§ 1. Purpose the purpose of these regulations is to ensure that electronic communications networks (ekomnett) is installed and maintained so that requirements for electrical safety, electromagnetic compatibility (EMC), frequency use and quality are taken care of, and that personnel in the business that perform installation and maintenance have the necessary qualifications.

§ 2. Scope the regulation applies to claims about the authorization of the business that performs the installation and maintenance of public and private ekomnett. The regulation includes the ekomnett built with fiber-optic cable, coaxial or twisted-pair cable, radio or other technology.

§ 3. Claims for ekomnettautorisasjon It is required authorization for the business that is responsible for the installation and maintenance of public and private ekomnett built with fiber-optic cable, coaxial or twisted-pair cable, radio or other technology.
Authorization is not required for the installation of ekomnett when all the installation materials and equipment that are included in the net is specially made to be able to be installed by persons without special professional skills.
Authorization is provided by the Post and telecommunications authority. The application for authorization shall be made on the prescribed form attached copies of diplomas, certificates, etc. for qualified person, cf. § 5. The authorization is valid until terminated by the business or cancelled by Post and telecommunications authority.
At the change of qualified person should you apply for change of authorization. At the change of business that involves new registration number, you should search for a new authorization.
Address change, name change and cessation of business shall immediately be reported to the Post and telecommunications authority.
Business which can be authorized as telecommunications, cable TV Installer-installer or radio installer after regulation 4. March 2005 Nr. 200 about authorization for the installer of electronic communications networks and radio equipment, maintain the authorization without having to meet the requirements in section 5 the second paragraph provided that the eligible person or organization number does not change.
Qualified person approved after regulation 4. March 2005 Nr. 200 about authorization for the installer of electronic communications networks and radio equipment, which can document additional education corresponding specialization module in electronic communication subjects, can be approved as a qualified person.
The regulation imposes no restrictions in the authorized business requirements that apply to the certification, etc., by other laws or regulations.

§ 4. Requirements for authorized business authorized business is responsible for ensuring that work is carried out on a professionally responsible manner and in accordance with the current requirements for execution, jf. section 7.
Subjects shall have the personnel sufficient knowledge about the ekomnett, material and equipment that are installed or maintained and whether the electrical and functional specifications for the technical interface with other network and user equipment. Their expertise should be able to be documented, such as the documentation of education, certificate, certificates, courses, etc.
Authorized business should be able to demonstrate expertise in engineering of private or public network.

§ 5. Demand for qualified person authorized business should have at least one full-time employee who meets the requirements for qualified person.
Qualified person should have a) education equivalent to graduation from 2-year-old vocational school in education program with specialization in electrical engineering module electronic communication subject b) one year of relevant practice.

To prevent the authorized business must adjust, Post and Telecommunications Authority make exceptions from the requirement for qualified person for a limited period.
The skills acquired in the State be considered in accordance with the EEA Agreement annex VII No. 1 for approval of vocational qualifications, jf. Directive 2005/36/EC Department I, II, III and IV chapter in article 50 no. 1 and article 51, section V article Nr. 56 1 and 2 and Appendix IV list in.

section 6. Requirements for documenting the Business to be able to engineer the engineer for the installation and maintenance tasks, have the relevant expertise, jf. § 4 the second paragraph.

Authorized business will issue a declaration provides a description of the work performed, and which regulations, standards and technical specifications that are followed. Declaration to be delivered to the owner, along with documentation. Norwegian post and Telecommunications Authority has prepared a form for declaration.
Authorized business that has carried out the installation, operation or maintenance, to keep copy of the documentation for at least 5 years.

§ 9. Confidentiality authorized business, and anyone who performs work or services for authorized business, confidentiality in accordance with the law on electronic communication section 2-9. The same applies to the installation and maintenance that does not require authorization, jf. § 3 the second paragraph.

§ 10. Fee authorized business to pay the annual fee as set out in the regulations on the fee to the Post and telecommunications authority.

section 11. Supervision Post and telecommunications authority oversees that the requirements set out in or pursuant to the regulations, are met.
Authorized business duties to contribute to the supervision, jf. the law on electronic communications section 10-1, section 10-3 and § 10-4. The same is true for operations that perform installation and maintenance without authorization, jf. § 3 the second paragraph.

§ 12. Sanctions for breach of duties under these regulations can Post and telecommunications authority implement the sanctions after the law on electronic communications chapter 10, and revoke the authorization by law about electronic communication section 2-14, third paragraph.

section 15. Entry into force these regulations shall enter into force 1. January 2012.
From the same date of revocation regulations 4. March 2005 Nr. 200 about authorization for the installer of electronic communications networks and radio equipment.

section 16. Transitional provisions it can be granted authorization for the cable-TV Installer for a period of two years after the entry into force of this regulation.
Authorization is required for cable-TV Installer for business that installs and maintains cable-TV networks built with coaxial cable technique or other technology designed for the transfer of point-to-multipoint (broadcast).
Qualified person should have a) technical knowledge equivalent to those required by the exam from the line for the service electronics engineer or line for the telecommunications engineer at the high school b) exam from the course in the cable TV-technique or equivalent theoretical expertise c) one year of relevant practice.

Business that granted authorization as cable-TV installer after this transitional provision, retain the authorization without having to meet the requirements in section 5 the second paragraph provided that the eligible person or organization number does not change.
