 1) the medical certificate issued on an ordinary print stating the State of pregnancy during the period of employment;

2) certificate or other document confirming the termination of employment due to the bankruptcy or liquidation of the employer;

§ 14. [3] 1. The evidence underpinning of abandoning the payment of maternity benefit in the resignation from maternity allowance by the insured child's mother for a period fixed the provisions of the labour code as a period of maternity leave in the case referred to in article 1. 180 § 5 of the Act of 26 June 1974-labour code (Journal of laws 1998, No 21, item 94., as amended.), are: 1) the Declaration of the insured, since the insured child's father will use the powers to maternity;

2) certificate of the employer of the date of cessation of use of maternity leave – in the case of employees whose maternity benefit is paid by the social insurance;

3) the application of the insured with a date from which relinquish from maternity benefit-in the case of a non-insured worker.

2. the Evidence underpinning of abandoning the payment of maternity benefit in the resignation from maternity allowance by the insured child's mother for a period fixed the provisions of the labour code as a period of leave under the conditions of maternity in the case referred to in article 1. 183 § 1 of the Act of 26 June 1974-labour code, are the documents referred to in paragraph 1. 1. § 15. 1. the Evidence underpinning the granting and payment of maternity benefit to the insured person the father of the child, in the case of the reduction by the insured mother child period of maternity allowance, are: 1) the reduced copy of the child's birth or a copy certified by the payer of the allowance to be in conformity with the original;

§ 16. 2. 2) the application of the insured filed the payer maternity before the date of commencement of the use of this allowance for the period given the provisions of the labour code the period of additional maternity leave or additional leave under the conditions of maternity in the case of an insured person that is not an employee.



§ 18a. [Evidence to provide the basis for the grant and payment of maternity allowance for the period of parental leave] [10] the evidence underpinning the granting and payment of maternity benefit of the insured for the period to be determined the provisions of the labour code as a period of parental leave, where the maternity allowance for the period immediately preceding the period covered by the application for the leave was taken by the insured, are: 1) the insured's claim about the lack of intention to use the other parent of the child during the period referred to in the application of the maternity allowance for a period of time determined the provisions of the labour code as a period of parental leave, or a statement of the insured period where the other parent of the child intends to use the maternity allowance for the period of leave, the period covered by the request or confirmed by the employer to be in conformity with the original copies of such statements, in the case of an employee, to whom the maternity allowance is paid by the social insurance;

2) certificate employer with a period of parental leave, and the employer's certificate with the term and full-time work during parental leave – in the case of a staff member to whom the maternity allowance is paid by the social insurance;

3) the application of the insured filed the payer maternity before the date of commencement of the use of this allowance for the period given the provisions of the labour code as a period of parental leave, in the case of an insured person who is not an employee.

§ 19. [11] the evidence underpinning the granting and payment of maternity allowance to exercise for a period of time determined the provisions of the labour code the period of additional maternity leave or additional leave under the terms of maternity leave, if the maternity allowance for the period immediately preceding the period covered by the application for such leave was taken by the other parent of the child, are: 1) the certificate of the payer of the allowance period for which maternity allowance was paid to the other parent of the child , the number of parts paid the allowance for a period of time determined the provisions of the labour code the period of additional maternity leave or additional leave under the terms of maternity leave and the rate of interest, in which the maternity allowance payable to the other parent of the child, containing your name and SOCIAL SECURITY that parent of the child or the series and number of the identity card or other document stating the identity, if not granted social security number;

2) certificate of the employer with the term and full-time work during additional maternity leave or additional leave under the terms of maternity leave – in the case of a staff member to whom the maternity allowance is paid by the social insurance;


3) the request of the insured, filed before the date of the allowance payer start using this allowance for the period given the provisions of the labour code the period of additional maternity leave or additional leave under the conditions of maternity in the case of an insured person that is not an employee;

4) reduced copy of the child's birth or a copy certified by the payer of the allowance to be in conformity with the original, or 5) Declaration by the insured, when the child has been adopted, and a certificate of guardianship of the Court to adoption of the child, including the date of birth of a child, or a copy certified by the payer of the allowance to be in conformity with the original, or 6) final judgment of the Court of guardianship for the placement of a child in a foster family or civil contract concluded between a surrogate family and the mayor or a copy certified by the payer child benefit to be in conformity with the original, and a document proving the age of the child.



§ 19a. [Evidence to provide the basis for the grant and payment of maternity allowance for the period of parental leave if the allowance was payable by the other parent] [12] the evidence underpinning the granting and payment of maternity allowance to exercise for a period of time determined the provisions of the labour code as a period of parental leave, where the maternity allowance for the period immediately preceding the period covered by the application for the leave was taken by the other parent of the child, are: 1) the insured's claim about the lack of intention to use the other parent of the child during the period referred to in the application of the maternity allowance for a period of time determined the provisions of the labour code as a period of parental leave, or a statement of the insured period where the other parent of the child intends to use the maternity allowance for the period of leave, the period covered by the request or confirmed by the employer to be in conformity with the original copies of such statements, in the case of an employee, to whom the maternity allowance is paid by the social insurance;

2) certificate of the payer of the allowance period for which maternity allowance was paid to the other parent of the child, the number of parts paid the allowance for a period of time determined the provisions of the labour code as a period of parental leave, and at a rate of interest, in which the maternity allowance payable to the other parent of the child, containing your name and SOCIAL SECURITY that parent of the child or the series and number of the identity card or other document stating the identity of the If you do not have been given a social security number;

3) certificate of the employer with the term and full-time work during parental leave – in the case of a staff member to whom the maternity allowance is paid by the social insurance;

5) the document referred to in § 19 paragraph 4 – 6.



§ 19b. [The evidence underlying the omission of payment of maternity benefit] [13] 1. The evidence underpinning of abandoning the payment of maternity benefit in the resignation from maternity allowance by the insured child's mother for a period fixed the provisions of the labour code the period of additional maternity leave, in whole or in part, the additional leave under the conditions of maternity, in whole or in part, or parental leave, in whole or in part, in the cases referred to in article 1. 1792 § 1, article. 1793 § 1 and article. 1824 § 2 of the Act of 26 June 1974-labour code, are: 1) the Declaration of the insured, or the insured child's father will use the powers to maternity benefit for the remaining period;

2) certificate of the employer of the date of cessation of use of additional maternity leave, additional leave under the conditions of maternity or parental leave, in the case of employees whose maternity benefit is paid by the social insurance;

3) the application of the insured filed payer benefit during maternity allowance with a date from which relinquish from maternity benefit-in the case of a non-insured worker.

2. the provision of paragraph 1. 1 shall apply mutatis mutandis in the case of maternity allowance by the insured child's father for a period of time determined the provisions of the labour code the period of additional maternity leave in part, additional leave under the conditions of maternity in part or parental leave in part, in the cases referred to in article 1. 1794. 1824 § 2 of the Act of 26 June 1974-labour code.



§ 19 c. [Contents of the claims of the insured] [14] the statements referred to in § 18a, paragraph 1, § 19a (1) and § 19b paragraph 2. 1 paragraph 1 shall contain in addition the name, surname and PERSONAL CODE of the other parent of the child or the series and number of the identity card or other document stating the identity, if you do not have been given a social security number.

§ 20. The evidence underpinning the granting and payment of maternity benefit of the insured for the period to be determined the provisions of the labour code as a period of paternity leave are: 1) the reduced copy of the child's birth or, where appropriate, the final order of the Court of the child's adoption or a copy certified by the payer of the allowance to be in conformity with the original;

2) Declaration by the insured that the maternity allowance for the period of paternity leave has not been downloaded from another title;

3) application of the insured for the payment of maternity allowance for a period of time determined the provisions of the labour code as a period of paternity leave, submitted before the date of commencement of use of maternity, that contains the date from which the insured intends to use the maternity allowance in the case of an insured person that is not an employee.

§ 21. Proof of which is the basis for the grant and payment of the allowance is a statement made on the printing of SOCIAL SECURITY with a-15, a specimen of which is set out in annex 6 to the regulation.

§ 22. Proof of which is the basis for the grant and payment of the allowance for the exercise of care during your stay abroad is foreign medicinal plant certificate or a foreign doctor meeting the conditions referred to in paragraph 5, taking into account paragraph 6 and the Declaration referred to in paragraph 21.

§ 23. 1. evidence which forms the basis for the grant and payment of the allowance due to the need to exercise personal custody of the child up to the age of 8 years is: 1) [15] Declaration of the insured – in the event of an unforeseen closure of nursery school, children's Club, kindergarten or school to which the child attends;

2) decision about having the child's isolation, granted by the competent authority or authorized body on the basis of the provisions for the prevention and combating of infections and communicable diseases in humans;

3) medical certificate issued to the insured on a regular printing in case of: a) childbirth or illness of the spouse of the insured person, constantly guarding the child, if the birth or illness prevents this spouse care, b) residence spouse constantly guarding the child in a stationary health care facility;

4) [16] statement by the insured about the disease a nanny or the daily guardian and a copy of the medical certificate referred to in article 2. 55 paragraph 1. 1 of the law of 25 June 1999 on the benefits cash social insurance sickness and maternity benefits, or a copy of a medical certificate issued on an ordinary print, showing the inability to work a nanny or the daily guardian, confirmed by the insured person for compliance with the original-in case of a nanny, that parents have a contract uaktywniającą, referred to in the Act of 4 February 2011 child care up to the age of 3 years (Journal of laws No. 45 , item. 235, as amended. d.), or the daily guardian, having custody of the child.

2. the certificate referred to in paragraph 1. 1, paragraph 3, should contain: 1) name and surname of spouse constantly guarding the child;

2) period and the reason for having custody of the child;

3) [17] child's name, which has to be exercised care, and his name, as long as the child has already been issued;

4) stamp and signature of the issuing certificate.

3. [18] the medical certificate issued on an ordinary print, stating the incapacity nanny, that parents have a contract uaktywniającą, referred to in the Act of 4 February 2011 child care up to the age of 3 years, or the daily guardian having custody of the child, should contain: 1) first name, last name, and SOCIAL SECURITY NUMBER or a guardian daily nanny having custody of the child or the series and number of the identity card or other document stating the identity of the If you do not have been given a social security number;

2) period of pronounced inability to work;

3) stamp and signature of the issuing certificate.

§ 24. The evidence underpinning the granting and payment of the allowance referred to in article 2. 32A of the Act of 25 June 1999 on the benefits cash social insurance sickness and maternity benefits, are:


1) a certificate issued by the hospital about the period of the insured child's mother in the hospital;

2) a statement of the insured person to download by insured mother child maternity allowance during the 8 weeks after birth.

§ 25. Prints according to the models referred to in the regulation referred to in section 26, may be used until stocks run out.

§ 26. Repealed the Ordinance of the Minister of labour and social policy of 27 July 1999 establishing the evidence underlying the grant and payment of social insurance benefits in the sickness and maternity benefits (Journal of laws No. 65, poz. 742, as amended. 3)).

§ 27. This Regulation shall enter into force after 14 days from the date of the notice.

Annex No. 6 MODEL-ZUS-15 [1] § 12 para. 1 point 2 as amended stipulated by § 1 (1) (a). a) Regulation of the Minister of labour and social policy dated 7 November 2013, the amending Regulation on the determination of the evidence underlying the grant and payment of social insurance benefits in the sickness and maternity benefits (OJ, item 1380). The change came into force on 26 November 2013.

[2] § 12 para. 2 paragraph 1 shall be inserted to be determined by § 1 (1) (a). (b)) Regulation of the Minister of labour and social policy dated 7 November 2013, the amending Regulation on the determination of the evidence underlying the grant and payment of social insurance benefits in the sickness and maternity benefits (OJ, item 1380). The change came into force on 26 November 2013.
