On the basis of article. 90 paragraph 1. 3 of the Act of 6 December 2008 on excise duties (OJ of 2009 # 3, item 11, as amended. 2)) are managed as follows: § 1. The regulation defines: 1) the types of substances used for marking and colouring of energy products referred to in article 1. 90 paragraph 1. 1 of the law of 6 December 2008 on excise duties, hereinafter referred to as "products";

2) the quantities of substances used for marking and colouring products, expressed in mg/l of the product, after which you have added a product shall be deemed to be properly marked and coloured.

§ 2. 1. For the marking of products shall be indelible marker, which is a substance called chemical N-ethyl-N-[2-(1-izobutoxy-etoxy) ethyl] azobenzeno-4-Amine (Solvent Yellow 124).

2. The colouring substance shall be used: 1) Solvent Red 164 or Solvent Red 19, in the case of a) fuel oils falling within CN codes 2710 19 51 to 2710 19 69 of which 30% or more by volume distils at 350 ° c or the density at 15 ° c is less than 890 kg/m3, b) gas oils falling within CN codes 2710 19 41 from to 2710 19 49 for fuel purposes;

2) Solvent Blue 35 if used for the purposes of navigation, including fishing trips: a) fuel oils falling within CN codes 2710 19 51 to 2710 19 69 of which 30% or more by volume distils at 350 ° c or the density at 15 ° c is less than 890 kg/m3, b) gas oils falling within CN codes 2710 19 41 from to 2710 19 49.

3. properly marked and coloured product is deemed, in the case of the products referred to in paragraph 1. 2:1), paragraph 1, the product to which you added the tag in the amount of not less than 6.0 mg/l, but not more than 9.0 mg/l of product, and dye Solvent Red 164 in a quantity of not less than 6.6 mg/l dyed product or a dye Solvent Red 19, in quantities of not less than 6.3 mg/l dyed product;

2) 2, the product to which you added the tag in the amount of not less than 6.0 mg/l, but not more than 9.0 mg/l of the product, and a dye Solvent Blue 35 in a quantity of not less than 6.0 mg/l dyed product.

4. in the case of the energy products referred to in paragraph 1. 2, paragraph 2, for the purposes of navigation used by the armed forces of the Republic of Poland, for the correctly marked product shall be deemed to the product, to which was added the tag in the quantities referred to in paragraph 1. 3 paragraph 2.

§ 3. The regulation shall enter into force on 1 September 2010, 3) Finance Minister: in the w.
