Chapter 1. Initial provisions § 1. Scope this Regulation applies to the certification of drivers of traction vehicles on the national railway network for a railway business that has the security certificate or security authentication.
The regulation does not apply to: a) drivers who exclusively lead rail/veimaskin on fixed area or stretch that is predisposed to work b) drivers who solely causes vehicle for railway maintenance on fixed area.

§ 2. Definitions, traction vehicles: vehicles with traction, including the locomotive, motor vehicle, rail tractor.
Shine-/veimaskin: vehicles that can run on both the road and Rails.
The European Railway Agency: the European Railway Agency dealt with in the regulation on the implementation of Regulation (EC) No. 881/2004 of 29. April 2004 establishing a European Railway Agency (ERA) (ERA-Regulation).
Skills: knowledge, skills and attitudes.

§ 3. Because the requirements for certification should be leading Drivers fit and have the necessary qualifications to perform the duties that are attributed to drivers of traction vehicles on an independent, responsible and safe manner. Drivers should hold a driver's evidence and a certificate. Leading evidence and certificate to be always with be brought under performance and could be presented the State's railway supervision on request.
If a driver from a third to lead traction vehicle solely on cross-border stretches of the national railway network, the driver's certification documents be authenticated in accordance with the bilateral agreements with the relevant third.

section 3a. Annex XIII of the EEA Agreement No. 42gb (Regulation (EC) No. 36/2010 of 3 December 2009 on community models for leading evidence, certificates, certified copies of certificates and application forms for driver's evidence under Directive 2007/59/EC) applies to that regulation with the customizations that follows from Annex XIII to the agreement, Protocol 1 and the agreement by the way. Adaptations to the model for leading evidence, certificate, certified copy of the certificate and the application form for leading evidence appears of attachment in to regulation here.

section 3b. Commission decision 2011/765/EU of 22. November 2011 about the criteria for the approval of training centres for the training of drivers, about the criteria for the approval of the sensors and the criteria for organization of trying after European Parliament and Council Directive 2007/59/EC apply that regulation with the customizations that follows from Annex XIII to the agreement, Protocol 1 and the agreement by the way.

§ 3 c. The Commission's enforcement decision 2014/89/EC of 14. February 2014 if a pilot project to implement the obligations set out in the management cooperation-European Parliament and Council Directive 2007/59/EC by means of the information system for the internal market (IMI) applies to that regulation with the customizations that follow of Appendix X, Protocol 1 to the agreement and the agreement by the way.

Chapter 2. Leads evidence § 4. Bevisets leads the content and design Leads evidence documenting that the holder meets the minimum requirements to the physical and mental health, basic education and general professional skills. Leads the proof will be in compliance with the requirements in Annex i.

A driver's evidence is valid for the entire EEA. Drivers with leads evidence from other EEA Member State do not need new leads evidence in Norway. If a driver who has a valid leads evidence from another EEA Member State applying to be issued driver's evidence in Norway they must meet the requirements of the regulations here.
The driver must have filled 20 years to be issued driver's evidence.
A driver's evidence is valid for 10 years, provided that the driver meets the requirements for periodic surveys and samples in the section 11 and section 19.

Chapter 3. Certificate section 6. The certificate's content and design a certificate specifies the infrastructure the holder is authorized by the railway business to lead the traction vehicle and the material that the holder is authorized by the railway to run the business. The certificate is valid only on the infrastructure and for the material entered. When the driver has been given additional approvals related to the infrastructure or rolling stock should the certificate be updated for these credentials to stand. All the certificates shall comply with the requirements in Annex i. extension of the Certificate Approver traction vehicles in one or more of the following categories: a) Category a: Shunting.

b) category B: driving of the train.

section 7. Issuance and validity of the certificate and the driver must possess a valid driver's evidence to be issued the certificate. The driver must pass the periodic tests under section 19 for the certificate to remain valid.
Certificate is issued by the railway business that he or she leads is associated. The certificate is owned by the railway business that issues it. The driver has the right to get a certified copy of the certificate.
The railway business should as part of its security management system to establish their own procedures, documented for the issuance, updating, suspension and revocation of certificates, including the internal complaint handling of such cases. The railway undertaking shall ensure and verify that the drivers associated with the business has a valid driver's evidence and certificate.
When a driver ceases to work for a railroad business, should the railway business under the railway immediately to correct the State's supervision.
A certificate becomes invalid when the holder of this no longer is employed as a driver. The holder should, however, get a certified copy of the certificate and of all documentation of the driver's training, qualifications, experience and professional expertise. When a railway company issues a certificate to a driver, they shall take into account all these documents.

section 8. Exceptions from the requirement to hold a certificate that is not entitled to the certificate for a particular infrastructure: a) When the interference of train operation or maintenance necessitates deviation for the train after setting closer infrastructure manager, b) for exception to one that uses historic train, c) for the exception to one for the shipping of goods, provided that the infrastructure manager agrees, d) for the delivery or demonstration of a new rolling stock , e) for the training of and tests for drivers.

Another driver who holds a valid certificate for the person in question, and that infrastructure can communicate with the leading traction vehicle, must still be with during the performance. The decision of whether the exception option after the first paragraph should be used, should be up to the railway undertaking and cannot be imposed by the infrastructure manager or the Railway Inspectorate of the State. The infrastructure manager shall be fixed in advance on the use of under a second leads as required.

Chapter 4. Health claims and health surveys, and more.


§ 9. Claims for medical and occupational psychological fitness Drivers should be medical and vocational psychological fit according to annex II, points 1.1, 1.2, 1.3, 1.4 and 1.5 in order to cause the traction vehicle in a safe manner.

§ 10. Claims about the investigation of the medical and occupational psychological fitness is an examination of the applicant's medical fitness. This survey should at least include the items in annex II, point 2.1. The survey will be carried out by, or under the supervision of, a physician approved in accordance with Chapter 6.
It should be made an examination of the applicant's occupational psychological fitness. This survey should at least include the items in annex II, point 2.2. The survey will be carried out by, or under the supervision of, a psychologist or doctor approved in accordance with Chapter 6. Such a survey should be carried out by the renewal of the also leads evidence under section 5 the fourth paragraph.

section 11. Claim for periodic examination of medical fitness For that a driver's evidence is to remain valid, it shall be made periodic examinations of the driver's medical fitness. The periodic surveys should at least include the items in annex II, point 3.1. The surveys will be carried out by, or happen under the supervision of, a doctor who is approved in accordance with Chapter 6.
Periodic surveys will be undertaken at least every three years up to the age of 55 years, and then every year. In addition, an approved doctor increasing the frequency of examinations if the medical skikketheten to a leading dictates this.
When a periodic examination is carried out, to the responsible doctor immediately inform the Norwegian Railway Inspectorate on the results of the survey on the certificate pursuant to section 13.

§ 12. Requirements for additional surveys of medical and occupational psychological fitness without prejudice to section 11 shall ensure that the activities be carried out a suitable examination of the driver's fitness after section 9 when: a) there is reason to doubt that the driver meets the requirements of section 9, b) driver has been involved in a work accident, c) driver has had absence period after a railroad accident or serious rail incident that has caused personal injury or risk of injury , or d) the driver is taken out of service for safety reasons.

The survey will be carried out by, or happen under the supervision of, a doctor or psychologist who is approved in accordance with Chapter 6.
Approved doctor or psychologist may decide that it will be implemented an appropriate medical examination in addition to the survey in the first paragraph, especially after sick leave of at least 30 days.
When an additional survey after the first or third paragraph is carried out, to the responsible physician or therapist immediately inform the Norwegian Railway Inspectorate on the results of the survey on the certificate pursuant to section 13.

section 13. Certificate Driver to demonstrate that the requirements of the medical and occupational psychological fitness is fulfilled by certificate from a doctor or psychologist who is approved in accordance with section 22. Certificate to be issued in the form set by the Norwegian Railway Inspectorate.

section 14. Information obligation on health conditions, and more. The driver shall immediately inform the railway business if the person is in doubt as to the requirements of section 9 are met.
The railway business shall immediately notify the State's railway supervision about the cases of inability to work that is longer than three months.

section 15. The railway enterprises ' supervision with their own drivers Train business shall ensure that drivers are under the influence of alcohol or other intoxicating or anesthetic agent that with probability can affect their concentration, attention or behaviour while they are in service.

Chapter 5. Training and tests section 16. Requirements to the training method That should be a good balance between theoretical and practical training. Computer-aided training can be used for individual learning of the operational rules, signalerings situations, etc.

§ 17. Requirements for training for the leading evidence should undergo training Drivers and pass a test that shows their overall professional competence. Training must at least include the goals of training related to lead evidence as specified in annex IV.
For drivers who are citizens of an EEA State and who have received their training certificate in a third case of the principles for the recognition of professional qualifications of Directive 2005/36/EC.

§ 18. Requirements for training for the Drivers to undergo training certificate and pass a test that shows their specific professional skills. Training must at least include the goals of training related to rolling stock in annex V and annex VI infrastructure. Drivers of traction vehicles on routes where the infrastructure manager's working language is different from the driver's home language must meet the language requirements in annex VI. Moreover, drivers receive training in the relevant parts of the security management system.
Training tasks and evaluation of knowledge related to infrastructure, including route knowledge and operation rules, shall be performed by persons or bodies that are accredited or approved by the Contracting State in which the infrastructure is located.

§ 19. Periodic testing Drivers should conduct periodic training and trial related to the requirements of section 17 and section 18.
The railway companies shall, in its security management system to determine the frequency of the periodic attempts to be held after the first paragraph. This should include all of the drivers that are associated with the business. These samples should at least be held: a) For language skills: every three years or after more than a one-year absence.

b) For knowledge of the infrastructure: every three years or after more than a one-year absence on the stretch.

c) knowledge of rolling stock: every three years.

For each of these samples should confirm by a railway business statement on the certificate and the certificate that the driver in the registry have passed.

section 20. Demand for sensors in connection with Trying training under section 17 and section 18 to be monitored and evaluated by the sensors approved according to the requirements of the resolutions 2011/765/EU. Chapter 6. The approval of the training centers, and more.

§ 21. Training centers training centers that perform the training of drivers according to § 17 shall be approved as a vocational school by law 20. June 2003 No. 56 about college graduate (vocational school law). Such training centers can also carry out training according to § 18.
The railway enterprises can learn up associated drivers according to § 18. The railway companies that perform the training of other than the associated drivers must have the approval of the Norwegian Railway Inspectorate.
Training centers that perform the training of drivers in accordance with section 18 must have approval of the Norwegian Railway Inspectorate.
To be approved as a learning centre must the relevant requirements of decision 2011/765/EC be met.

§ 22. Doctors and psychologists Health surveys after the regulation here can only be carried out by or under the supervision of authorized doctors that in addition is approved by the Norwegian Railway Inspectorate.
Occupational psychological examinations after the regulation here can only be carried out by or under the supervision of physicians as mentioned in the first paragraph or authorized psychologists which in addition is approved by the Norwegian Railway Inspectorate.
To be approved, it is required that the doctor or psychologist has undergone training approved by the Norwegian Railway Inspectorate.
Approval is granted for a period of a maximum of five years. To refine the validation they must a physician or psychologist have conducted or overseen by at least ten examinations annually. Moreover, the competent doctor or psychologist have conducted continuing education approved by the Norwegian Railway Inspectorate.

§ 23. Revocation of approval Approval by this chapter may be revoked if the conditions for approval are no longer met.

Chapter 7. Tables section 24. Register of training centers and more Norwegian railway supervision to lead a public register of training centers and people with approval for Chapter 5 and 6.

§ 25. Leading evidence Norwegian railway to registry audits result in an updated register of all leading evidence. The register shall contain the information as stated in Appendix VII. The information should be available by using the national number to be assigned to each lead.
Norwegian railway supervision to after a reasoned request, provide information about the status of such leads evidence to the competent authorities of the other Contracting Parties, to the European railway agency or to the employers for drivers.
Drivers have the right to access to information concerning themselves and that is stored in the driver's evidence registry, and shall on request receive a copy of this information.

§ 26. Certificate registry Railway companies should lead an updated register, or ensure that such a registry is taken, of all their certificates. This register shall contain the information as stated in annex VIII, including the periodic controls referred to in section 19.
The railway companies shall cooperate with the State's railway supervision in order to exchange information. The railway companies to give the State's railway supervision access to necessary information.
On request to the railway business give information about the contents of the certificates to the competent authorities in other EEA States when this is required as a result of their transnational business.
Drivers have the right to access to information concerning themselves and that is stored in the certificate registry, and shall on request receive a copy of this information.

Chapter 8. The enforcement


§ 27. Supervision and control the State's Railway Inspectorate oversees that drivers, rail businesses, doctors, psychologists, examiners and training centres to comply with the provisions of this regulation. Everyone is obliged to give the State's Railway Inspectorate the information it requires to carry out its tasks, as well as for the same purpose to give the supervisory authority access to facilities, including facilities, equipment, and other materials related to the railway business.
If the State's railway supervision consider that a particular driver poses a serious threat to the safety of the railway, to the State's railway supervision immediately take the necessary measures, including halting the traction vehicle and prohibit the driver to lead the traction vehicle as long as it is needed. The State's Railway Inspectorate shall inform the EFTA Surveillance Authority and other competent authorities about such decisions.
Drivers who run the train or shift without possessing evidence or leads that are not certified for that material or stretch to be denied further driving. Norwegian railway supervision can abolish leads the proof of the place. section 29 the first paragraph applies accordingly.
An independent assessment of the procedures for the acquisition and assessment of occupational skills, as well as of the system for the issuance of driver's proves to be performed, every five years. This requirement does not apply to railway companies with security certificate or infrastructure manager with the security authentication. The assessment will be carried out by qualified persons who are not even involved in the affected businesses.

section 28. Revocation of driver's evidence If a driver no longer satisfies one or more criteria to hold leads evidence, to the State's railway supervision call back leads the proof temporarily or permanently. The driver and the train business that he or she leads is affiliated under the decision to be directed on immediately.
The competent authority in another EEA State can ask the State's railway to conduct closer supervision surveys, or call back leads the proof where a leads with leads evidence issued in Norway no longer meets one or more criteria for possessing leading evidence. Norwegian railway supervision to look into the request within four weeks and notify the other authority, the EFTA Surveillance Authority and other competent authorities of its decision.
For leading evidence issued in another EEA Member State, to the State's railway supervision apply to the competent authority and provide a reasoned request that it either be carried out a further inspection or that leads the proof being suspended. The State's Railway Inspectorate shall inform the EFTA Surveillance Authority and other competent authorities of its request. Norwegian railway supervision may prohibit drivers to perform traction vehicle in Norway in anticipation of a communication on issuing legal decision.
If the State's Railway Inspectorate finds that a decision by the third paragraph does not comply with the relevant criteria, the procedure given in Directive 2007/59/EC article 29 number 5 apply. In anticipation of a final decision, an imposed ban on to perform traction vehicles on the national railway network is maintained.

section 29. Revocation of certificate the railway business that has issued certificate to a driver can call back the certificate if the driver does not meet the criteria for possessing the certificate.
If the State's Railway Inspectorate finds that a driver no longer satisfies one or more required conditions for possessing the certificate, to the State's railway supervision apply to the issuer of the certificate and request that a further inspection be carried out or that the certificate will be called back temporarily or permanently. The issuer of the certificate shall take appropriate measures and report back to the State's railway supervision within four weeks. Norwegian railway supervision may prohibit drivers to lead traction vehicles in anticipation of the report, and shall inform the EFTA Surveillance Authority and other competent authorities about this.
The competent authority in another EEA State can ask a railway business in Norway that have issued a certificate that a further inspection be carried out or that the certificate will be called back temporarily or permanently. The railway business should look into the request within four weeks and notify the requesting authority, the State's railway supervision, the EFTA Surveillance Authority and other competent authorities of its decision.

Chapter 9. Final provisions § 30. Authority the State's railway supervision can in special cases make exceptions from regulation when this is not in violation of international treaties have entered into Norway.
Norwegian railway supervision processes complaints in the event of disagreements about decisions regarding the issuance, updating, suspension or revocation of certificates between the train business and it involved the driver. Both the driver and the train business can bring such a case in the State's Railway Inspectorate.
National body for quality in education (KUT) approves the programmes undertaken by the individual training centers fagskole under section 21 the first paragraph.

section 31. Entry into force these regulations shall enter into force immediately.
The registers mentioned in section 25 and section 26 should be created within and be taken into use from 29. October 2011.

section 32. Transitional arrangements Foreign drivers must possess leads evidence and certificate by performance of the traction vehicle on the national railway network at the latest within the time limits specified in the Directive 2007/59/EC article 37. Until then shall they be able to present a valid authorization proof.

section 33. The safeguarding of existing professional expertise by the issuance of driver's evidence and certificate should be taken into account all the occupational skills that each driver has already acquired, so that this requirement does not lead to unnecessary administrative and financial burdens. Leading rights previously issued to a driver, should as far as possible be secured. Norwegian railway supervision and train businesses may still determine that additional tests and/or training is required for evidence and/or certificates for individual drivers or for groups of drivers in accordance with this regulation.

section 34. Changes in other regulations Regulations 18. December 2002 No. 1678 about requirements for health for personnel with work tasks of importance for traffic safety at the railway, including light rail, underground and suburban railway and more (health claims regulation) is changed as follows:---regulations 18. December 2002 No. 1679 of training of personnel with work tasks of importance for traffic safety at the railway, including light rail, underground and suburban railway and more (training regulations) be modified as follows:-Annex I requirements to design ... leading evidence and certificates etc.

1. Leads evidence Leads the proof will be in accordance with Annex I to Regulation (EU) No. 36/2010 of 3. December 2009 about community models for leading evidence, certificates, certified copies of certificates and application forms for driver's evidence under Directive 2007/59/EC, with the following adjustments:-"N: Norway" should be added to the list in the No. 3 letter c) between MA: Malta NL Netherlands and:-in Nr. 3 the seventh paragraph should refer to the "EEA model" in Norwegian and nynorsk, and the words "leading evidence" on the languages of the other Contracting Parties. In the overview it should be taken into the suitable place "Norwegian: Leads evidence".

-in Nr. 6 to "EC model" be replaced with "EEA model", and instead of the EU flag with the letters of the Member State's nationality to the letter N be printed in black surrounded by a black ellipse.

2. The certificate the certificate shall be in accordance with annex II to Regulation (EU) No. 36/2010 of 3. Annex II. Requirements for health and health research, etc.

1. General requirements 1.1.

Drivers should not have any health problems or take medications, drugs or substances that can cause sudden bevissthetstap,-a reduction in attention or concentration,-sudden loss of work capacity,-loss of balance or koordineringsevne,-significant limitation of mobility.

1.2. Requirements for sight to have vision that Operators satisfy the following requirements:-Vision at a distance (acuity) with or without correction: 1.0; at least 0.5 for the worst eye.

-Largest correction: wearers + 5/myopia-8. Approved doctor may allow deviations from this in exceptional cases and after the opinion of an ophthalmologist.

-views on short and medium distance: adequate, either with or without correction.

-

Sight on both eyes: this is not required when the driver has lost the binokulære the sight after to have begun as the driver and the driver has adequate adaptation and sufficient kompenseringserfaring.

-field of vision: full (no field of outcomes).

-Binokulært field of view: Effective (no field of outcomes).

-color vision: normal.

-Recognition of colour signals: the testing should be based on recognition of single colours and not on relative differences.

-Contrast sensitivity: good.

-No progressive eye diseases.

-ability to resist glare.

By the way, the following apply:-contact lenses and glasses are allowed when these regularly checked by an ophthalmologist or an optometrist.

-Coloured contact lenses and the photo is not allowed chromatic lenses. Lenses with UV filter is allowed.
