§ 1. Purpose purpose of these regulations is to prevent domestic market disruptions caused by preferential tariff treatment for imports of agricultural products from developing countries covered by the Norwegian scheme for general tariff preferences (GSP), while the scheme aims to facilitate increased imports from developing countries are safeguarded.

§ 2. The release of the security mechanism
(1) Where imports of an agricultural commodity that is given GSP preferential tariff, constitutes a substantial market disruption or risk of substantial market disruption, the King may by regulations implement the measures necessary to remove this market disruption, including wholly or partially suspend preferential tariff treatment for the particular item with immediate effect.

(2) This section applies agricultural products specified in chap. 1 under Annex 1 of the Agreement on Agriculture of the WTO.

(3) Project duration must be limited to that necessary to remove market disturbance, but not after a period of one year.

(4) The measure must be applied equally to all developing countries covered by the GSP. Countries covered by the zero tariff scheme within the GSP ordningen1 may be exempt from the measure.

(5) A shipment, which can be documented to be underway in accordance with the contract signed before the measure was announced, shall be exempt from the measure.

§ 3. GSP import permit for cereals, flour and animal feed from countries covered by the zero tariff scheme
(1) Relief from customs duty on import of grain, flour and animal feed from countries covered by the zero tariff scheme within the GSP ordningen1 granted to an importer who can produce valid GSP import permit at the time.

(2) With grain, flour and feed defined as the goods covered by the Annex to this regulation. Directorate of Agriculture is authorized to update the Annex to achieve compliance with the Nomenclature.

(3) Subject to § 2 issuer Agriculture Directorate GSP import permit at any substantiating that they intend to introduce goods covered by this section. From the time the reasoned proposal on the use of security mechanism is sent from farm management, can issuance of GSP import permits be postponed until the King has taken a position on measures to eliminate market distortion should be implemented.

(4) GSP import permit is granted for the quantity stated in the application within the following validity periods:
1. August - November 7,
8. November - April 24, or
25. April - 31 July.

(5) GSP import permits are not transferable.

(6) Agriculture Directorate may stipulate requirements for applications for GSP import permits under this section.

§ 4. Commencement This Regulation shall enter into force immediately.
