Short Title
Regulations concerning civil protection law in Svalbard

Adopted by Directorate for Civil Protection and Emergency Planning 18 December 2012 pursuant to Act 25 June 2010 No.. 45 on municipal emergency preparedness, civil protection measures and civil defense (civil protection law) § 2, § 14, § 15 and § 29, ref. Royal Decree. December 7, 2012 No.. 1186 and Delegated Decision of 25 June 2010 No.. 943 and delegation decisions 13. December 2012 No.. 1262.

§ 1. The use of civil protection law for Svalbard Act 25 June 2010 No.. 45 on municipal emergency preparedness, civil protection measures and civil defense § 14, § 15 and § 29 applies to Svalbard. The municipality's obligations under § 14 and § 15 incumbent Longyearbyen local council. The reference in § 14, second paragraph of the Planning and Building Act shall be construed as reference to the Svalbard Environmental Protection Act as stipulated in the Regulations. The obligation in § 14 subsection to update risk and vulnerability analysis in line with the revision of the municipality plans pursuant to the Planning and Building Act § 11-4 first paragraph does not apply to local government in Longyearbyen.

§ 2. Purpose These regulations shall ensure that the Longyearbyen Community safeguard people's safety and security. Longyearbyen local council will work systematically and comprehensively to civil protection across sectors, with the aim of reducing the risk of loss of life or damage to health, property and the environment.
Obligation includes Longyearbyen local council that authority within their geographical area, cf. Svalbard Act § 33, as a company and as the driving force towards other players.

§ 3. Comprehensive risk and vulnerability Longyearbyen local council shall conduct a comprehensive risk and vulnerability, including mapping, and evaluate the likelihood of adverse events that may occur in Longyearbyen land-use area and how these can affect the planning area and Longyearbyen local council.
The overall risk and vulnerability analysis to be anchored in the local council.
Analysis shall include as a minimum:

A)
existing and future risk and vulnerability factors in Longyearbyen land-use area.

B)
risk and vulnerability outside Longyearbyen land-use area that may affect the Longyearbyen land-use area or local government in Longyearbyen.

C)
how different risk and vulnerability factors can influence each other.

D)
special challenges related to critical societal functions and loss of critical infrastructure.

E)
Longyearbyen local council's ability to maintain its activity when exposed to an unwanted event and the ability to resume their activities after the event has occurred.

F)
need for population warning and evacuation.

Longyearbyen local council shall ensure that the relevant public and private actors are invited to work with the preparation of risk and vulnerability analysis.
Where uncovered a need for further detailed analysis, the Longyearbyen Community undertake further analyzes or encourage other relevant actors to implement these. Longyearbyen local council should encourage relevant actors to implement prevention and mitigation measures.

§ 4. Comprehensive and systematic samfunnssikkerhets- and emergency work In view of the overall risk and vulnerability analysis should Longyearbyen Community:

A)
develop long-term goals, strategies, priorities and plans for monitoring of samfunnssikkerhets- and preparedness efforts.

B)
consider matters which should be integrated into land use plans and processes for the Svalbard Environmental Protection Act, Chap. VI.

§ 5. Contingency Longyearbyen Community should be prepared to deal with incidents, and shall on the basis of the overall risk and vulnerability analysis prepare an overall emergency plan. Longyearbyen local council's overall contingency plan shall coordinate and integrate other contingency plans for the planning area. It should also be coordinated with other relevant public and private emergency and contingency plans.
Contingency plan shall contain at a minimum:

A)
a plan for Longyearbyen local council crisis management which provides information about who constitutes Longyearbyen local council crisis management and their responsibilities, roles and authorizations, including who is authorized to decide that crisis management should be collected.


B)
a notification list of actors who have a role in Longyearbyen local council crisis management. Longyearbyen local council shall inform all existing notification list about their role in crisis management.

C)
a resource list containing information about the resources Longyearbyen local council has at its disposal itself and the resources that are available from other players by adverse events. Longyearbyen local council should first enter into agreements with relevant stakeholders for assistance during emergencies.

D)
evacuation plans and plan for population alert based on the overall risk and vulnerability analysis.

E)
plan for crisis communication with the population, the media and our own employees.

§ 6. Update / revision Longyearbyen local council holistic risk and vulnerability should be updated at least every four years, and by the way by changes in risk and vulnerability image.
Longyearbyen local council contingency plan should always be updated, and as a minimum revise once. year. Off plan must state who is responsible for updating the plan and when the plan was last updated.

§ 7. Exercises and training Longyearbyen local council contingency plan shall be practiced every two years. The scenarios for the exercises should be collected from Longyearbyen local council holistic risk and vulnerability. Longyearbyen local council will practice together with other relevant actors where chosen scenario and practice shape makes this appropriate.
Longyearbyen Community shall have a system of training that ensures that all intended for a role in Longyearbyen local council crisis management, have adequate qualifications.

§ 8. Evaluation by exercises and incidents Longyearbyen local council shall after exercises and incidents evaluate crisis management. Where evaluation provides a basis for it shall be made necessary changes in risk and vulnerability analysis and emergency plans.

§ 9. Documentation Longyearbyen local council shall document in writing that the regulation requirements are met.

§ 10 Supervision Governor supervises the legality of Longyearbyen local council in fulfillment of obligations under these regulations. The audit shall follow the provisions of Chapter 10A of the Act on 25 September 1992 no. 107 on local and regional authorities (Local Government Act).

§ 11. Entry into force These regulations enter into force immediately.
